RESOLUTION OF THE CITY COIINCIL OF T8E CITY OF
LARE ELSINORE DETERMINING THAT A STREET
EASEMENT (PORTION OF SILVER STREET) IS
UNNECESSARY FOR PRESENT OR PROSPECTIVE PIIBLIC
IISE AND VACATING SAID EASEMENT.
WHEREAB, the City Council of the City of Lake Elsinore desires to
vacate a street easement pursuant to the procedures set forth in
Streets and Highwavs Code Section 8320 et sea., said easement being
more particularly described as follows:
' Right of Way Vacation of a portion of Silver Street Southerly of
' Pottery Street in Block 65 of Heald's Resubdivision, in the City
of Lake Elsinore, as shown by Map on file in Book 8, Page 378, of
Maps, records of Riverside County, California, more specifically
described as:
COMMENCING at the Northwesterly corner of Lot 20 of said Block 65,
said point being the intersection of the Southerly Right of Way
line of Pottery Street and the Easterly Right of Way line of Silver
Street;
THENCE South 18'29'30" West, 10.00 feet, along said Easterly Right
of Way line of Silver Street, to the True Point of Beginning;
THENCE South 18•29'30" West, 35.53 feet along said Easterly Right
of Way line to a point on a curve, concave Southwesterly, having
a radius of 48.00 feet, the radial bearing to the point being south
57°10'26" West;
THENCE Westerly along the arc of said curve 64.61 feet, through a
central angle of 77° 21' 52" to a point on the curve, the radial
bearing to the point being South 20 11'26" East, said point being
a point on the Westerly Right of Way line of Silver Street;
THENCE North 18°29'30" East, 35.53 feet along said Westerly Right
of Way to a point, said point also being a point on the Easterly
property line of Lot 19 of said Block 65;
THENCE South 71' 31'00" East, 60.00 feet to the True Point of
Beginning; and
wHEREAS, the City Council of the City of Lake Elsinore adopted a
Resolution of Intention setting a time and place for public hearing
on said vacation; and
WHEREAS, pursuant to that Resolution of Intention, the public
hearing has been held and evidence submitted;
NOW, THEREFORE BE IT RESOLVED by the City Council of the City of
Lake Elsinore as follows:
1. That the foregoing recitals are true and correct.
2. That based upon the evidence submitted as said public
hearing, the City Council hereby finds that the street easement
described in the Resolution of Intention is unnecessary for present
or prospective public use.
3. That the street easement more particularly described
above is hereby ordered to be vacated.
' 4. That the City Clerk is hereby ordered to record this
Resolution of Vacation in the Riverside County Recorder's Office.
PASSED, APPROVED AND ADOPTED this 11th day of December, 1990.
