RESOLUTION NO. 98-1
A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF LAKE ELSINORE, CALIFORNIA
RECOMMENDING APPROVAL OF AMENDMENT NO.1 TO
THE EAST LAKE SPECIFIC PLAN AND ADDENDUM TO
THE FINAL EIR FOR THE EAST LAKE SPECIFIC PLAN -
LIBERTY (TMC COMMUNITIES)
The Planning Commission of the City of Lake Elsinore does resolve as follows:
SECTION 1. The Planning Commission hereby certifies that there has been filed with the
City of Lake Elsinore an amendment application by TMC Communities for the East Lake Specific
Plan, an area which consists of 784 acres of the East Lake Specific Plan area, generally located at
the southwest corner of Malaga Street and Mission Trail; that due notice of said application has
been given and public hearing conducted thereon pursuant to State Planning and Zoning Law and
local ordinance;
SECTION 2. The Planning Commission hereby determines that:
1. SPA No. 1 meets the City's Specific Plan criteria for content and required
implementation of the General Plan established by Section 65450 et sea. of the
California Government Code and Section 17.99 of the City of Lake Elsinore
Municipal Code.
2. SPA No. 1 is consistent with the Goals, Policies and Objectives of the General
Plan; and Redevelopment Plans, and with other applicable plans or policies adopted
by the City.
3. Development standards and regulations contained in SPA No. 1 supersede
applicable City ordinances and codes, unless specifically stated to the contrary.
Approval of SPA No.1 shall not be interpreted as waiving compliance with other
Federal or State laws or City Codes.
4. Location of SPA No. 1 allows future development to be well-integrated with its
surroundings.
5. All vehicular traffic generated by future development, either in phased increments
or at full build-out, will be accommodated safely and without causing undue
congestion upon adjoining streets.
6. Except as limited by State law, including SB 1287, SPA No.1 provides plans which
allows land uses to be adequately serviced by existing or proposed public facilities
and services.
7. Overall design of SPA No. 1 will produce attractive, efficient and stable
development.
8. SPA No.1 will not be detrimental to the health, safety, comfort or general welfare
of the persons residing or working within the City, nor will it be injurious to
property or improvements in the project area or within the City.
9. The Addendum EIR has been prepared, submitted and reviewed in accordance with
requirements of the California Environmental Quality Act and the City's CEQA
guidelines, and is complete and adequate in its evaluation of all environmental
effects of SPA No. 1 and associated discretionary approvals.
10. SPA No.1 will not degrade the quality of the environment, substantially reduce fish
habitat or wildlife species, cause fish or wildlife population to drop, threaten plant
or animal communities, reduce or restrict the range of rare or endangered plant or
animal species, or eliminate important cultural resources.
11. SPA No. 1 will not have the potential to achieve short-term goals to the
disadvantage of long-term environmental goals.
12. SPA No. 1 will not have impacts which are individually limited but cumulatively
considerable.

13. SPA No. 1 will not have environmental effects which cause substantial adverse
effects on people.
SECTION 3. The Planning Commission hereby recommends that the City Council adopt
the East Lake Specific Plan Amendment No.1, based upon the Findings of the Staff Report and
the Conditions of Approval, and recommends that the City Council certify the Final EIR and
Addendum based upon the facts and findings in the staff report and presented at the public hearing.
SECTION 4. The Secretary of the Planning Commission shall certify to the adoption of
this resolution and forward a copy to the City Clerk for reference and consideration of the City
Council.

