Thereupon the Treasurer's and Clerks monthly reports were presented to Council and on motion duly made and carried were accepted and ordered placed on file. Thereupon the Clerk presented to Council a statement submitted by the Temescal ,-ter Co. covering their water withdrawals during the month of Sept. 1933 from their Railroad Canyon Reservoir showing a total withdrawal of 15,164 M.I.D. or 606.56 acre feet, and their statement covering monthly withdrawals during the year from Oct. 1, 1937 to Oct. 1, 1938 showing total withdrawal for the year of 157,905 MI.I.D. or 6316.20 acre feet and water elevation on Oct. 1, 1938 being 1379.93 ft. or a storage increase of 0.04 ft, equal to 22 acre feet. Thereupon Legislative Bulletin # 1, 1939 Series submitted by the League of Calif. lAunicipalities together with notice that the suggested tdodel City Tax Ordinance is now completed and ready for distribution and that one copy will be sent to the City Clerk of each member City upon written request, was presented to Council. Thereupon it was moved by Councilman Macy and seconded by Councilman Perret that said Bulletin be received and filed and that the Clerk be directed to make a r;ritten request for a copy of the Model Tax Ordinance, which motion upon vote was carried. Thereupon -the Clerk presented to Council a communication from the R'chfield Oil Co, together with their proposal to enter into a Sales agreement ' ith the City, offering to furnish the City's gasoline requirements for the year of 1939 at following quoted prices. Richfield Ethyl Gasoline @ .16¢ per gal. Hi- Cctane First Grade " @ .130 per gal. Flash Gasoline .125 per gal. Upon Councils due consideration of said proposal it was agreed that the matter be laid over for further consideration at the next meeting of Council. Evans of Riverside that the next regular meeting of th:, Citrus Belt League of Calii, Municipalities will be held at Riverside on Jan, 27th and requested to be advised as to number that �,ould attend from Elsinore.. Thereupon it vras agreed by Council that the Clerk be instructed to fon ^a_rd request for three reservations for Elsinore. Thereupon 'a communication from E. C. Collatz vas presented to Council in which it. was requested that'Council autkiorize a ccntribution of �10.00.to help.defray the expenses in connection with the holding of the 'Imperial Highway Annual Meeting in Elsinore to be held on Jan. 28th at the Amsbury- Hotel.. !Nheereupon`it :.as'agreed to Council that Payment of piG.00 be authorized: to -, i,ard expenses of the Imperial Highway meeting upon proper presentation of bill of same. Thereupon a. communication from Franklin A. Hiller, Minister, Elsinore Church of Christ was presented to Council, in which he acknowledged receipt of Councils letter of. Dec. 23rd., expressing Councils appreciation for his service to the City in spiritual matters and stated that he rejoiced in the op'portuni'ty of tieing able to serve the 'City of Elsinore in this way. Whereupon it sas duly moved and carried that said communication be receI`Iad and filed. Thereupon a communication from G. Thereupon the Clerk reported' to Council that he has received from the County Auditor a i °arrant covering the first installment of 19337.39 Tax collections.and sub- mitted to Council a statement covering the amount distributed to each of the various funds. -_ , 'Nhereupon it eras duly moved and carried that said report be received and filed. Thereupo'w the Clerk- presented to Council a proposal submitted by the'3tandard Oil Co, to enter, into an agreement with the City t.o furnish the City's gasoline require- ment for one year at the follo�-.ing quoted prices. 160, 13¢ and 12zy, per gallon. Upon Councils consideration of the matter it was agreed that action on proposals received be deferred until storage tank and pump is purchased and installed. Whereupon it was moved by Councilman. Perret and seconded -;by Councilman Lovejoy that Councilmein fiSacy and Mills, Water and Street Commissioners be authorized to in- vestigate and purchase a gasoline pump and tank equipment for the City and have same installed at the City 'd:ater Plant, 1..hich motion ,,,,as carried by the following. vote: I Ayes: Councilmen: Lovejoy, Uacy,`Perret, L?ills and t"atich. ;toes: None. Thereupon it was moved by Councilman Mills and seconded by Ctuncilman Macy that said report be received and filed and that the check for 6345.98 be deposited to the credit of the