The applicant is requesting design review consideration for the design and establishment of a
2,371 square-foot two-story single-family residence with an attached 514 square-foot two (2)
car garage, a 96 square-foot front entry porch, and a 134 square-foot covered solid rear patio
cover. The proposed 2,371 square-foot residence will include four (4) bedrooms, a living
room, dining room, laundry room, kitchen with breakfast nook, family room, three (3)
bathrooms, and a second-story deck on the front (east) elevation.
The proposed two-story single-family dwelling unit located at 29414 Pinnell Street will be
situated in the center of the existing two (2) lots. It should be noted that the applicant will
have to apply and submit for a lot merger with the City of Lake Elsinore's Engineering
Division prior to the issuance of a building permit. Considering this, the existing lots climb in
grade from the front of the property along Pinnell Street to the rear. The applicant will have
to cut approximately 750 cubic-yards and fill approximately 350 cubic-yards in order to
create a level pad for development.
The applicant has chosen to construct the two-story single-family dwelling unit using
Mediterranean style architecture. The front (east) elevation will include an arched front-entry
porch, double front-entry doors with sectional windows adjacent and above, window
surrounds, coach lights, a decorative garage door, window surrounds, and decorative
"rosette" foam attic vents. In addition, the applicant is proposing to incorporate an
approximately two hundred (200) square-foot deck with thirty-six inch (36") wrought-iron
railing that will be located directly above the attached two (2) car garage.
Planner Carlson went on to state that, the north elevation will include window surrounds, a
belly band and a decorative dormer that will include a "rosette" foam attic vent. The south
elevation will include a fireplace chimney with cap, window surrounds, a belly band, and a
coach light adjacent to the "French" side-entry doors.
The rear (west) elevation will include a solid covered rear patio with stucco columns,
window surrounds, a rosette attic vent, and a turret-like architectural pop-out to be located
adjacent to the rear solid covered patio. It should be noted that the roof of the solid covered
patio will incorporate the same concrete tiles as proposed on the main dwelling unit. It should

Hector Gutierrez (Applicant) stated that he was concerned about Conditions of Approval. He
was concerned about paying $2.00 per square foot for Affordable Housing Units. It was his
understanding that it only applied to Duplexes. Deputy City Attorney Santana clarified that
all residential developments pursuant to The Affordable Housing Agreement, was approved
by the City Council in December 2005, and reads exactly as the City Council approved.
Under Condition of Approval No. 48: Mr. Gutierrez wanted all street improvement
conditions to be struck out. City Engineer Seumalo said Staff recommended that all
reference to street improvements be stricken, and under Condition of Approval No. 51, Mr.
Seumalo also stated that there will be an Encroachment Permit required unless the applicant

is using a septic tame Therefore, street improvement plans will be submitted with grading
plans.
Mr. Gutierrez thanked the Planning Commission for doing a good job. He stated that it was
one of the biggest homes in the area and the site has beautiful views.
6:10 pm Chairman O'Neal closed the Public Hearing.
Comments:
Commissioner Zanelli said he liked the site and design and thinks it will be an improvement
to the community.
Commissioner Flores stated the project complies with the Municipal Code and is in favor of
the project.
Commissioner Mendoza had no comment.
Vice Chairman Gonzales expressed concerns about the water pressure at the property.
Associate Planner Carlson addressed that concern by stating that a "Will Serve" letter
regarding proper water pressure was submitted to the Lake Elsinore Water District. He also
indicated that staff has the letter on file and that the Conditions of Approval state that the
"Will Serve" letter be submitted prior to Building Permit issuance.

The .25 acre vacant site is located approximately 145 linear feet northwest of Machado
Street. Currently, at the rear of the property there is an existing wood fence and chain linked
fence. The applicant will be removing the chain linked fence with an adjacent neighbor.
There is also a block wall that extends from the rear of the property towards the front of the
property and drops in height. Wrought iron with pilasters is included in the design.
The applicant is requesting design review consideration for the design and establishment of a
1,986 square-foot single-story single-family residence with an attached 749 square-foot three
(3) car garage and a 234 square-foot front entry porch.
The front (northeast elevation) will include a decorative stone base furring, coach lights,
arched windows with lights, window surrounds, an arched front-porch entry, double front-
entry doors, and a light-weight concrete tile roof. In addition, the applicant is also proposing
six-foot (6') high stucco block pilasters with wrought iron return wall fencing on both sides
of the proposed dwelling units. It should be noted that the proposed block pilasters will
aesthetically match the stucco on the dwelling unit. The applicant is going to reduce the size
of the pilasters and incorporate more wrought iron so he can locate a recreation vehicle on
the side of the home.
Staff would like to ask the Commission to strike of Condition of Approval, Item No. 35 from
the record with a Condition that reads; "The applicant shall connect to the existing sewer line
located within the Machado Street Right of Way as stated in the Uniform Plumbing Code".
Applicant Julian Suarez stated his name and address. He presented an issue to the
Commission regarding Conditions of approval No. 35. He requested a septic tank: on his
property, instead of tying into sewer. Chairman O'Neal stated that under Code requirements,
he is required to hook up to sewer, and therefore, cannot do septic.

Plannine: Commissioner Comments
Vice Chair Gonzales - House looks great and recommends going to sewer.
Commissioner Mendoza - Based on the changes to Condition No.35, he sees no problems.
Commissioner Flores - As long as the applicant is hooked up to sewer, he has no questions.
Commissioner Zanelli - Concurred with the rest of the Commissioners as long as the change
is made to Condition of Approval No. 35.

Chairman O'Neal opened the Public Hearing at 6:22 p.m.
Director of Community Development Preisendanz presented the project and turned it over to
the planner for a formal presentation.
Planning Consultant Miller presented the Staff Report for a Single Family Residence located
at 988 Miramar Street.
Planning Consultant Miller stated that she would like to add Condition of Approval No. 66,
requiring the applicant to add a weather proof 3' x 3' sign at the entrance of the project site,
identifying the approved days and hours of operation and a statement directing any
complaints to the City of Lake Elsinore, Code Enforcement Division, phone number 951-
674-3124.
Planning Consultant Miller continued stating, the applicant is proposing to construct a 3,835
square foot conventionally built single family residence with an attached 761 square foot
garage on a 12,008 square foot (net) vacant lot. The total building footprint is 2,752 square
feet or twenty-one percent (21 %) of the lot area meeting the maximum allowable building
area of fifty percent (50%) per the requirements of the Historic Elsinore standards. The
project meets all requirements of the LEMC. The residence will include an interior entry,
dining room, family room, kitchen, office, game room, bathroom and utility room on the first
floor and three bedrooms and two bathrooms.
The architecture proposed is a Monterey style. Features include second story balconies with
wood railing and covered roofs, paned windows with wide trim, shutters, cultured stone
wainscot, multiple roof lines with rafter tails, and a tower structure.
Planner Miller went on to explain that, an automatic irrigation system and landscaping will
be provided along Miramar Street and Franklin Street which is approximately 3,099 square
feet or twenty-four percent (24%) of the lot area. The applicant will utilize the following
three (3) types of fencing on the irregularly shaped lot:

1) A five foot (5') tubular steel fence with five foot (5') decorative masonry
pilasters will be constructed along the Miramar Street and Franklin Street
frontages; and
2) The City Standard six foot (6') wood fence will be provided along the eastern
and northern interior property lines, and
3) A six foot (6') tubular fence will be used along the farthest eastern property line
and the southern property line in order to provide views of the rolling hills and
the lake.
Planner Miller also stated that, pursuant to the California Environmental Quality Act
(CEQA), this project is categorically exempt pursuant to Section 15303 (New Construction
or Conversion of Small Structures) Class 3(a) that exempts up to three (3) single family
residences.
In conclusion, Planning Consultant Miller recommends that Planning Commission adopt a
Resolution approving the Minor Design Review for the Single Family residence and
associated improvements located at 988 Miramar Street based on the Findings, Exhibits, and
Conditions of Approval.
Applicant Robert Skrede stated his name and address.
Mr. Skrede agreed to the Conditions of Approval.

