A RESOLUTION OF THE PLANNING
COMMISSION OF THE CITY OF LAKE
ELSINORE, CALIFORNIA, ADOPTING THE
SINGLE-FAMILY RESIDENTIAL DESIGN
GUIDELINES.
WHEREAS, the Planning Commission ofthe City of Lake Elsinore has deemed that quality
physical environment is necessary for the protection of the public's health, safety, and welfare; and
WHEREAS, the Planning Commission of the City of Lake Elsinore deemed necessary to
adopt the Single-Family Residential Design Guidelines to ensure that single-family residential
development occurs in a manner which enhances the character and quality of surrounding
residential properties ; and
WHEREAS, the Planning Commission's goal in implementing these Design Guidelines is
to foster the quality design that enhances the community.
WHEREAS, the Planning Commission of the City of Lake Elsinore held a public meeting
on February 3, 1999 to discuss the proposed Single-Family Residential Design Guidelines and
concurred on the adequacy of the Guidelines.
NOW THEREFORE, the Planning Commission of the City of Lake Elsinore DOES
HEREBY RESOLVE as follows:
SECTION 1. The Planning Commission has considered the proposed Single-Family
Residential Design Guidelines and found that the proposed Single-Family Residential Design
Guidelines are consistent with the Zoning Code and General Plan ofthe City of Lake Elsinore.
NOW, THEREFORE, based on the above, the Planning Commission of the City of Lake
Elsinore DOES HEREBY ADOPT the Single-Family Residential Design Guidelines which shall
apply to all single-family residential zones within the City of Lake Elsinore.
I hereby certify that the preceding resolution was adopted by the Planning Commission at a
scheduled meeting thereof conducted on February 17, 1999, by the following vote:

RESOLUTION NO. 99-2
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, RECOMMENDING APPROVAL OF
THE NORTH PEAK SPECIFIC PLAN AMENDMENT NO.2, GENERAL PLAN
AMENDMENT NO. 98-2, "A" TENTATIVE TRACT MAP NO. 28888, AND
ENVIRONMENTAL IMPACT REPORT NO. 98-2 - TMC COMMUNITIES
The Planning Commission of the City of Lake Elsinore does resolve as follows:
SECTION 1. The Planning Commission hereby certifies that there has been filed with the City
of Lake Elsinore an application by TMC Communities, for adoption of North Peak Specific Plan
Amendment No.2, which consists of approximately 1,779 acres, for a mix of detached and attached
residential units, commercial uses, natural open space, golf courses, a conservation bank, and parks.
The Specific Plan Amendment No.2 area is generally bounded by Highway 74 on the south, Steele
Valley on the north, and Bull Canyon on the west. Steele Peak is located just outside the project site
boundary at the northeast comer. 1-15 passes approximately one mile southwest ofthe project site.
An amendment to the City's Circulation Element of the General Plan is also requested to ensure
consistency between the proposed project-related Nichols Road improvements, the County's General
Plan, and the City's Circulation Element. An "A" Tentative Tract Map to subdivide the entire North
Peak site into large lots for financial purposes is also requested. Due notice of said applications has
been given and public hearing conducted thereon pursuant to State Planning and Zoning Law and
local ordinances.
SECTION 2. The Planning Commission hereby determines that:
1. The Draft EIR No. 98-2, Mitigation Monitoring Program, Response to Comments document,
Findings and Fact document, and Statement of Overriding Considerations have been prepared,
submitted and reviewed in accordance with requirements of the California Environmental
Quality Act and the City's CEQA requirements, and are complete and adequate in their
evaluation of all environmental effects of the North Peak Specific Plan Amendment No. 2 and
associated discretionary approvals.
The North Peak Specific Plan Amendment No.2 will result in unavoidable impacts relating to
construction-related air pollution, traffic-generated air pollution, and cumulative air pollution
and noise generated by future City-wide traffic. A Statement of Overriding Considerations was
prepared to set forth the project's benefits which offset these unavoidable impacts. The City can
approve the Specific Plan Amendment No.2 even though the Specific Plan Amendment No.2
will cause significant effects on the environment, as described in Sections 15043 and 15093 of
the CEQA Guidelines and Sections 21002 and 21081 of the California Public Resources Code.
2. The North Peak Specific Plan Amendment No.2 and other discretionary applications will not
significantly degrade the quality of the environment, substantially reduce fish habitat or wildlife
species, cause fish or wildlife population to drop, threaten plant or animal communities, reduce
or restrict the range of rare or endangered plant or animal species, eliminate important cultural
resources, or significantly affect or be affected by land use, energy resources, agriculture,
seismicity, water quality, and traffic.
3. The proposed General Plan Amendment No. 98-2 will not be: a) detrimental to the health, safety,
comfort or general welfare of the persons residing or working within the neighborhood of the
proposed amendment or within the City, or b) injurious to the property or improvements in the
neighborhood or within the City.
4. The proposed General Plan Amendment No. 98-2 will permit reasonable development of the
area consistent with its constraints and will make the area more compatible with adjacent
properties.
5. The proposed General Plan Amendment No. 98-2 will allow for a land use density and usage
more in character with the subject property's location, access, and constraints.
6. The proposed General Plan Amendment No. 98-2 will not have a significant effect on the
environment.
7. The North Peak Specific Plan Amendment No.2 meets the City's Specific Plan criteria for
content and required implementation of the General Plan established by Section 65450 et seq.
of the California Government Code and Section 17.99 of the City of Lake Elsinore Municipal
Code.
8. The North Peak Specific Plan Amendment No.2 shall be implemented consistently with the
Goals, Policies and Objectives of the General Plan; and with any other applicable plans or

