JANUARY 13, 2010 CALL TO ORDER - 6:00 P.M. Chairman Norkin called the meeting to order at 6:00 p.m. PLEDGE OF ALLEGIANCE The Pledge of Allegiance was led by Mr. Brown. ROLL CALL PRESENT: CHAIRMAN NORKIN VICE-CHAIR DAILEY COMMISSIONER CUMMINGS ABSENT: COMMISSIONER FAIRCHILD COMMISSIONER STEWART Also present were: Information/Communications Manager Dennis, Public Works Manager Payne, Assistant City Attorney Mann, Sergeant Rose, Public Works Director/City Engineer Seumalo and Office Specialist Porche. PUBLIC COMMENTS Martin Roza, resident of Canyon Hills spoke of his concerns with the trees on Toyon Court which have died and requested information on the types of trees that are allowed in the public right-of-way. Chairman Norkin advised Mr. Roza to contact the City's Planning Division for a list of the types of trees that are allowed in the public right-of-way. COMMISSION APPROVES CONSENT CALENDAR ITEM(S) 1. Minutes of the December 9, 2009 Public Safety Advisory Commission Chairman Norkin asked if there were any corrections to the Minutes. There being no comments, Chairman Norkin called for a motion. Public Safety Advisory Commission January 13, 2010 Page 2 of 8 MOTION was made by Vice-Chair Dailey and seconded by Chairman Norkin approving the Consent Calendar. AYES: CHAIRMAN NORKIN VICE-CHAIR DAILEY COMMISSIONER CUMMINGS NOES: NONE BUSINESS ITEMS 2. Deputy Shannon Wheeler with the LEPD/Sheriff Station provided a PowerPoint presentation regarding the National Bicycle Registry (NBR), an Intemet-based bicycle registration system that can enable the City residents to register and pay bicycle licensed fees in a safe and secure manner via the Internet. She stated once the applicant's information has been entered into the NBR database, NBR will send a certificate of registration and an engineered, tamper-proof label to be applied to the register bike. She stated, NBR is working with law enforcement agencies nationwide and is no cost to the City. Chairman Norkin requested Commissioner's comments. Vice-Chair Dailey asked how many cities currently have a municipal code that mandates the registration and if so, what are the penalties a bicycle is not registered. Deputy Shannon Wheeler replied by saying she did not know of how many cities in the County were implementing the program, however she stated for those that are using the program, the penalty fees were $35. Vice-Chair Dailey pointed out that Lake Elsinore does not need to mandate the program, just recommend to the citizens who own bikes to have their bikes registered. Commissioner Cummings agreed with Vice-Chair Dailey's comments and added residents not only could list their bicycles with NBR but also provide a list of other household items that could be retrieved. Deputy Shannon Wheeler suggested that she would like to have the information available on the City's Web site which would provide the link to NBR. Chairman Norkin suggested having the information added to the City's Outlook newsletter. Public Safety Advisory Commission January 13, 2010 Page 3 of 8 Information/Communications Manager Dennis agreed with Chairman Norkin's suggestion which would include all of the avenues of city promotion including the periodic Outlook newsletter which is mailed to the residents. He requested Deputy Shannon Wheeler advise the Commission the procedures on what to do should a citizen's bike get stolen or lost. Deputy Shannon Wheeler stated should a bike get stolen or lost the owner should report it to the Police Department. She stated a report would be filed and the serial number that is on the label would be entered into the system. MOTION was made by Vice Chair Dailey and seconded by Commissioner Cummings to promote the National Bicycle Registry. AYES: CHAIRMAN NORKIN VICE-CHAIR DAILEY COMMISSIONER CUMMINGS NOES: NONE 3. Second Draft Revisions to Crime Free Multi-Housing Ordinance. Information/Communications Manager Dennis stated he has been working in conjunction with the City Attorney's office and identified several key elements that should be included in the draft ordinance. He requested the Assistant City Attorney Mann to guide the Commission through the highlights that would assist participation and help encourage participation if approved. He stated one of the key elements under the Crime Free Multi-Housing inspection section is the concept of CPTED (Crime Prevention through Environment Design). He stated in order to be certified as a Crime Free Multi-Housing facility, inspections are necessary. Assistant City Attorney Mann indicated the ordinance is a draft which was included in the Commission's agenda