Plannine: Commissioner Comments
Commissioner Mendoza - Very good job on the design of the house, beautiful addition to the
city.
Commissioner Zanelli - Beautiful design. He directed the question to Planning Consultant
Miller regarding the street along the property line. Consultant Miller stated that Mr.Skrede is
improving the street to the end of the property line and that he has been working on the
grading for a year.
Commissioner Gonzales stated he had no problem with the house, his concern was Franklin
Street. He wanted to know if it will be widened and he asked Engineering Manager Seumalo
ifthe front of the applicant's property would go up to Franklin Street.
Engineering Manager Seumalo responded by stating that the ultimate roadway width will be
40 feet from his curb line to the curb line across the street and that traffic on Franklin will be
shifted to Pottery. He went on to explain that, Pottery will be the main road and that Franklin

will be converted to a local road. He also stated that there will be traffic control until the
work is completed. He further stated that there may be some encroachment on the road due
to road construction, but did not anticipate it to be to be significant.

4. Miti2ated Ne2ative Declaration No. 2006-07 for the Slope Stabilization Plan at
Wasson Creek ("Rosetta Hills". Tentative Tract Map No. 31792)
Chairman O'Neal opened the Public Hearing at 6:35 p.m.
Director of Community Development Preisendanz presented the project and turned it over to
the planner for a formal presentation.
Planning Consultant Donahoe presented the Staff Report by stating that, the applicant
requests adoption of Mitigation Negative Declaration No. 2006-07, the environmental review
document for the proposed Slope Stabilization Plan ("Plan") for Tract Map No. 31792. The
Plan has been reviewed and approved by the City Engineer to perform remedial grading to
reconstruct and stabilize an existing manufactured slope which was previously constructed
but not completed in the early 1990s.
Rosetta Hills, formerly approved as the Villages at Wasson Canyon, is located southeast of
Highway 74, east of Interstate 15, and east of the intersection of Conard Avenue and Third
Street.
Upon the recommendation of the Planning Commission, the City Council of the City of Lake
Elsinore approved Tentative Tract Map No. 31792 on September 28, 2004. On June 20,
2006, the Planning Commission approved Residential Design Review No. 2005-20, which
was conditioned to provide a Remediation Plan, and Mitigated Negative Declaration for Lots
49 thru 68 approved and adopted by the City Council.
Lennar Homes has begun their development of Rosetta Hills, and the Remediation Plan has
been reviewed and approved by the Engineering Department.
Planner Donahoe concluded by, recommending that the Planning Commission recommend to
the City Council adoption of Mitigated Negative Declaration No. 2006-07, based upon the

findings set forth in the attached resolution and Exhibit 'B,' and subject to the Mitigation
Monitoring Program attached thereto and that, Staff recommends that the Planning
Commission recommend to the City Council that the project is exempt from the MSHCP
based upon the findings set forth in the attached resolution.
Applicant Ellen Michael of Lennar Homes stated name and address. Ms. Michael stated that
they (Lennar Homes) have all permissions necessary to do all of the work outside of their
property boundary and a copy of the Plan , as well as a copy of the Agreement with South
Shore, which she stated is available for review.

Plannine: Commissioner Comments
Commissioner Flores stated that hased on the previous approval Design Review No. 2005-20
by the Planning Commission on June 20, 2006, finds this project to conform as a Tentative
Tract Map No. 31702 and for the Slope Stabilization Plan, has his approval.
Commissioner Zanelli statedjt has his approval. He wanted to know what the length of the
project was and when do they expect to begin?
Applicant Ellen Michael of Lennar Homes stated the subdivision is already under
construction; stabilization starts once engineering issues permits. Completion should be
within 30 working days.
Commissioner Mendoza commented that he_was concerned about the length of time it will
take to complete. He also stated it looks like a large undertaking, but with our fine engineers,
it should be able to be completed within 30 days.
Vice Chair Gonzales stated that he approves the project.

Director of Community Development Preisendanz presented the continuance of the project
from the Planning Commission meeting of October 3, and turned it over to the planner for a
formal presentation.
Senior Planner Harris presented the continuance of the Staff Report.
Senior Planner Harris indicated that six (6) Items under Conditions of Approval were
contested by the applicant. Staff recommended the following:
Administrative Services Department Condition No.17 be deleted.
Administrative Services Department Condition No. 82 be deleted.
Administrative Services Department Condition No. 83 be deleted.

Engineering Division Condition No. 65
A revised signing and striping plan for Canyon Estates Drive, from Summerhill Drive to
Ridgecrest Drive, shall be submitted for review. The installation of the revised signing and
striping will be the responsibility of the applicant.
The Engineering Division has agreed to extend the timing for completion of this condition to
prior to issuance of Certificate of Occupancy.
Engineering Division Condition Item No. 66
The project driveway at Boulder Vista Drive shall be revised to a right-in/right-out only with
the installation of right-in/out median at the driveway entrance.
The Engineering Division has agreed to extend the timing for completion of this condition to
prior to issuance of Certificate of Occupancy to allow the developer time to enter into a cost
sharing arrangement with surrounding property owners.
Engineering Condition No. 68
Relocate the existing street light on Canyon Estates Drive, from approximately 60 feet east of
the project driveway/Boulder Vista Drive to near the driveway entrance.
The Engineering Division has agreed to extend the timing for the completion of this condition

Planner Harris concluded by recommending that the Planning Commission recommend to the
City Council;
1) Adoption of findings consistent with the Multi-Species Habitat Conservation
Plan.

3) Approval of Tentative Condominium Tract Map No. 34864 based on the
following findings, Exhibits "A" thru "K" and the proposed Conditions of
Approval.
Applicant Lon Bike with Architectural Team Three stated his name and address. He
indicated that he has been working with the Engineering and Planning Staff over the last two
(2) weeks in order to resolve any issues and is looking forward to moving forward with the
project.
Owner Brett Keshtkar with Canyon Plaza Partners LLC stated his name and address. He
had no comment.

Plannine: Commissioner Comments
Vice Chair Gonzales requested clarification about the extending the time, referred to in
Condition of Approval No.65, 66 and 68. He also asked what happens ifthe other property
owners can't come to an agreement, does it come back to us.
Engineering Manager Seumalo responded by stating that there were nine (9) property owners
that are affected by these improvements and that it should be a fair share cost. He went on by
stating that the intent of the new condition was to go back to the Master Developer and
contact all of the property owners get concurrence and participate in this cost. He also stated
that if they don't get concurrence, the City will work with the applicant to pay for the cost of
the improvements because the City sees it as an important safety issue.
Commissioner Mendoza stated that he stated that he thinks something of this size is too big.
He went on by stating that he doesn't think it is right for this site and that there is already too
much traffic there.

