RESOLUTION NO. 2009-59
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, INCREASING THE TRAFFIC
OFFENDER FUND FEE
WHEREAS, the City Council of the City of Lake Elsinore adopted an
ordinance creating a Traffic Offender Fund ("TOF") on March 26, 2002;
WHEREAS, Section 10.76.060 of that ordinance provides that the Police
Chief shall propose the amount of the TOF fee; and
WHEREAS, the Chief has determined that the actual administrative cost
related to the removal, impoundment, storage, and release of the vehicle driven by
persons arrested for DUI, who are driving on suspended/revoked licenses, or have
never been issued a drivers license has increased from $100.00, originally set in March
2002, to $125.00
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE, DECLARE, DETERMIE AND
ORDER AS FOLLOWS:
SECTION 1. The City Council of the City of Lake Elsinore hereby
approves the increase of the TOF fee from $100.00 to $125.00 in accordance with the
ordinance for the Traffic Offender Fund noted in Chapter 10.76 of the Lake Elsinore
Municipal Code.
SECTION 2. The City Clerk shall certify to the passage and
adoption of this Resolution and enter it into the book of original Resolutions. The
effective date of the increase in the TOF fee shall be December 1, 2009
PASSED, APPROVED AND ADOPTED at a regular meeting of the City
Council of the City of Lake Elsinore, California, on this 24th day of November 2009.
