Review is pursuant to Chapter 17.23 (R-1, Sing1e- Family Residential), Chapter 17.82 (Design Review), Chapter 17.14 (Residential Development Standards), and Chapter 17.66 (Parking Requirements) of the Lake Elsinore Municipal Code (LEMC). BACKGROUND The Design Review Committee (DRC) reviewed the plans for the two (2) proposed single-family dwelling units and provided several substantive comments on the proposed architectural design, fencing, landscaping, structure heights, and retaining walls. Once revised, the applicant re-submitted plans along with building elevations for the two (2) proposed homes, which incorporated the recommendations that were suggested by the DRC. Pi\Gl: I 01=_ Ja.9 REPORT TO PLANNING COMMISSION MAY 1, 2007 PROJECT TITLE: MINOR DESIGN REVIEW OF TWO (2) THREE- STORY SINGLE-FAMILY DWELLING UNITS LOCATED AT 16782 & 16784 LASH AVENUE (APN'S: 378-263-023/024) On April 3, 2007, the Planning Commission continued the item to the April 17, 2007 regularly scheduled Planning Commission meeting. There were two (2) reasons why the Planning Commission voted to continue the item, they are as follows: first (1), was the issue of the availability of water necessary to serve the project site. Although the Elsinore Valley Municipal Water District (EVMWD) provided staff with written verification that there were two (2) fire hydrants within the existing shopping center directly across the street that could serve the project site, the Planning Commission had accessibility concerns with having to cross property lines and existing fencing to gain access to the existing fire hydrants. The second reason for the continuance was relative to the proposed rear retaining walls and slopes. For the proposed single-family dwelling units located at 16782 and 16784 Lash Avenue, the applicant was proposing two (2) retaining walls that would be connecting to two (2) existing retaining walls on the adjacent property. The developer, however, for the adjacent property did not construct their retaining walls pursuant to the original approval. Specifically, the developer for the adjacent property constructed a single retaining wall approximately ten-feet (10') high in place of two (2) staggered retaining walls. Due to this conflict between the two (2) proposed walls and the existing single wall, the applicant for the proposed two (2) single-family dwelling units located at 16782 and 16784 Lash Avenue needed to revise his grading plan accordingly. On April 17, 2007 the Planning Commission continued the item for a second time to the May 1, 2007 Planning Commission meeting. The second continuance was necessary in order to allow the applicant to have more time to address the concerns that were voiced at the April 3, 2007 regularly scheduled Planning Commission meeting. WATER AVAILABILITY /FIRE FLOW ISSUES The proposed dwelling units located at 16782 and 16784 Lash Avenue are located within Country Club Heights. Staff routed the plans to the Riverside County Fire Department for their review on October 2, 2006. Staff did not receive any comments and/or conditions of approval. The Fire Department staff did not attend the City's DRC meeting on November 13, 2006. The applicant notified staff that the Elsinore Water District's 'will serve' letter and plans were submitted to the Fire Department for AGENDA ITEM d PAGEaOF~O REPORT TO PLANNING COMMISSION MAY 1, 2007 PROJECT TITLE: MINOR DESIGN REVIEW OF TWO (2) THREE- STORY SINGLE-FAMILY DWELLING UNITS LOCATED AT 16782 & 16784 LASH AVENUE (APN'S: 378-263-023/024) review. He indicated that the Fire Department was unable to assist him in ascertaining comments and/or conditions of approval as well as reviewing his Elsinore Water District's 'will serve' letter for fire flow approval. He then advised staff that the Elsinore Valley Municipal Water District (EVMWD) has two (2) fire hydrants within the vicinity of the project and believes that those two (2) fire hydrants would satisfy staff s concerns regarding minimum adequate water pressure and water availability. Staff asked the applicant to provide the necessary information and paperwork regarding the two (2) fire hydrants and pending the information provided from EVMWD, staff would move forward to Planning Commission. On February 8, 2007, the applicant submitted a letter to the Community Development Department from EVMWD that was addressed to the Riverside County Fire Department. The letter stated that there are two (2) existing residential fire hydrants located approximately 365-feet from the proposed homes (please see Attachment # 5) . The letter went on to state that the two (2) existing EVMWD fire hydrants are 6" with a 2-1/2" and a 4" outlet. The existing water line within Lash Avenue is a 24" line and minimum fire flow can be achieved at 500 gallons per minute (GPM). It should be noted that the 'will serve" letter submitted by the applicant from the Elsinore Water District (EWD) indicates that the agency has a "Warfhead" fire hydrant located approximately 675-feet with a flow of 1,000 gallons per minute from the project site. By having EVMWD's two (2) fire hydrants as well as Elsinore Water District's (EWD) existing "Warfhead" hydrant in close proximity to the project site, staff accommodated the applicant by moving the project forward for Planning Commission review with an attached Condition of Approval stating that the applicant shall comply with all requirements of the Riverside County Fire Department. On April 9, 2007, the applicant provided a letter from the Elsinore Water District (EWD) stating that the water district has sufficient water to service the proposed dwelling units at present. The applicant has agreed to purchase an approved standard fire hydrant (6" X 4" X 2 ~"), the hydrant would be located approximately 200-feet from the project site. Once the fire hydrant is installed and on-line, EWD states that a minimum fire flow shall be 500 GPM for a two (2) hour duration at a 20-PSI residual (Please see attachment 6). To ensure that there will not be any confusion with possible AGENDA ITEM 1 PAGE 3 OF -feO REPORT TO PLANNING COMMISSION MAY 1, 2007 PROJECT TITLE: MINOR DESIGN REVIEW OF TWO (2) THREE- STORY SINGLE-FAMILY DWELLING UNITS LOCATED AT 16782 & 16784 LASH AVENUE (APN'S: 378-263-023/024) occupancy of the proposed dwelling units and the installation of the standard fire hydrant, staff has added a condition of approval stating that the standard (6" X 4" X 2 ~") fire hydrant shall be installed and on-line within 200-feet of the project site, prior to the issuance of a building permit. On April 18, 2007, the applicant submitted ten (10) sets of the revised preliminary grading and drainage plan for the proposed single-family dwelling units located at 16782 and 16784 Lash Avenue. A further analysis of the revised plans is reflected in the Siting section of the staff report below. PROJECT LOCATION The proposed existing vacant lots are generally located 450 linear-feet southeast ofthe Morberg Street and Lash Avenue intersection at 16782 and 16784 Lash Avenue. Furthermore, the project site is located within the R-l (Single-Family Residential) Zoning District and has a General Plan designation of Future Specific Plan J (Country Club Heights #1) (APN'S: 378-263-023/024). The layout of the proposed dwelling units is as follows: 16782 Lash Avenue The proposed dwelling unit located at 16782 Lash Avenue will have a two (2) car garage and storage area on the ground floor. The first-floor living area will have a front-entrance porch, living room, dining room, kitchen, family room, one (1) bathroom, a patio, and balcony. The second-floor living area will have two (2) bedrooms, a bathroom, a laundry room, a master bedroom with hallway closets, master bathroom, and balcony. Furthermore, the total building footprint for the proposed dwelling unit located at 16782 Lash Avenue, which includes the proposed garage floor, first-floor living area, and second-floor living area will be approximately forty-two percent (42%). 16784 Lash Avenue The proposed dwelling unit located at 16784 Lash A venue will have a two (2) car garage and storage area on the ground floor. The first-floor living area will have a front-entrance porch, living room, dining room, kitchen, family room, a patio, a balcony, and one (1) bathroom. The second-floor living area will have two (2) bedrooms, a laundry closet, a bathroom, and a master bedroom with hallway closets, master bathroom, and deck. Furthermore, the total building footprint for the proposed dwelling unit located at 16784 Lash Avenue, which includes the proposed garage floor, first-floor living area, and second-floor living area will be approximately forty-two percent (42%). It should be noted that the proposed dwelling units located at 16782 and 16784 Lash Avenue comply with the maximum lot coverage requirement of fifty-percent (50%) as AGENDA ITEM d- PAGE S OF liLo REPORT TO PLANNING COMMISSION MAY 1, 2007 PROJECT TITLE: MINOR DESIGN REVIEW OF TWO (2) THREE- STORY SINGLE-FAMILY DWELLING UNITS LOCATED AT 16782 & 16784 LASH AVENUE (APN'S: 378-263-023/024) outlined in Chapter 17.23.090 of the Lake Elsinore Municipal Code (LEMC). The applicant is also proposing to connect to the new sewer system that is currently being constructed and staff has conditioned the applicant to submit a 'will serve' letter for the service of sewer and water, prior to the issuance of a building permit. Siting 16782 Lash Avenue The two (2) proposed three-story single-family dwelling units will be located on a relatively hilly location of Lash Avenue. In order to develop the properties, the applicant will have to conduct extensive grading and utilize retaining walls in order to create buildable stepped-pads for development. For the proposed dwelling unit located at 16782 Lash Avenue, the applicant is proposing to cut approximately 910 cubic-yards of earth from the slope. The rear of the lot will have two (2) retaining walls that connect to an existing wall on the northwest comer of the adjacent lot, via a stem wall that runs to the front ofthe subject lot. The stem wall is approximately ten feet (10') in height at connection and decreases to approximately eight feet (8') as it reaches the proposed walls on the subject lot. It should be noted that the stem wall has an approximate linear length of eight feet (8 '). The applicant is proposing a two (2) wall system in order to achieve a "stepped or tiered" affect, thus ultimately lowering the overall appearance of the retaining wall system. The main wall, closest to the proposed dwelling unit, will be approximately eight feet (8') in height as it progresses the length of the property, from northwest to northeast. The second retaining wall, which is the furthest from the proposed dwelling unit, will be approximately two feet (2') in height as it progresses the length of the property from northwest to northeast. It should be noted that the rear retaining wall, closest to the subject dwelling unit, will be set back a minimum of fifteen feet (15') from the rear wall of the house. This complies with section 17.23.080 of the LEMC, which mandates that finished slopes in excess of five percent (5%) shall not be permitted within fifteen feet (15') of the main dwelling unit. In addition, the applicant is also proposing to landscape and automatically irrigate all slopes to assist in slope stability. 