Street.
Project Planner Resendiz presented the Minor Design Review of two (2) Single Family
Residences with an attached 2 -car garage for each unit. Project Planner Resendiz indicated
that the building will be Craftsman in architectural style. He further stated that Staff has
determined that the project meets the requirements of the Lake Elsinore Municipal Code and

that Staff recommends that the Planning Commission adopt the Resolution approving the
proposed residential design.
The applicant, Arturo Perez 168 W. 43rd Street, Los Angeles, advised the commission that he
is present.
Chair O'Neal stated that he pulled this item because of reverse and repeat design, and
questioned the applicant on what the building is supposed to look like. He also stated that the
pictures submitted do not reflect what he has in his back up material. There are missing
elevations, and the drawings are different. The applicant stated there have been changes,
since first submitting the application, he also stated what is on the screen is what is correct.
Chair O'Neal said that this will be accepted with the plans revised on June 15, 2006, sheets
AS 1, A3, which are shown on the screen with the enhanced architectural features.

5. Annexation No 78; General Plan Amendment No. 2006 -01; Pre - annexation Zone
Change No 2006 -03; Mitigated Negative Declaration No. 2006 -03 a request to
redesi2nate2l 13acres from County Zoning of Very Low Density Residential, 1 acre
minimum lot size (VLDR) to "East Canyon Hills Specific Plan ", and pre- zoning
from County Residential A2riculture -1, one acre minimum lot size to "East Canyon
Hills Specific Plan ".
Chairman O'Neal opened the Public Hearing at 6:29:07 PM .
Director of Community Development Preisendanz presented the items and turned it over to
Project Planner Carole Donahoe for formal presentation.
Associate Planner Donohoe related that the C & J Family Trust requests Annexation of 21.13
acres, which is vacant land adjacent to the city boundaries, at the city's far eastern edge. The
property is currently in the County of Riverside's jurisdiction.

Associate Planner Donahoe indicated that the applicant is requesting a zone change for this
property as well as a General Plan Amendment to the East Canyon Lake Specific Plan, in
order to utilize the Specific Plan Designation and ultimate zoning standards.
The project lies between Holland Road to the North and Corson Road to the South, just
Westerly of Anna Lane. The existing County zoning is Residential - Agriculture, one (1) acre
minimum lot size. Staff found that the subject site is not part of the Wildomar incorporation
effort, but it is part of the proposed City of Menifee Valley Incorporation.
In conclusion Project Planner Donahoe stated she has received some phone calls regarding
disturbing information being disseminated into the Menifee Valley area. A flyer has been
posted on fences and mailboxes, bearing my name (Carole Donahoe) and the flyer indicated
that it came from the City or Planner Donahoe. The only flyer that went out was a notice of
the meeting occurring tonight. Planner Donohoe requested Attorney Santana to provide
some information on eminent domain. City Attorney Santana stated that the process of
eminent domain is completely driven by the City Council and the City Council has to adopt a
resolution of necessity indicating that a portion of land will be subject to the eminent domain
provisions. At this point the City Council has not made any indication to Staff that eminent
domain is going to be utilized.
Sheila Thomberg, a property owner 25710 Holland Road, Menifee stated she is opposed to
any annexation or zone change. She stated she would like to keep the rural lifestyle.
Joan Leonhardi, 31040 Byers Street, Menifee, stated that she resides 2.5 acres from the site
of the proposed annexation. She stated she lives in the oldest part of Menifee Valley, without
street lights, on dirt roads and they enjoy the rural lifestyle.
Julie Cheney 31300 Hawthorne Street, Menifee, stated she was in opposition of the Lake
Elsinore annexation and re- zoning, this will have a negative effect on the quality of life for
the rural residents and for the future tract home owners.
Tom Fuhrman, 25690 Holland Road Menifee. He stated projects to need to be planned years
in advance and looked at on a long term basis. He also stated current residents need to be
considered, as well as the effect on their way of living.
Beverly Sherratt 31139 Anna Lane, Menifee, stated of all the species of animals and Native
American artifacts that will be lost if tract homes are put there. She also stated the run off
from these developments have been pumped into our neighborhood and caused our septic
system to back up.
Jon & Karen Christensen 20770 Stoneybrook Circle Riverside stated there are no plans to
develop the property at this time. They also stated that the property was believed to have
been part of the original Elsinore annexation in the late 1980's early 1990's.

Upon the death of their Grandfather, they found out this was not the case and they still want
it to be part of Lake Elsinore.
Rosemary Cincinelli 215 Byers Street Menifee, stated she moved here for the rural lifestyle
and does not want to give it up.
Comments:
Commissioner Flores stated he has reviewed the packet concerning this project and
understands the residents need to keep the area rural. He also stated the annexation will
provide logical expansion of the city, along with public agencies working together to provide
the necessities for the health, safety and welfare of its community. In conclusion
Commissioner Flores stated he moves to proceed to the next level.
Vice Chair Gonzales stated he agrees to the annexation, but when it comes to development
we must watch what is being done with the property and try to keep it at 1 acre lots.
Commissioner Mendoza concurs with the fellow Commissioners, and is in support of the
annexation but feels the property owner should be able to do what he wants with his
property. Developers also need to be aware of drainage problems and be responsible in 2 -3
years for fixing the problems.
City Attorney Santana commented in regards to clarifying the Scope of Review, under the
California Environmental Quality Act. She stated, based upon an initial study that the city
conducted, it was found that the project could potentially have significant environmental
effects and the city is not denying this, but we have created a Mitigation Monitoring and
Reporting program, as well as conditions of approval, which Mitigate all of the potential
impacts to a level of insignificance. The city has not yet submitted an application to LAFCO
because as a precursor to the submission of the application, the city must adopt resolutions,
pre- zoning this territory to be consistent with the city's general plan, and must also adopt
resolutions to annex this property into the city's boundaries. In conclusion, Attorney Santana
stated it would be premature for the city to have filed the application, absent the adoption of
those resolutions. The annexation of this property will not affect the keeping of horses or
farm animals on adjacent properties.
Commissioner Zanelli commented on not being able to stop development, but we can try and
control it. He also stated the Christensen's have a right to have control over their property.
In conclusion he stated he is in support of the annexation.
Chair O'Neal commented he is in support of the annexation and the rights of the
Christensen's to do what they want with their land. He stated he would not be favorable to
someone that says they have no plans for development and a year from now comes in with
plans.

