HomeMy WebLinkAboutCC Reso No 1990-026RESOLUTION NO. 90-26 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, SIGNIFYING ITS INTENTION TO 5UBMIT A CLAIM FOR FUNDS UNDER TAE TRANSPORTATION DEVELOPMENT ACT OF 1971 AND AUTHORIZING THE CITY MANAGER TO COMPLETE ALL DOCUMENTS TO SUPPORT CLAIMS FOR FUNDS. WHEREAS, a State Program for local transportation improvement funds known as the Transportation Development Act of 1971, Chapter 1400, Status 1971 (SB325, 1971) is being implemented in Riverside County under the review of the Southern California Association of Governments; and WHEREAS, the Riverside County allocation has been apportioned to provide local transportation funds to the City of Lake Elsinore for Fiscal Year 1981-90 in the amount of $107,486; and WHEREAS, the City of Lake Elsinore has substantial need for these funds for the planning and demonstration of a local transportation system. NOW, THEREFORE BE IT RESOLVED that the City of Lake Elsinore will actively participate in the program, and request, in accordance with Chapter 1400, Statues of 1971, and applicable Rules and Regulations, the payment of funds by the Riverside County Auditor with approval by the Southern California Association of Governments; BE IT FURTHER RESOLVED that the City Council, City of Lake Elsinore, authorizes the City Manager to act as representative for the City in completing all documents in support of claims for the $107,486. to be used under Article 8 (local streets and roads) of the Transportation Development Act of 1971. DATED: May 17, 1990 CLERK ELSINORE CITY OF (SE.AL) RESOLUTION NO. 91-26 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE DETERMINING THAT A PORTION OF COLLIER AVENUE BETWEEN RIVERSIDE DRIVE AND NICHOLS ROAD IS UNNECESSARY FOR PRESENT OR PROSPECTIVE PUBLIC USE AND VACATING SAID EASEMENT WHEREAS, the City Council of the City of Lake Elsinore desires to vacate alley easement pursuant to the procedures set forth in Streets and Highways Code Section 8320 et seq., said easement being more particularly described as follows: Those portions of Government Lots 3, 4, 5, and 6 of Fractional Section 25, Township 5 South, Range 5 West, San Bernardino meridian, County of Riverside, California being a strip of land 34 feet in width described as follows: Commencing at the intersection of the east line of Section 36, Township 5 South, Range 5 West, San Bernardino meridian and the Rancho La Laguna line of Block "A" of the Rancho La Laguna, as shown by map on file in Book 8 of Maps at page 377 thereof, Records of San Diego County, California: Thence North 46 51' 59" West along said Rancho La Laguna line and the north right of way line of Collier Avenue, a distance 1475.43 feet to an intersection with the south line of said Fractional Section 25; Thence North 89 24' 07" East along said south line of Fractional Section 25, a distance of 43.40 feet to a point in a line parallel with and distant 30.00 feet northeasterly, measured at a right angle, from the Rancho La Laguna line; Thence North 46 51' 59" West along said parallel line, a distance of 251.23 feet to a point therein; Thence North 43 O8' 01" East, at a right angle to said Rancho La Laguna line, a distance of 6.00 feet for the TRUE POINT OF BEGINNING; Thence continuing North 43 08' Ol" East, a distance of 34.00 feet to a point in a line parallel with and distant 70.00 feet northeasterly, measured at a right angle, from the Rancho La Laguna line; Thence North 46 51' 59" West, along said parallel line, a distance of 3612.01 feet; Thence North 89 46' 13" West, a distance of 48.70 feet to a point in a non-tangent curve, concave to the east, having a radius of 750.00 feet, the radial line at said point bears South 45 51' 35" West; Thence southeasterly along said curve, to the left, through a central angle of 02 43' 34", an arc distance of 35.68 feet to the end thereof, said point being in a line parallel with and distance 36.00 feet northeasterly, measured at a right angle, from the Rancho La Laguna line; Thence South 46 51' 59" East along said parallel line, a distance of 3612.01 feet to the true point of beginning. Containing 2.83 acres, more or less. RESOLUTION NO. 91-26 WAEREAS, the City Council of the City of Lake Elsinore adopted a Resolution of Intention setting a time and place for public hearing on said vacation; and WHEREAS, pursuant to that Resolution of Intention, the public hearing has been held and evidence submitted; NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Lake Elsinore as follows: l. That the foregoing recitals are true and correct. 2. That based upon the evidence submitted as said public hearing, the City Council hereby finds that the street easement described in the Resolution of Intention is unnecessary for present or prospective public use. 3. That the street easement more particularly described above is hereby ordered to be vacated. 4. That the City Clerk is hereby ordered to record this Resolution of Vacation in the Riverside County Recorder`s Office. PASSED, APPROVED AND ADOPTED this 26t~lay of March, 1991.
