RESOLUTION NO. 00-01
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF LAKE ELSINORE, CALIFORNIA,
RECOMMENDING TO THE CITY COUNCIL OF THE
CITY OF LAKE ELSINORE CERTIFICAITON OF
ENVIRONMENTAL IMPACT REPORT NO. 98-1.
WHEREAS, Lusk Elsinore, Inc. has submitted applications for Annexation No. 69 and
Sphere of Influence Amendment, General Plan Amendment No. 98-3, Zone Change No. 98-3,
and Tentative Tract Map No. 28751. The project consists of the ultimate development of a 64.52
acre site for construction of 133 residential lots. The project site located outside the eastern
boundaries of the City of Lake Elsinore within the unincorporated boundaries of Riverside
County. The site is bounded by the City Lake Elsinore to the south and west, adjacent to an area
commonly known as Tuscany Hills. The site is also bounded by the City of Canyon Lake to the
north and east.
WHEREAS, Annexation 69 and Sphere of Influence Amendment, General Plan
Amendment No. 98-3, Zone Change No. 98-3, and Tentative Tract Map No. 28751 together
comprise the "project" as defined by Section 21065 of the California Environmental Quality Act
(CEQA), Cal. Public Resources Code S 21000 et seq., which is defined as an activity which may
cause either a direct physical change in the environment, or a reasonably foreseeable indirect
physical change in the environment and which includes the issuance to a person of a lease,
permit, license, certificate, or other entitlement for use by one or more public agencies.
WHEREAS, public notice of said applications has been given, and the Planning
Commission has considered evidence presented by the Community Development Department
and other interested parties at a public hearing held with respect to this item on January 19,2000;
WHEREAS, Section 21081.6 of CEQA requires that where an EIR has been prepared for
a project for which mitigation measures are adopted, that a mitigation monitoring or reporting
program be adopted for said project, and pursuant to Section 21081.6 of CEQA, the City has
prepared a Mitigation Monitoring and Reporting Program.
WHEREAS, in accordance with Section 15132 of the State CEQA Guidelines, Final
Environmental Impact Report No. 98-1 (Final EIR 98-1) consists of:
a. Draft Environmental Impact Report (DEIR) No. 98-1 with Technical Appendices (A-J),
prepared in June 1999;
b. Final Environmental Impact Report (FEIR) No. 98-1 including Additional Analyses, and
Response on DEIR Comments, prepared in January 2000;
c. Statement of Fact and Findings for FEIR No. 98-1, prepared January 2000;
d. Statement of Overriding Considerations for FEIR No. 98-1, prepared January 2000;
e. Mitigation Monitoring Program for FEIR No. 98-1, prepared January 2000.
NOW THEREFORE, the Planning Commission of the City of Lake Elsinore DOES
HEREBY RESOLVE as follows:
1. The Planning Commission has reviewed and considered Final EIR 98-1 and finds that it is
complete, contains all required information, and has been completed in compliance with
CEQA; the Final EIR was presented to the Planning Commission and the Planning
Commission reviewed and considered the information contained in the Final EIR prior to
recommending to the City Council certification of the Final EIR; and the Final EIR reflects
the Planning Commission's independent judgment and analysis.
2. In compliance with Section 15074 of the CEQA Guidelines, Final EIR 98-1 and the records
of the proceedings upon which this decision is based are and will be on file with the City of
Lake Elsinore, 130 South Main Street, Lake Elsinore, California 92530.

