RESOLUTION No. 90-91
A RESOLUTION OF TIiG CITY COUNCIL OF THE CITY OF
LAKE ELSINOR~. CALIFORNIA, PASSING ON THE "REPORT"
OF THB ENGINL:CR, GIVING PAGLIMINARY APPROVFlL, AND
SETTING A TIM~ AND PLACE FOR PU6LIC HGAKING
WHEREAS, the CITY COUNCIL of the CITY OL' LAKE CLSINOftG, CALIFORNIA, ~ ,
hae instituted proceedings for the acquisition of certain public works of
improvement and appurtenances iinder provisions of the "Municipal Improvement
Act of 1913", beinq Division 12 of the Streets and Highways Code of the State
of California, in a special assessment district known and designated as
ASSCSSMGNT DISTRICT NO. 90-1A (hereinafter referred to as the "l~ssessment
District"); and,
WHEREAS, there Itas been prepared and filed with the legislative body a
"Report" provided for in Sections 10203 and 10204 of the Streets ancl Highways
Code of the State oE California, and this "Report" has been presented for
consideration; and,
WHEREAS, a Resolution of Intention for this impr~ovement was previously
adopted by the leyislative body; and the "Report" as now presented shall
stand as the "Report" for the purpose of subsequent proceedings hereunder.
NOW, THGRGI'OAE~ BE IT RGSOLVCD AS FOLLOWS:
1. That the above recit:als are all true and correct.
2. That the "Report•' of the Engineer referred to hereinabove is
conaidered adopted, passed upon, and preliminarily approved, as follows:
A. 1'hat the plans for the "as-built" improvements to be made,
contained in said "Report" be, and they are hereby preliminarily approved and
adopted;
FS. That the L•'ngineer's estimate of the itemized and~total costs
and expenses of said "as-built" acquisition and improvements, and of the
~~ incidental expenses in connection therewith, contained in said "Repo[t", be,

c. That the dlagram ehowing the Assessment Dietrict referred to
and deacribed in eaid Reeolution of Intention, and also the boundariee and
dimensione of the respective subdivisions of land within said Assesement
Dietrict, as the same exiated at~the time of the paesage of said Resolution
of Intentlon, each of which subdivisions have been given a separate number
upon said diayram, ae contained in eaid "Report",~ be, and it is hereby
preliminarily approved and adopted;
D. Tliat the proposed assessinenl upon the several subdivisions of
Land in said Assessment District, in proportion to the estimated benefits to
be received by such subdivisions, respectively, from said acquisition, and of
the incidental expenses thereof, as contained in said "Report", be, and they
are hereby preliminarily approved and adopted;
E. That the maps and descriptions of the lands and easements to
be acquired, as contained in said "Report" be, and the same are hereby
preliminarily approved;
F. That said "Report" shall stand as the Cngineer's "Report" for
the purpose of all subsequent proceedinys had pursuant to said Resolution of
Intention.

DISTRICT, OR TO THG PROPOSED GRADCS, MAY APPEAR AND SHOW CAUSE WHY SAID WORK
SHOULD NOT BE ACQUIRGU IN ACCORDANCG WITH THG RESOLUTION OF INTENTION AND THG

4. That the City Clerk is hereby directed to qive notice of said
eublic Hearing by causiny to be conspicuously posted on all open streeL-s
within the Aesessment DistricC, not more than 300 feet apart on each street
so posted, but not less than 3 in all, notice of the passage of tlie Resolu-
tion of Intention and of this Resolution, ~all in accordan~e:with the provi-
~ ~ slons of said Division 12.

5. That the City Clerlc is hereby directed to give notice of said
Public Hearing and of the passage of the Resolution of Intentian and thie
Resolution by causing auch notice to be published in accordance with Section
6066 of the Government Code, in the newspaper previously designated as the
newepaper for all publications as required by law and as necessary for comple-
tion of this Asaesement District.
6. That the City clerk is hereby directed.to mail notice of saicl
Public Hearing and Lhe adoption oL Lhe Resolution oE Intention and oE the
filing of the "Report" to all persons owning real property proposed to be
assessed, whose names and addresses appear on the last equalized assessment
roll for County taxes prior thereto, or as known to said City Clerlc, and to
all other persons as prescribed in accordance with the provisions of said
Division 12.
7. That the City Clerlc is hereby further directed to file a copy of
the proposed boundary map in the oEfice of the county Recorder within fi.fL-een
(15) days of the adoption of the proposed boundary map; said boundary map to
be in the manner and form as seL forth in Division 4.5 of the Streets and
Highways Code of the 5tate of California. ~
