SUBJECT: R.O.V.E. UPDATE (PRESENTATION BY LEPD)
BACKGROUND
The PSAC last visited the topic of off-highway vehicle enforcement in May, following a fatal
accident involving an off-road rider. Within City limits, off-road enforcement is performed by the
LEPD, through the Riverside County Sheriffs Department Off-highway Vehicle Enforcement
Program (R.O.V.E.).
DISCUSSION

Illegal off-highway motorized vehicle (ORMV) ridership affects the hills, canyons and trails of Lake
Elsinore. Illegal off-roading impacts include vandalism, damage to the environment, complaints from
property owners and residents, accidents, and occasionally, fatal injuries.
Within City limits, off-road enforcement is performed by the LEPD, through the Riverside County
Sheriffs Department Off-highway Vehicle Enforcement Program (R.O.V.E.). The RO.V.E. team is
equipped with quad-type equipment and trained officers for this special duty. A combination of grant
and local funding determines the frequency and availability ofR.O.V.E. services to the City.
The LEPD, RO.V.E. and Code Enforcement Division share enforcement responsibilities. When
illegal off-roading involves vandalism, such as removal offencing and No Trespassing signs, Code
Enforcement officers may also cite any offenders they catch. Fines begin at $100, typically.
FISCAL IMPACT
None. The LEPD contract includes support ofRO.V.E. and related services.

ORDINANCE ADDING TRAFFIC SAFETY TO THE COMMISSION'S
ENUMERATED DUTIES AND RESPONSIBILITIES
BACKGROUND
Following a request by the Commission at the August 8, 2007 meeting, the City Attorney's office has
prepared a draft ordinance adding traffic safety to the list of Commission duties and responsibilities.
DISCUSSION
The attached draft ordinance amends Section 2.46.060 of the Municipal Code to provide that the
Commission can hear citizens' traffic safety concerns. The amendment authorizes the Commission
/'"' to communicate such complaints and concerns to City staff and respond to such concerns in a timely
manner.
Based on the Commission's comments and direction tonight, the City Attorney's office will make
final revisions and submit the ordinance to the City Council for consideration.
FISCAL IMPACT
None.

revised ordinance with a staff report to the City Council for consideration.

WHEREAS, the Public Safety Advisory Commission (the "Commission")
was established in 2004 to serve as a conduit of information and communication
from residents and business people to the City's public safety, code enforcement
and emergency services professionals; and
WHEREAS, Chapter 2.46 of the Lake Elsinore Municipal Codes
enumerates the duties and responsibilities of the Commission and provides that the
Commission may request that the City Council consider additional duties and
responsibilities for the Commission.

THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DOES
ORDAIN AS FOLLOWS:
SECTION 1. That Section 2.46.060, subparagraph I is hereby restated as
subparagraph J.
SECTION 2. That Section 2.46.060, subparagraph I is hereby added as
follows:

I. The Commission shall hear citizen complaints and concerns
regarding traffic safety, communicate such complaints and concerns
to City personnel designated by the City Manager, and report back to
citizens within a reasonable time period.
SECTION 3. If any provision, clause, sentence or paragraph of this
Ordinance or the application thereof to any person or circumstance shall be held
invalid, such invalidity shall not affect the other provisions of this Ordinance and
are hereby declared to be severable.
SECTION 4. This Ordinance shall take effect thirty (30) days after the
date of its final passage. The City Clerk shall certify as to adoption of this
Ordinance and cause this Ordinance to be published and posted in the manner
required by law.

BACKGROUND
On August 8, 2007 the Public Safety Advisory Committee recommended to City Staff to draft an
ordinance to establish a maximum speed limit for Lake Elsinore's High Speed Zone, with a
requirement for those desiring to exceed the maximum speed limit to obtain a Special Event Permit.

DISCUSSION
Attached is the DRAFT High Speed Zone Ordinance for review by the Commissioners. The
effective date of the ordinance would be January 1, 2008. This would allow time for City Staff to
change public information literature and signage to conform with the new regulation.
FISCAL IMPACT
Staff does not anticipate any significant fiscal impact to the City ifthe ordinance is approved.

SAFETY REGULATIONS FOR NEWSSTANDS IN THE PUBLIC RIGHT-
OF-WAY
SUBJECT:
BACKGROUND
This item is to follow-up on a citizen's request during the August 8th meeting. The issue is regulating
newsstands that are in the public-right-of-way to maintain safety for pedestrians, or the disabled.
DISCUSSION

Curbside newsstands in front of the Lake Elsinore Post Office on Graham Avenue impede
pedestrians both on the sidewalk and at curbside and preclude motorists from entering or exiting
their parked cars at curbside. Newsstands positioned on a public sidewalk or at the curb may create
conditions ranging from visual nuisance, or inconvenience, to a public safety hazard.
The City Attorney will comment on options available to the City for regulating newsstands that are
in the public right-of-way. The goals are to ensure that any newsstand in the public right-of-way:
I. Is properly positioned to meet City standards for public access;
2. Does not impede curbside access to parked vehicles;
3. Does not interfere with pedestrian access or use of public sidewalks;
4. Meets standards to withstand vandalism so as not to become a public nuisance.
FISCAL IMPACT
Unknown at this time.
RECOMMENDATION
