RESOLUTION NO. 2009-64
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, APPROVING TENTATIVE PARCEL MAP
NO. 36123
WHEREAS, Carl Johnson, Lake Elsinore 1 L.P. (the "Developer"), filed an
application with the City of Lake Elsinore requesting approval of Tentative Parcel Map
No. 36123 for the subdivision, design, construction and establishment of five (5)
industrial/warehouse buildings totaling 39,445 square feet on 2.62 acres of vacant land
("the ProjecY'); and
WHEREAS, the property that Developer proposes to subdivide is located at the
northwest corner of Pasadena Street and Central Avenue at APN 377-120-059 (the
"Site"); and
WHEREAS, the City of Lake Elsinore General Plan and Zoning Maps designate
the Site for limited industrial uses; and
WHEREAS, the Site has approved access from Pasadena Street and Central
Avenue, which streets' alignments and widths have been approved by the City Council
as part of the General Plan Circulation Element; and
WHEREAS, pursuant to California Government Code sections 66426(c) and
66426(f) it is appropriate for the proposed subdivision to be effectuated by way of a
parcel map in lieu of a tract map; and
WHEREAS, The California Legislature has determined that certain
classes of projects are exempt from the California Environmental Quality Act (Cal. Pub.
Res. Code §§ 21000 et seq.: "CEQA") and the State Guidelines for Implementation of
CEQA (14 C.C.R. §§ 15000 et seq.: the "CEQA Guidelines"). A Class 32 exemption
exists for:
"[P]rojects characterized as in-fill development meeting the following
conditions
(a) The project is consistent with the applicable general plan
designation and all applicable general plan policies as well as with
applicable zoning designation and regulations.
(b) The proposed development occurs within city limits on a project site
of no more than five acres substantially surrounded by urban uses.
(c) The project site has no value as habitat for endangered, rare or
threatened species.
(d) Approval of the project would not result in any significant effects
relating to traffic, noise, air quality, or water quality.

(e) The site can be adequately served by all required utilities and
public seroices."
The City Council hereby finds and determines that the Project is exempt from the
requirements of the California Environmental Quality Act pursuant to a Class 32
exemption. Specifically, the City Council finds that the Project:
1. The Site is designated as M-1, limited manufacturing, on the City's Zoning
Map and LI, limited industrial, on the City's General Plan. The proposed Project is an
industrial project and is therefore consistent with the applicable general plan designation
and all applicable general plan policies as well as with applicable zoning designation
and regulations as set forth herein below.
2. The Project Site 2.62 acres, which is less than (5) acres. The Site is
substantially surrounded by urban uses with the Target shopping center to the north,
and industrial buildings to the east and south.
3. The Project Site currently vacant. However, according to the Narrow
Endemic Plant Species and Burrowing Owl Habitat Assessment report prepared by
Principe and Associates, the Site has no value as habitat for endangered, rare or
threatened species.
4. Approval of the Project will not result in any significant effects relating to
traffic, noise, air quality or water quality.
5. The Project Site can be adequately served by all required utilities and
public services.
WHEREAS, the City Council, of the City of Lake Elsinore, California, has been
delegated with the responsibility of reviewing and making decisions relating to the
subdivision of land; and
WHEREAS, the City Council has considered the recommendation of the
Planning Commission following its consideration on December 1, 2009, as well as
evidence presented by the Community Development Department and other interested
parties at a public hearing held with respect to this item on December 22, 2009.
NOW, THEREFORE, the City Council of the City of Lake Elsinore, California,
does hereby resolve as follows:
SECTION 1. The City Council has considered the proposed request for
Tentative Parcel Map No. 36123 prior to making a decision. The City Council finds and
determines that the Tentative Parcel Map request is consistent with Title 16 of the Lake
Elsinore Municipal Code
SECTION 2. The City Council hereby finds and determines that the Project is
exempt from the requirements of the California Environmental Quality Act pursuant to a
Class 32 exemption and the CEQA Guidelines (14 C.C.R. §§ 15000 et seq.).

SECTION 3. That in accordance with the Subdivision Map Act and the City of
Lake Elsinore Municipal Code, the City Council makes the following findings to approve
Tentative Parcel Map 36123:
The proposed subdivision, together with the provisions for the design and
improvement, are consistent with the General Plan; Zoning Code; Title 16 of the
Municipal Code relating to Subdivisions; and the State Subdivision Map Act.
The Lake Elsinore Genera/ Plan designates the Site as LI (Limited Industrial) and
the Zoning Map designates the Site as M-1 (Limited Manufacturing). Tentative
Parcel Map 36123 appropriately subdivides the Site into five (5) parcels. The project
is consistenf with the designated land use planning area, development and design
standards, and all other appropriate requirements contained in the General Plan,
Zoning Code, City Municipal Code, and Subdivision Map Act.
2. The proposed subdivision is compatible with the objectives, policies, general land
uses and programs specified in the General Plan (Government Code Section
66473.5).
The project is consistent wifh the land use plan, development and design standards
and programs, and all other appropriate requirements contained in the General Plan.
3. The effects this proposed subdivision is likely to have upon the housing needs of the
region, the public service requirements of its residents, and the available fiscal and
environmental resources have been considered and balanced.
The project is consistent with the City's General Plan and Zoning Code, will provide
necessary public services and facilities, will pay all appropriate fees, and will not
result in any adverse environmental impacts.
SECTION 4. Based upon all of the evidence presented, the above findings, and
the conditions of approval imposed upon the Tentative Parcel Map, the City Council
hereby approves Tentative Parcel Map No. 36123.
SECTION 5. This Resolution shall take effect from and after the date of its
passage and adoption.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City
Council of the City of Lake Elsinore, California, this 22 day of December, 2009
