HomeMy WebLinkAboutCouncil Policy No. 200-03 - Conflict of Interest CITY OF LAKE ELSINORE CALIFORNIA COUNCIL POLICY MANUAL SUBJECT: Conflict of Interest Policy No. 200-3 Effective Date: 3/23/99 Revised: 9/12/06 Page No. 1 of 1 BACKGROUND The Lake Elsinore City Council, Redevelopment Agency Board and Planning and Public Safety Commissions are subject to laws pertaining to conflicts of interest. The Political Reform Act (PRA) and other state laws prohibit public officials from participating in decisions that may have a material financial affect on a source of income to, or the assets of the official. California law also prohibits public officials from having a financial interest in any transaction to which the City is a party. In some cases, public officials may participate in decisions if their interests are minor and made public. PURPOSE The conflict of interest laws and regulations are complex and in many cases the advice of the City Attorney will not protect the official from civil or criminal sanctions. The City Council has adopted this policy to promote awareness among public officials and to help them comply with conflict of interest laws. POLICY A. Notice. Every City official shall promptly notify the City Attorney when he/she becomes aware of facts that suggest his/her participation in a decision could give rise to a conflict of interest. The City Attorney will evaluate and discuss the matter with the official. B. Procedure. The City Attorney will make a determination and/or shall assist the official in requesting guidance from the Fair Political Practices Commission (FPPC) if the potential conflict relates to the Political reform Act. C. Disqualification. When a member of the City Council, Board or Commission has, or reasonably believes he/she has, a conflict of interest, the official shall disclose the conflict of interest, refrain from any participation in the decision and remove him or herself from the dais during deliberations.