packet. He indicated the Crime Free Ordinance would substantially reduce the likelihood of properties becoming blighted and reduces the occurrence of crime and calls for service. Chairman Norkin asked if the Code Enforcement Department would conduct the inspections of the buildings or would the Sheriffs Department handle this. Information/Communications Manager Dennis stated the Crime Free Program is administered by the Sheriffs Department and the training is part of the program. He stated the inspections would be conducted by the Building & Safety Inspectors and Sheriffs Department. Vice-Chair Dailey indicated there was a study which had determined participants did not want to pay the application fee. She asked if there were a way to Public Safety Advisory Commission January 13, 2010 Page 4 of 8 determine any other options that other cities were using that could it be included in the ordinance. Information/Communications Manager Dennis indicated the sub-committee is proposing is not a cost recovery basis for this program. This would have to be paid for by the City as one of its service level to the community. He stated the CFMH program is voluntary but the City would make a strong recommendation for participation. Vice-Chair Dailey asked if the fees were annual or a one-time. Information/Communications Manager Dennis stated the licensing fees were annual. He indicated the fees depend on the scale of the operation, $39 for the first 3 apartment units, and $6.50 per unit thereafter. Commissioner Cummings asked should there be any substandard issue, who picks up the cost for the inspection. Information/Communications Manager Dennis stated that the inspection would be conducted by the City's Building & Safety/Code Enforcement department. MOTION was made by Chairman Norkin and seconded by Vice-Chair Dailey to receive and file the Second Draft Revisions to Crime Free Multi-Housing Ordinance. AYES: CHAIRMAN NORKIN VICE-CHAIR DAILEY COMMISSIONER CUMMINGS NOES: NONE 4. Proposed PSAC Goals & Objectives for 2010 Chairman Norkin requested having this item postponed to the next Regular PSAC meeting due to the absence of Commissioners Fairchild and Stewart. MOTION was made by Vice-Chair Dailey, and seconded by Chairman Norkin to discuss the proposed PSAC Goals & Objectives for 2010 at the next Regular PSAC meeting. It was approved by 3/0 vote. 5. Proposed Joint Study Session with City Council Chairman Norkin pointed out that this was a request by Commissioner Stewart. He suggested having the Joint Study session moved to either March 4t' or 18~ . Public Safety Advisory Commission January 13, 2010 Page 5 of 8 MOTION was made by Chairman Norkin and seconded by Vice-Chair Dailey to have the Proposed Joint Study Session moved to either March 4th or 18th in order for Commissioner Stewart participate in the discussion. AYES: CHAIRMAN NORKIN VICE-CHAIR DAILEY COMMISSIONER CUMMINGS NOES: NONE 6. Presentation Regarding Overview of Public Nuisance and City Code Enforcement Assistant City Attorney Mann provided a PowerPoint presentation regarding the City's Code Enforcement powers and defined the difference between a Public Nuisance and Private Nuisance. He provided the definition of a nuisance which is to include the following: Injurious to health • Illegal sale of controlled substances • Indecent or offensive to the senses • An obstruction to the free use of property, so as to interfere with the comfortable enjoyment of life or property • Unlawfully obstructs the free passage or use a navigable lake, or river, bay, etc., public park, square, street, or highway. He provided the definition of a nuisance is defined in Civil Code Section 3479 and also provided and differences between a Private and Public Nuisance which are defined in Civil Code Section 3480 and Section 3481. MOTION was made by Chairman Norkin and seconded by Commissioner Cummings to receive and file the Presentation Regarding Overview of Public Nuisance and City Code Enforcement. AYES: CHAIRMAN NORKIN VICE-CHAIR DAILEY COMMISSIONER CUMMINGS NOES: NONE 7. Proposed Community Outreach Meeting: Rosetta Canyon Chairman Norkin suggested postponing this item until the entire commission is present. Public Safety Advisory Commission January 13, 2010 Page 6 of 8 MOTION was made by Chairman Norkin and seconded by Vice-Chair Dailey to postpone the Proposed Community Outreach Meeting to the next Regular PSAC meeting. Annual Report For 2009 Information/Communications Manager Dennis stated it is customary for PSAC to report their activities of the past year to City Council. He reviewed with the Commission the