16784 Lash Avenue The proposed dwelling unit located at 16784 Lash Avenue will also be required to cut approximately 910 cubic-yards of earth from the slope. The rear of the lot will have also have a two (2) retaining wall system that is an extension of the two (2) retaining wall system located on 16782 Lash Avenue. The main wall, closest to the dwelling unit, be approximately eight feet (8') in height and will decrease to approximately six- feet (6') in height as it progresses the length of the property, from northwest to northeast. The second wall, which is the most distant from the proposed dwelling unit, will be approximately two-feet (2') in height as it runs the length of the property. It should be noted that the second retaining wall will cease approximately halfway across the property and will turn southwest to connect to the main retaining wall. The northeast interior property line retaining wall will be approximately six-feet (6') in height and will run along the northeast interior property line and will cease at the rear ofthe house. It should be noted that the rear retaining wall will be set back a minimum of fifteen-feet (15') from the rear wall of the house. This complies with section 17.23.080, which mandates that finished slopes in excess of five percent (5%) shall not be permitted within fifteen feet (15') of the main dwelling unit. The south (front) elevation will include an "S" -tile roof, Spanish style coach lights, an arched front-entry door with windows on the right side, Spanish-style columns, a "Rosette" foam vent, cultured stone veneer wainscot, arched windows with lites and surrounds, wrought-iron fencing with gate, ornamental first-floor porch and second floor deck wrought-iron fencing, and an arched decorative garage door. The north elevation (rear) will include window surrounds, a coach light, a "Rosette" foam attic vent, and a sliding rear entry window. The west (interior) elevation will include windows with divided lites and surrounds, a "Rosette" attic vent, and a cultured stone veneer base in front of the side entry gate. The east (interior) elevation will include a "Rosette" foam attic vent and windows with divided lites and surrounds. The east and west interior elevations will have a six foot (6') high wood fence that will connect to an existing six foot (6') fence that is located at the rear of the property. Furthermore, the applicant is proposing decorative fencing, on both sides ofthe subject property, which runs from the house to the front of the property along Lash Avenue. The wall will be solid stuccoed block with open wrought-iron fencing on top and a decorative pilaster with cap approximately every ten feet (10 '). It should be noted that the overall height of the front-yard fencing will not exceed a height of five feet (5') and will be stuccoed to match the proposed stucco on the dwelling unit. 16784 Lash Avenue The applicant is proposing to include Monterey style architecture for the proposed single-family dwelling unit located at 16784 Lash Avenue. Siting 16782 Lash Avenue The total building footprint for the proposed dwelling unit located at 16782 Lash Avenue, which includes the proposed garage floor, first-floor living area, and second- floor living area will be approximately forty-two percent (42%), which is below the maximum lot coverage of fifty percent (50%) as outlined in Chapter 17.23.090 ofthe LEMC. In addition, the site plan will meet all applicable development standards and criteria outlined in the R-l (Single-Family Residential) Zoning District and the Residential Development Standards outlined in the LEMC. 16542 Gunnerson Street The total building footprint for the proposed dwelling unit located at 16784 Lash Avenue, which includes the proposed garage floor, first-floor living area, and second- floor living area will be approximately forty-two percent (42%), which is below the maximum lot coverage of fifty percent (50%) as outlined in Chapter 17.23.090 of the LEMC. In addition, the site plan will meet all applicable development standards and criteria outlined in the R-l (Single-Family Residential) Zoning District and the Residential Development Standards outlined in the LEMC. The proposed colors and materials to be incorporated are consistent with the goals and intent of the architectural design guidelines of the General Plan's Community Design Element, in that the proposed residence provides an aesthetic quality that lends to the overall achievement of a well balanced R-l (Single-Family Residential) Zoning District. Landscaping The minimum landscape coverage requirements for in- fill single-family dwelling unit's states that the applicant landscape the front-yard with an automatic irrigation system as outlined in Chapter 17.14 (Residential Development Standards). The applicant has met this requirement by proposing a fully landscaped, automatically irrigated front yard. Furthermore the applicant is proposing to incorporate a rain sensor for both single- family dwelling units, which will assist in the conservation of water. It should also be noted that the applicant is proposing to irrigate and landscape all slopes greater than five feet (5'). ENVIRONMENTAL DETERMINATION Pursuant to the California Environmental Quality Act (CEQA), Section 15332(In-Fill Development Projects), staff has determined that the proposed project will not have a significant affect on the environment and shall therefore be exempt from the provisions of CEQA. Therefore no additional environmental clearance is necessary. RECOMMENDATION Staff recommends that the Planning Commission adopt Resolution No. 2007-_ approving the proposed two (2) single-family dwelling units based on the Findings, Exhibits, and the proposed Conditions of Approval. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE, AND ORDER AS FOLLOWS: SECTION 1. The Planning Commission has considered the proposed design for the Project and has found it acceptable. The Planning Commission finds and determines that the Project is consistent with the Lake Elsinore Municipal Code. SECTION 2. The Planning Commission finds and determines that the Project is categorically exempt from the California Environmental Quality Act (Cal. Pub. Res. Code ~~ 21000 et seq.: "CEQA") and the CEQA Guidelines (14 C.C.R. ~~ 15000 et seq.) pursuant to a class 32 exemption for In-Fill Development Projects (14 C.C.R. ~ 15332) because the Project involve the construction of two (2) three-story single-family dwelling units within City limits on lots of no more than five (5) acres, which are surrounded by urban uses and have no value as habitat for endangered, rare or threatened species. The Project will not result in any significant effects relating to traffic, noise, air quality, or water quality and the homes can be served by all required utilities and public services. That in accordance with Lake Elsinore Municipal Code Chapter 17.82, the Planning Commission makes the following findings for the approval of the Project: 1. The Project, as approved, will comply with the goals and objectives of the intended General Plan and the Zoning District in which the Project will be located. The Project complies with the goals and objectives of General Plan designation Specific Plan J (Country Club heights No.1) as well as the R-1 (Single-Family Residential) Zoning District. General Plan designation Specific Plan J is intended to provide a wide range of housing densities and some limited commercial and industrial uses. Furthermore, Table III-5 (General Plan/Zoning Compatibility Matrix) within the General Plan identifies that the General Plan designation Future Specific Plan J (Country Club Heights No.1) is compatible with the R-1 (Single-Family Residential) Zoning District. In addition, the Future Specific Plan J General Plan designation mandates that the average residential density will be six (6) dwelling units to the acre. By proposing one (1) single-family residence with attached garage, the Project(s) located at 16782 and 16784 Lash Avenue will cover approximately forty-two percent (42%) of the net lot area respectively and is in compliance with the goals and objectives of the Future Specific Plan J designation of the General Plan, R-1 (Single-Family Residential) Zoning District, and the General Plan/Zoning Compatibility Matrix. Approval of this Project will assist in achieving the development of a well balanced and functional mix of residential, limited commercial, limited industrial, open space, recreational and institutional land uses by providing additional affordable housing within the R-1 (Single-Family