Commissioner Zanelli asked Engineer Seumalo it Canyon Estates Drive is scheduled to be
widened to four (4) lanes. Engineering Manager Seumalo said there is a widening in the

Director of Community Development Preisendanz presented the project and turned it over to
the planner for a formal presentation.
Associate Planner Resendiz presented the Staff Report.
The applicant is requesting design review consideration for a "conventionally" built, five (5)
unit residential apartment complex and associated improvements located at the northwest
comer of Pottery and Lindsay Streets, APN No. 374-042-022. The proposed five (5) unit
residential development will be available for rent only and will be subject to the provisions of
the recorded CC&R's. The project will include five (5) attached two (2) story dwelling units
and attached garages, common areas, private yard areas and related improvements. Each
dwelling unit will be approximately 1,349 square feet and will include three (3) bedrooms, a
living room, a dining room, a kitchen and two and one half (2 1/2) bathrooms.
The .32 acre project site is located on the northwest side of Pottery Street and Lindsay Street
within an area identified as the "Historic Elsinore" Overlay District, more specifically
identified as within the Medium Density Residential (MD AREA 6) land use area and
Assessor Parcel Number(s) 374-042-022.
Planner Resendiz concluded for stating that, pursuant to the Historic Elsinore Architectural
Design Guidelines, the proposed architectural design of the homes can be identified as
"Mission" style architecture. To accomplish this, the applicant has incorporated such
elements as red roof tiles, stucco walls, recessed window and door openings, and wood
accents along the roof lines, arcade wing walls, low pitch roof angles, and decorative
wrought iron work for the windows.
Applicant Salvador Ayala with Peakside Development stated his name and address and
agreed with all Conditions of Approval and with the removal of Condition of Approval
Numbers 42 and 43.

Community Development Director Preisendanz addressed two (2) Conditions of Approval
and requested to add language to these Conditions.

Community Development Director Preisendanz requested that Deputy Attorney Santana
explain the addition to the Conditions of Approval relative to the CC&R's.
Deputy Attorney Santana responded by stating that she would like to add two (2) sentences
to the end of the condition:
1) The CC & R's shall identify the City of Lake Elsinore as
an expressed third party beneficiary, and the City of Lake
Elsinore shall have the right but not the obligation to
enforce the CC&Rs for the project.
Deputy Attorney Santana went on to say that this is for the protection of the project in the
event that there is an Annexation or a Deannexation from the project or if the Property
Owner's Association dissolves and the City does have the power to come in and make sure
that the property is maintained properly. She also stated that condition of approval No. 57
read as follows:
1) The applicant shall place a weather proof 3 ft. x 3 ft. sign at
the entrance to the project site identifying the approved
days and hours of construction activity and if anyone needs
to lodge complaints they are directed to call the City of
Lake Elsinore, Code Enforcement Division, phone number
(951) 674-3124.
Chairman O'Neal asked the applicant ifhe agreed with the Conditions of Approval.
Applicant Salvador Ayala stated that he agreed with the Conditions of Approval.

Engineer Seumalo responded by stating that he did not know there were plans for a Pottery
Street Bridge. He did say he would put it on the unfunded Capital Improvement Program list
and look for funding to have it constructed.

and in conjunction with CDBG funds and that these sidewalks are located throughout the
city, including Summerhill and that Engineering staff applied for a Grant which was
awarded. Project will start in early November.
Regarding Grand/Ortega, Engineering Manager Seumalo is hoping to hand deliver corrected
Plans on Wednesday, October 18 to Cal Trans and will stay at Cal Trans until he receives a
permit.

Planning Manager Tom Weiner introduced Kristine Herrington to the Planning Commission,
as the new Office Specialist III, and stated that she will be handling the administrative duties,
and will also be attending the Planning Commission meetings and will generate the meeting
minutes.
Community Development Director Preisendanz said at a recent Planning Commission, there
was an inquiry about Planning Commission's compensation. He went on to say that with the
City Attorney's help, in Section 2.24 of the Municipal Code, the Planning Commission
compensation is set by City Council Resolution, with the most recent Resolution being
adjusted in 1984 which set the current compensation at $50.00 a meeting. He went on to state
that in order to increase the compensation the City Council would have to approve a
Resolution specifying the amount to be paid and that if the Commission desires to increase
the compensation, Community Development Director Preisendanz said he would be more
than happy to prepare a Staff Report and Resolution requesting City Council consideration of
an increase in compensation. He concluded by stated that he would need direction from the
Planning Commission tonight or next meeting.
Deputy City Attorney Santana welcomed Office Specialist Herrington.
Commissioner Zanelli thanked Justin for his work on the Larson Street project, and that staff
really needs to look at amending the code to eliminate septic systems for any new
construction in the city.
Commissioner Zanelli also asked Engineering Manager Seumalo as to what it will take to get
the project moving to widen the road at Canyon Estates Drive.
Engineering Manager Seumalo responded by stating that Staff has been discussing the need
for widening the road and it comes down to a philosophical evaluation. He went on to say,
CAL TRANS in their evaluation, in the improvement of Railroad Canyon Road has included
an interchange at Franklin, as well as a bridge over Interstate 15 at Malaga if we include that
as a Railroad Canyon Road Interstate system, part of the system will be Canyon Estates
Drive. The General Plan identifies four (4) lanes which can carry quite a bit of traffic. At a
minimum, the Engineering Division wants to widen one (1) more lane to provide left turn
protection or they will widen it to four (4) full lanes. The timing of this will be in
conjunction with CAL TRANS; therefore, the Engineering Division is looking two (2) years
down the road.
Commissioner Zanelli commented that the sooner the better to get this done, or the project
will get behind.
Engineering Manager Seumalo agreed.

Commissioner Zanelli responded by stating that he spends six (6) or eight (8) hours on
reviewing projects and that the projects come to him on Friday afternoon, and he would like
to get the projects sooner so he can get a background on it, rather than sift through tons of
paperwork in a few days.
Community Development Director Preisendanz said he would schedule a regular meeting for
each Commissioner to review the projects that come in and the issues that relate to those
projects.
Commissioner Flores thanked the Staff for the information regarding Larson Street. The
septic system was a great concern. He also indicated that he thought more material would be
needed when the septic systems come about and that there is sufficient percolation in the
surrounding homes which includes wells. There are a lot of wells in the area. He also stated
that, if you're going to construct the septic system, you have to make sure it is a distance
from the well supply, or you will run into problems.
Commissioner Flores stated he spends hours reviewing projects. Depending on the project,
some projects take six (6) hours, and others could take 14 hours or more.
Commissioner Mendoza thanked Senior Planner Harris for researching the Amendment in
the General Plan changes. He also requested the package be delivered a little earlier,
Thursday night, or Friday morning instead of Friday afternoon. He suggested deleting
additional topics. He stated that he does appreciate all of the hard work. He concluded by
stating that he spends a minimum of 6 hours reviewing projects, and on the last project, he
spent 14 hours reviewing it.
Vice Chair Gonzales stated he spends a lot of hours going over the projects. He also tries to
visit the sites, if at all possible.
Vice Chair Gonzales stated that when he joined the Planning Commission in February of
2005, they approved a gated condominium area behind Grape Street and asked Engineering
Manager Seumalo when this project is supposed to start?
Engineering Manager Seumalo responded by stating that that the Processing Developer is
looking for someone to sell it to. He met with him two (2) weeks ago, and they presented
erosion control and drainage control proposals to keep it in an interim condition and won't
see anything happening for three (3) months to one (1) year.
Vice Chair Gonzales asked Engineering Manager Seumalo if there will be sewers put in at
Gunderson.
Engineering Manager Seumalo stated it is one (1) project with two (2) manufactured homes
in which the Water District required the developer to install a sewer main at their cost and

enter into a reimbursement agreement, located on Gunderson going towards Lakeshore
Drive. The cost is approximately $250,000.
Chairman O'Neil indicated that he does spend a substantial amount of time reviewing
projects and does recommend as a group, an increase of the amount of money that the
Commissioners do get paid. He wanted to say that he does recognize they are doing a public
service and there is something to say about giving back to your community, but it is a lot of
time spent doing so.
Commissioner Flores was not concerned about the monetary part of it, but does think the
Chairman deserves a step above in pay compared to the rest of the Commissioners because of
the added burden of being the Chairman.
Chairman O'Neal said he would prefer to accept the same pay as the rest of the
Commissioners.
Community Development Director Preisendanz stated he would bring a proposal back to the
next meeting of what compensation would be appropriate for the Planning Commission.

