HomeMy WebLinkAboutCouncil Policy No. 100-01 - Council Policy Manual CITY OF LAKE ELSINORE, CALIFORNIA COUNCIL POLICY MANUAL SUBJECT: City Council Policy Manual Policy No. 100-1 Effective Date: 5/27/86 Revised: 9/12/06 Page No. 1 of 3 BACKGROUND The City Council of the City of Lake Elsinore is charged with the responsibility of establishing the laws of the City of Lake Elsinore through the enactment of ordinances, resolutions and official policies. Ordinances are legislative acts by the City Council and are regulatory in nature involving a command or prohibition. Ordinances are generally set forth in the Lake Elsinore Municipal Code. Resolutions are typically less formal enactments relating to administrative matters. Council Policies are an expression of City Council opinion as to the conduct of City business enacted to guide the various functions of the City and, where necessary, to establish procedures by which functions are performed in a fair and consistent manner. These Council Policies are not intended to address matters otherwise covered by State law or City Ordinance. Nor are the City Council Policies intended to supercede, negate or otherwise invalidate the City’s Personnel Rules and Regulations, applicable Memoranda of Understanding or applicable statutes, ordinances, employment contracts or otherwise dictate rules and regulations governing the employment of City personnel. PURPOSE It is the purpose of this City Council Policy Manual to: 1) Clearly state and compile Policies of the City Council relating to the conduct and operation of City functions and such municipal matters by which the responsibility or decision is vested in the City Council by virtue of the general laws of the State of California, the Lake Elsinore Municipal Code, or specific City ordinances or resolutions; and 2) Establish procedures for the preparation, distribution and maintenance of Council Policies and the “City Council Policy Manual”. There is hereby established a “City Council Policy Manual” which shall contain all Council Policy statements adopted by Resolution or Minute Order of the City Council. The City Clerk’s Office shall periodically review this Manual, update the Table of Contents, and take such actions are necessary to ensure its accuracy. Policies that do not appear in this Policy Manual shall not be considered Official Policies. 2. All policy statements of the City Council shall be prepared in writing and approved by Resolution or Minute Order. Once approved, statements of policy will be reproduced, distributed and included in the “City Council Policy Manual”, accompanied by the Resolution number and/or date of adoption. 3. Each policy statement shall include: a) a brief background description, when appropriate b) the purpose of the policy c) the policy statements, and d) other criteria or procedural sections as required. 4. The City Clerk shall be responsible for the preparation, continuing maintenance and distribution of the “City Council Policy Manual”, and additions or deletions thereto. 5. The City Clerk shall distribute copies of the “City Council Policy Manual” to members of the City Council, City Attorney, City Treasurer, City Manager and Department Directors. 6. Copies of the information contained in the “City Council Policy Manual” shall be available to the general public at a cost established by resolution of the City Council for public records requests. 7. A Council subcommittee shall annually review the City Council Policy Manual “Table of Contents” to determine the need for additions or amendments. Councilmembers, City Manager, City Clerk, City Attorney, administrative staff members and/or the residents of the City of Lake Elsinore may initiate or suggest policy statements for consideration by the City Council. 2. The City Clerk shall be responsible for the assignment of tentative and final policy numbers and titles to proposed policies. 3. Drafts of proposed Council policies and amendments to existing policies shall be reviewed by the City Attorney. 4. After City Attorney review and approval, the proposed Policy along with the Resolution of adoption (as applicable) are placed on a Council Agenda for review and consideration. If the City Council approves the proposed Policy or Policy revisions, the City Clerk will prepare a final version of the Policy for incorporation into this City Council Policy Manual and distribution to members of the City Council, City Attorney, City Treasurer, City Manager and Department Directors. 5. As required, the City Clerk shall update the Table of Contents of the “City Council Policy Manual”. HISTORY Adopted by Resolution No. 86-32 5/27/86 Amended by Resolution No. 2006-152 9/12/06