Residential) Zoning District Lake Elsinore Municipal Code. The Project(s) also encourages the development and maintenance of a broad range of housing types for all income groups and age categories. Finally, the Project(s), which incorporates elements of "Spanish" and "Monterey" style architecture, will provide a well rounded design while maintaining the desirable rural characteristics and base framework to achieve quality and compatibility in the physical design of the developing portions of the City. Overall, the Project(s) will enhance the existing developed areas within General Plan designation Future Specific Plan J and Zoning Designation R- 1 (Single-Family Residential) of the Lake Elsinore Municipal Code. The Project complies with the design directives contained in Section 17.82.060 and all other applicable provisions of the Municipal Code. The Project located at 16782 and 16784 Lash Avenue are appropriate to the site and surrounding developments in that the proposed single-family dwelling units have provided: a twenty foot (20') front-yard setback; a fifty- seven foot (57') and fifty-nine foot (59') rear-yard setback; sufficient front yard landscaping; and, safe and sufficient on-site vehicular circulation. In addition, the Project complies with all setback, height, and lot coverage requirements as outlined in the R-1 (Single-Family Residential) Zoning District of the Lake Elsinore Municipal Code. Further, the Project as proposed will complement the quality of existing projects in that the applicant is providing elements of "Spanish" and "Monterey" style architecture which includes: 360-degree architecture articulation pursuant to the "General Plan, Community Design Element Design Guidelines"; decorative style window surrounds with divided window lites; decorative entry doors with windows, coach lights, ledgers tone veneer; and "s" - tile roofs. 3. Subject to the attached conditions of approval, the Project is not anticipated to result in any significant adverse environmental impacts. Pursuant to the California Environmental Quality Act (CEQA) Guidelines 15332, the Projects located at 16782 and 16784 Lash Avenue is exempt from environmental review because it involves the construction of two (2) single- family residences and an attached garages in a residential zone. Therefore, no further environmental analysis is required. Notwithstanding the foregoing, however, the attached conditions of approval incorporate design features into the Project which suggest that the Project will not have a significant effect on the environment. 4. Conditions and safeguards pursuant to Chapter 17.82.070 of the Zoning Code, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the Project to ensure development of the property in accordance with the objectives of Chapter 17.82. The Project has also been conditioned to comply with all aspects of the Lake Elsinore Municipal Code. Based upon the evidence presented, the above findings, and the conditions of approval, the Planning Commission hereby approves the Minor Design Review application. SECTION 5. The applicant shall defend (with counsel acceptable to the City), indemnify, and hold harmless the City, its Officials, Officers, Employees, and Agents from any claim, action, or proceeding against the City, its Officials, Officers, Employees or Agents to attach, set aside, void, or annul an approval of the City, its advisory agencies, appeal boards, or legislative body concerning the Minor Design Review project attached hereto. 2. The decision of the Planning Commission shall be final fifteen (15) days from the date of the decision, unless an appeal has been filed with the City Council pursuant to the provisions of Chapter 17.80 of the Lake Elsinore Municipal Code. 3. If the project proposes an outdoor storage tank, the applicant shall locate the unit within the side or rear yards. If location must be within the front yard, the applicant shall provide a method of screening subject to the review and approval of the Director of Community Development or his designee. 4. Minor Design Review approval of two (2) single-family dwelling units located at 16782 and 16784 Lash Avenue (APN'S: 378-263-023/024) will lapse and become void one (1) year of the approval date unless a building permit is issued and construction commenced and the project is diligently being pursued toward completion. 5. Prior to issuance of any grading or building permits, the applicant shall sign and complete an "Acknowledgement of Conditions," and shall return the executed original to the Community Development Department for inclusion in the case records. 7. All materials and colors depicted on the plans and materials board shall be used unless modified by the Applicant and approved by the Community Development Director or designee. 8. All site improvements shall be constructed as indicated on the approved site plan and elevations, with revisions as noted herein. The applicant shall meet all required setbacks, and development standards pursuant to the R-I (Single- Family Residential) development standards. Any revisions to the Minor Design Review attached hereto shall be processed in a similar manner as the original Minor Design Review. All plans submitted for Building Division plan check shall conform to the submitted plans as modified by the Conditions of Approval. 9. All windows shall use foam surrounds and/or other architectural-type features approved by the Community Development Director or designee. 10.All necessary exterior/ancillary equipment shall be effectively screened from public view. All proposed screening methods shall be reviewed and approved the Community Developer Director or designee. 11.All roofing materials shall have a minimum Class "A" Fire rating, and so noted on the construction plans. 12. The Applicant is to meet all applicable City Codes and Ordinances. l3.A cash bond of $1,000.00 shall be required for any construction trailers placed on the site and used during construction. Bonds will be released after removal of trailers and restoration of the site to an acceptable state, subject to the approval of the Community Development Director or designee. l4.The Applicant shall comply with the City's Noise Ordinance. Construction activity shall be limited to the hours of 7:00 AM to 5:00 PM, Monday through Friday, and no construction activity shall occur on Saturdays, Sundays or legal holidays. Construction generated dust and erosion shall be mitigated in accordance with the provisions of Municipal Code, Chapter 15.72 and using accepted control techniques. Interim erosion control measures shall be provided thirty (30) days after the site's rough grading, as approved by the City Engineer. 16.Any exterior air conditioning or other mechanical equipment shall be ground mounted and screened so that they are not visible from neighboring property or public streets. Air conditioning units and related equipment may not encroach more than two-feet (2') into the required minimum side yard setback. 17. Garages shall be constructed to provide a minimum interior clear space of twenty feet (20') x twenty feet (20') for two cars. 18. The Applicant shall provide shrubs and plant materials as shown on the landscape plan. Any changes to this plan shall be subject to the approval of the Community Development Director or designee. The landscape plan improvements and plantings shall be fully installed prior to issuance of a Certificate of Occupancy. 1 9. Planting within fifteen feet (15') of ingress/egress points shall be no higher than 36 inches. 20.Driveways shall be constructed of concrete per Building and Safety Division standards. 21.All walls or fences located in any front yard shall not exceed thirty-six inches (36") in height with the exception that wrought-iron fences may be five feet (5') in height. Chain link fences shall be prohibited. 22. The applicant shall be required to remove and replace any existing chain link fencing and any fencing that is in poor condition. It will be the responsibility of the applicant to contact the effected neighboring property owners. If the existing fencing is in good condition, this requirement may be waived per the approval of the Community Development Director or Designee. 23.The applicant shall provide a flat concrete pad a minimum of 3'- 0" by 7'- 0" adjacent to each dwelling unit. The applicant shall submit a check in the amount of $64.00 made payable to the County of Riverside for a Notice of Exemption. The check shall be submitted to the Planning Division for processing within 48 hours of the projects approval. 25. The applicant shall place a weatherproof 3' x 3' sign at the entrance to the project site identifying the approved days and hours of construction activity and a statement that complaints regarding the operation can be lodged with the City of Lake Elsinore Code Enforcement Division (951) 674-3124. 26. The proposed fencing located within the front-yard setback shall not exceed a maximum height of five feet (5'); three feet (3') solid two feet (2') open. Furthermore, the solid block and pilasters shall be stuccoed to match the stucco as proposed on the dwelling units. 27.All exposed block walls visible from Lash Avenue shall utilize a split-face block or be stuccoed to match the main dwelling unit. 28. The applicant shall comply with all requirements of the Riverside County Fire Department. 29. The applicant is to meet all requirements of Southern California Edison. PRIOR TO THE ISSUANCE OF BUILDING PERMITS 30.All walls and/or fencing need to be located off the property line and so indicated on the construction plans. If the Applicant proposes to place any walls and/or fencing on the property line he/she must submit a notarized agreement between the subject property owner and the adjacent property owner to the Planning Department prior to issuance of a building permit. 31. The applicant shall provide assurance that all required fees to the Lake Elsinore Unified School District have been paid prior to issuance of building permits. 