PROJECT BACKGROUND
An automobile dealership (identified as Lake Elsinore Ford) was approved by the
Planning Commission and City Council in November and December, 2005,
respectively. The project included Mitigated Negative Declaration No. 2005-06,
Commercial Design Review No. 2005-02, Conditional Use Permit No. 2005-06,
and Variance No. 2005-03. The Conditional Use Permit was approved pursuant to
SectionI7.48.030 (Subject to a Conditional Use Permit) of the Lake Elsinore
Municipal Code (LEMC), which allowed the establishment of an automobile
dealership. The Variance allowed for the reduction of the required parking and
landscape setbacks along Auto Center Drive and Avenue 12, pursuant to Section
17.48.080 (A), and Chapter 17.76 (Variances), of the Lake Elsinore Municipal
Code (LEMC).
The applicant is now requesting a revision to the Commercial Design Review
application in order to allow for modifications to the previously approved parking
and landscaping areas, as well as a reduction in the size of the building (from
72,290 square feet to 29, 632 square feet). It should be noted that since
Conditional Use Permit and Variance applications "run" with the land, no variation
or deviation is being requested herein.

PROJECT DESCRIPTION
Site Plan
The applicant requests approval to construct a new 29,632 square foot (72,298
square feet previously approved) new automobile dealership on the subject 10-acre
vacant site. The dealership will consist of outdoor vehicle display on the
north/northeast half of the site facing Auto Center Drive. The "sales and service"
buildings will be located in the center of the site, with inventory and service
parking located to the south/rear portion of the site. The "sales/administration"
building will contain the showroom, sales offices, retail and wholesale parts sales
and storage. A covered area for receiving vehicles for service will be located
immediately to the north of the sales/administration building. The service drive is
two (2) lanes wide and will accommodate approximately six (6) service vehicles.
Immediately west of the service drive is a quick lube area which will service
vehicles on site. To the west of the sales administration building is the service
building complex. This area houses twelve (12) service bays for both cars and
trucks, four (4) bays for large vehicles and trucks, and one (1) bay for washing and
detailing vehicles. Additionally, a break room, locker area, and rest rooms are
provided for the technicians in the "showroom/service" building area.
Circulation and Parking Space Layout
Main access to the site will be made available through the two (2) driveways
proposed along Auto Center Drive. One hundred and thirteen (113) parking spaces
will be provided, including six (6) handicap spaces. Vehicle display spaces are
provided along the frontage of Auto Center Drive. Customer parking spaces are
identified near and around the sales and service buildings. Employee parking will
be provided at the rear portion of the site.
Landscaping
The applicant is proposing to develop the site with 32,864 square feet (80,474
square feet previously approved) of landscaping, or eight percent (8%) of the
overall site. Construction of the automobile dealership will actually occur on five
(5) acres of the overall ten (10) acre site. If the landscape calculation was given to
the five acre portion of the site, the landscaping calculation would result in over
fifteen percent (15%) of landscaped area for the "development portion" of the site.

A ten foot (10') landscape buffer separates the parking and display areas from the
public right-of-way. Additionally, landscape islands will be provided within the
display parking lot. Considering that the perimeter landscape buffer is less than
the required twenty foot (20) average and fifteen foot (15) minimum, (Section
17.48.080 of the LEMC), a variance was approved with the previously approved
application. Lastly, a fifteen foot (15') minimum landscaped buffer has been
provided between the proposed lot and the residential land to the north, providing
both a visual separation and sound attenuation.
Architecture/Color and Materials
The exterior design of the buildings will incorporate both plaster and split-face
concrete block. The design elements are contemporary in nature, incorporating
simple geometric shapes for the building massing and simple reveal details
necessary to minimize the scale of the building. The storefront window frames
will be clear anodized frames with tinted blue glass. All roof-mounted equipment
will be screened from public view by the heights of the adjacent parapets.

Issues relating to light and glare, noise, traffic, and the potential of visual impacts
were critically analyzed by staff. It was determined that with proper mitigation
and implementation of conditions of approval, potential impacts of the project
could be reduced to acceptable levels.
Light and Glare
With respect to the issue of light and glare, conditions (conditions #9, and #19)
have been imposed, requiring the submittal of a photometric study prior to issuance
of building permits. Additionally, staff required the shielding of on site light

fixtures. These conditions will insure that the proposed lighting glare and pole
locations are not located in areas where these may negatively impact adjoining
properties. In addition, the project site is significantly lower in pad elevation with
relation to the adjacent residential dwelling units. The lower elevation of the site
will assist in the reduction of light and glare spilling over, onto or down on
adjacent property.
Noise
With respect to the noise generated by car repairs, mitigation measures have been
incorporated, which require compliance with the City's Noise Ordinance, (Chapter
17.78). The Noise Ordinance requires that noise or sound levels be below 60
decibels between the hours of 7:00 am to 10:00 pm and below 40 decibels in
nearby residential areas between the hours of 10:00 pm to 7:00 am. Prohibiting the
use of an outdoor P A system will also reduce noise generated by the dealership.
Traffic
With respect to traffic, some increase in traffic is expected from car test driving
and customer visits. Staff has included a condition (condition #8) requiring the
applicant to route "test drives" to Auto Center Drive and to the Freeway and not
residential areas. Further, the Traffic Analysis prepared for the original "Lake
Elsinore Ford" project, determined potential impacts resulting from the proposed
project. As a result, the City's Traffic Engineer concluded that traffic volumes
would only increase moderately in the area and that with proper street and
circulation improvements, as well as a traffic signal, adequate circulation would be
maintained. In summary, the Circulation Element of the General Plan, utilizing the
adopted street system will not be significantly impacted.
Finally, it is anticipated that an agreement will be presented to the City Council,
which will request reimbursement for public improvements. Although details of
the agreement have not been finalized at this time, an agreement will be presented
to the City Council for consideration.
Visual Impacts
Lastly, since visual impacts could result from the proposed auto display areas
within the front landscaped setback areas, additional landscaping is proposed