Chairman O'Neal opened the Public Hearing at 7:30:51 PM
Director of Community Development Preisendanz presented the project and turned it over to
the Project Planner Carole Donahoe for a formal presentation.
Associate Planner Donahoe stated that the Shopoff Group is requesting an annexation to
bring 62.42 acres into the city boundaries that are currently in the County of Riverside
jurisdiction, but within the city's sphere of influence. She also stated that the General Plan
Amendment will cover all the properties that we are discussing this evening. The zone
changes differ in that the pre - annexation zone change only covers the property that is
currently not in the city and the second zone change 2006 -07 only covers the 4.99 acres that
is currently in the city. Associate Planner Donohoe went on to state that Tentative Tract Map
No. 33725, covers all that is in yellow, it does not cover the four outlying parcels that were
added to the annexation request because, LAFCO wanted to square off corners and not have
an island tucked in between the city boundaries and the county. The amendment to the
Ramsgate Specific Plan (the 5th revision) incorporates the properties in Tentative Tract No.
33725 and therefore provides the zoning standards for which that will be developed.
Associate Planner Donohoe stated she wanted to speak on the issue of the parks, which was
questioned by one of the commissioners that perhaps the map was not in compliance with the
second memorandum of understanding that was agreed upon by the city and the developer.
She indicated that map #33725 will include a neighborhood park and 2 small pocket parks
with an aggregate of plus or minus 3 acres, to be maintained by an HOA or other acceptable
management entity. She stated that these parks will have active uses in that there is a
volleyball court, hiking trail from one park to another, wildlife lookout with interpreted
signage, and the other park is more passive with just open space to rest or play. These are
part of the retention basin, so there is a limit on how to develop them. Staff believes this has
been adequately designed and recommends approval of all the items mentioned and approval
of the Mitigated Negative Declaration.
Christine Zortman with the Shopoff Group has requested to speak on the Ramsgate Specific
Plan Amendment No.5. She thanked Associate Planner Donahoe for all that she has done
working with their group. She stated the primary goal for acquiring the land was to provide
the access to Tentative Tract Map No. 25475, which is the southerly map, just below the map
that's being approved tonight. She stated that with the dedication of open space, they lost a

lot of the circulation elements that provided access to that southern most map. She also stated
that in acquiring these parcels and pulling them into the Ramsgate Specific Plan, we are
giving the other tract access, also participating in the other aspects of Ramsgate as well. Ms.
Zortman went on to state that the city did indicate that the minimum they would accept in fee
title would be 5 acres of contiguous land at which time, they were unable to do but they did
agree to 3 acres of non - contiguous area.
Vice Chairman Gonzales asked if a road could be added in the future so residents would have
easier access to their properties. He also questioned if these were going to be 2 story houses,
he would prefer single story homes. Ms. Zortman stated at this time there is no architecture
being considered.
Commissioner Mendoza commented on the school site and whether or not it is a loss. Ms.
Zortman stated that there was a deletion of 1300 dwelling units, so there is not a need for a
new school at this time.
Commissioner Flores questioned the difference between a pocket park and a neighborhood
park. Ms. Zortman stated that pocket parks are more passive just open space and park
benches. Neighborhood parks will provide amenities to the immediate area. She also stated
they are privately owned and maintained, versus a regional or community type park which
would be owned by the city.
Chairman O'Neal referred to the Fiscal Impact Report. Chairman O'Neal pointed out
inconsistencies within the report. Director of Community Development Preisendanz stated
he would look into finding out why numbers were wrong.
Commissioner Zanelli had no comments.

STAFF COMMENTS
Engineer Seumalo stated the Grand/Ortega signal and intersection widening is still waiting
for a CALTRANS encroachment permit which will, hopefully be obtained by mid -
September. He stated the sidewalk project will begin construction next month, and
CALTRANS has scheduled an analysis of the ultimate improvements at the I -15 and Central
Avenue for late October. He also indicated the signal at Temescal Canyon Road and Lake
Street is currently in plan check, so approval should come later this month so construction
can begin. The historic street lights on Lake Street are being evaluated for strength and
replacement parts are being cast. There was a glitch in that we could not find an intact
competent whole street light to send to the concrete company to have cast, but one was

found. Engineer Seumalo stated the signal light process at Gunnerson & Riverside Drive has
begun, this will be a lengthy process. In conclusion he thanked City Attorney Santana for her
advice, guidance in legal issues, and, Happy Birthday.
Associate Planner Miller stated that annexations are coming back at the next Planning
Commission meeting and the Clubhouse for the Golf Course will probably be brought to the
first meeting in October.
Director of Community Development Preisendanz stated Building & Safety along with Code
Enforcement has performed a net project where they were able to collect quite a bit of trash
and debris from a specific area in town.
Commissioner Flores stated he wanted to thank the staff for their quick response to a phone
call this afternoon. He also recommended staff taking a look at park issues.
Commissioner Mendoza stated to please thank Wendy for the positive feedback.
Commissioner Gonzales questioned a sign on Auto Center Drive which says "School Zone"
and that it should have been moved a long time ago. Engineer Seumalo stated he will look
into it, as well as striping at McDonalds. Commissioner Gonzales also stated the city can not
sustain fancy landscaping, when the city is trying to save on water.
Commissioner Zanelli questioned Engineer Seumalo, regarding Collier North bound at
Riverside. There are 2 lanes that go North bound, and the street was recently re- striped so
that the right hand lane could either go straight, turn left or turn right; the sign on the traffic
light above is not the same. Engineer Seumalo has discussed the issue with CALTRANS and
they are going to look into it.

2. Commercial Design Review No 2006 -11 For Lake Elsinore Chrysler, Dodge,

Director of Community Development Preisendanz provided a brief overview of the
proposed project and said Planning Consultant Coury could not attend the meeting.
Therefore, Director of Community Development Preisendanz requested Planning Manager
Weiner review it with the Commission and answer questions.
Planning Manager Weiner provided an overview of the project.
This project is for the construction of a new 29,632 square foot automotive dealership and
related improvements. The 10 -acre project site is located at the Southwest corner of Avenue
12 and Auto Center Drive. The automobile dealership (identified as Lake Elsinore Ford)
was approved approximately one (1) year ago. The approval included a Mitigated Negative
Declaration, Commercial Design Review, Conditional Use Permit, and Variance. The
Variance allowed for the reduction of the required parking and landscape setbacks along
Auto Center Drive and Avenue 12.
At this time, the applicant is requesting a revision to the Commercial Design Review
application in order to allow for modifications to the previously approved parking and
landscaping areas, as well as a reduction in the size of the building from 72,000 square feet to
29,000 square feet. It should be noted that Conditional Use Permit and Variance Approvals
will remain as is, as they were approved a year ago by the Planning Commission and the City
Council.
The proposed dealership will consist of vehicle display areas, sales and service areas, as well
as offices, restrooms and other customer and employee areas. Vehicle access to the site is
provided via two (2) driveways off of Auto Center Drive. One hundred and thirteen (113)
parking spaces will be provided on site.
Approximately eight (8) percent of landscape area is provided on site which meets current
minimum Lake Elsinore Municipal Code requirements. This requirement will increase after
formal adoption of recently modified landscaping regulations, however it will not affect this
project.

The exterior design of the buildings will incorporate both plaster and split -face concrete
block. The storefront window frames will be clear anodized frames with tinted blue glass.
Light, noise and traffic issues have been addressed through the original Mitigated Negative
Declaration and included Conditions of Approval which set mechanisms to control impacts
on these and other items.
Applicant Adrian Colinski stated his name and address. He agreed with the Conditions of
Approval. He wanted to ask the City for a sales tax reimbursement and discuss the amount.
Director of Community Development Preisendanz clarified that the reimbursement request
is for the public improvements to Auto Center Drive and this will be brought to the City
Council at the same time as the project is brought forward for approval.