32. The applicant shall pay park-in-lieu fees in effect at the time prior to issuance of building permits. 33.The applicant shall provide assurances to the Planning Division that all requirements and fees of the Riverside County Flood Control and Water Conservation District have been met. The applicant shall pay the Multiple Species Habitat Conservation Plan Fee (MSHCP) Local Development Mitigation Fee (fee for density less than 8 dulac) prior to obtaining building permits. 35.Prior to the issuance of any building permit for the Project, the Developer shall enter into an agreement with the City and the Redevelopment Agency of the City of Lake Elsinore to provide (a) 15% of the units constructed in the Project as affordable housing units in accordance with the requirements of Section 33413(b )(2) of the California Community Redevelopment Law (Health & Safety Code Sections 33000 et seq.), or (b) an alternative equivalent action as determined by the City which may include (without limitation) dedication of vacant land, construction of affordable units on another site, or payment of an in-lieu fee at the rate of $2.00 per square-foot of assessable space for each dwelling unit in the Project. For purposes of this condition, "assessable space" means all of the square-footage within the perimeter of a structure, not including any carport, walkway, garage, overhang, patio, enclosed patio, detached accessory structure, or similar area. The amount of the square-footage within the perimeter of a residential structure shall be calculated by the building department of the City in accordance with the standard practice of the City in calculating structural perimeters. 36.Prior to the issuance of a building permit the Applicant shall obtained and submit a "will serve" letter from Elsinore Municipal Water District to the satisfaction of the Director of Community Development. The "will serve" letter shall specifically indicate the specific water flow volumes for both domestic and fire protection water supply. 37.The applicant shall pay all applicable Library Capital Improvement Fund fees, prior to the issuance of a building permit. 38.The applicant/developer shall submit a "Will Serve" letter to the City Planning Division from the applicable water agency stating that water and sewer arrangements have been made for this project and specify the technical data for the water service at the location. such as water pressure and volume etc. The applicant shall submit this letter indicating that water and sewer arrangements have been made, prior to applying for a building permit. t,C;':fY\~i, NO. ).. PAGE_~LOF Coo 39.Prior to the issuance of a building permit, the applicant shall revise the site plan to indicate that all front elevation decks facing Lash A venue are pulled back out of the required twenty foot (20') front-yard setback. 40.Prior to the issuance of a building permit, the applicant shall revise the elevations page to identify where keynote number twelve (12) is located. 4l.Prior to the issuance of a building permit, the applicant shall provide assurances to the Community Development Department indicating that sewer arrangements have been made for the two (2) single-family dwelling units located 16782 and 16784 Lash Avenue. 42.Prior to the issuance of a building permit, there shall be a standard (6" X 4" X 2 ~") fire hydrant installed and fully operational and within 200- feet of the project site. PRIOR TO THE ISSUANCE OF A CERTIFICATE OF OCCUPANCY 43.The Applicant shall plant twenty-four inch (24") box street trees along all street frontages selected from the City Street Tree List, a maximum of thirty feet (30') apart. Planting is subject to the approval of the Community Development Director or designee prior to issuance of a Certificate of Occupancy. 44. The applicant shall provide an irrigation system for landscaped areas onsite as shown on the landscape plans. The irrigation system shall be fully installed and operational prior to the issuance of a Certificate of Occupancy. 45. The Applicant shall provide a rain sensor as shown on the landscape plan. The rain censor shall be installed prior to the issuance of a Certificate of Occupancy. 46.All exposed slopes in excess of three feet (3') in height shall have permanent irrigation system and erosion control vegetation installed, as approved by the City's Landscape Architect. A Planting and Irrigation Plan shall be submitted, approved and planted prior to the issuance of a Certificate of Occupancy. Fees are required for review of plans and inspections. 47. The building address shall be a minimum of four inches (4 ") high and shall be easily visible from the public right-of-way. Care shall be taken to select colors and materials that contrast with building walls or trim. The applicant shall meet all Conditions of Approval prior to the issuance of a Certificate of Occupancy and release of utilities. ENGINEERING DIVISION GENERAL 49.All Public Works requirements shall be complied with as a condition of development as specified in the Lake Elsinore Municipal Code (LEMC) prior to building permit. 50. The applicant shall submit a "Will Serve" letter to the City Engineering Division from the applicable water agency stating that water and sewer arrangements have been made for this project and specify the technical data for the water service at the location. such as water pressure and volume etc. Submit this letter prior to applying for a building permit. 51.All arrangements for relocation of utility company facilities (power poles, vaults, etc.) out of the roadway or alley shall be the responsibility of the property owner or his agent. 52. The applicant shall provide fire protection access and facilities as required in writing by Riverside County Fire. 53.In accordance with the City's Franchise Agreement for waste disposal & recycling, the applicant shall be required to contract with CR&R Incorporated for removal and disposal of all waste material, debris, vegetation and other rubbish generated during cleaning, demolition, clear and grubbing or all other phases of construction. 54. The applicant shall protect all palm trees in place or contact the Community Services of City of Lake Elsinore for Palm Tree Preservation Program, LEMC 5.78 Ordinance 1044. 55.All grading and street improvement plans submitted to engineering shall be drawn on 24" x 36" Mylar and be set into City's specific border and title block and include city specific general notes for grading or street improvements AGENDA ITE~il NO._ d- PACE ~ OF (aJ)) respectively. STREET IMPROVEMENTS 56.All work done under an encroachment permit for off-site improvements of utility lines shall be delineated on the street improvement plans and approved and signed by the City Engineer, prior to issuance of building permits. 57. The applicant shall pay all fees and meet requirements of an encroachment permit issued by the Engineering Division for construction of off-site public works improvements (LEMC12.08, Res.83-78). All fees and requirements for an encroachment permit shall be fulfilled before Certificate of Occupancy. GRADING 58. The developer shall obtain all necessary off-site easements for off-site grading from the adjacent property owners prior to issuance of grading permit approval. 59. The applicant shall apply and obtain a grading permit with appropriate security prior to any grading activity. 60.A grading plan stamped/signed by a California Registered Civil Engineer is required if the sum of the cut and fill in grading exceeds 50 cubic yards and the existing drainage flow pattern is substantially modified as determined by the City Engineer. The grading plan shall show volumes of cut and fill, adequate contours and/or spot elevations of the existing ground as surveyed by a licensed surveyor or civil engineer. All contours shall extend to minimum of 15 feet beyond property lines to indicate existing drainage pattern. Apply and obtain a grading permit with appropriate security prior to grading permit Issuance. 61. The applicant shall provide soils, geology and seismic report, as part of this report address the requirement of the Alquist-Priolo Earthquake Fault Zoning Act. The applicant shall provide final soils report showing compliance with recommendations. 62. The applicant to provide erosion control measures as part of their grading plan. The applicant shall contribute to protection of storm water quality and meet the AOfNDA ITEM NO.~.-.2::..-_ PAGE ;;)... -, OF ~ d _ goals of the BMP in Supplement "A" in the Riverside County NPDES Drainage Area Management Plan. 63.All grading shall be done under the supervision of a geotechnical engineer and he/she shall certify all slopes steeper than 2 to 1 for stability and proper erosion control. DRAINAGE 64.All on-site drainage shall be conveyed to a public facility, accepted by adjacent property owners by a notarized letter of drainage acceptance, or conveyed to a drainage easement. 65.All natural drainage traversing the site shall be conveyed through the site or shall be collected and conveyed by a method approved by the City Engineer. 66.All roof drains shall not be allowed to outlet directly through coring in the street curb. All roofs shall drain to a landscaped area. All driveways shall be sloped to drain into landscaping prior to entering street facilities 67. The applicant shall submit Hydrology and Hydraulic Reports for review and approval by City Engineer prior to issuance of grading permits. The developer shall mitigate any flooding and/or erosion downstream caused by development of the site and/or diversion of drainage. FEES 68. The applicant shall pay all Capital Improvement and Plan Check fees (LEMC 16.34). The current traffic mitigation fee is $1,369.00 per unit; the current per unit drainage fee is $702.00 (West Elsinore Drainage Dist.) and the current per unit TUMF amount is $9,693.00; the amount of fees shall be adjusted according to the fee schedule current at the time of payment. 