which include a mix of turf, shrubs and trees within the front landscaped areas,
reducing the visual impacts to acceptable levels.
ENVIRONMENTAL DETERMINATION
Pursuant to Title 14 of the California Code of Regulations Sections 15070 et seq.,
on December 13, 2005, the City Council approved and certified Mitigated
Negative Declaration 2005-06, which analyzed and mitigated potential
environmental impacts associated with development of the Chrysler, Jeep, Dodge
automotive dealership. Mitigated Negative Declaration 2005-06 was processed in
conjunction with the initial Project entitlements requested by the developer.
Design review is the final entitlement that the applicant must secure in order to
begin development of the dealership. The action taken by the legislative body with
regard to design review is part of the whole action. To that end, consistent with
Title 14 of the California Code of Regulations Section 15006, the potentially
significant environmental impacts of the Project have been analyzed under
Mitigated Negative Declaration 2005-06 and no further CEQA review is required.
RECOMMENDATION
It is recommended that the Planning Commission adopt Resolution No. 2006-_
recommending to the City Council adoption of findings of consistency with the
MSHCP, and Resolution No. 2006-_ recommending approval of Commercial
Design Review No. 2006-11 to the City Council. This recommendation is based
on the findings, exhibits and conditions of approval attached to this Staff Report.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING TO
THE CITY COUNCIL ADOPTION OF FINDINGS THAT THE
PROJECT KNOWN AS LAKE ELSINORE CHRYSLER, DODGE,
JEEP IS CONSISTENT WITH THE MULTI-SPECIES HABITAT
CONSERVATION PLAN (MSHCP)
WHEREAS, The Automotive Group has filed an application with the City
of Lake Elsinore requesting approval of Commercial Design Review No. 2006-11
for the design, construction and establishment of the new Lake Elsinore Chrysler,
Dodge, Jeep automobile dealership to be located at the southwest comer of Auto
Center Drive and Avenue 12 (the "Project"); and
WHEREAS, Section 6.0 of the MSHCP requires that all discretionary
projects within an MSHCP criteria cell go through the Lake Elsinore Acquisition
Process ("LEAP") and Joint Project Review ("JPR") to analyze the scope of the
proposed development and establish a building envelope that is consistent with the
MSHCP criteria; and
WHEREAS, Section 6.0 of the MSHCP further requires that the City of
Lake Elsinore adopt consistency findings demonstrating that the proposed
development is consistent with the MSHCP cell criteria, and the MSHCP goals and
objectives; and
WHEREAS, action taken by the Planning Commission and City Council
with regard to design review applications is a discretionary action; and
WHEREAS, pursuant to the California Environmental Quality Act (Cal.
Pub. Res. Code ~~ 21000 et seq.: "CEQA") and the CEQA Guidelines (14 C.C.R.
~ ~ 15000 et seq.), public agencies are expressly encouraged to reduce delay and
paperwork associated with the implementation of CEQA by using previously
prepared environmental documents when those previously prepared documents
adequately address the potential impacts of the proposed Project (CEQA
Guidelines Section 15006); and
WHEREAS, the City Council approved and certified Mitigated Negative
Declaration 2005-06 on December 13, 2005, to address the potentially significant
environmental impacts associated with development of the Chrysler, Dodge, Jeep
automotive dealership; and

WHEREAS, public notice of the Project has been given, and the Planning
Commission has considered evidence presented by the Community Development
Department and other interested parties at a public hearing held with respect to this
item on November 21,2006.
NOW THEREFORE, THE PLANNING COMMISSION OF THE
CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE
AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has considered the Project's
consistency with the MSHCP prior to recommending that the City Council adopt
Findings of Consistency with the MSHCP.
SECTION 2. That in accordance with State Planning and Zoning laws, the
Lake Elsinore Municipal Code, and the MSHCP, the Planning Commission makes
the following MSHCP Consistency Findings:
1. The Project is a project under the City's MSHCP Implementing Resolution, and
the City must make an MSHCP Consistency finding before approving the
Project.
Pursuant to the City's MSHCP Implementing Resolution, prior to approving
any discretionary entitlement, the City is required to review the project to
ensure consistency with the MSHCP cell criteria and other "Plan Wide
Requirements. "
The Lake Elsinore Chrysler, Dodge, Jeep dealership lies within MSHCP
Criteria Cells #4646 and #4743. Results of the LEAPS and JPR indicate that
the developable footprint for the Project is consistent with the Cell Criteria for
#4646 and #4743.
In addition, the Project was reviewed and found consistent with the following
"Plan Wide Requirements": Protection of Species Associated with
Riparian/Riverine Areas and Vernal Pool Guidelines (MSHCP, ~ 6.1.2 ),
Urban/Wildlands Interface Guidelines (MSHCP, ~ 6.1.4), Additional Survey
Needs and Procedures (MSHCP ~ 6.3.2), and payment of the MSHCP Local
Development Mitigation Fee (MSHCP Ordinance, ~ 4).

2. The Project is subject to the City's LEAP and the County's Joint Project
Review processes.
The Project consists of a Commercial Design Review within the MSHCP Lake
Elsinore Area Plan. Therefore, a LEAP application and JPR were required.
The LEAP application was reviewed by the City. Upon determining that the
Project is consistent with the MSHCP, Staff forwarded the LEAP to the
Regional Conservation Authority (RCA) for its JPR.
Results of RCA's JPR and the City's LEAP reveal that approximately 2.0 acres
of the project encroach into an area designated for Proposed Linkage 8 (San
Jacinto River). This area is steep and unvegetated. The Applicant has
proposed the donation of 3 acres of conserved land within the floodplain of the
San Jacinto River that are low gradient areas and would allow connection to
larger areas of more valuable habitat.
The Project was found to be consistent with the MSHCP Cell Criteria
requirements by both the City and RCA. The Project was also found consistent
with the other "Plan Wide Requirements" of the MSHCP, as described below.
3. The Project is consistent with the Riparian/Riverine Areas and Vernal Pools
Guidelines.
Section 6.1.2 of the MSHCP focuses on protection of riparian/riverine areas
and vernal pool habitat types based upon their value in the conservation of a
number of MSHCP covered species.
The Project site contains two linear drainage areas and three broader areas
which support riparian vegetation, mulefat, and arroweed. Impacts from the
project will be approximately 0.35 acres with the impacted vegetation being
scattered and insufficient to provide functional habitat. The Applicant proposes
to create bioswales on-site that would be three times larger than the 0.35 acres
of impact (i.e, 3:1 mitigation ratio). The bioswales will be vegetated with
riparian scrub species and will function as filters for first-flush storm
discharges and other post-project drainage, thus improving water quality. As
such, the Project is compliant with Riparian/Riverine Areas and Vernal Pool
Guidelines set forth in Section 6.1.2 of the MSHCP.

4. The Project is consistent with the Protection of Narrow Endemic Plant Species
Guidelines.
The Project is not located in a Narrow Endemic Plant Species Survey Area as
mapped in Section 6.1.3 of the MSHCP. Therefore the provisions of Section
6.1.3 are not applicable to the Project.
5. The Project is consistent with the Additional Survey Needs and Procedures.
The Project is located within the Burrowing Owl survey area as identified in
Section 6.3.2 Additional Survey Need and Procedures of the MSHCP. Three
surveys were conducted on the entire site. There were no areas on the site
considered as suitable habitat for the burrowing owl, and no protocol surveys
are required. However, the Project will be required to conduct a pre-
construction survey 30 days prior to the commencement of grading. The
Project is consistent with Section 6.3.2 of the MSHCP.
6. The Project is consistent with the Urban/Wildlands Interface Guidelines.
The Project is located adjacent to land set aside for conservation by the
Applicant. Further, the site is directly adjacent to the San Jacinto River, which
has been designated as Proposed Linkage 8. Therefore the Urban/Wildlands
Interface Guidelines of MSHCP Section 6.1.4 are applicable to the Project.
The Project will be enclosed by fencing or other barriers to the San Jacinto
River. Surface water discharge will be controlled and treated prior to flowing
into the wildland area. Lighting will be directed away from the River, and all
landscaping and other bioswale plantings will consist of native species. No
additional mitigation measures or conditions of approval are required. The
Project is consistent with Section 6.1.4 of the MSHCP.
7. The Project is consistent with the Vegetation Mapping requirements.
Vegetation Mapping requirements do not apply to the Project. However, the
Applicant has mapped the 0.35 acres of scattered riparian vegetation as part of
the submittal to the City and to RCA. No other mapping is required.
8. The Project is consistent with the Fuels Management Guidelines.
Although the Project area is next to an area being donated to the RCA, and
adjacent to the Proposed Linkage 8, this area is not heavily vegetated and
would not be considered a hazard to humans and their property. Therefore, the
Fuels Management Guidelines of MSHCP Section 6.4 are not applicable to the

Project. No additional mitigation measures or conditions of approval are
required.
9. The Project will be conditioned to pay the City's MSHCP Local Development
Mitigation Fee.
As a condition of approval, the Project will be required to pay the City's
MSHCP Local Development Mitigation Fee at the time of issuance of building
permits.
10. The Project is consistent with the MSHCP.
For the foregoing reasons, the Project is consistent with the MSHCP.
SECTION 3. This Resolution shall take effect from and after the date of its
passage and adoption.

