A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, MAKING FINDINGS ON
PETITION ~ .
WHGR631S, the CITY COUNCIL~ of the CITY OC LAKC ELSINORE, CALIFORNIA,
has been presented by certain property owners an executed Petition requesting
the conetruction of certain public improvements, toyether with appurtenances
and appurtenant work in connection therewith, said improvements to be
conetructed pursuanL- to the terms and provisions of the "Municipal Improve-
ment Act of 1913•', being.Division 12 of the Streets and Highways Code of the
State of California, in a special assessment district Icnown and designat-ed as
ASSESSMENT DISTRICT NO. 90-1 (SUMMERHILL) (hereinafter referred to as the
"Asseesment District"); and,
WH~RCAS, it has been reported that said Petition contains the siyna-
tures oE more Lhan sixty percent (60'k) of the property owners of Che assess-
able area of the property to be subject to assessment for the.proposed works
of improvement. Said Petition meets the requiremenLs ot Section 2804 of
Division 4 of the Streets and Hig hways Code of the Slate of California; and,
WHEREAS, in order Lo Limely accomplish the acquisiLion of the facili-
ties, the above-referenced Aesessment District shall be further divided into
subdistricts, with the first district to be for the acquisition of certain
necessary public grading within the rights-of-way, said district hereinafter
to be designated as ASSGSSMENT DISTRICT NO. 90-1A. Subseyuent sabdistricts ~
will be formed for other worics of improvement upon their installation and
completion.
NOW, THERGFORG, 6E IT RGSOLVtiD AS P'OLLOWS:
1. That the above recitals are all true and correct.
2.~ That it ie hereby found that said Petition has been signed by
ownera owning land constituting more than sixty percent (60~) of all
asseeeable land within the boundariea of the proposed Assessment District,
and eaid Petition meets the requirements of Sections 2804 and 2804.5 of
Divieion 4 of the Streets and tliyhways Code of Che SlaLe of Cali[ornia.
3. That said Petition shall be filed with the transcript of these
proceedings and shall remain open to public inspection.
q. This legislative body further finds and determines, based on
written evidence. submitted, that the total estimate amount of the proposed
aesessments will not exceed seventy-five percent (75F) of the estimated fair
marlcet value of the land proposed to be assessed after the proposed public
improvements ehall have been constructed.
5. That the first subdistLict above reterenced designated as Assess-
ment District No. 90-1A shall be for the first phase of construction, and the
worlcs of improvement to be acquired shall be the 9rading necessary for the
righte-oE-way within Tracts 20704 and 20705.. Subseyuent suUdistricts will be
formed for other phases of the worlc upon their installation and completion.