69.The applicant shall provide in-lieu payment for future off-site public improvements prior to building permit. (Res. 86-35) In-lieu payments shall be calculated by developers' engineer or architect and submitted for city engineers approval. The estimate shall be based on current cost of street improvements from property line to centerline of the street within the property limits, plus a 15% added cost for engineering and construction administration. t,G i;' NO.;;;>- P/:lGS c'}- <i3 ..Of (00 STORMW ATER/ CLEANW ATER PROTECTION PROGRAM 70. The City of Lake Elsinore has adopted ordinances for storm water management and discharge control. In accordance with state and federal law, these local storm water ordinances prohibit the discharge of waste into storm drain system or local surface waters. This includes non-storm water discharges containing oil, grease, detergents, trash, or other waste remains. Brochures of "Storm water Pollution, What You Should Know" describing preventing measures are available at City Hall. PLEASE NOTE: The discharge of pollutants into street, gutters, storm drain system, or waterways -without Regional Water Quality Control Board permit or waver - is strictly prohibited by local ordinances and state and federal law. COMMUNITY SERVICES DEPARTMENT 71. The developer is to pay park fees of $1,600 per unit (2 units at $1,600 each = $3,200). 72. The developer is to comply with all NPDES storm water requirements. 73.The developer is to comply with all City Ordinances regarding construction debris removal and recycling as per Section 8.32 of the Lake Elsinore Municipal Code. 74.The developer is to meet City curb, gutter, and sidewalk requirements. 75. The City's Landscape Architect is to review all landscape and/or irrigation requirements. ELSINORE WATER DISTRICT 76.Water is available; the applicant shall request a 'will serve' letter. RIVERSIDE COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT 77. The project is located within the limits of the District's West Elsinore Area Drainage Plan for which drainage fees have been adopted. PROJECT LOCATION The project site is located on the southwest comer of Rosetta Canyon Drive and Ardenwood Way, within the Ramsgate Specific Plan. BACKGROUND On May 23,2006, the City Council approved an agreement for professional services with STK Architecture, Inc. to provide architectural and construction management services for the Rosetta Canyon Fire Station and design of the Community Center. On February 6th and February 13,2007 respectively, the Planning Commission and the City Council both endorsed the conceptual plans. The Planning Commissioners were particularly pleased with the architectural designs. Subsequently, STK submitted formally for Design Review approval. The existing raised landscaped median will be modified to accommodate this access. Any healthy trees in the median will be relocated onto the project site. The Fire Station can receive visitors, with parking available both in the front of the building and the rear. Phasing Due to funding constraints, the project has been phased. Phase II will include the Community Center, four baseball fields, concession/rest room facility, the supplemental parking lot along the west side of the park, and other improvements (additional picnic areas, walking paths, etc.). The total cost for Phase I is estimated at $7,415,000. The project will be funded through a combination of revenue sources including park impact fees, developer agreement fees, fire facility impact fees, community center impact fees, the General Fund, CFD proceeds and potential County contributions. The Community Center Visitors to the Community Center and the park amenities in Phase I, will approach and exit from the two driveways on Ardenwood Way. The City Traffic Engineer requested, and STK provided, right turn in/right turn out limitations for the easternmost driveway, due to its proximity to the left turn pocket on Ardenwood. An entry monument will be located at the comer of Ardenwood Way and Rosetta Canyon Drive, and the project is conditioned to submit the design for the monument as a separate application prior to building permit. The Community Center building houses a high school size basketball court plus four half-courts, with tilt and roll bleachers. Surrounding an interior courtyard with water feature/fountain and landscaping are two multi-purpose rooms, a dance room, activity room, a police sub-station, kitchen and offices for sports and recreation. The Community Park Concurrent with the Community Center, the four baseball diamonds will be completed, along with the supplemental parking area along the west boundary ofthe site. The City Traffic Engineer requested, and STK provided, a four-lane driveway into and out of the supplemental parking lot, as well as appropriate signage designating the baseball facilities. Architectural features match the outstanding elevations for the fire station and community center, with arched entries and columns, and tiled roof-top elements. ENVIRONMENTAL DETERMINATION Staff has determined that the project complies with Addendum No. 3 to the Final Supplemental Environmental Impact Report (State Clearinghouse No. 88090525) for the Ramsgate Specific Plan No. 89-1, and the Mitigation Measures thereto, certified by the City Council on August 22, 2006. Commercial Design Review No. 2007-03 does not propose substantial changes to the Ramsgate Specific Plan, nor would any substantial changes to the Specific Plan result from its approval. No new significant environmental effects, nor an increase in the severity of previously identified significant effects are anticipated. Therefore, in accordance with the California Environmental Quality Act (CEQA) and pursuant to Section 15162 - Subsequent EIRs and Negative Declarations, of said act, staff has determined that Addendum No.3 provides the necessary environmental clearances for the proposed fire station, community center and park, and that no further environmental documentation for Commercial Design Review No. 2007-03 is necessary. RECOMMENDATION Staff determined that the project complies with the Ramsgate Specific Plan 89-1 Fifth Revision, provides visually pleasing architecture and efficient floorplans, and therefore recommends that the Planning Commission recommend approval to the City Council of Design Review C2007-03 for the Rosetta Canyon Fire Station, Community Center and Park, in accordance with Exhibits 'B' through 'H.' PAce , ~ RESOLUTION NO. 2007-_ RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING THAT THE CITY COUNCIL APPROVE COMMERCIAL DESIGN REVIEW NO. 2007-03 FOR THE ROSETTA CANYON FIRE STATION, COMMUNITY CENTER, AND PARK WITHIN TRACT MAP NO. 25479 WHEREAS, an application has been filed with the City of Lake Elsinore by STK Architecture, Inc. requesting Design Review approval to construct a three- bay, 8,657 square foot fire station, an 18,934 square foot Community Center, and regional park facilities that include three tennis courts, two basketball courts, tot lot, picnic areas, four baseball diamonds, walking trail, restrooms, concession facility, and two parking lots, all within Tract Map No. 25479, located on the southwest comer of Rosetta Canyon Drive and Ardenwood Way, east of Interstate 15, and south of Highway 79, and known as Assessor's Parcel Nos. 347-120-050 and -053; and WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated with the responsibility of making recommendations to the City Council regarding Design Review requests; and WHEREAS, pursuant to the California Environmental Quality Act (Cal. Pub. Res. Code gg 21000 et seq.: "CEQA") and the CEQA Guidelines (14 C.C.R. gg 15000 et seq.), public agencies are expressly encouraged to reduce delay and paperwork associated with the implementation of CEQA by using previously prepared environmental documents when those previously prepared documents adequately address the potential impacts of the proposed project (CEQA Guidelines Section 15006); and WHEREAS, CEQA Guidelines, Article 11, Section 15162 establishes the standard to be used when determining whether further environmental documentation is necessary and says that when an environmental document has already been adopted for a project, no subsequent environmental documentation is needed for subsequent entitlements which comprise the whole of the action unless substantial changes or new information are presented by the project; and WHEREAS, on August 22, 2006, the City Council reviewed and approved Addendum No. 3 to the Final Supplemental Environmental Impact Report (State Clearinghouse No. 88090525) for the Ramsgate Specific Plan No. 89-1; and AGENDA ITEM fJO. PACE 7 3 OF .30 PLANNING COMMISSION RESOLUTION NO. 2007-_ PAGE20F4 WHEREAS, the Project does not present substantial changes or new information regarding the potential environmental impacts of development and it is found that no further environmental review would be required; and WHEREAS, public notice of the Design Review has been given, and the Planning Commission has considered evidence presented by the Community Development Department and other interested parties at a public hearing held with respect to this item on May 1, 2007. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE DOES HEREBY RESOLVE, DETERMINE AND ORDER AS FOLLOWS: SECTION 1. The Planning Commission has considered the proposed design for the Rosetta Canyon Fire Station, Community Center and Park, and has found them acceptable. SECTION 2. The Planning Commission finds and determines that the Commercial Design Review No. 2007-03 does not propose substantial changes to the Ramsgate Specific Plan and does not present any new information, circumstances, or changes to the project that was analyzed under Addendum No.3 to the Final Supplemental Environmental Impact Report. The Design Review application is part of the whole action which was analyzed in Addendum No. 3 when the Ramsgate Specific Plan was amended. The Design Review does not change density or intensities of use. It simply establishes standards for color palates, articulation, orientation, and design. Therefore, it is not necessary to conduct any further environmental review for the Project. SECTION 3. That in accordance with Lake Elsinore Municipal Code Section 17.82, the Planning Commission makes the following findings for the approval of Commercial Design Review No. 2007-03: 1. The project as conditioned, will comply with the goals and objectives of the Ramsgate Specific Plan Fifth Revision, and therefore the City's General Plan. The master-planned Ramsgate Specific Plan designates the site for Community Park. The proposed fire station, community center and park implements the land use objectives and requirements of the Specific Plan. AGENDA ITrM NO. 3 PAGE . The project complies with the design directives of Ramsgate Specific Plan No. 89-1 Fifth Revision and those pertinent directives contained in Section 17.82.060 and all other applicable provisions of the City Municipal Code. Staff has reviewed the project with adjacent neighborhoods and proposed development and finds that it complements their quality of construction, provides a pleasing use of color and materials, demonstrates a respect for privacy and views, and offers visually attractive landscaping and open space amenities. The Fire Department, Policy Department and Community Services Department have worked with the architect to develop an efficient, strategic and cohesive layout. 3. Conditions and safeguards pursuant to Section 17.82.070, including guarantees and evidence of compliance with conditions, have been incorporated into the approval of the subject project to ensure development of the property in accordance with the objectives of this Chapter and the planning district in which the site is located. Staff has provided conditions regarding landscaping, monumentation, lighting, and fencing. SECTION 3. Based upon the evidence presented, the above findings, and the attached conditions of approval imposed upon the Project, the Planning Commission hereby recommends that the City Council approve Commercial Design Review 2007-03. SECTION 4 This Resolution shall take effect from and after the date of its passage and adoption. Applicant shall meet all American with Disabilities Act requirements for access to the fire station, community center and park facilities. 7. Prior Approvals. Applicant shall comply with all requirements of the underlying Tract Map No. 25479, and Ramsgate Specific Plan No. 89-1 Fifth Revision, unless superceded by these conditions. Where these documents are silent, the project shall comply with all applicable City Codes and Ordinances. a. Applicant shall comply with all relevant Mitigation Monitoring Program requirements as set forth in Addendum No.3 to the Final Supplemental Environmental Impact Report (SCH 88090525) for Ramsgate Specific Plan No. 89-1. Applicant shall provide a Mitigation Monitoring Program Report on a quarterly basis during construction. 8. RDA. This project is not within a designated Redevelopment Agency Project Area. 9. Hours of Construction. The City's Noise Ordinance shall be met during all site preparation activity. Construction shall not commence before 7:00 a.m. and shall cease at 5:00 p.m., Monday through Friday. Construction activity shall not take place on Saturday, Sunday or any legal holidays. 10. Construction Trailers. A cash bond of $1,000.00 shall be required for any construction trailers used during construction. Bonds will be released after removal of trailers and restoration of the site to an acceptable state, subject to the approval of the Community Development Director or designee. The project shall connect to sewer and meet all requirements for water availability of the Elsinore Valley Municipal Water District (EVMWD). Applicant shall submit water and sewer plans to the EVMWD and shall incorporate all district conditions and standards, including payment of applicable water and sewer connection fees. The applicant shall submit a "Will Serve" letter from the District. 12. SCE. The applicant shall submit a "Will Serve" letter from Southern California Edison stating that electrical service will be provided to the project. 13. Fire Department Requirements. The applicant shall comply with the conditions of approval submitted by the Riverside County Fire Department dated April 3, 2007. 14. Walls & Fences. All perimeter walls shall be coated with anti-graffiti paint. 15. Any retaining walls visible to the public shall match the interior masonry block walls in color and style. 16. Any tubular steel view fence installed shall be of industrial-grade material for safety purposes. 17. FMZ. The applicant shall abide by the approved Fuel Modification Plan for Tract 25479, and all conditions of approval of said tract. 18. Signage. All signage shall be reviewed and approved by the Community Development Director or his designee, and shall require the issuance of a Sign Permit as appropriate. a. Applicant shall install an entry monument for the western parking lot, indicating it as access to the baseball fields. Prior to Issuance of Building/Grading Permits 19. Acknowledgment of Conditions. Prior to issuance of any precise grading permits or building permits, the applicant shall sign and complete an "Acknowledgment of Conditions" and shall return the executed original to the Community Development Department for inclusion in the case records. 20. Grading Ordinance Compliance. Applicant shall comply with all requirements of the City's Grading Ordinance. Construction generated dust and erosion shall be mitigated in accordance with the provisions of Municipal Code, Chapter 15.72 and using accepted control techniques. Interim erosion control measures shall be provided thirty (30) days after the site's rough grading, as approved by the City Engineer. 21. Trash Enclosures. The applicant shall work with staff to locate a trash enclosure for the Community Center, prior to the issuance of a building permit. 22. ConcessionJRestrooms. The applicant shall submit building plans and elevations for the concession building prior to the issuance of building permit, with the design of the building to match up to other buildings on site. These plans are subject to review and approval by the Director of Community Development or his designee. 23. Plancheck Submittal. UBC. The applicant shall submit for review and approval by the Building Division building plans that are designed to current UBC and adopted codes, and meet all applicable Building and Safety Division requirements. 25. Driveways. Driveways shall be constructed of concrete per Building and Safety Division standards. 26. Building Addresses. The building addresses shall be a minimum of four inches (4") high and shall be easily visible from the public right-of-way. Developer shall obtain street addresses for all project lots prior to issuance of building permits. The addresses (in numerals at least four inches (4" high) shall be displayed near the entrance and be visible from the front of the unit. Care should be taken to select colors and materials that contract with building walls or trim. 27. Meeting with Contractor. Prior to Building Permits the Construction Supervisor shall meet with the Planning Division to review the Conditions of Approval. 28. Landscape & Irrigation Plans. The project shall be properly landscaped with an automatic irrigation system using a combination of drip and conventional irrigation methods. The final Landscaping Plans and Irrigation Details for each plan shall be required, and a Cost Estimate shall be submitted for review and approval by the Community Development Director or Designee prior to issuance of building permits. A Landscape Plan Check Fee and Inspection Fee shall be paid for the entire project at the time of submittal. Street Trees. The applicant shall install street trees to match existing street trees a maximum of thirty feet (30') apart, and at least twenty- four inch (24") box in size. b. Sight Visibility. Planting within fifteen feet (15') of ingress/egress points shall be no higher than thirty-six-inches (36"). c. Water Conservation. The landscape plan shall provide for ground cover, shrubs, and trees and meet all requirements of the City's adopted Landscape Guidelines. Special attention to the use of Xeriscape or drought resistant plantings with combination drip irrigation system to be used to prevent excessive watering. d. Easements. Landscaping shall be shown and installed on both sides of any drainage easements. e. Drainage facilities. Particular attention shall be given to the screening of drainage facilities from public view or adjacent residences. f. Tree preservation. The applicant shall preserve as many healthy, mature trees as feasible that may be removed from the existing raised landscaped median in Rosetta Canyon Drive. These trees shall be relocated to the project site, to enhance the streetscene or park areas. g. Slope Landscaping. All exposed slopes in excess of three feet in height within the subject tract and within private lots shall have a permanent irrigation system and erosion control vegetation installed, as approved by the Landscape Architect and Planning Division, prior to issuance of certificate of occupancy. h. Buffering Adiacent Uses. The applicant shall locate the perimeter block wall and select appropriate landscaping to maximize the screening vehicle headlights and noise from the adjacent apartments. Landscaping shall also be used to minimize the opportunity for graffiti. 1. Perimeter Landscaping. The project shall install streetscape along Rosetta Canyon Drive and Ardenwood Way, including the comer monument, by the completion of Phase I. Staff is aware that landscaping must not affect the sight visibility of the fire trucks leaving the station onto Rosetta Canyon Drive. J. Landscape Bond. All landscape improvements shall be bonded with a 10 percent Faithful Performance Bond for labor and materials for one year from Certificate of Occupancy. 