WHEREAS, The Automotive Group filed an application with the City of
Lake Elsinore requesting approval of Commercial Design Review No. 2006-11 for
the design, construction and establishment of the Lake Elsinore Chrysler, Dodge,
Jeep automobile dealership to be located at the southwest comer of Auto Center
Drive and Avenue 12 (the "Project"); and
WHEREAS, the Planning Commission of the City of Lake Elsinore has
been delegated with the responsibility of considering and recommending approval,
conditional approval, or denial of Design Reviews for commercial projects to the
City Council; and
WHEREAS, public notice of the Project has been given, and the Planning
Commission has considered evidence presented by the Community Development
Department and other interested parties at a public hearing held with respect to this
item on November 21,2006.
NOW THEREFORE, THE PLANNING COMMISSION OF THE
CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE
AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has considered the proposed
request for Commercial Design Review No. 2006-11 and has found it consistent
with the design standards set forth in section 17.48.130 of the Lake Elsinore
Municipal Code ("LEMC") for the C-2 General Commercial District.
SECTION 2. Pursuant to Title 14 of the California Code of Regulations
Sections 15070 et seq., on December 13, 2005, the City Council approved and
certified Mitigated Negative Declaration 2005-06, which analyzed and mitigated
potential environmental impacts associated with development of the Chrysler,
Jeep, Dodge automotive dealership. Mitigated Negative Declaration 2005-06 was
processed in conjunction with the initial Project entitlements requested by the

developer. Design review is the final entitlement that the applicant must secure in
order to begin development of the dealership. The action taken by the legislative
body with regard to design review is part of the whole action. To that end,
consistent with Title 14 of the California Code of Regulations Section 15006, the
potentially significant environmental impacts of the Project have been analyzed
under Mitigated Negative Declaration 2005-06 and no further CEQA review is
required.
SECTION 3. That in accordance with LEMC Chapter 17.82, the Planning
Commission makes the following findings for the approval of Commercial Design
Review 2006-11 :
1. The Project, as approved, will comply with the goals and objectives of the
General Plan and the Zoning District in which the Project is located.
The proposed Project complies with the goals and objectives of the General
Plan and the C-2 General Commercial zoning designation. The Project is
consistent with the General Plan because the approval of this automobile
dealership will assist in achieving the development of a well-balanced and
functional mix of residential, commercial, industrial, open space, recreational
and institutional land uses. The automobile dealership will contribute to the
City's commercial land uses and diversifY Lake Elsinore's economic base.
2. The Project complies with the design directives contained in Section 17.82.060
and all other applicable provisions of the Municipal Code.
The proposed Project is appropriate to the site and surrounding developments
in that the automobile dealership has been designed in consideration of the size
and shape of the property, thereby creating interest and varying vistas as a
person moves along the street. Further, the Project as proposed will
complement the quality of existing development and will create a visually
pleasing, non-detractive relationship between the proposed and existing
projects in that the architectural design, color and materials and site design
proposed evidence a concern for quality and originality, consistent with
existing automobile dealerships in the immediate area.

3. Subject to the attached Conditions of Approval, the Project is not anticipated to
result in any significant adverse environmental impacts.
Pursuant to the California Environmental Quality Act (Pub. Res. Code ~ ~
21000 et seq.: CEQA), Mitigated Negative Declaration 2005-06 was prepared
and approved for the project. The approved Mitigated Negative Declaration
incorporates effective mitigation measures into the Project design which reduce
any potential environmental impacts to a level of insignificance.
In addition to the environmental mitigation included in Mitigated Negative
Declaration 2005-06, the Project has been conditioned by all City divisions and
departments, as well as other responsible agencies, in order to ensure that the
Project will not have a significant effect on the environment.
4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code,
including guarantees and evidence of compliance with conditions, have been
incorporated into the approval of the subject project to ensure development of
the property in accordance with the objectives of Chapter 17.82.
Pursuant to LEMC Section 17.82.070, the proposed Project has been scheduled
for consideration and approval of the Planning Commission.
SECTION 4. This Resolution shall take effect from and after the date of its
passage and adoption.

GENERAL
1. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold
harmless the City, its Officials, Officers, Employees, Agents, and its Consultants from
any claim, action, or proceeding against the City, its Officials, Officers, Employees, or
Agents to attach, set aside, void, or annul an approval of the City, its advisory
agencies, appeal boards, or legislative body concerning implementation and
construction of the proposed project, which action is bought within the time period
provided for in California Government Code Sections 65009 and/or 66499.37, and
Public Resources Code Section 21167. The City will promptly notify the applicant of
any such claim, action, or proceeding against the City and will cooperate fully with
the defense.
PLANNING DIVISION
2. Approval of the identified project applications will lapse and be void unless building
permits are issued within one (1) year, of the City Council approved date.
3. All Conditions of approval shall be reproduced on page one of building plans prior to
their acceptance by Building Division. All Conditions of Approval shall be met prior to
the issuance of a Certificate of Occupancy and release of utilities.
4. All site improvements approved with this request shall be constructed as indicated on the
approved site plan and elevations. Revisions to approved site plans or building
elevations shall be subject to the review of the Director of Community Development.
All plans submitted for Building Division Plan Check shall conform with the submitted
plans as modified by Conditions of Approval, or the Planning Commission/City Council
through subsequent action.
5. All structures shall be developed on-site as depicted on the approved site plan and/or as
modified by the Director of Community Development or designee.
6. The applicant shall comply with the City's Noise Ordinance Chapter 17.78 (Noise
Control) of the LEMC.
7. The use of an outdoor public address system shall not be allowed.

8. The applicant shall not allow test driving of vehicles by customers and/or employees
through residential areas. All test driving traffic shall be limited to; Auto Center
Drive, major arterial streets or the 1-15 freeway.
9. Prior to the issuance of a building permit (i.e. light standards), the applicant shall
provide a photometric study. Said study shall be reviewed and approved to the
satisfaction of the Director of Community Development. All exterior on-site lighting
shall be shielded and directed on-site so as not to create glare onto neighboring
property and streets or allow illumination above the horizontal plane of the fixture.
All light fixtures shall match the architectural style of the building.
10. The applicant shall prepare a final wall and fence plan subject to the review and
approval of the Director of Community Development or designee. In addition, a
decorative masonry wall shall be constructed along the west side of the planter identified
to the north of the "pre-owned" sales office building.
11. Trash enclosures shall be constructed per City standards as approved by the Director of
Community Development or designee, prior to issuance of building permit.
12. The Planning Division shall approve construction trailers utilized during construction.
All construction trailers shall require a $1,000.00 cash bond for each.
13.Parking stalls shall be double-striped with four-inch (4") lines two feet (2') apart.
14.All loading zones shall be clearly marked with yellow striping and shall meet City
Standards for loading zones.
IS.Painted arrows on the asphalt shall be located at all internal drive aisles.
16. The applicant shall submit a Sign Program for the approval of the Planning
Commission prior to the issuance of the certificate of occupancy.
17.All roof mounted or ground support air conditioning units or other mechanical
equipment incidental to development shall be architecturally screened or shielded by
landscaping so that they are not visible from neighboring property or public streets. Any
roof mounted central swamp coolers shall also be screened, and screening plan shall be
approved by the Director of Community Development, prior to issuance of building
permit.

