RESOLUTION No. 90-33
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, OVERRULING AND DENY-
ING PROTESTS AND MAKING CERTAIN FINDINGS IN A
SPECIAL ASSESSMENT DISTRICT
WHEREAS, the CITY COUNCIL of the CITY OF LARE ELSINORE, CALIFORNIA,
has, by Reaolution, declared its intention to order the construction of
certain public works of improvement, pursvant to the terms and provisions of
the '•MUnicipal Improvement Act of 1913'•, being Divieion 12 of the Streets and
Highways Code of the State of California, in a special asaesement dietrict
known and designated as NORTHWEST SEWER ASSESSMENT DISTRICT NO. 86-1 (herein-
after referred to as the "ASSesement Dietrict"); and,
WHEREAS, certain owners of property liable to be aesessed for improve-
ments have filed written protests or objectione and delivered the same to the
City Clerk not later than the hour set for hearing auch objectiona; and
WHEREAS, at the time set for said Public Hearing, all protesta and
objectiona were duly heard and considered, and all matters as to the method
and formula of the assessment epread and the determination as to whether or
not the property did receive a benefit and whether the assessmenta were
apportioned in accordance to benefit were heard and considered; and,
WHEREAS, an initial environmental study hae been completed for the
project, indicating that the project shall not have a significant effect on
the environment and that approval of a Negative Declaration wovld be
appropriate.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That the above recitals are all true and correct.
2. That the public hearing on the Aasessment Diatrict is hereby
closed.
3. That a11 protests and objections of every kind and nature be, and
the eame hereby are, overruled and denied, and it is further deter-
mined that eaid protests and objectione are made by the owners of
lees than one-half (1/2) of the area of property to be aeeessed Eor
said improvements within said Asaeesment District.
4. That is hereby further determined that all properties within the
boundariea of the Asseasment District receive a local and direct
benefit from the works of improvement as proposed for eaid Asaese-
ment Diatrict, and it ie hereby fnrther determined and declared
that all assessable costs and expensea have been apportioned and
spread over the properties within the boundaries of the Asaessment
District in direct proportion to the benefits received thereby.
5. That the Engineer•s method of spread and apportionment of all costs
is hereby approved and adopted as being a correct and proper appor-
tionment and distribution of all asseasable coets for these works
of improvement.
6. That the formation of the Asaessment District and the conatruction
of the improvements pursuant thereto ahall not have a significant
impact on the environment. The Negative Declaration, as presented,
has been prepared in accordance with the provisione of the Califor-
nia Environmental Qvality Act and the guidelinea thereto, and is
hereby approved and adopted. ~