29. Ground Mounted Equipment. All mechanical and electrical equipment on the building shall be ground mounted. All outdoor ground or wall mounted utility equipment shall be consolidated in a central location and architecturally screened along with substantial landscaping, subject to the approval of the Community Development Director, prior to issuance of building permits. If the equipment is placed behind the fencing, landscaping will not be required. Air conditioning and related equipment located in side yards shall maintain a minimum of 3 feet of unobstructed, leveled clearance between the equipment and the adjacent property line. 30. Ball Field Lighting. The applicant shall install MUSCO lighting systems at the ball fields, at a height of 70 to 90 feet. 31. Supplemental Parking Lot Lighting. The applicant shall install low-pressure sodium lighting in the west parking lot adjacent to the residential apartments to the west. Page 7 of 16 AGENDA ITEM NO. The applicant shall install metal halide or high- pressure sodium lighting at the Community Center, Fire Station, and game courts, where color rendition and differentiation may be important during night-time activities. 33. All facility external lighting shall be turned off by 10 p.m. in accordance with City Ordinances. Prior to Final Approval 34. Issuance of Occupancy. The applicant shall meet all Conditions of Approval prior to the issuance of a Certificate of Occupancy and release of utilities. ENGINEERING DIVISION General Requirements 35. A grading plan signed and stamped by a Calif. Registered Civil Engineer shall be required if the grading exceeds 50 cubic yards or the existing flow pattern is substantially modified as determined by the City Engineer. If the grading is less than 50 cubic yards and a grading plan is not required, a grading permit shall still be obtained so that a cursory drainage and flow pattern inspection can be conducted before grading begins. 36. Prior to commencement of grading operations, applicant shall provide to the City a map of all proposed haul routes to be used for movement of export material. Such routes shall be subject to the review and approval of the City Engineer. 37. All grading shall be done under the supervision of a geotechnical engineer and he shall certify all slopes steeper than 2 to 1 for stability and proper erosion control. This project shall comply with applicable Conditions of Approval of Tract 25479. 39. Phasing Plan shall be approved by the City Engineer. Bond public improvements for each Phase as approved by the City Engineer. 40. An Encroachment Permit shall be obtained prior to any work on City right-of- way. 41. Arrangements for relocation of utility company facilities (power poles, vaults, etc.) out of the roadway or alley shall be the responsibility of the property owner or his agent. Overhead utilities shall be undergrounded. 42. Underground water rights shall be dedicated to the City pursuant to the provisions of Section 16.52.030 (LEMC), and consistent with the City's agreement with the Elsinore Valley Municipal Water District. 43. The applicant shall install permanent bench marks per Riverside County Standards and at locations to be determined by the City Engineer. 44. Provide fire protection facilities as required in writing by Riverside County Fire Department. 45. Install blue dot reflective markers at all fire hydrant locations. 46. Applicant shall pay all applicable development fees, including but not all inclusive: TUMF, MSHCP, TIF and area drainage fees. 47. Ten-year storm runoff shall be contained within the curb and the 100-year storm runoff shall be contained within the street right-of-way. When either of these criteria are exceeded, drainage facilities shall be provided. All drainage facilities in this project shall be constructed to Riverside County Flood Control District Standards. 49. All compaction reports, grade certifications, monument certifications (with tie notes delineated on 8 'li" x 11" Mylar) shall be submitted to the Engineering Division before final inspection of public works improvements will be scheduled and approved. 50. Slope maintenance along public right-of-ways shall be maintained by a maintenance mechanism as approved by the City. 51. All open space and slopes (except for schools) and flood control facilities outside the public right-of-way shall be owned and maintained by an entity approved by the City. 52. All landscaping at intersections shall meet City Sight Distance Standards. 53. All waste material, debris, vegetation and other rubbish generated during cleaning, demolition, clearing and grubbing or other phases of the construction shall be disposed of at appropriate recycling centers. The applicant should contract with CR&R Inc. for recycling and storage container services, but the applicant may use the services of another recycling vendor. Another recycling vendor, other than CR&R Inc., cannot charge the applicant for bin rental or solid waste disposal. If the applicant is not using CR&R Inc. for recycling services and the recycling material is either sold or donated to another vendor, the applicant shall supply proof of debris disposal at a recycling center, including verification of tonnage by certified weigh master tickets. 54. On-site drainage shall be conveyed to a public facility, accepted by adjacent property owners by a letter of drainage acceptance, or conveyed to a drainage easement. Education guidelines and Best Management Practices (BMP) shall be provided to residents of the development in the use of herbicides, pesticides, fertilizers as well as other environmental awareness education materials on good housekeeping practices that contribute to protection of storm water quality and meet the goals of the BMP in Supplement "A" in the Riverside County NPDES Drainage Area Management Plan. City of Lake Elsinore has adopted ordinances for storm water management and discharge control. In accordance with state and federal law, these local storm water ordinances prohibit the discharge of waste into storm drain systems or local surface waters. Prior to Issuance of a Grading Permit 61. Streets with a slope greater than 9% shall be redesigned to 9% or less, unless approved by the City Engineer. 62. Maintenance access shall be provided to all open spaces and drainage facilities and easements. 63. A Calif. Registered Civil Engineer shall prepare street and traffic improvement plans and specifications for the street improvements as shown on the Site Plan. Improvements shall be designed and constructed to Riverside County Standards, latest edition, and City Codes (LEMC 12.04 and 16.34). Street improvement plans shall include curb and gutter, sidewalk, street lighting, ac pavement and drainage improvements. 64. The applicant shall make an offer of dedication for all public streets and easements required by these conditions or as shown on the Site Plan. All land so offered shall be granted to the City free and clear of all liens and encumbrances and without cost to the City. 65. Applicant shall submit signing and striping plans for the required street improvements. All signing and striping and traffic control devices shall be installed prior to final inspection of public improvements. The signing and striping shall include Street Name Signs, "No Parking" and Street Sweeping Signs for streets within the project. 66. Submit grading plans with appropriate security, Hydrology, and Hydraulic Reports prepared by a Registered Civil Engineer for approval by the City Engineer. Construction Project access and hauling route plan shall be submitted and approved by the City Engineer, 68. Provide soils, geology and seism\c report including street design recommendations. Provide final soils report showing compliance with recommendations. 69. An Alquist-Priolo study shall be performed on the site to identify any hidden earthquake faults and/or liquefaction zones present on-site. 70. The applicant shall obtain all necessary off-site easements and/or permits for off-site grading and/or drainage acceptance from the adjacent property owners prior to grading permit issuance. 71. The applicant shall provide erosion control measures as part of their grading plan. The applicant shall contribute to protection of storm water quality and meet the goals of the BMP in Supplement "A" in the Riverside County NPDES Drainage Area Management Plan. 72. Applicant shall provide the city with proof of his having filed a Notice of Intent with the Regional Water Quality Control Board for the National Pollutant Discharge Elimination System (NPDES) program with a storm water pollution prevention plan prior to issuance of grading permits. November 7,2006 Planning Commission recommends approval of Text Amendment No. 2006- 02 (increase to landscape requirements) to Ci Council. City Council approves Text Amendment No. 2006-02. November 28, 2006 December 12, 2006 City Council second reading of Text Amendment No. 2006-02. January 12, 2007 30-day adoption period ends. Revisions to the landscape ordinance take effect. As shown in the table above, the Planning Commission recommended City Council approval of Text Amendment Number 2006-02, which was subsequently approved by the City Council and adopted by ordinance, therefore modifying existing landscape standards. This approval did the following: . Increased the on-site landscape requirement for commercial development from 10% to 20% and industrial development from 8% to 20%. . Increased the requirement for the number and size of trees within parking areas from one (1) fifteen (15) gallon tree per every ten (10) parking spaces to one (1) 24-inch tree for every five (5) parking spaces. It should be noted that this Text Amendment pertains to landscape percentages only and the above listed (second bullet) tree to parking space ratio will not be modified. Staff recommended increases to landscaping provisions primarily to bring the