general fund, which motion upon vote was unanimously carried. Thereupon a communication from R. T. Hicks County Audltor`csas pr'sented to Council, submitting a corrected statement of tax collections, advising that his office had inadvertently posted the amount of 6212.84 to the-'credit of• 1920 Elsinore{ Street'Imprcvement fund instead of to the 1926'rrater`Improvement fund and advised that the correct segregation of-these tcio`funds is as follows: Elsinore Street Imp. Whereupon it e ";as agreed by Council that the card be returned with instruc- tions that five mould attend from Elsinore. Thereupon R. B. Fairchild .Promotion Engineer from the W.P.AL. "office of Los Angeles appeared before "GOUneil and reported that they i[,e-re- interested in receiving proposals for worthwiiil W'.P.A[. Projects.from the City of Elsinore, stating that they has fifty -eight persons on the ;d.P.A. R611 in Elsinore.and desired to keep them employed on local projects and suggested they mere particu- larly interested in receiving applications, for projects providing for improvement of streets, sewers, curbs and gutters and reported that they are in a position to furnish, supervision, labor and up to 010.00 per mail a month for material to be used in said work. Upon Ccuncils due 'consideration. the matter, it v:as agreed that a survey of the City be made to deiermine the most feasable improvement work that can be submitted for W.P.A..Projects., Thereupon "Councilman Lovejoy reported to Council -that he.has investIig -,ted the offer received by the City from Mr. Mclean for the purchase of the Ci,ty's. unused adding machine and suggested that as the City has no use for this equipment and the price of u`25..00 offered ira.s reasonable, he e:,culd.reconmend that same be sold. Whereupon it v;as moved by Councilman Perret and seconded by Councilman Lovejoy -,'I that said dividend check be accepted and that the Clerk be diredted to deposit it to the credit of the General Fund, which motion upon, vote was carried. Thereupon the Clerk presented to Council notice from the Division of Highcaays that Encroachment Permit vras issued to Ross Millard granting hire permission to cons- truct approximately 200 feet of concrete curb on the north side of Graham Avenue betn,een Lowell and 5civener Sts.; subject to specifications of the Division and approval of said permit by the City Council of Elsinore. Horton on behalf of the Elsinore Business and Pro- fessional +,omens Club appeared "before Ceuc,cil and resorted that their Ciub,is interested in secur = free mail delivery for "the; City of Elsinore and that they,, have been reliably :informed that this service can 'be secured providing -that the City Streets are signed, lighted and sidewalks are placed over'the entire City and it was the request of the Club that the City Council cooperate in this project by providing if possible, the necessary requirements. Poore and Howard Habenicht, 'nembe'rs of the 'City Planning Commission appeared before Council and reported that the Commission has devoted considerable time to the study of the proposed plan of :zoning the City and that they were 'now prepared'tc file for Council's consideration a tentative map deline- ating certain proposed zones for the City of Elsinore togethor ith certain written restrictions to be applied to' said zones. They stated that their proposal vlas merely tenative to Council_ and would be subject to any correction_ or change by Council, afteri study-rand ;consideration of the matter. Whereupon it was agreed by Council, that the proposed zone maps be received for study and consideration. Councilman Macy having been previously excused from, the meeting by the Chair, Councilman Mills 'was "appointed to serve on, th''- "auditing committee. C. Lawrence a representative of the American.Rubber I.Sfg. Co. appeared before Council arid, reported that.his Company furnished the last order o fire hose purchased by the City sortie nine years ago and that at the request of Fire Chief Cox he prepared a written proposal :Afl ich was suU;oitted to Council, agreeing to furnish the City with their .unicipal brand of fire hose at 1.10. per foot, for either immediate or future delivery. Thereupon it etas agreed by Council that said proposal be turned over to Council- man Macy, Fire Commissioner for his consideration. Thereupon Legislative Bulletin -71j subrlitted by the Calif. League :of Nunicipalit'ies was presented to Council and upon