highlights of year 2009 and PSAC accomplishments. Chairman Norkin thanked Mr. Dennis for his report and City Staff for all their time and effort on helping the Commission. MOTION was made by Chairman Norkin and seconded by Commissioner Cummings to file and receive the Annual Report for 2009. It was approved by 3/0 vote. PUBLIC SAFETY SUBCOMMITTEE REPORTS Vice-Chair Dailey provided an update regarding the Citizen Corps to the Commission. She stated the last meeting was held earlier today. During the meeting they swore in four new volunteers which brings the total of volunteers to eighteen. She stated the Citizen Corps is currently working on setting up their goals for the fiscal year of 2009/2010. She stated the Citizen Corps has sub- committees within the Citizen Corps which includes a funding sub-committee, training sub-committee and a recruitment sub-committee. Currently the committees are made up of two City Council members and City Staff. She stated the two volunteers would join the sub-committees mentioned and would meet with the other committees to set up goals for the coming year as well as tasks to help meet the goals. Public Works Manager Payne spoke of an allotment of $10,000 that was given to the Citizen Corps. He stated the Committee has done a great job on seeking out grants and donations. Public Safety Advisory Commission January 13, 2010 Page 7 of 8 CITY STAFF COMMENTS Public Works Director/City Engineer Seumalo commented on the following: He reported to the Commission a speed study conducted on McVicker Canyon Park Road. He stated a strategy has been implemented to develop a new speed limit. He indicated staff has completed a stripping plan and the plan is expected to be completed before the end of next month. Chairman Norkin suggested having a neighborhood meeting prior to implementing a new speed limit on that road. Public Works Manager Payne commented on the following: He spoke of the January 26th City Council meeting the Citizen Corps. would be providing a brief presentation regarding the annual report and introduced the new volunteers to the program. Information/Communications Manager Dennis commented on the following: He stated on January 26`" the City Council would be looking at a draft volunteer policy. He stated the purpose of the policy is to help unify the City's approach with volunteers. In addition the policy would protect the City from liability. PUBLIC SAFETY ADVISORY COMMISSIONER'S COMMENTS Chairman Norkin commented on the following: He spoke of the utilization of red-light cameras at specific intersections such as the one at Railroad Canyon and Summerhill. He spoke the increase of graffiti and suggested to continue with pushing the Graffiti Program. Public Works Manager Payne agreed with Commission Norkin and pointed out that graffiti has a tendency to increase when children are on Christmas and summer break. He stated staff is out everyday removing graffiti and he would continue to provide a report to the Commission. Vice-Chair Dailey commented on the following: She spoke of having the School District's assistance with the promotion of graffiti awareness to parents and suggested to continue to encourage them to spread the awareness of the City's graffiti program as well as the new bicycle registry program. She thanked staff for helping with implementing a new speed limit along McVicker Canyon Park Road and concurs with Chairman Norkin's suggestion of having a neighborhood meeting prior to setting the new speed limit. Public Safety Advisory Commission January 13, 2010 Page 8 of 8 Commissioner Cummings commented on the following: • She thanked Public Works Director/City Engineer Seumalo for the infrastructure along Lake Street and asked when the improvements would be completed. Public Works Director/City Engineer Seumalo stated the road work has been completed. He stated the signal issue has been resolved and there may be some stripping changes. However the roadway is only half built. He stated two additional lanes will be constructed as well as the raised median. • She spoke of the traffic issues at the Terra Cotta Middle School and pointed out with the presence of the Police, the traffic has eased significantly. Public Works Director/City Engineer Seumalo replied, the purpose for having a Police Officer present is because of a complaint that had been received of cars double-parked. PUBLIC COMMENTS None ADJOURNMENT It was the consensus of the Commission to adjourn to a regular meeting on February 10, 2010, at 6:00 p.m. in the Cultural Center located at 183 North Main Street, Lake Elsinore, California, CA, 92530.