Chairman O'Neal opened the Public Hearing at 6:08 p.m.
Chairman O'Neal stated that Mr. Cartier of Lake Elsinore Ready Mix was late in his request
to speak. However, he could speak after the Public Hearing.
Planning Commissioners Comments
Commissioner Zannelli had no questions.
Commissioner Gonzales asked Project Engineer Eric Markeson what was being done about
the problems behind the Chevy Dealership with regards to all of the houses on Avenue 12.
Eric Markeson, Project Engineer said to mitigate light and glare, they are providing
directional lighting. There is a 6 foot screen wall at the top of the slope in order to screen
the property from the residential neighborhood above, and will be providing a light shielding
at all of the perimeter lighting. Most of the lighting is located at a minimum of 15 feet or in
excess of 15 feet from the property line. Therefore, all of the lighting will be directed away
from the street.
Commissioner Gonzales asked Mr. Markeson if Avenue 12 is a paved street.
Mr. Markeson said yes it is.

Commissioner Gonzales said he had no comments.
Chairman O'Neal asked staff for color swatches and said he did not receive them He would
appreciate receiving them.
Chairman O'Neal said the west face design is flat. He is concerned about the rear of the
property. Can it be screened? He does like the saw tooth design on the side.
Planning Manager Weiner asked the applicant to elaborate on the screening. He didn't know
if there was going to be a lot of screening at that elevation. He asked that the applicant
enhance the elevation to add some elements in order to reduce the visual impact to the
street.
Chairman O'Neal said he would be more comfortable with the design if the applicant would
do that. He asked if it was possible to use the logos of the Dealership on the back side. He
said it is pretty flat and unappealing. He doesn't want the applicant to spend a lot of money
but would like the applicant to do something that makes it a little more interesting.
Adrian Colinski spoke for the Developer. He said the westerly facing facade are the
openings for the service bays and there is not a lot they can do with the building
architecturally but they had the landscaping easement that extends from the regular run
along Avenue 12 about fifteen (15) additional feet out and plan on landscaping that out to a
higher degree.
Chairman O'Neal said he is concerned with what will be above the bay doors because that is
what you are going to be able to see. You may not be able to see the bay doors as much as
the flat face that is just a stretch of split face. It would be nice to have some kind of
enhancement there. He said he does like the Chrysler logo but could there be some kind of
relief stripe across it to make it more interesting.
Mr. Markeson said they knew they were dealing with a utilitarian look, specifically on the
back side of the building. Therefore, they added banding of split face and precision block,
not just texture but also color contrast to give more visual interest to the back of the
building.
Chairman O'Neal said this would be good. It was not apparent on the drawings.
Mr. Markeson agreed with Chairman O'Neal that as they developed the exteriors that
something had to be done across the back of the building, even though it was a utilitarian
function, they wanted to give it some visual interest.

Chairman O'Neal requested Robert Cartier to address the Planning Commission.
Robert Cartier of Lake Elsinore Ready Mix said he has had a business in the area for almost
sixty (60) years. He noticed there wasn't a very large participation at the various Planning
Commission and City Council meetings which he thinks are very important. He stated that
the largest business they have in the valley is education. There are almost six thousand
(6,000) students in high school and he thought it would be wonderful if the Planning
Commission would make a formal invitation to have the students in Government, Civics,
and History classes attend some of the meetings. It would derive great benefit from learning
how City Government and the Planning Commission was conducted.
After the students leave high school, they might not have the opportunity to learn what
takes place in City Government. It would be a wonderful opportunity, and he wished the
Planning Commission would make a formal notification to the schools to invite them to the
meetings to see how the City Government is run.
Chairman O'Neal thanked Mr. Cartier.

BUSINESS ITEM
3. Planning Commission Compensation
Director of Community Development Preisendanz provided an overview of the proposed
Planning Commission Compensation.
Director of Community Development Preisendanz said Section 2.24.070 (Compensation) of
the Lake Elsinore Municipal Code (LEMC) states that, "Council shall from time to time, by
resolution, fix the compensation of the Planning Commission ". Planning Commission
compensation was adopted in 1984, which set the compensation at fifty (50) dollars per
meeting. In order to increase the compensation, the City Council would have to approve a
resolution specifying the amount to be paid.
He did some comparable compensation benefits paid to other Planning Commissioners in
neighboring cities.
City of Murrieta has no compensation or benefits, City of Temecula pays fifty (50) dollars
per meeting, City of Perris pays one hundred (100) dollars per meeting.
Regarding health insurance, the City provides a maximum monthly allowance of one
thousand fifty (1,050) dollars towards health insurance premiums. If the actual monthly
health insurance premium exceeds the monthly allowance, the difference is paid by the
employee. The four (4) allowed health insurance providers under PERS are Blue Shield,
Kaiser, PERS Choice and PERS Care.
They all have various premiums associated with them. Kaiser, which is an HMO, is nine
hundred and thirty seven (937) dollars a month for employee plus two (2) dependants which
would require a zero (0) addition into that payment.
Director of Community Development Preisendanz brought before the Planning
Commission an example of what one health insurance company policy would cost and also
what the City pays for each employee. Director of Community Development Preisendanz
further stated that then there is a request to the Council as to what amount the Planning
Commission decides on to be paid per meeting, and health insurance allowance.
Planning Commissioner Comments
Commissioner Flores said he thought the Commissioners should have an increase in pay.
He understood that recently, the Council had an increase in their pay. He thought the
Planning Commissioners should get half of the pay that Council receives which is one
hundred (100) dollars per meeting.

Regarding health insurance, he believes they should submit what they have and allow
Council to decide if health insurance would be beneficial. He asked Director of Community
Development Preisendanz to submit a health package and please report back as to what the
cost would be. He also thanked him for the information, and did a good job.
Commissioner Gonzales agreed with Commissioner Flores and said he can't change his
health insurance because of a pre- existing condition with his wife.
Commissioner O'Neal said that was not necessarily true.
Commissioner Gonzales said he did not want to change over because if he is no longer on
the Planning Commission, he would have a problem getting the previous health insurance
back.
Commissioner O'Neal agreed.
Commissioner Zanelli said he does not have any comments, he is retired and it does not
impact him one way or another.
Chairman O'Neal said he believes higher compensation is due. He said they provide a
professional service, and should get paid a professional wage. In addition to that, he would
like to see health benefits extended to the Commission if they would like to have them. If
they do not want them, they don't have to participate. If the Commissioners use the
insurance, it is an expense the City should pay for. This is also a nice prerequisite for anyone
that resigns and new Commissioners come in, they will be working hard but they will also be
rewarded for their hard work. It could be a recruiting tool.
Currently, we have good Commissioners, but in the past, we have had trouble getting good
candidates for these positions. If the job is worthwhile for future candidates then they
would be more willing to participate. He said he supports both the increase in pay and the
health benefits.
Director of Community Development Preisendanz also wanted to mention that employees
get vision and dental but this proposal didn't include that. He didn't know if the
Commission wanted him to go to propose that.
Commissioner O'Neal said personally speaking; he did not want it to go to that point. He
didn't know how the rest of the Commission felt about it.
Commissioner Flores agreed with Commissioner O'Neal. He did want to know if Council
had the visual benefits.
Director of Community Development Preisendanz said yes.

