Thereupon the Clerk presented to Council the Treasurer's monthly report, which on motion duly made and carried was accepted and ordered placed on file. Whereupon the Clerk presented to Council three communications received from City F.ttorney Best. First regarding City of Elsinore V. S. Temescal Water Co. advising that de- fendants have made a motion for new trial which was agreed on .Jan. 31st. The Judge took the matter under submission and that as soon as decision is rendered he would advise Council. Second advising. that he has written to the Brown Creemmer Co, informing them that if they will accept sixteen thousand dollars in full settlement for the 1915 delinquent bonds, that Council will put the matter on the ballot for the general election on April 12th and that their reply to same xvas that they are willing to accept $17,000.00 cash providing that said amotant is paid not later than Ploy 1st, 1938. Third advising that he wired the Brown Creemmer Co. that Council offer *~16500.00' for full settlement of said bonds and that they replied by telegram that they are not interested in settlement for leas than X17000.00, Upon Councils due consideration of these matters, it was moved by Councilman T~".acy and seconded by Councilman Perret that it be authorized to instruct the City Attorney to proceed to prepare the necessary legal proceeding to vote upon the issuance of $T15000.00 of general bonds at the coming general election, providing that if bonds carry, there is necessary time to dispose of them prior to May 1st, 1938, which motion upon vote was unanimously carried.