3. This Planning Commission recommends to the City Council that it finds that Final EIR 98-1
has identified all significant environmental effects of Annexation 69 and Sphere of Influence
Amendment, General Plan Amendment No. 98-3, Zone Change No. 98-3, and Tentative
Tract Map No. 28751 and adopts findings set forth in Section 21081 of CEQA and Section
15091 of the State CEQA Guidelines with respect to each significant environmental effect
identified in Final EIR 98-1, and each alternative considered in Final EIR 98-1, and the
explanation of its reasoning with respect to each such finding set forth in the document
entitled, Statement of Findings and Facts in Support.
4. This Planning Commission recommends to the City Council that it finds that although Final
EIR 98-1 identifies certain significant environmental effects that may occur if Annexation 69
and Sphere of Influence Amendment, General Plan Amendment No. 98-3, Zone Change No.
98-3, and Tentative Tract Map No. 28751, are approved, most significant effects that can
feasibly be mitigated or avoided have been reduced to an acceptable level by the imposition
of project design features, standard conditions or mitigation measures, all of which have been
identified and set forth in Final EIR 98-1, and all of which are hereby specifically adopted by
this Planning Commission to mitigate the environmental impacts of the proposed project,
except those impacts related to traffic, air quality, and noise.
5. This Planning Commission recommends to the City Council that it finds that the unavoidable
significant environmental effects identified in Final EIR 98-1, related to traffic, air quality,
and noise, that have not been reduced to levels of insignificance have been substantially
lessened in their severity by the imposition of the mitigation measures, and are clearly
outweighed by specific economic, legal, social, technological and other project benefits
which offset these unavoidable impacts, and which are set forth in the Statement of
Overriding Considerations, and adopts the Statement of Overriding Considerations, which
support and justify approval of the Annexation 69 and Sphere of Influence Amendment,
General Plan Amendment No. 98-3, Zone Change No. 98-3, and Tentative Tract Map No.
28751 notwithstanding certain unavoidable significant environmental effects which cannot
feasibly be substantially mitigated.
6. This Planning Commission recommends to the City Council that it finds that the Mitigation
Monitoring and Reporting Program establishes a mechanism and procedures for
implementing and verifying the implementation of and compliance with the project design
features, and mitigation measures pursuant to Public Resources Code Section 21081.6, and
adopts the Mitigation Monitoring and Reporting Program.
7. This Planning Commission recommends to the City Council that it finds that Final EIR 98-1
serves as adequate and appropriate environmental documentation for the Annexation 69 and
Sphere ofInfluence Amendment, General Plan Amendment No. 98-3, Zone Change No. 98-
3, and Tentative Tract Map No. 28751and hereby recommends that the City Council certify
Final EIR 98-1 as complete and adequate, and fully complies with the requirements of
CEQA, the State CEQA Guidelines, and the City's environmental analysis procedures.
NOW, THEREFORE, based on the above findings, the Planning Commission of the City
of Lake Elsinore DOES HEREBY RECOMMEND that the City Council of the City of Lake
Elsinore certify EIR 98-1.

RECOMMENDING TO THE CITY COUNCIL THE
COMMENCEMENT OF PROCEDINGS TO AMEND THE
CITY'S SPHERE OF INFLUENCE AND ANNEX TERRITORY
DESIGNATED AS ANNEXATION NO. 69 (APN 363-030-002,
-003,-004,-005,-006,-007,-008,-009,-010,-011,-012,-013,AND
-014) INTO THE CORPORATE BOUNDARIES OF THE CITY
OF LAKE ELSINORE.
WHEREAS, an application has been filed with the City of Lake Elsinore by Lusk Elsinore,
Inc. to amend the City's Sphere oflnfluence and to Annex certain property described as APN 363-
030-002, -003, -004, -005, -006, -007, -008, -009, -010, -011, -012, -013, AND -014 (approximately
64.52 acres) into the corporate boundaries of the City of Lake Elsinore; and
WHEREAS, this proposal is made pursuant to the Cortese-Knox Local Government
Reorganization Act of 1985, Government Code Section 57082; and
WHEREAS, Lusk Elsinore, Inc. has submitted additional applications for GP A No. 98-3,
Zone Change No. 98-3, and Tentative Tract Map No. 28751. The project consists of the ultimate
development of a 64.52 acre site for construction of residential lots. The project is site located
outside the eastern boundaries of the City of Lake Elsinore within the unincorporated boundaries of
Riverside County. The site is bounded by the City Lake Elsinore to the south and west, adjacent to
an area commonly known as Tuscany Hills. The site is also bounded by the City of Canyon Lake
to the north and east.
WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated with
the responsibility of making recommendations to the City Council for amendments to the City's
Sphere of Influence and Annexations; and
WHEREAS, public notice of said application has been given, and the Planning Commission
has considered evidence presented by the Community Development Department and other interested
parties at a public hearing held with respect to this item on January 19,2000;
SECTION 1. The Planning Commission has considered the proposed Amendment of the
City's Sphere of Influence and Annexation (Annexation No. 69), prior to making a decision to
recommend that the City Council commence proceedings to annex the subject territory. The
Planning Commission finds and determines that Environmental Impact Report No. 98-1 is adequate
and prepared in accordance with the requirements of the California Environmental Quality Act
(CEQA) which analyzes environmental effects of Annexation No. 69, and recommends City Council
certification, based upon the following findings and determinations:
SECTION 2. That in accordance with the Cortese-Knox Local Government Reorganization
Act of 1985, Government Code Section 57082, and the City of Lake Elsinore the following findings
for the approval of Annexation No. 69 have been made as follows:
1. The proposed annexation area is contiguous to the City of Lake Elsinore and will not create
pockets or islands.
2. The proposed annexation will not result III any adverse significant impacts on the
environment.
3. The proposed annexation will eliminate an existing undesired pocket of county area.