policies adopted by the City.
9. Those issues, standards, guidelines, etc. not addressed in the North Peak Specific Plan
Amendment NO.2 will revert to the City Municipal Code and/or Zoning Code in effect at the
time future projects are proposed.
10. Development standards and regulations contained in the North Peak Specific Plan Amendment
No.2 supersede applicable City ordinances and codes, unless specifically stated to the contrary.
Approval of the Specific Plan Amendment No.2 shall not be interpreted as waiving compliance
with other Federal or State laws or City Codes.
11. Location of the North Peak Specific Plan Amendment No.2 allows future development to be
well-integrated with its surroundings.
12. All vehicular traffic generated by future development, either in phased increments or at full
build-out, will be accommodated safely and without causing undue congestion upon adjoining
streets.
13. The North Peak Specific Plan Amendment No. 2 proposes land uses to be adequately serviced
by existing and/or proposed public facilities and services.
14. Overall design of the North Peak Specific Plan Amendment No.2 will produce attractive,
efficient and stable development.
15. The North Peak Specific Plan Amendment No.2 will not be detrimental to the health, safety,
comfort or general welfare of the persons residing or working within the project area or within
the City, nor will it be injurious to property or improvements in the project area or within the
City.
16. The proposed "A" Tentative Tract Map No. 28888, together with the provisions for its design
and improvement, is consistent with the General Plan. The proposed subdivision is compatible
with the objectives, policies, general land uses and programs specified in the General Plan
(Government Code Section 66473.5).
17. Effects that "A" Tentative Tract Map No. 28888 is likely to have upon the housing needs of the
region, the public service requirements of its residents and the available fiscal and
environmental resources have been considered and balanced.
18. Design of "A" Tentative Tract Map No. 28888 will provide to the greatest extent possible, for
future passive or natural heating or cooling opportunities in the subdivision. (Governmental
Code Section 66412.3)
SECTION 3. The Planning Commission hereby recommends that the City Council certify
Environmental Impact Report No. 98-2 based upon the facts and findings in the staff report and
presented at the public hearing and approve General Plan Amendment No. 98-2, North Peak Specific
Plan Amendment No.2, and "A" Tentative Tract Map No. 28888, based upon the findings in the staff
report, conditions of approval, and corrections to documents presented to and noted by the Planning
Commission following the public hearing.
SECTION 4. The Secretary of the Planning Commission shall certify the adoption of this
resolution and forward a copy to the City Clerk for reference and consideration of the City Council.

ELSINORE, CALIFORNIA FINDING THAT
CREMATORIUM USES ARE CONSISTENT
IN THE M-l ZONING SUBJECT TO A
CONDITIONAL USE PERMIT PURSUANT TO
SECTION 17.56.030.M OF THE LAKE
ELSINORE MUNCIP AL CODE.
WHEREAS, the Planning Commission of the City of Lake Elsinore has considered that
crematorium uses are in accord with the purpose of the M-1 Zoning District.
WHEREAS, The Planning Commission of the City of Lake Elsinore has deemed that
requiring a conditional use permit for such uses would further promote the protection of the public's
health, safety, and welfare; and
WHEREAS, the Planning Commission of the City of Lake Elsinore held a public hearing
on May 19, 1999 to discuss the appropriateness of crematorium uses within the M -1 Zoning.
NOW THEREFORE, the Planning Commission of the City of Lake Elsinore DOES
HEREBY RESOLVE as follows:
SECTION 1. The Planning Commission has considered the appropriateness of
crematorium uses and found these uses to be consistent to those uses allowed under a conditional
use permit.
NOW, THEREFORE, based on the above, the Planning Commission of the City of Lake
Elsinore DOES HEREBY ADOPT Resolution No. 99-3 to finds crematorium uses consistent to
allowed under a conditional use permit.

