The meeting was called to order at the hour of 7:30- P.M. with ,Iayor .Washburn in the chair. -_ € i' Councilmen :R. Hull, R. Macy; J. W. Rigdon's resignation be accepted. Motion, upon vote, was carried. !€ i, rn]hereupon it eras moved by Councilman Farber, seconded b~> Councilman Macy that C. 0.- Soots be appointed temporary Superintendent of Street. Motion, upon vote, was carried, It was suggested by council that cit~r water clerk write Ben Sapkin telling him of existing water meter conditions of his building and that Mr. J. Seitz re- fused to pay water bill. P4otion, upon vote, vras carried. Whereupon it was moved by Councilman Farber; seconded by Councilman D4acy that a letter be sent to the Santa Fe Railroad Company stating the city vrill put in burm on east side of Spring Street and blacktop two or three foot strip as will be required to meet their section excepting at switches. DRY OF December I9 5]_ A regular meeting of the City Council-of the City of Elsinore was held on the above date. The meeting was called to order at the hour of 7:30 P.M, with Maygr sMashburn in thechair. Councilmen R. Hull, R. Macy, S. Farber and Mayor :Mashburn were present. Absent, J. Taxis. Thereupon the Clerk read the minutes of the Nieetirtg of November 26, 1951 and there being no errors or omissions, were approved as raad. Whereupon it was moved by Councilman Farber, seconded b° Councilman Macp that Mr. Becker be allowed to run his sewer line in the parkway on E. Graham Avenue, on the north side of street, at no expense to the City of Elsinore. Motion was carried by the following vote. Motion, upon vote, was carried. The council agreed that V. Present. it ~~ Thereupon the Clerk read the minutes of the meeting of November 13th, 1951 ~j and .there being no errors or omissions, were approved as read, I ~i Mr. L. Seers, representative of the American Legion Lyn Mort Post 2@0 I. requested the City Council to con sidera proposition of donating land for a Legion Clubhouse building. The Council in tum requested the Legion to show adequate proof of being able to build the builnYng and also to look over some If city property before further negotiations would be carried on. Mayor Washburn, Councilmen Farber and Macy gave a brief resume of the meeting with Mr. Sam Ste•.~rart and his attorney. The meeting eras held at Mr. E. Best's office, Saturday November 17, 1951. The result of the meeting is that after careful consideration, Mr. Stewart finally accepted the following offer for and in consideration of,the City of Elsinore would receive, based upon land appraisal, a fib re agreed upon by all parties concerned, the Southwest one-half of Parcel ll of Goodwin, Whitten and Elliott's Subdivision, consisting o£ 9.12 acres, more or less, and the Southwesterly 659.47 feet of Lot 11, Block °A° Rancho La Laguna, consisting of 20 acres, more or less; also the Northwesterly. 3.86 acres o£ Lot 4.a~I_Mr. S. Ste~.vart would receive a five (5) year lease on all the abo ve land, plus the 20 acres, more or less, now .owned by the City of Elsinore and all the waste water flowing from the dispdsal plant, c~dlatever the flow might be, plus an option, subject to biel, for an additional five (5) years." If a figure cannot be determined by either party, an arbitration board will be set up to negotiate the lease price of the additional 5 years. thereupon it was moved by Councilman Farber, seconded by Councilman Hull, that a. resolution be adopted allowing the Mayor and City Clerk authorization to give a decd on 20 acres of the Goodwin, i~Pnitten and Elliott Tract owned by the City, to John Doe and Jane Doe. Motion, upon vote, was carried. GVhereupon it was moved by Councilman Farber, seconded by Councilman Macy that the annexation proceedings due to be held this evening be postponed for 30 days. Thereupon Mr. S. W. Lowden of the State Division of Highways appeared before the council on the matter of the Freeway through Elsinore city. limits. A letter was read to the Council from the California Highway Commission asking them to pass a resolution indicating whether or not it was necessary or desirable to hold a public hearing. Whereupon it was moved by Councilman Farber, seconded by Councilman Hull that it be resolved by the City Council,:that they waive the necessity of a public hearing on the Freeway and that the Clerk send a copy to Supt. Jones and £our copies of same to S. 'r7. Lowden. Luckow stating that if the-City wished to move the garage off city property they may do so at their own expense. Councilman Tavis stated as long as he had been notified before and at this time received notice from the City Attorney to move the garage off city property, the City should not assume expense or become involved moving the garage. Councilman Macy and Councilman Farber are to investigate the water line to Afr. Mosko~s residence in connection with a partial refund of deposit made by Nr. Mosko. Councilman Farber is to investigate crack in sidewalk at 122.5. Main Street.. Whereupon it was moved by Councilman Farber, seconded by Councilman Hull that sidewalk be put in on south side of l~l. Thereupon the Clerk read the letter from Pacific Indemnity Co. notifying. the council of increased rate on city liability insurance. The Council instructed the Clerk to notify the above company that the council would like a recapitulation of claims settled by the company and why rates increased. i~lhereupon it was moved by Mayor Washburn, seconded by Councilman Tavis that all city work done on the sewer system, will be the city sewer-mains only and water lines up to and including water meter. Motion, upon vote, was carried. Whereupon it was moved by Councilman Hull, seconded by Councilman Macy that the city purchase gas tank,fittings and pipe from LeGaye Company for X206.00, including tax. January 13th 1951 at 1:30 P. M. The meeting was cdlled to order with Mayor Washburn in the chair. Councilmen J. Tavis, S. Farber, R. Macy, C. Hull and Mayor Washburn answered roll call. Thereupon the clerk read the minutes of the previous meeting and there being no errors or omissions, were approved as read. Whereupon it was motioned by Councilman Farber, sewnded by Councilman Tavis, that Resolution 662 be drawn up and approved and shall contain the following: That Patrolman Walter C.Bittle~s salary shall be $175.00 per month. Motion, upon vote, was carried. Whereupon Mayor Washburn decreed the following: Apparently the City~s interests would be best served by a change in administrative committees. I, therefore, relieve Councilman Tavis of the Police Department, and appoint Councilman Hull to administer the affairs of the Police Department. Councilman Tavis challenged the Mayors authority for this action and expressed the belief that the Mayor himself should be removed. Whereupon it wag motioned by Mayor Washburn, seconded by Councilman Macy, that Councilman Tavis be removed as Police Committeeman and that Councilman Hull be appointed in his stead. Thereupon Councilman Tavis asked chair if it was not customary that the subject be open to discussion before vote taken. Chair replied that that was the usual procedure. Thereupon Councilman Tavis read a letter received by him from San Diego on Citation 001!+1. After said letter had been read, G. iestphal addressed the chair, saying that he had heard people saying they wondered why the Council met and held meetings when the Councilmen were dilatory i.n carrying out their allotted duties; that this City should be run as a business and not as a charitable organization; that the Police Department has been in a continuous uproar and that if the Council wished to get rid of Chief V. C. Burch or any other man, Council should bring that individual to the Council meeting and get things straightened out; and when complaints are received they are to be read at the Council meeting and not taken home and read. Councilman Tavis stated that he had heard that G. Wesphal, along with others, were trying to oust him. G. Westphal replied that he was too busy to play around with such foolishness, i and further, that it was just poor business to employ Former Chief W. Bittle and place him as Patrolman because of the fact that there is bound to be friction ~ between him and Chief Burch.