18. The Applicant shall comply with the requirements of the Elsinore Valley Municipal
Water District. Proof shall be presented to the Chief Building Official prior to issuance
of building permits and final approval.
19.All exterior on-site lighting shall be shielded and directed on-site so as not to create glare
onto neighboring property and streets or allow illumination above the horizontal plane of
the fixture. The light fixture proposed is to match the architecture of the building.
20.All exterior downspouts shall be painted to match the building color.
21. Materials and colors depicted on the materials board shall be used unless modified by
the Director of Community Development or designee.
22.Prior to issuance of a Grading Permit the applicant shall pay the appropriate MSHCP
Fee.
23. Prior to issuance of building permits, applicant shall provide assurance that all required
fees to the Lake Elsinore Unified School District have been paid.
24.Prior to issuance of building permits, applicant shall provide assurance that all
requirements of the Riverside County Fire Department have been met.
25. Prior to issuance of building permits, applicant shall pay park-in-lieu fee in effect at time
of building permit issuance.
26.Prior to issuance of any grading permit or building permits, the applicant shall sign
and complete an "Acknowledgement of Conditions" form and shall return the
executed original to the Planning Division for inclusion in the case records.
27. The final landscaping/irrigation plan is to be reviewed and approved by the City's
Landscape Architect Consultant and the Community Development Director or
Designee, prior to issuance of building permit. A Landscape Plan Check Fee will be
charged prior to final landscape approval based on the Consultant's fee plus forty
percent (40%).
a. All planting areas shall have permanent and automatic sprinkler system with
100% plant and grass coverage using a combination of drip and conventional
irrigation methods.

b. Applicant shall plant street trees, selected from the City's Street Tree List, a
maximum of thirty feet (30) apart and at least twenty-four-inch (24") box in
SIze.
c. All planting areas shall be separated from paved areas with a six inch (6")
high and six inch (6") wide concrete curb.
d. Planting within fifteen feet (15') of ingress/egress points shall be no higher
than thirty-six inches (36").
e. Any transformers and mechanical or electrical equipment shall be indicated
on landscape plan and screened as part of the landscaping plan.
f. The landscape plan shall provide for ground cover, shrubs, and trees and
meet all requirements of the City's adopted Landscape Guidelines. Special
attention to the use of Xeriscape or drought resistant plantings with
combination drip irrigation system to be used to prevent excessive watering.
g. All landscape improvements shall be bonded 100% for material and labor
for two years from installation sign-off by the City. Release of the
landscaping bond shall be requested by the applicant at the end of the
required two years with approval/acceptance by the Landscape Consultant
and Community Development Director or Designee
h. All landscaping and irrigation shall be installed within affected portion of
any phase at the time a Certificate of Occupancy is requested for any
building. All planting areas shall include plantings in the Xeriscape concept,
drought tolerant grasses and plants.
1. Final landscape plan must be consistent with approved site plan.
J. Final landscape plans to include planting and irrigation details.
28. The applicant shall comply with all mitigation measures identified in the Mitigation
Monitoring Program for Mitigated Negative Declaration No. MND 2005-06.
29.The applicant shall comply with Chapter 17.98 of the Lake Elsinore Municipal Code
(LEMC) regarding all temporary use activities.

ENGINEERING DIVISION
30.The applicant shall dedicate right-of-way and shall construct full half width
improvements on Auto Center Drive. Right-of-way dedication shall be 50-feet as
measured from the centerline of Auto Center Drive to the project property line. Full
half width street improvements shall be constructed such that the measurement from
the centerline of Auto Center Drive to the project-side curb face is 40- feet.
Development shall construct median along Auto Center Drive for full frontage width
of the project. Median design shall maintain existing circulation patterns as approved
by the City Engineer.
31. The terms of the development agreement shall be referenced and incorporated into the
project requirements as detailed in the agreement.
32.Provide a striping and signing plan for striping from Mill Street to the bridge with
special attention to the design and adequate tapers of traffic lanes to and from the
bridge to the new four lane facility on Auto Center Drive. This plan shall be approved
by the Traffic Engineer prior to issuance of the building permit.
33.Provide detention and desiltation basin sized to detain the increase in the 100 year
storm flow between the developed and undeveloped site condition.
34.The slope on the north side of the project shall be improved with long-term erosion
control planting.
35.The outlet drainage pipe on the east slope of the project shall be improved such that
the outlet condition slows the discharge to a non-erosive velocity and that the down
stream property owner is protected from the 100-year storm flows. The existing outlet
restriction shall be removed unless the applicant can demonstrate that the pipe was
designed and constructed to accommodate pressure flow.
36.Sight distance for ingress / egress at all driveways shall be unobstructed.
37.Parking shall not be allowed on Auto Center Drive within 120 feet north and 20 feet
south of driveways.

38.Underground water rights shall be dedicated to the City pursuant to the provisions of
Section 16.52.030 (LEMC) and be consistent with the City's agreement with the
Elsinore Valley Municipal Water District.
39.All street improvements shall be installed and functioning prior to certificate of
occupancy.
40.Pay all Capital Improvement and Plan Check fees (LEMC 16.34, Resolution 85-26),
mitigation fees, area drainage fee, traffic impact fee (TIF), Transportation Uniform
Mitigation Fee (TUMF), encroachment permit fees and inspection fees associated
with the project and its development. Fee amount to be paid shall be consistent with
the current amount as stipulated in each fee ordinance.
41. Submit a "Will Serve" letter to the City Engineering Division from the applicable
water agency stating that water and sewer arrangements have been made for this
project. Submit this letter prior to issuance of a building permit.
42.Construct all public works improvements per approved street plans (LEMC 12.04).
Plans must be approved and signed by the City Engineer prior to issuance of a
building permit (LEMC 16.34).
43.Street improvement plans and specifications shall be prepared by a California
Registered Civil Engineer. Improvements shall be designed and constructed to
Riverside County Road Department Standards, latest edition, and City Codes (LEMC
12.04 and 16.34).
44.Applicant shall enter into an agreement with the City for the construction of public
works improvements and shall post the appropriate bonds prior issuance of a building
permit.
45.All compaction reports, grade certifications, monument certifications (with tie notes
delineated on 8 'l1" x 11" Mylar) shall be submitted to the Engineering Division before
final inspection of public works improvements will be scheduled and approved.
46. The applicant shall install permanent survey monuments in compliance with the City's
municipal code.