Commissioner Flores said if they want to include it on their behalf, so be it.
Commissioner Zanelli agreed with Commissioner Flores.
Commissioner Flores reiterated that he would like the compensation to be half of what the
City Council gets which is one hundred (100) dollars per meeting.
Director of Community Development Preisendanz said he would bring a
resolution forward that recommends a pay increase to tone hundred (100)
dollars per meeting and compensation at the rate that the employees are paid
per the PERS Program with the contracting agencies for Southern California.
Commissioner Flores asked Director of Community Development Preisendanz who would
be making the presentation and when would it be presented to Council.
Director of Community Development Preisendanz said he would do the presentation and
would take direction from the Commission and how they would like him to present it.
Commissioner O'Neal said he would address the Council on this particular item, type
something up to present it to them and follow up with Director of Community
Development Preisendanz to put on the Agenda.
Commissioner Flores agreed that it would be good if Commissioner O'Neal could present
this to Council.
Director of Community Development Preisendanz said he would follow-up with
Commissioner O'Neal as to when it will be put on the Agenda.
4. Schedule joint Planning Commission /Public Safety Advisory Commission
(.PSAC) on December 13, 2006
Commissioner O'Neal said 3:00 p.m. is not a good time for him.
Commissioner O'Neal asked the other Commissioners what time they would like the
meeting to start.
All of the Commissioners said they were flexible.
Commissioner O'Neal said 4:00 p.m. would be a better time to have the meeting.
Director of Community Development Preisendanz said he would coordinate with
Information and Communications Manager Dennis to accommodate a 4:00 p.m. meeting.
He said this is a request of City staff, with the Planning Commission and the PSAC to

participate in a Joint Study Session to discuss the Lakeshore Drive Overlay District and
current issues thereof relative to the General Plan Update at 4:00 - 6:00 p.m. at the Cultural

Commissioner O'Neal thanked Director of Community Development Preisendanz for
changing the time to 4:00 p.m.
Commissioner Zanelli requested documentation on the subject material so it can be
reviewed before the meeting.
Director of Community Development Preisendanz said he would prepare a staff report
which will include sections of the code that refer to the Lakeshore Overlay District, as well
as recreational zoning district, commercial zones in that area, and any pertinent information
related to code enforcement and lake management. He will provide the report to
Commissioners.

INFORMATIONAL ITEMS
Engineering Manager Seumalo spoke about the following items.
Engineering Manager Seumalo said regarding our capital improvement update;
Railroad Canyon Road is moving along slowly. Cal Trans is not allowing the
contractors to backfill the retaining wall. That is why you are not seeing work there
until the full wall is cured. He said they were hoping Cal Trans will allow in
segments. Even with this hold up, we were hoping the project would be completed
by late December. These are external influences on the project and not the
responsibility of the contractors so it will not affect their working days.
• The Grand Ortega intersection widening and signalization project has been
advertised for bidding and staff anticipates to take it to Council on December 12
with construction beginning in early January. He said he believes it is a four (4)
month project so they are hoping to have it completed by the end of April.
Therefore there will be a widened intersection and signalization at that location.
• The Lincoln Street Park is currently in construction. It is moving along nicely.

• Regarding the City park construction, there is a proposed restroom facility upgrade
to conform with ADA requirements as well as construction of a kitchen facility.
This project is in advertisement and is anticipated to go before the City Council
December 12.
• By mid December there will be a City Wide Sidewalk Improvement project going on.
It is in design now and it is funded with CDBG and SB821 grant money.
The Police Chief had a concern about the traffic patterns in front of the Corman
Leigh project on Lakeshore Drive across from Stater Bros. There is insufficient
traffic striping so our traffic engineer is looking into putting an edge line and
directing traffic into the existing two (2) travel lanes, discouraging them from
creating their own third (31 travel lane.
Also, he said he is not sure if the Commission has heard complaints about this but
apparently people are turning left into the Costco and Lowes shopping center in the
right in right out driveway. Staff is talking with Cal Trans to see if we can get
channelizers which are the vertical posts that are adhesive to the payment, installed.
If Cal Trans denies that, we are hopefully close to getting an Encroachment Permit
to install lane widening beneath the bridge at Central Avenue. Part of that project
will construct a physical median in that area to prevent traffic from turning left.
Commissioner Flores asked Engineering Manager Seumalo regarding Lakeshore Drive, in
front of Stater Bros, what was the time factor.
Engineering Manager Seumalo said by the last week of November or the first week of
December. The request went to our Traffic Engineer late last week and he needs to
investigate the plans, the responsibility of Corman Leigh to install or not to install the stripe
and field the investigation itself.
Commissioner Zanelli asked Engineering Manager Seumalo if there will be widening of
Riverside in the near future so that it can accommodate two (2) left turn lanes because the
traffic is backing up all the way to Home Depot.
Engineering Manager Seumalo said the answer to the question is unknown. It is going to be
a developer driven improvement. Staff can go to Cal Trans and identify the issue and hope
for action but it's not likely. He said he knows that the City Council is considering
Acquisition of State Route 74 which then the answer would be yes. The project would go
on the Capitol Improvement Plan. It would go on unfunded but identified as a project.
Engineering Manager Seumalo said they will talk to Cal Trans about the congestion and that
receiving lanes /merging lanes was supposed to help the situation but it actually did the

opposite. Therefore, staff will go to Cal Trans, identify the issue and hopefully get some
action.
Commissioner O'Neal commented about the traffic problem on Gunnerson. He said
because of the stacking on Collier, there is a huge amount of cars that run in that direction
and then the way the lights are set, traffic from the opposite direction has to wait until
traffic is gone. Therefore, you end up sitting on Gunnerson waiting to turn left.
Engineering Manager Seumalo said the spacing of the signals are so far apart that the
beneficial gap that is provided by a red light is lost because the differential speed in the
vehicles.
Commissioner O'Neal said the speed of the cars on Gunnerson is incredibly fast.
STAFF COMMENTS
Planning Manager Weiner wished the Planning Commission a Happy Thanksgiving.
Director of Community Development Preisendanz had two (2) items to discuss.
Director of Community Development Preisendanz indicated that the K -Mart
building is still on hold. The plans are still in plan check. We have a hold on the
project. We have a parcel map on that site that has been submitted. There are
outlying parcels along the street and we are looking at that in relation to parking.
We are having issues with the amount of parcels that can be developed out there
with relation to parking and shared parking.
• There are two (2) manufactured homes located at 316 & 318 Townsend, they are
side by side. They are located in a valley. They were brought to Director of
Community Development Preisendanz attention by a couple of people in the
community regarding one (1) in relation drainage, (2) the architecture of the
manufactured homes. He said they notified the applicant today. The homes have
been set there. They are very simple boxes, they have T1, 11 siding on them, they
have asphalt shingling on them. They have called the applicant and told him these
homes need to be built per Planning Commission approved plans which is stucco,
wainscoting, architectural shingles, etc. He wanted to let the Planning Commission
know that they have the applicant on notice. The grading was approved by the City
of Lake Elsinore, there is an offske easement that needs to be recorded in order for
all of the drainage to occur and transfer onto adjacent property and that is still
pending. Those two (2) homes are on our radar.