Planning Commission finds and determines that Environmental Impact Report No. 98-1 is
adequate and prepared in accordance with the requirements of the California Environmental
Quality Act (CEQA) which analyzes environmental effects of General Plan Amendment No. 98-
3, and recommends City Council certification, based upon the following findings and
determinations:
SECTION 2. That in accordance with State Planning and Zoning law and the City of
Lake Elsinore the following findings for the approval of General Plan Amendment No. 98-3
have been made as follows:
1. The approval of the requested designation permits development to the highest and best
nature within mitigable means to insure maintenance of the general public health, safety,
and welfare.
2. Granting of the requested designation will permit reasonable development of the property
consistent with its constraints and be more compatible with adj acent properties and
proposed development.
3. The proposed General Plan Amendment would establish a land use and density more in
character with the subject property's location, access, and constraints.

with the requirements of the California Environmental Quality Act (CEQA) which analyzes
environmental effects of Zone Change No. 98-3, and recommends City Council certification,
based upon the following findings and determinations:
SECTION 2. That in accordance with State Planning and Zoning law and the City of
Lake Elsinore the following findings for the approval of Zone Change No. 98-3 have been made
as follows:
1. The proposed Zoning is consistent with the Goals, Policies, and Objectives in the General Plan.
2. The proposed Zoning is consistent with the General Plan and the various land uses authorized
by the Ordinance are compatible with the objectives, policies, general land uses, and programs
specified in the Plan. (Government Code Section 65860).
3. The proposed Zoning will establish the necessary pre-zoning for the site.
4. Reasons why the City has considered the effect of Zoning Ordinances on the regional housing
needs in which the City is located and how the City has balanced these needs against the public
service needs of its residents and available fiscal and environmental resources. (Government
Code Section 65863.6).

HEREBY RESOLVE as follows:
SECTION 1. The Planning Commission has considered the proposed subdivision (TTM
No. 28751), prior to making a decision to recommend that the City Council approve the
proposed subdivision into 133 lots. The Planning Commission finds and determines that
Environmental Impact Report No. 98-1 is adequate and prepared in accordance with the
requirements of the California Environmental Quality Act (CEQA) which analyzes
environmental effects of TTM No. 28751, and has recommended City Council certification,
based upon the following findings and determinations:
1. The Planning Commission has reviewed and considered Final EIR 98-1 and finds that it is

CEQA; the Final EIR was presented to the Planning Commission and the Planning

SECTION 2. That in accordance with State of California Subdivision Map Act, and the
City of Lake Elsinore the following findings for the approval of Tentative Tract Map No. 28751
have been made as follows:
1. The proposed subdivision, together with the provisions for its design and improvement, is
consistent with the General Plan. The proposed subdivision is compatible with the
objectives, policies, general land uses and programs specified in the General Plan
(Government Code Section 66473.5).

WHEREAS, an application has been filed with the City of Lake Elsinore by Studio 7
Architecture to request a Conditional Use Permit, CUP 00-5, for a storage yard for an industrial
project to be located on a 1.7 acre site on Chaney Street - APN 377-160-002;
WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated
with the responsibility of approving Conditional Use Permit requests for outdoor storage; and

1. The proposed use, on its own merits and within the context of its setting, is in accord with the
objectives of the General Plan and the purpose of the planning district in which the site is
located.
2. That the proposed use will not be detrimental to the general health, safety, comfort, or
general welfare of persons residing or working within the neighborhood of the proposed use
or the City, or injurious to property or improvements in the neighborhood ofthe City.
3. That the site for the intended use is adequate in size and shape to accommodate the use, and
for all the yards, setbacks, walls or fences, landscaping, buffers and other features required
by the this Title.
4. That the site for the proposed use relates to streets and highways with proper design both as
to width and type of pavement to carry the type and quantity of traffic generated by the
subject use.
5. That in approving the subject use at the specific location there will be no adverse effect on

Chapter 3 which are based on mandates found in CEQA 21000 through 21177 of the California

WHEREAS, CEQA requires governmental agencies at all levels to develop
standards and procedures necessary to protect environmental quality ( 21001 of the California
Public Resources Code, Division 13) and therefore implementation ofCEQA.
WHEREAS, 15022 of the California Code of Regulations, Title 14, Division 6,
Chapter 3, states that each public agency shall adopt objectives, criteria, and specific procedures
consistent with CEQA for administering the responsibilities under CEQA including the orderly