due consideration of same it was moved by Councilman Mills and seccnd.ed by Councilman ..Lovejoy that the 15ayor be directed to forward telegrams or letters to Assemblyman'Delviorth and Senator Phillips of Riverside County urging them to support the bills bAng sponsored, by the League and to appose, passage':. of bills which are being apposed by the League. REGULAR ADJCURNED MEETING OF THE CITY COUNCIL JULY 31, 1939 A regular adjourned meeting of the City Council'of the City,of,Elsinore,was held on the above date The meeting was called, to order at the hour; of ']:30;:P.M: with Mayor` Matich in the Chair. Councilmen: Roy Macy; Henry.Perret, J E;_ Mille and N. 9gatick�.anawered the roll call. Absent' Councilman: - "C: A. Lovejoy: Thereupon.the Chair ordered that the,reading of the minutes c. f the last regular meeting be dispensed with. This being the time and olaced fixed on the proposed City Zoning,Ordinance the Chair inquired of the persons present if alI`were` informed as to the provisions of said ordinance to which question there was an affirmative reply ZCher'eupon':the Chair informed all 'persons prea nt that if anyone, had any ob jections °to said proposed' City Zoning ' °Ordinance or`desired to off any suggested changes in same that they would. be heard now. Whereupon a petition signed 'by.four proper-_ty oiv:jers was �pre sentead to Council in.., which 'they requested that their''lots' Nos 10 -11 -12 and`13'in Block 3 of Healds 2nd addition to Elsinore be taken out of Zone R -3 and included in Zone B -1 also Mr. Maurice Wassel personally requested of Council that his Lot 19 Block M of Hamptons First addition be taken out of Zone R -3 and included in Zone B -1. Whereupon further request was made by a number of persons present that the chicken and animal Zone be changed to place the boundary line along East Hill Street. Upon Councils consideration of the above requests for changes in the proposed City Zoning Ordinance it was agreed that unless Council desired to overrule objections and deny requests it would be necessary to refer said matters back to the City Planning Commission. Whereupon it was moved by Councilman Mills and seconded by Councilman Macy that the matter of proposed City Zoning Ordinance be referred back to the City Planning Commission for further consideration and that the date for a hearing before the City Planning Commission be fixed to take place on August 7th, 1939 at the hour of 7;30` P.M. in the City Hall and that notice of said hearing be given by publication, which motion was carried by the following vote: Ayes: Councilmen: Macy, Ferret, Mills and Matich. Noes: None. Absent: Councilman: C. A. Lovejoy. Thereupon Councilman Mills reported to Council that W. L. Burgess has personally tendered to him, his resignation as City Garbage collector and therefore suggested that Council take action on the matter. Whereupon it was moved by Councilman Mills and seconded by Councilman Macy that the resignation of W. L. Burgess, Garbage Collector be accepted, which motion was carried by the following vote: Ayes: Councilmen: Macy, Ferret, Mills and Matich. Noes: None. Absent: Councilman: Lovejoy. Thereupon the Clerk presented to Council a communication from Mrs. 0, G. Schubert calling to Councils attention that the sidewalk at the Southwest corner of Main and Franklin Sts. was in a defective condition and advised that she is obliged to travel over same quite frequently. that should a , e - suffer I I an I d injury as a result of this defective sidewalk she would hold the City responsible. Whereupon it was agreed by Council that this matter be referred to Councilman Mills Street Commissioner for his attention. Thereupon a card received from the family of Kenneth Barber was presented to Council stating that they will hold in grateful remembrance, Councils kind expression of sympathy. Whereupon it was duly moved and carried that same be received and filed. Thereupon a communication from the Regal Oil Co. was presented to Council which they acknowledged the receipt of notice that they were ai�,arded the contract to furnish the City road oil at $5.50 per ton as per their bid, but called to Councils attention that the Calif. Sales Tax is to be added to the price quoted and requested that they be informed that the matter of sales tax is acceptable. Whereupon it was moved by Councilman Mills and seconded by Councilman Perret that the Clerk be authorized to notify the Regal Oil Co. that