PLANNING COMMISSIONER'S COMMENTS
Commissioner O'Neal had two (2) comments.
• Commissioner O'Neal said he thinks Mr. Cartier's public school participation is
an excellent suggestion and he encourages staff to prepare invites or place phone
calls and cordially invite them to any Planning Commission meeting, big or small.
Commissioner O'Neal said Planning Consultant Coury made a suggestion to
Engineering Manager Seumalo who related it to Commissioner O'Neal and said
they wanted to meet with all of the Planning Commission in a closed session
about future projects and then they talked about whether it was a violation Brown
Act, which it is. Therefore, Commissioner O'Neal suggested to Engineering
Manager Seumalo about having a review committee from the Commission,
perhaps two (2) people who could meet with staff and report back to the
Commission.
Vice Chairman Gonzales and Commissioner Zanelli said they would be more than happy
to volunteer to sit on the committee.
Commissioner O'Neal requested to set up meetings with Vice Chairman Gonzales and
Commissioner Zanelli with staff on a monthly basis regarding any large projects. Also,
he wanted to request meeting minutes.
Engineering Manager Seumalo said he appreciated the Commissioner's support for this
idea but he formally apologizes to Director of Community Development Preisendanz and
Planning Manager Weiner for not clearing it with them first.
Commissioner O'Neal apologized to everyone and said he didn't mean to step on
anyone's toes.
Director of Community Development Preisendanz said no apologies were necessary, it was
something they discussed and he thought it was a good idea to get the Commissioners
included, have a study session, and have Commissioners in for meetings to show them what
is going on in the City.
Commissioner O'Neal asked Director of Community Development Preisendanz about
Pancake House (IHOP).
Community Development Preisendanz asked Planning Manager Weiner to give feedback on
this. '

Planning Manager Weiner said the last conversation he had with IHOP was over a month
ago. They talked about site design for the building. They designed the building with the
most aesthetically pleasing elevation facing the adjacent cemetery. Planning Manager Weiner
indicated that staff asked that they modify the design in order to have the most aesthetically
pleasing elevation be towards the street and they said they would modify the entry to the site.
Planning Manager Weiner said (IHOP) would be completed in about 30 days.
Commissioner O'Neal asked Director of Community Development Preisendanz about
what was going in at the corner where Seven Eleven (7 -11) was going to be.
Community Development Preisendanz said that McDonalds which is on the other side of
the driveway is moving forward. The developer was talking about a steakhouse for the
corner site, but he didn't mention who he was in discussions with.
Commissioner Zanelli wished everyone a Happy Thanksgiving and would see everyone in a
couple of weeks.
Commissioner Flores would like to see a steak restaurant come in, looking forward to the
Pancake House, and now that McDonalds is coming in, he can't wait to have breakfast there.
He wished everyone a Happy Thanksgiving and will see everyone around Christmas.
Commissioner Gonzales wished everyone a Happy Thanksgiving. He had breakfast at
McDonalds that morning. He also wanted to know what kind of construction was going on
Hunt Avenue.
Community Development Preisendanz said he didn't know and he would follow-up with
him to find out what is going on.

as Planning Area 6 of the "Historic Elsinore" Overlay District. More specifically, the
property is located within the Medium Density Residential (MD) land use area and has
a General Plan designation of Medium Density (MD)(APN: 374 - 0082 -017).
PROJECT DESCRIPTION
The applicant is requesting design review consideration for the development of a two -
story conventionally built attached duplex. The development will consist of two (2)
units, each having a living space area of approximately 1,472 square -feet for the rear
unit and 1,509 square feet for the front unit. Each one of the units will include three (3)
bedrooms, three (3) baths, a living room, a dining room, kitchen and a laundry /utility
room. The project will also have a two -car carport for each unit and two (2) uncovered
parking spaces for a total of six (6) off - street parking spaces. Open space areas and a
94- square foot front -entry porch will be provided for each unit.
The total building footprint, including the two residences, the carports, and entry

with the "Monterey" architectural style and the purpose and intent of the "Historic
Elsinore" Overlay District.
Further, the applicant is proposing a variety of architectural elements consistent with
the proposed architectural design of the units. These elements include, cross gable roof
design, tile roof material, smooth stucco walls, second story balconies, wood railing
and wood columns, exposed rafter tails, decorative wood doors, exterior light fixtures,
and wood window shutters.
Landscaping
The applicant is proposing to incorporate 35% of the net area of the site for the
purposes of landscaping. In addition to being automatically irrigated, the landscaping
will include three (3), 15 gallon "Crape Myrtles" and one (1), 15 gallon "Jacaranda"
tree. Foundation and accent plantings will consist of "Indian Hawthorn" and "Glossy
Abelia" that will be utilized along with "Tall Fescue Blend" and "Gazania Fallbrook
Mix" turf at the front and rear of the development.
Colors and Materials
BACKGROUND
On September 8, 2006 the Design Review Committee (DRC) reviewed the proposed
plans and provided several substantive comments on the proposed architectural design,
building massing, fencing along the right -of -way of the subject property, and
landscaping. The DRC recommended that the applicant revise the architecture to
incorporate elements that are consistent with the selected style of architecture. Once
revised, the applicant re- submitted plans along with building elevations which

incorporated the recommendations that were suggested by the DRC.
ANALYSIS
Staff has reviewed the project and found that with the attached conditions of approval,
the project meets all minimum requirements of the Historic Elsinore Architectural
Design Guidelines and Development Standards and Chapter 17.82 (Design Review)
and Chapter 17.66 (Parking Requirements) of the Lake Elsinore Municipal Code
(LEMC). Minimum requirements included, but were not limited to; density, setbacks,
landscaping, parking, private open space, and lot coverage.
Parking and circulation
The proposed parking and circulation meets the requirements of Chapter 17.66
(Parking Requirements). Section 17.66.020 requires the following:

The applicant has met the minimum requirements as mandated by Section 17.66.030 of
the LEMC, by providing a two (2) covered parking spaces for each dwelling unit plus
one and one -third (1 -1 /3) uncovered (open) parking spaces onsite. The applicant is also
proposing to provide two (2) concrete parking spaces, which will have access from the
alley way. This will allow the applicant to achieve the one and one -third (1-1/3)
parking space requirement as well as incorporating additional landscaping.
Architecture
The proposed architectural design of the duplex meets the requirements set forth within
the Historic Elsinore Architectural Design Guidelines (Appropriate Architectural
Styles for Residential Uses). The Architectural Design Guidelines for the land use in
which this project is located, states that:
A variety of residential styles are allowed including Bungalow, Craftsman,
Spanish Eclectic (which may include elements of the Mission style), Folk
Victorian, Monterey, Prairie, Shingle and Victorian Stick.