WHEREAS, an application has been filed with the City of Lake Elsinore by Studio 7
Architecture to request approval of Conditional Use Permit No. 00-6 for a .6 acre outdoor
storage yard for Industrial Project No. 00-1 for Triple 'J' Development;
WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated
with the responsibility of approving Conditional Use Permits; and
NOW THEREFORE, the Planning Commission of the City of Lake Elsinore DOES
HEREBY RESOLVE as follows:
SECTION 1. The Planning Commission has considered the Conditional Use Permit No.
006 for the .6 acre outdoor storage yard for Industrial Project No. 00-1 and has found it
acceptable. The Planning Commission finds and determines this project is consistent with the
Lake Elsinore Municipal Code and that this action is exempt from the requirements of the
California Environmental Quality Act (CEQA) per Article 19, Categorical Exemptions, Section
15332.b, In-fill Development.
SECTION 2. That in accordance with Chapter 17.74 (Conditional Use Permit) of the
Lake Elsinore Municipal Code the following findings for the approval of Conditional Use Permit
No. 00-6 have been made:
1. The proposed use, on its own merits and within the context of its setting, is in accord with the
objectives of the General Plan and the purpose of the planning district in which the site is
located.
2. That the proposed use will not be detrimental to the general health, safety, comfort, or
general welfare of persons residing or working within the neighborhood of the proposed use
or the City, or injurious to property or improvements in the neighborhood of the City.
3. That the site for the intended use is adequate in size and shape to accommodate the use, and
for all the yards, setbacks, walls or fences, landscaping, buffers and other features required
by the this Title.
4. That the site for the proposed use relates to streets and highways with proper design both as
to width and type of pavement to carry the type and quantity of traffic generated by the
subj ect use.
5. That in approving the subj ect use at the specific location there will be no adverse effect on
abutting property or the permitted and normal use thereof.
6. Conditions and safeguards pursuant to Section 17.74.50 of the Zoning Code, including
guarantees and evidence of compliance with conditions, have been incorporated into the
approval of the Conditional Use Permit to insure that the use continues in a manner
envisioned by these findings for the term of the use.

MAP NO. 29811.
WHEREAS, an application has been filed with the City of Lake Elsinore by Project Design
Consultants representing Pardee Construction Company to subdivide certain property into 43 single-
family residential and two lettered lots; and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated with
the responsibility of making recommendations to the City Council pertaining subdivision ofland;
and
WHEREAS, public notice of said application has been given, and the Planning Commission
has considered evidence presented by the Community Development Department and other interested
parties at a public hearing held with respect to this item on December 20, 2000;
NOW THEREFORE, the Planning Commission of the City of Lake Elsinore DOES
HEREBY RESOLVE as follows:
SECTION 1. The Planning Commission has considered the proposed subdivision
(Tentative Tract Map No. 29811), prior to making a decision to recommend that the City Council
approve the proposed subdivision. The Planning Commission finds and determines that the City
Council certified Environmental Impact Report No. 88-1 is adequate and prepared in accordance
with the requirements of the California Environmental Quality Act (CEQA) which analyzes
environmental effects of Tentative Tract Map No. 29811.
SECTION 2. That in accordance with State of California Subdivision Map Act, and the
City of Lake Elsinore the following findings for the approval of Tentative Tract Map No. 29811 have
been made as follows:
1. The proposed subdivision, together with the provisions for its design and improvement, is
consistent with the General Plan. The proposed subdivision is compatible with the objectives,
policies, general land uses and programs specified in the General Plan (Government Code
Section 66473.5).
2. The effects this project is likely to have upon the housing needs of the region, the public service
requirements of its residents and the available fiscal and environmental resources have been
considered and balanced.
3. The design ofthe subdivision provides to the greatest extent possible, for future passive or
natural heating or cooling opportunities in the subdivision. (Governmental Code Section
66412.3)
4. Environmental Impact Report No. 88-1 is adequate and prepared in accordance with the
requirements of the California Environmental Quality Act (CEQA) and analyzes environmental
effects of Tentative Tract Map No. 29811. EIR No. 88-01 provides adequate environmental
clearance and analysis for the proposed subdivision.
NOW, THEREFORE, based on the above findings, the Planning Commission of the City of
Lake Elsinore DOES HEREBY RECOMMEND that the City Council of the City of Lake Elsinore
approve Tentative Tract Map No. 29811.