matter of sales tax being added to the price quoted for road oil is acceptable to Council which motion upon vote was carried. thereupon a communication from Dr. W. M. Dickie, Director State Dept. of Public Health was presented to Council in which he urged that the City Health Officer attend the Annual meeting of the Calif. Health Officers to be held in connection with that of the League of Calif. Municipalities, at Oakland, Sept. 18th to 20th. Whereupon it was duly moved and carried that said communication be received and filed. Thereupon the Clerk presented to Council a communication from Roscoe R. Hess, Atty. acting as special Counsel for the City of Lynwood and other Citrus in an action filed in the Superior Court of Los Angeles County against the So. Calif. Gas. Co. and the So. Wetzel was presented to Council in which he requested to be advised regarding the operations of the Clevelin Realty Co, in connection with a booth maintained by them at the San Francisco Fair and from which they award prizes to lucky winners, including Club memberships in the Lake Elsinore Country Club and represent that the City of Elsinore in participating in the matter as an advertising medium. Whereupon it was moved by Councilman Perrot and seconded by Councilman Lovejo that this letter be referred to the City Atty. for answer and that a copy of same' be sent to the Fair Association which motion upon vote was carried. Thereupon Resolution 3334 was introduced and read being a resolution of the City Council of Elsinore granting to the County of Riverside, the right to enter upon certain Streets in the City of Elsinore. Whereupon Resolution #336 was introduced and read being a resolution of the City Council resolving that the Mayor and Clerk of the City of Elsinore be autho rized to enter into an agreement for and on behalf and in the name of the City Council of the City of Elsinore, with the Board of Supervisors of the County of Riverside, for the purchase of certain property located in the City of Elsinore, under and pursuant to the provisions of Sec 3697 -D of the political Code of Calif a copy of agreement being attached thereto. Thereupon a report from the State Division of Highways was presented to Council in which they submitted a statement of the g cent gas tax allocation for the thid quarter of 1939, Elsinore receiving $352.59, Whereupon it was decided and duly moved and carried that said report be received and ordered filed. Thereupon encroac? ment permit issued by the 'State Division of Highways to the Burgess Refrigerating Cokpany granting them permission to construct a drive- way to Graham Avenue in front of Lot 3 Block 9 of "akeshore Drive Addition. subject to the approval of the City Council was presented to Council for their consideraticn Whereupon it was moved by Councilman Macy and seconded by Councilman erret that said permit be- referred to the Street Commissioner for his attention which motion upon vote was carried. Thereupon Ordinance #237 was presented to Council on first reading being an Ordinance of the City of Elsinore relating to the care and expenditure of moneys received from the State of California under the provisions of Article 5, Chapter 1 of the Streets and Highway Code. Whereupon it was moved by Councilman Mills and seconded by Councilman Macy that Ordinance #237 be passed to its second reading which motion was carried by the following vote: Ayes: Councilmen: Lovejoy, Macy, Ferret, Mills and Matich. Noes: None Absent: None Thereupon Council took up for consideration the matter of placing Stop Signs"When Pedestrians are Crossing" on Main Street in the Business District and it was agreed by Council that the Street Commissioner be authorized to purchase two smch signs and have then placed at the most effective locations. Thereupon a communication addressed to Mayor Matich from the Secretary of the Citrus Belt Division of the League of California Cities was presented to Council in which she advised that at the last meeting of the League held at Indio it was decided that they would like to have Elsinore be the host City for the next meeting to be held January 26th and the Mayor's reply to same was read in which he extended a most heart welcome to all of the member- cities to attend the next meeting at Elsinore on January 26th. Whereupon it was moved by Councilman Lovejoy and seconded by Councilman at that the action of the Mayor be approved which motion upon vote was carried.