In compliance with the architectural design guidelines, the applicant has chosen a
"Monterey" architectural style for the proposed duplex. In conformance with the
Historic District, the applicant has incorporated architectural elements consistent with
and according to the "Monterey" design standards as stated within the Historic
Elsinore Architectural Design Guidelines.
Landscapinr�
The proposed landscaping meets the requirements set forth within Section V
(Landscape Standards) of the Historic Elsinore Architectural Design Guidelines. The
proposed landscaping serves to emphasize and enhance the established character by
incorporating landscape design criteria, which will upgrade and support the downtown
1920's theme and the desired character of the existing neighborhoods
Color and Materials
The proposed colors and materials meet the requirements of the Historic Elsinore
Architectural Guidelines in that the colors and materials proposed have been selected
from the approved color palate and will complement and enhance one another as well
as the surrounding neighborhood. An attachment reflecting the proposed colors has
been included to this report.
ENVIRONMENTAL DETERMINATION
Pursuant to the California Environmental Quality Act (Cal. Pub. Res. Code § § 21000
et seq.: "CEQA ") and the CEQA Guidelines (14 C.C.R. § § 15000 et seq.) pursuant to a
class 3(b) exemption for new construction or conversion of small structures because
the Project involves construction of up to four dwelling units. (See 14 C.C.R.
§ 15303(b)). Staff has determined that the proposed project will not have a significant
affect on the environment and is therefore exempt from the provisions of CEQA.
Therefore no additional environmental clearance is necessary.

RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF LAKE ELSINORE, CALIFORNIA, APPROVING A
MINOR DESIGN REVIEW FOR A RESIDENITIAL DUPLEX
AT 905 WEST SUMNER AVENUE (APN: 374 - 082 -017).
WHEREAS, Enrique Flores filed an application with the City of Lake
Elsinore requesting approval of a Minor Design Review for a residential duplex to
be located on the north side of Sumner Avenue and approximately 100 -feet west of
Scrivener Street, more particularly identifiable as 905 West Sumner Avenue (APN:
374 - 082 -017; the "Project "); and
WHEREAS, the Planning Commission of the City of Lake Elsinore has
been delegated with the responsibility of considering, approving, conditionally
approving, or denying Minor Design Review requests for residential duplex
projects; and
WHEREAS, notice of the Project has been given and the Planning
Commission has considered evidence presented by the Community Development
Department and other interested parties with respect to this item on December 5,
2006.
NOW, THEREFORE, THE PLANNING COMMISSION OF THE
CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE
AND ORDER AS FOLLOWS:
SECTION 1. The Planning Commission has considered the Project and
finds that it is consistent with MD, Medium Density Single - Family Residential
standards and citywide parking requirements as set forth in the Lake Elsinore
Municipal Code ( "LEMC ").
SECTION 2. The Planning Commission finds and determines that the
Project is categorically exempt from the California Environmental Quality Act
(Cal. Pub. Res. Code §§ 21000 et seq.: "CEQA ") and the CEQA Guidelines (14
C.C.R. §§ 15000 et seq.) pursuant to a class 3(b) exemption for new construction
or conversion of small structures because the Project involves construction of a
duplex or similar multi - family structure totaling no more than four units. (See 14
C.C.R. § 15303(b)).
SECTION 3. That in accordance with LEMC Chapter 17.82, the Planning
Commission makes the following findings for the approval of the Project:

1. The Project, as approved, will comply with the goals and objectives of the
intended General Plan and the Zoning District in which the Project will be
located.
The Project complies with the goals and objectives of General Plan
designation, which is Medium Density. The Medium Density designation is
intended for a wide range of residential development types including
attached and detached single-family units at the lower end of the range and
multiple family units at the higher end of the density range. The maximum
permissible density under the Medium Density designation is twelve (12)
dwelling units per acre. The Project proposes two (2) dwelling units for the
entire existing lot, which falls within the permissible density range of the
Medium Density designation.
The Project will assist in achieving the development of a well balanced and
functional mix of residential, limited commercial, limited industrial, open
space, recreational and institutional land uses by providing additional
affordable housing within the City of Lake Elsinore. The Project
encourages the development and maintenance of a broad range of housing
types for all income groups and age categories. The Project, which
incorporates "Monterey" style architecture, provides a well rounded design
and maintains the desirable rural characteristics and base framework of the
City to achieve quality and compatibility with preexisting development.
2. The Project complies with the design directives contained in Section
17.82.060 and all other applicable provisions of the Municipal Code.
The Project is appropriate to the site and surrounding developments in that
the duplex project has provided a twenty foot (20 ) front yard setback, two
(2) 100 square foot private open spaces, sufficient front and rear yard
landscaping, and safe and sufficient on -site vehicular circulation. Further,
the Project will complement the quality of existing development and creates
a visually pleasing, non - detractive end product. The duplex will utilize
"Monterey" style architecture which includes elements such as 360- degree
architectural articulation pursuant to the "Historic Elsinore Design
Guidelines", cross gable roof design, concrete tile roof material, smooth
stucco walls, second story balconies, wood railing and wood columns,
exposed rafter tails, decorative wood doors, exterior light fixtures, and wood
window shutters.

3. Subject to the attached conditions of approval, the Project is not anticipated
to result in any significant adverse environmental impacts.
A Class 3 CEQA exemption may be invoked when the development proposal
involves construction of a duplex or similar multi family residential
structure totaling no more than four dwelling units. Pursuant to CEQA
Guidelines 15303(b), the Project is exempt from environmental review
because it involves the construction of a duplex which does not exceed the
maximum allowable number of units.
Moreover, the Project has been reviewed by all City divisions and
departments. After reviewing the Project, each City division and department
has identified certain conditions of approval which have been imposed on
the Project. In light of those conditions of approval, as well as the design
features of the Project itself, the Project will not have a significant effect on
the environment.
4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning
Code, including guarantees and evidence of compliance with conditions,
have been incorporated into the approval of the Project to ensure
development complies with the objectives of Chapter 17.82.
Pursuant to Section 17.82.070, the Project has been scheduled for
consideration on December 19, 2006 The Applicant shall meet all required
setbacks and development standards for Medium Density development in the
"Historic Elsinore Overlay District, " as set forth in the Historic Elsinore
Design Guidelines.
SECTION 3. This Resolution shall take effect from and after the date of its
passage and adoption.

Note: Fees listed in the Conditions of Approval are the best estimates available at
the time of approval. The exact fee amounts will be reviewed at the time of permit
issuance and may be revised.
GENERAL CONDITIONS
1. The applicant shall defend, indemnify, and hold harmless the City, its officials,
officers, employees, and /or agents from any claim, action, or proceeding against
the City, its officials, officers, employees, or agents concerning the attached
Minor Design Review project.
2. The decision of the Planning Commission shall be final ten (10) days from the
date of the decision, unless an appeal has been filed with the City Council
pursuant to the provisions of Chapter 17.80 of the Lake Elsinore Municipal
Code.
3. If the project proposes an outdoor storage tank, the applicant shall place that
unit within the side or rear yards. If the storage tank must be placed in the front
yard, the applicant shall screen the storage tank from view with material subject
to the review and approval of the Director of Community Development or his
designee.
PLANNING DIVISION
4. Minor Design Review approval of a residential duplex located at 409 Sumner
Avenue (APN: 374 - 082 -017) will lapse and be void unless a building permit is
issued within one (1) year of the approval date.
5. All conditions of approval shall be reproduced upon page one of building plans
submitted to the Building and Safety Division for Plan Check. All conditions
of approval shall be met prior to the issuance of a Certificate of Occupancy and
release of utilities.
6. Prior to issuance of any grading or building permits, the Applicant shall sign
and complete an "Acknowledgement of Conditions," and shall return the