City of Lake Elsinore landscape requirements in line with those found in neighboring communities. Outreach Prior to and during the preparation of the initial Text Amendment (2006-02), staff made efforts to advise commercial/industrial development applicants in the review process (as well as prospective applicants) ofthe proposed increases to the landscaping requirements. Many applicants in the review process modified their plans accordingly in order to meet the new requirements prior to the official code change. These include the following recently approved projects: . Rite Aid pharmacy and Shopping Center (Lakeshore/Machado): 20% landscaping provided . Diamond Professional Plaza Medical Offices (Diamond Drive): 27% landscaping provided . McDonald's (Oak Grove/Target Shopping Center): 23 % landscaping provided . Southern California Primary Medical Building (Canyon Estates Drive- adjacent to Washington Mutual): 21 % landscaping provided . Omni West Medical Building (Canyon Estates Drive) 33% landscaping provided After the ordinance was adopted, it became evident to staff that not all project applicants were aware or fully understood the level of change relative to the adoption of the Text Amendment to the LEMC. On January 24, 2007, staff coordinated a meeting with several members of the development community (including applicants with submitted project applications) in order to explain and discuss the new landscaping requirements. Those in attendance included developers, architects, and commercial/industrial property owners. A key issue of the discussion was the impact that the increased landscaping requirements would have on maximizing building square footage on properties as well AGENDA ITEM ~ PAGE?L OF r'3 '- REPORT TO PLANNING COMMISSION May 1, 2007 PROJECT TITLE: TEXT AMENDMENT NO. 2007-02 as comments relating to there being no financial benefit of having increased landscaping incorporated into commercial and industrial developments. Staff informed those in attendance that even though requirements were increased, the landscaping ordinance provided relief to developers who sought reductions in landscaping. Decreasing landscaping percentages for development projects was possible based on the following language currently found in the landscape ordinance for all commercial and industrial zones: "A reduction in (landscape) coverage may be sought and approved during the Design Review process in recognition of quality design. For the purpose of this provision, quality considerations include the use of courtyards, atriums, creative use of ground floor public space, creative use of water elements, and the incorporation of sculpture or art work in the landscape proposal. " In spite of the landscape ordinance provision listed above, those in attendance indicated that over time, possible Planning staff attrition and future interpretation ofthe stated guideline did not give them assurances that there would be flexibility in reducing landscaping requirements if certain aesthetic and design goals were reached. Based on the discussion and comments received at this meeting, the general consensus was that the landscaping requirement be reduced from 20% to 15 % for commercial development and from 20% to 12% for industrial developments. In addition to the State mandated public notice and newspaper publishing, staff e- mailed all ofthose in attendance at the January 24,2007 meeting advising them ofthis new Text Amendment proposal. ANALYSIS On-Site landscaping It is generally recognized that commercial and industrial developments with sufficient landscaping provide many positive attributes to the areas, which include: . Enhancing property aesthetics and overall community image. . Beautifying streetscapes and public rights-of-way. Minimum On-site Landscaping Percentage Requirements in Other Cities Communities employ an array of percentages for the requirement of on-site landscaping requirements for commercial and industrial districts. The following matrix reflects the minimum on-site landscaping requirements for various communities throughout the County of Riverside. Temecula 21% 23% Murrieta 17% 10% Perris 10% 10% Moreno Valley nla nla The percentages listed represent an average of the various commercial and industrial districts. It should be noted that no commercial or industrial zoning district was below twenty- percent (20%). The percentages listed represent an average of all the various commercial and industrial districts and does not include any commercial and industrial specific plan landscape re uirements. No comment The City of Moreno Valley does not have a minimum landscape percentage requirement. The City requires all setbacks exclusive of required walkways and driveways will be landsca ed lantin areas. AGENDA ~M ~ PAGE -'- OF -J.~ REPORT TO PLANNING COMMISSION May 1, 2007 PROJECT TITLE: TEXT AMENDMENT NO. 2007-02 Hemet n/a n/a The City of Hemet does not have a minimum landscape percentage requirement. The City requires that all setbacks be landscaped. Ontario 14% 12.5% The percentages listed represent an average of all different commercial and industrial districts. It should be noted that the percentages differ whether it the lot in question is a comer or interior lot. More than half of all cities surveyed have a minimum percentage of the site devoted to landscaping. It should be noted however, that like Lake Elsinore, some of the cities listed above have specific plan areas and zone overlays incorporated into their zoning and General Plan Maps, where provisions for more or less than minimum on-site landscape percentage requirements could theoretically be found. Lake Elsinore currently requires minimum on-site landscape percentage requirements of twenty-percent (20%) for development in commercial and industrial districts. This percentage is on the higher end of the spectrum when compared to the other cities surveyed, with Temecula being the only City requiring more landscaping. If this Text Amendment is approved, thereby reducing landscaping percentages for Lake Elsinore to the proposed 15% for commercial and 12% for industrial, it would place the City among the middle of the range compared to other nearby communities in terms of required landscaping ratios. It should be noted that the table above lists the average of on-site landscape percentage requirements for all the different commercial and industrial districts within the surveyed cities. Staffs analysis of the numbers provided was achieved by adding up all the requirements within each district and calculating an overall average for the commercial and industrial districts. In addition, staff concluded that some cities require varying amounts oflandscaping for different parcel locations. For example, the City of Ontario requires a lower percentage of on-site landscaping for interior lots and a higher percentage for comer lots. Minimum On-site Landscaping Percentage Requirements Conclusion As shown, communities have taken a variety of approaches in their use of on-site landscaping for commercial and industrial zoning districts. The benefits and disadvantages of on-site landscaping are summarized below: Benefits · Enhanced aesthetics and community image. · Beautifies streets capes and public right-of-ways · Improves air-quality and reduces energy consumption. · Stabilizes soils by minimizing soil erosion Disadvantages · Reduces buildable footprint area for projects. · Requires additional maintenance by the property owner or management company. As reflected in the proposed "Draft" ordinance (Attachment 2), it is staffs recommendation that the minimum on-site landscaping requirements be decreased from twenty-percent (20%) to fifteen-percent (15%) in all commercial zoning districts. Additionally, staff recommends that the on-site landscaping requirements be decreased from twenty-percent (20%) to twelve-percent (12%) in all industrial zoning districts. The landscaping ratios listed above will become the mandated guideline if this Text Amendment is adopted, however it should be noted that: 1) more landscaping can be requested for prominent parcels and/or developments during the design review process and 2) less than the required landscaping can be incorporated into developments when certain design features are included in the project. SUMMARY To summarize, the proposed landscape-related changes to the commercial and industrial zoning districts are as follows: · Decrease the amount of required on-site landscape coverage from twenty- percent (20%) to fifteen-percent (15%) in all commercial districts. . Decrease the amount of on-site landscape coverage from twenty-percent (20%) to twelve-percent (12%) in all industrial districts. ENVIRONMENTAL DETERMINATION Pursuant to the California Environmental Quality Act (CEQA), an Initial Study was completed to analyze the potential environmental impacts ofthe proposed project. The Initial Study concluded that the proposed project would have no significant environmental impacts. A Negative Declaration has accordingly been prepared and released for review. The review period commenced on April 17, 2007 and ends on May 18, 2007. FISCAL IMPACT The proposed Text Amendment would make minor changes to existing on-site landscape requirements within all commercial and industrial districts. The changes would not affect the overall scope or complexity of the standards and as such would not require any additional staff time or resources to administer. There would be minimal fiscal impact to the City resulting from administration or enforcement of the proposed ordinance. That in accordance with State Planning and Zoning Law and the Lake Elsinore Municipal Code, the Planning Commission makes the following findings for the recommendation of approval of Text Amendment No. 2007-02: 1. The Text Amendment will not be detrimental to the health, safety, comfort, or general welfare of the persons residing or working within the neighborhood of the proposed amendment or within the City.