RESOLUTION NO. 99-4
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, RECOMMENDING APPROVAL OF
THE LIBERTY SPECIFIC PLAN AMENDMENT NO.2, GENERAL PLAN AMENDMENT
NO. 98-4, "A" TENTATIVE TRACT MAP NO. 28766, AND
SUBSEQUENT MITIGATED NEGATIVE DECLARATION NO. 99-3
(LIBERTY FOUNDERS)
The Planning Commission of the City of Lake Elsinore does resolve as follows:

SECTION 1. The Planning Commission hereby certifies that there has been filed with the City
of Lake Elsinore an application by Liberty Founders, for adoption of Liberty Specific Plan
Amendment No.2, which is intended to allow more flexibility necessary to develop a "Traditional
Neighborhood Design" community and to better implement mitigation plans associated with Federal,
State, and County resource agencies. SPA 2 proposes minor land use changes and amendments to
policies and conditions associated with the 1993 East Lake Specific Plan. The overall East Lake
Specific Plan site is located in the southeastern portion of the City of Lake Elsinore. The entire East
Lake Specific Plan area is 3,000 acres and is bounded by Lakeshore Drive to the north, Mission Trail
and Corydon Road to the east, and Lake Elsinore to the west. Liberty Specific Plan Amendment No.2
applies to the entire East Lake Specific Plan area. An amendment to the City's Circulation Element
of the General Plan is also requested to redesignate a section of Diamond Drive, between Malaga
Road and Bundy Canyon Road, from a Major Highway to a Collector Highway. An "A" Tentative
Tract Map to subdivide the Phase I portion of the East Lake Specific Plan area into large lots for
financial purposes is also requested. Due notice of said applications has been given and public
hearing conducted thereon pursuant to State Planning and Zoning Law and local ordinances.
SECTION 2. The Planning Commission hereby determines that:

1. Subsequent Mitigated Negative Declaration No. 99-3 and technical appendices have been
prepared, submitted and reviewed in accordance with requirements of the California
Environmental Quality Act and the City's CEQA requirements, and are complete and adequate
in their evaluation of all environmental effects of the Liberty Specific Plan Amendment No.2
and associated discretionary approvals. The Liberty Specific Plan Amendment No.2 and
associated discretionary approvals will not result in any significant and unavoidable impacts.
Based on evaluations and discussions contained in the Subsequent Mitigated Negative
Declaration, while the proposed applications may have the potential to degrade the quality of
the environment, a number of mitigation measures and PDFs are either recommended in the
Subsequent Mitigated Negative Declaration or in the 1993 ELSP FEIR or 1998 SPA 1
Addendum to reduce any potential adverse impact to a level of insignificance. The proposed
applications, with mitigation, will not significantly affect the environment. The proposed
applications will benefit existing fish and wildlife by increasing the acreage of habitats through
implementation of the WHEP.
2. The proposed applications will not have impacts that are individually limited but cumulatively
considerable. Given that project impacts are insignificant with mitigation, cumulative impacts
are not foreseen.
3. The proposed applications do not have the potential to adversely affect humans, either directly
or indirectly, with mitigation measures.
4. General Plan Amendment No. 98-4 will not be: a) detrimental to the health, safety, comfort or
general welfare of the persons residing or working within the neighborhood of the proposed
amendment or within the City, or b) injurious to the property or improvements in the
neighborhood or within the City.
5. General Plan Amendment No. 98-4 will permit reasonable development of the area consistent
with its constraints and will make the area more compatible with adjacent properties.
6. General Plan Amendment No. 98-4 will allow for a land use density and usage more in character
with the subject property's location, access, and constraints.
7. General Plan Amendment No. 98-4 will not have a significant effect on the environment.
8. Liberty Specific Plan Amendment NO.2 meets the City's Specific Plan criteria for content and