executed original to the Community Development Department for inclusion in
the case records.
7. Prior to the issuance of a building permit, the applicant shall obtain and submit
a "will serve" letter from Elsinore Valley Municipal Water District to the
Director of Community Development. The "will serve" letter shall specifically
indicate the specific water flow volumes for both domestic and fire protection
water supply. It shall be within the Director of Community Development's sole
discretion to determine whether the "will serve" letter is sufficient.
8. Prior to the issuance of any building permit for the Project, Developer shall
enter into an agreement with the City and the Redevelopment Agency of the
City of Lake Elsinore to provide (a) 15% of the units constructed in the Project
as affordable housing units in accordance with the requirements of Section
33413(b)(2) of the California Community Redevelopment Law (Health &
Safety Code Sections 33000 et seq.), or (b) an alternative equivalent action as
determined by the City which may include (without limitation) dedication of
vacant land, construction of affordable units on another site, or payment of an in
lieu fee at the rate of $2.00 per square foot of assessable space for each
dwelling unit in the Project. For purposes of this condition, "assessable space"
means all of the square footage within the perimeter of a residential structure,
not including any carport, walkway, garage, overhang, patio, enclosed patio,
detached accessory structure, or similar area. The amount of the square footage
within the perimeter of a residential structure shall be calculated by the building
department of the City in accordance with the standard practice of the City in
calculating structural perimeters.
9. All site improvements shall be constructed as indicated on the approved site
plan and elevations, with revisions as noted herein. The applicant shall meet all
required setbacks set forth in the Historic Elsinore Architectural Design
Guidelines and the Lake Elsinore Municipal Code (LEMC). Any other
revisions to the approved site plan or building elevations shall be subject to the
review of the Community Development Director or his designee. All plans
submitted for Building Division Plan Check shall conform to the submitted
plans as modified by the conditions of approval.

10. All materials and colors depicted on the plans and materials board shall be used.
If the applicant wishes to modify any of the approved materials or colors
depicted on the plans, the applicant shall submit a proposal setting forth the
modifications for review by the Community Development Director or his
designee.
11.All windows shall use foam surrounds and /or other architectural -type features
approved by the Community Development Director or designee.
12.All roofing materials shall have a minimum Class "A" fire rating and the fire
rating shall be noted on the construction plans.
13.The Applicant shall comply with all applicable City codes and ordinances.
14.A cash bond of $1,000.00 shall be required for any construction trailers placed
on the site and used during construction. Bonds will be released after removal
of trailers and restoration of the site to a state acceptable to and approved by the
Community Development Director or his designee.
15.The Applicant shall comply with the City's Noise Ordinance. Construction
activity shall be limited to the hours of 7:00 AM to 5:00 PM, Monday through
Friday, and no construction activity shall occur on Saturdays, Sundays or legal
holidays.
16.The Applicant shall comply with all requirements of the City's Grading
Ordinance. Construction generated dust and erosion shall be mitigated in
accordance with the provisions of Municipal Code, Chapter 15.72 and using
accepted control techniques. Interim erosion control measures shall be
provided thirty (30) days after the site's rough grading, as approved by the City
Engineer.
17.Any exterior air conditioning or other mechanical equipment shall be ground
mounted and screened so as to be invisible from neighboring property or public
streets. Air conditioning units and related equipment may not encroach more
than two -feet (2') into the required minimum side yard setback.

18.Garages or carports shall be constructed to provide a minimum interior clear
space of twenty feet (20') x twenty feet (20') for two cars.
19.The Applicant shall plant street trees, selected from the City Street Tree List, a
maximum of thirty feet (30') apart along all street frontages. Planting is subject
to the approval of the Community Development Director or designee prior to
issuance of a Certificate of Occupancy.
20.The Applicant shall provide shrubs and plant materials as shown on the
landscape plan. Any changes to the landscape plan shall be subject to the
approval of the Community Development Director or designee. The landscape
plan improvements and plantings shall be fully installed prior to issuance of a
Certificate of Occupancy.
21.Any planting within fifteen feet (15') of ingress /egress points shall be no higher
than thirty -six inches (36 ").
22.The Applicant shall provide an irrigation system for landscaped areas onsite as
shown on the landscape plans. The irrigation system shall be fully installed and
operational prior to the issuance of a Certificate of Occupancy.
23.The Applicant shall provide a rain sensor as shown on the landscape plan. The
rain censor shall be installed prior to the issuance of a Certificate of Occupancy.
24.All exposed slopes in excess of three feet (3') in height shall have a permanent
irrigation system and erosion control vegetation shall be installed in a fashion
approved by the City's Landscape Architect. A Planting and Irrigation Plan
shall be submitted, approved and planted prior to the issuance of a Certificate of
Occupancy. Fees are required for review of plans and inspections.
25.Driveways shall be constructed of concrete per Building and Safety Division
standards.
26.All walls or fences located in any front yard shall not exceed thirty -six inches
(36 ") in height with the exception that wrought -iron fences may be five feet (5')
in height. Chain link fences shall be prohibited.

27.All walls and /or fencing need to be located off the property line. If the
Applicant proposes to place any walls and /or fencing on the property line
he /she must submit a notarized agreement between the subject property owner
and the adjacent property owner to the Planning Department prior to installing
the fence.
28.The Applicant shall construct the City's standard six foot (6') wood fence along
the sides and rear property line. Where views exist, the applicant shall have the
option of constructing a tubular steel fence. The applicant shall be required to
remove and replace any existing chain link fencing and any fencing that is in
poor condition. It shall be the responsibility of the applicant to contact the
effected neighboring property owners. If the existing fencing is in good
condition, this requirement may be waived per the approval of the Community
Development Director or his designee.
29.The building address shall be a minimum of four inches (4 ") high and shall be
easily visible from the public right -of -way. Care shall be taken to select colors
and materials that contrast with building walls or trim.
30.The Applicant shall provide a flat concrete pad a minimum of 3'- 0" by T- 0"
adjacent to each dwelling unit. The storage pad for trash barrels shall be
concealed from public view.
31.The Applicant shall provide assurance that all required fees to the Lake Elsinore
Unified School District have been paid prior to issuance of building permits.
32.Prior to issuance of a building permit, the Applicant shall pay park -in -lieu fees
at the rate in effect at the time that the applicant requests the building permit.
33.The Applicant shall satisfy all conditions of approval prior to the issuance of a
Certificate of Occupancy and release of utilities.
34.The Applicant shall pay the Multi Species Habitat Conservation Plan Fee
(MSHCP) Local Development Mitigation Fee of $1,651.00 (fee for density less
than 8 du /ac) prior to obtaining building permits.