47.Applicant shall obtain all necessary off-site easements for off-site grading or
construction from the adjacent property owners prior to issuance of a building permit.
48.Arrangements for relocation of utility company facilities (power poles, vaults, etc.)
out of the roadway or alley shall be the responsibility of the property owner or his
agent.
49.Provide fire protection facilities as required in writing by the Riverside County Fire
Department.
50.Provide street lighting and show lighting improvements as part of street improvement
plans as required by the City Engineer.
51.Applicant shall install blue reflective pavement markers in the street at all fire hydrant
locations.
52.Applicant shall submit a traffic control plan showing all permanent traffic control
devices for the project to be approved prior to issuance of a building permit. All
permanent traffic control devices shall be installed prior to final inspection of public
improvements. This includes No Parking Signs for travel ways within the
development.
53.Construction traffic control plans shall be submitted to and approved by the City's
Traffic Engineer prior to issuance of encroachment permit.
54.All improvement plans and tract maps shall be digitized. At Certificate of Occupancy
applicant shall submit tapes and/or disks which are compatible with City's ARC
Info/GIS or developer to pay $300 per sheet for City digitizing.
55.All utilities (electrical, cable television, telephone) except electrical over 12 kv shall
be placed underground, as approved by the serving utility.
56.Apply and obtain a grading permit with appropriate security prior to building permit
issuance. A grading plan signed and stamped by a California Registered Civil
Engineer shall be required if the grading exceeds 50 cubic yards or the existing flow
pattern is substantially modified as determined by the City Engineer. If the grading is
less than 50 cubic yards and a grading plan is not required, a grading permit shall still

be obtained so that a cursory drainage and flow pattern inspection can be conducted
before grading begins.
57.Provide soils, geology and seismic report including street design recommendations.
Provide final soils report showing compliance with recommendations.
58.An Alquis-Priolo study shall be performed on the site to identify any hidden
earthquake faults and/or liquefaction zones present on-site.
59.All grading shall be done under the supervision of a geotechnical engineer. All slopes
steeper than 2 to 1 shall be approved by the City Engineer and certified for stability
and proper erosion control requirements by a licensed Geologist or licensed
Geotechnical Engineer. All manufactured slopes greater than 30 ft. in height shall be
contoured and have a six (6) foot wide bench with a three (3) foot wide terrace drain
constructed for every thirty (30) vertical foot of slope.
60.Prior to commencement of grading operations, applicant to provide to the City with a
map of all proposed haul routes to be used for movement of export material. Such
routes shall be subject to the review and approval of the City Engineer.
61.Applicant to provide to the City a photographic baseline record of the condition of all
proposed public City haul roads. In the event of damage to such roads, applicant shall
pay full cost of restoring public roads to the baseline condition. A bond may be
required to ensure payment of damages to the public right-of-way, subject to the
approval of the City Engineer.
62.1ndividuallot drainage shall be conveyed to a public facility or accepted by adjacent
property owners by a letter of drainage acceptance or conveyed to a drainage
easement.
63.0n-site drainage facilities located outside of road right-of-way should be contained
within drainage easements shown on the final map. A note should be added to the
final map stating: "Drainage easements shall be kept free of buildings and
obstructions" .
64.All natural drainage traversing site shall be conveyed through the site, or shall be
collected and conveyed by a method approved by the City Engineer.

65.Meet all requirements ofLEMC 15.64 regarding flood hazard regulations.
66.Meet all requirements ofLEMC 15.68 regarding flood plain management.
67.Submit Hydrology and Hydraulic Reports for review and approval by City Engineer
and the Riverside County Flood Control District as a submittal requirement of the
rough grade plan check. Applicant shall mitigate any flooding and/or erosion caused
by development of site and diversion of drainage.
68.All drainage facilities in this site shall be constructed to Riverside County Flood
Control District Standards.
69.Storm drain inlet facilities shall be appropriately stenciled to prevent illegal dumping
in the drain system, the wording and stencil shall be approved by the City Engineer.
70.l0-year storm runoff should be contained within the curb and the 100-year storm
runoff should be contained with the street right-of-way. When either of these criteria
is exceeded, drainage facilities should be installed.
7l.A drainage acceptance letter shall be required from the downstream property owners
for out-letting the proposed storm water run-off on private property if the flows are
inconsistent with the historic flow details.
72.Applicant will be required to install BMP's using the best available technology to
mitigate any urban pollutants from entering the watershed.
73.Applicant shall obtain approval from Santa Ana Regional Water Quality Control
Board for their stormwater pollution prevention plan including approval of erosion
control for the grading plan prior to issuance of grading permits. The applicant shall
provide a SWPPP for post construction which describes BMP's that will be
implemented for the development and including maintenance responsibilities.
74.Education guidelines and Best Management Practices (BMP) shall be provided to the
manager of the business in the use of herbicides, pesticides, fertilizers as well as other
environmental awareness education materials on good housekeeping practices that
contribute to protection of stormwater quality and meet the goals of the BMP in
Supplement "A" in the Riverside County NPDES Drainage Area Management Plan.

75.Applicant shall provide first flush BMP's using the best available technology that will
reduce stormwater pollutants from parking areas and driveways. These provisions
include the development and compliance with a Water Quality Management Plan
(WQMP).
76.Driveway intersection site distance shall meet the design criteria of the CALTRANS
Design Manual (particular attention should be taken for intersections on the inside of
curves). If site distance can be obstructed, a special limited use easement must be
recorded to limit the slope, type of landscaping and wall placement.
77.Reciprocal access agreements shall be processed with adjacent property owners.
78.All waste material, debris, vegetation and other rubbish generated during cleaning,
demolition, clear and grubbing or other phases of the construction must be disposed of
at appropriate recycling centers. The applicant shall contract with CR&R, Inc., in
accordance with the City's Franchise Agreement.

SUBJECT: PLANNING COMMISSION COMPENSATION
BACKGROUND
Section 2.24.070 (Compensation) ofthe Lake Elsinore Municipal Code (LEMC) states
that, "Council shall from time to time, by resolution, fix the compensation of the
Planning Commission". The most recent resolution adjusting the Planning
Commission compensation was adopted in 1984, which set the compensation at $50.00
per meeting. In order to increase the compensation, the City Council would have to
approve a resolution specifying the amount to be paid.
DISCUSSION
At the request of the Planning Commission, staff has prepared the following
information relative to the compensation and health benefits paid to other Planning
Commissioners in neighboring cities.

Additionally, it is important to note that currently the City provides a maximum
monthly allowance of $1,050.00 towards health insurance premiums. If the actual
monthly health insurance premium exceeds the monthly allowance, the difference is
paid by the employee. The four (4) allowed health insurance providers under PERS
are Blue Shield, Kaiser, PERS Choice and PERS Care.
In the case ofPERS Choice (Blue Cross), for example, the total monthly premium for
an Employee & 2+ Dependents is $1,124.86. Since the monthly allowance is
$1,050.00 per month the employee would need to pay $74.86 each month to make up
the difference. However, using the same health provider as an example, since the
premium for an Employee & 1 Dependent is $865.28 per month, the monthly
allowance would exceed the actual premium cost and no additional payments would be
required of the employee. Other rates are dependent on the Plan chosen.
The effective date of the new Monthly Premiums for Contracting Agencies under the
Public Employment Retirement System (PERS) is January 1,2007 thru December 31,
2007.
FISCAL IMPACT
The fiscal impact to the City will be based on the amount of compensation and/or
Health Benefits ultimately approved by the City Council.
RECOMMENDATION
Concurring action of the Planning Commission providing direction to staff in the
preparation of a staff report and resolution for City Council consideration which
includes a proposal on a compensation amount and health insurance allowance.

BACKGROUND
This item sets the time and place for ajoint study session ofthe Planning Commission
and Public Safety Advisory Commission (PSAC).
DISCUSSION
At the request of City staff, both the Planning Commission and the PSAC have been
asked to participate in a joint study session to discuss the Lakeshore Drive Overlay
District and current issues thereof relative to the General Plan Update.
Representatives from the Community Development Department, Code Enforcement
Division and Lake and Aquatic Resources Department will facilitate this discussion.

None.
RECOMMENDATION
Concurring action to schedule a joint Planning Commission/Public Safety Advisory
Commission Study Session on Wednesday, December 13, 2006 at 3:00 p.m. in the