35.The Applicant shall submit a check in the amount of $64.00 made payable to
the County of Riverside for a Notice of Exemption. The check shall be
submitted to the Planning Division for processing within 48 hours of approval
of the Project.
36.The Applicant shall pay all applicable Library Capital Improvement Fund fees.
CITY OF LAKE ELSINORE COMMUNITY SERVICES DEPARTMENT
37.The Applicant shall pay park fees of $1,600 per unit (2 units @ $1,600 ea. _
$3,200.00).
38.The Applicant shall participate in the "Public Facility" fee program.
39.The Applicant shall participate in the City -wide LLMD.
40.The Applicant shall comply with all City ordinances regarding construction
debris removal and recycling as set forth in Section 8.32 of the Lake Elsinore
Municipal Code.
41.The Applicant shall comply with the City's curb, gutter, and sidewalk
requirements.
42.The City's Landscape Architect shall review all landscape and irrigation plans.
LAKE ELSINORE UNIFIED SCHOOL DISTRICT
43.Under the provisions of SB 50, the applicant shall pay school fees or enter into
a mitigation agreement prior to the issuance of a certificate of compliance by
the district.
LAKE ELSINORE POLICE DEPARTMENT
44.The Applicant shall provide assurances, prior to building permit, that all
requirements of the Lake Elsinore Police Department have been met.

45.The applicant shall provide assurances to the City that all requirements of the
Riverside County Fire Department have been satisfied.
ELSINORE VALLEY MUNICIPAL WATER DISTRICT
46.The Applicant shall request a "will server" letter.
ENGINEERING DIVISION
47.Prior to the issuance of a building permit, the applicant shall provide evidence
of satisfaction of all public works requirements set forth in the Lake Elsinore
Municipal Code.
48.Prior to applying for a building permit, the applicant shall submit a "will serve"
letter to the City Engineering Division from the applicable water agency stating
that water and sewer arrangements have been made for this project and specify
the technical data for the water service at the location, such as water pressure
and volume etc.
49.Arrangements for relocation of utility company facilities (power poles, vaults,
etc.) out of the roadway or alley shall be the responsibility of the property
owner or his agent.
50.The applicant shall provide fire protection access and facilities as required in
writing by Riverside County Fire.
51.In accordance with the City's Franchise Agreement for waste disposal &
recycling, the applicant shall be required to contract with CR &R Inc. for
removal and disposal of all waste material, debris, vegetation and other rubbish
generated during cleaning, demolition, clear and grubbing or all other phases of
construction.
52.All grading and street improvement plans submitted to engineering shall be
drawn on 24" x 36" Mylar, set into City's specific border and title block, and

shall include city specific general notes for grading or street improvements
respectively. Digital files for the border and the notes are available by request

DEDICATION:
53.Prior to issuance of a building permit, the applicant shall dedicate a 2.5' wide
strip of right of way along the northerly property line to the City for an alley.
54.Public right -of -way dedications shall be prepared by the applicant or his agent.
Deeds shall be submitted to the Engineering Division for review and approval
prior to issuance of building permit.
STREET IMPROVEMENTS
55.The applicant shall construct alley improvements from the property line to the
concrete gutter (the minimum pavement section shall be 2.5" Asphalt Concrete
over 4" compacted native base). Alley improvements may be shown on
Grading Plans. Plans shall be approved and signed by the City Engineer prior
issuance of a construction permit (LEMC 16.34).
56.Improvements shall be designed and constructed to Riverside County Road
Department Standards, latest edition, and City Codes (LEMC 12.04 and 16.34).
Alley improvement plans shall show existing and future profiles at centerline of
the alley. The profiles and contours shall extend to 50' beyond the property
limits on the alley centerline.
57.If the existing street improvements are to be modified, the existing street plans
on file shall be modified accordingly and approved by the City Engineer prior
to issuance of building permit. An encroachment permit shall be required to do
the work.
58.Work done under an encroachment permit for off -site improvements shall be
delineated on the street improvement plans and approved and signed by the City
Engineer prior to issuance of building permits.

59.The applicant shall pay all fees and meet all requirements of an encroachment
permit issued by the Engineering Division for construction of off -site public
works improvements (LEMC 12.08, Res.83 -78). All fees and requirements for
an encroachment permit shall be fulfilled before Certificate of Occupancy.
GRADING
60.Developer shall obtain all necessary off -site easements for off -site grading from
the adjacent property owners prior to final map approval.
61.The applicant shall apply for and obtain a grading permit with appropriate
security prior to undertaking any grading activity.
62.If the sum of the cut and fill in grading exceeds 50 cubic yards and the existing
drainage flow pattern is substantially modified as determined by the City
Engineer, a grading plan stamped /signed by a California Registered Civil
Engineer shall be required. The grading plan shall show volumes of cut and
fill, adequate contours and /or spot elevations of the existing ground as surveyed
by a licensed surveyor or civil engineer. Contours shall extend to a minimum
of fifteen feet (15') beyond the property lines to indicate the existing drainage
pattern.
63.The applicant shall provide a soils, geology and seismic report, and as part of
this report, the applicant shall address the requirements of the Alquis - Priolo
Earthquake Fault Zoning Act. The applicant shall provide a final soils report
showing compliance with recommendations.
64.The applicant shall provide erosion control measures as part of the grading plan.
The applicant shall contribute to protection of storm water quality and shall
meet the goals of the BMP in Supplement "A" in the Riverside County NPDES
Drainage Area Management Plan.
65.All grading shall be done under the supervision of a geotechnical engineer who
shall certify all slopes steeper than 2 to 1 for stability and proper erosion
control.

DRAINAGE:
66.0n -site drainage shall be conveyed to a public facility, accepted by adjacent
property owners by a notarized letter of drainage acceptance, or conveyed to a
drainage easement.
67.All natural drainage traversing the site shall be conveyed through the site, or
shall be collected and conveyed by a method approved by the City Engineer.
68.Roof drains shall not be allowed to outlet directly through coring in the street
curb. Roofs shall drain to a landscaped area. Driveways shall be sloped to
drain into landscaping prior to entering street facilities.
FEES:
69.The applicant shall pay all Capital Improvement and Plan Check fees (LEMC
16.34). The current traffic mitigation fee is $959.00; the current drainage fee is
$2600.00 (Town No.6. Dist.) and the current TUMF amount is $6,806.00, the
amount of fees are per unit and shall be adjusted according to the fee
schedule in effect at the time..
70.The applicant shall pay in -lieu fees for future off -site public improvements prior
to building permit (Res. 86 -35).
71. In —lieu payment shall be calculated by developer's engineer or architect and
submitted for City Engineer's approval. The estimate shall be based on current
cost of street improvements from property line to centerline of the street within
the property limits, plus a 15% added cost for engineering and construction
administration.
STORMWATER/ CLEANWATER PROTECTION PROGRAM
72.City of Lake Elsinore has adopted ordinances for storm water management and
discharge control. In accordance with state and federal law, these local storm
water ordinances prohibit the discharge of waste into storm drain system or
local surface waters. This includes non -storm water discharges containing oil,

grease, detergents, trash, or other waste remains. Brochures of "Storm water
Pollution, What You Should Know" describing preventing measures are
available at City Hall.
PLEASE NOTE: The discharge of pollutants into street, gutters, storm drain
system, or waterways - without Regional Water Quality Control Board permit or
waver — is strictly prohibited by local ordinances and state and federal law.