A RESOLUTION OF THE PLANNING COMMISSION OF
THE CITY OF LAKE ELSINORE, CALIFORNIA,
RECOMMENDING TO THE CITY COUNCIL OF THE CITY
OF LAKE ELSINORE ADOPTION OF GENERAL PLAN
AMENDMENT 98-1 TO CHANGE THE LAND USE
DESIGNATION OF APN 373-071-018 FROM MEDIUM HIGH
DENSITY RESIDENTIAL TO GENERAL COMMERCIAL.
WHEREAS, the General Plan must be periodically updated to meet new conditions and from
time to time be revised or amplified to respond to unforeseen changes or needs; and
WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated the
responsibilities of making recommendations for changes in the General Plan; and
WHEREAS, the applicant desires to amend the General Plan to revise the land use specified
on the General Plan Land Use Map of the Land Use Element relating to a 9.11 acre site from Medium
High Density to General Commercial; and
WHEREAS public notice of said application has been given, and the Planning Commission
has considered evidence presented by the Community Development Department and other interested
parties at a public hearing held with respect to this item on March 4, 1998;
NOW THEREFORE, the Planning Commission of the City ofLake Elsinore DOES HEREBY
RESOLVE as follows:
SECTION 1. The Planning Commission has considered the proposed General Plan
Amendment (GP A 98-1), prior to making a decision to recommend that the City Council approve the
proposed amendment to the 1990 City of Lake Elsinore General Plan. The Planning Commission
finds and determines that Mitigated Negative Declaration 98-1 is adequate under California
Environmental Quality Act (CEQA) to analyze the environmental effects of General Plan Amendment
98-1, and recommends City Council approval, based upon the following findings and determinations:
SECTION 2. That in accordance with State Planning and Zoning law and the City of Lake
Elsinore the following findings for the approval of General Plan Amendment 98-1 have been made
as follows:
1. The proposed General Plan Amendment will not be: a) detrimental to the health, safety,
comfort or general welfare of the persons residing or working within the neighborhood of the
proposed amendment or within the City, or b) injurious to the property or improvements in
the neighborhood or within the City.
2. The proposed General Plan Amendment will permit reasonable development of the area
consistent with its constraints and will make the area more compatible with adjacent
properties.
3. The proposed General Plan Amendment would establish a land use density and usage which
is in character with the subject property's location, access and constraints.
4. The proposed General Plan Amendment will not have a significant effect on the environment.

NOW, THEREFORE, based on the above findings, the Planning Commission of the City of
Lake Elsinore DOES HEREBY RECOMMEND that the City Council of the City of Lake Elsinore
approve General Plan Amendment No. 98-1.

HEREBY RESOLVE as follows:
SECTION 1. The Planning Commission has considered the proposed General Plan
Amendment (GP A No. 98-5), prior to making a decision to recommend that the City Council
approve the proposed amendment to the 1990 City of Lake Elsinore General Plan. The Planning

A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
LAKE ELSINORE, CALIFORNIA, RECOMMENDING APPROVAL OF
THE LA LAGUNA SPECIFIC PLAN NO. 92-4 AND
ENVIRONMENTAL IMPACT REPORT NO. 92-2 - LA LAGUNA ESTATES
The Planning Commission of the City of Lake Elsinore does resolve as follows:

"SECTION 1. The Planning Commission hereby certifies that there has been filed with the City
of Lake Elsinore an application by La Laguna Estates, for adoption of Specific Plan 92-4, which consists
of approximately 489 acres, for a mix of single-family detached, single-family attached, natural open
space, and open space uses. The La Laguna Specific Plan area is bordered by the Cleveland National
Forest to the west and is bisected by McVicker Canyon on the south and Rice Canyon on the north. The
site is located directly west of Grand Avenue and Lincoln Street. Direct access to the site is provided
by McVicker Canyon Road and Sandpiper Court. Due notice of said application has been given and
public hearing conducted thereon pursuant to State Planning and Zoning Law and local ordinances.
SECTION 2. The Planning Commission hereby determines that:
1. The La Laguna Estates Specific Plan meets the City's Specific Plan criteria for content and required
implementation of the General Plan established by Section 65450 of the California Government
Code and" section 17.99 of the City of Lake Elsinore Municipal Code.
2. The La Laguna Estates Specific Plan meets the City's Specific Plan criteria for content and required
implementation of the General Plan established by Section 65450 ~. Of the California
Government Code and Section 17.99 of the City of Lake Elsinore Municipal Code.
3. The La Laguna Estates Specific Plan is consistent with the Goals, Policies and Objectives of the
General Plan; CFD No. 88-3; La Laguna Estates Development Agreement and Funding and
Acquisition Agreement; and with any other applicable plans or policies adopted by the City.
4. Development standards and regulations contained in the La Laguna Estates Specific Plan supersede
applicable City ordinances and codes, unless specifically stated to the contrary. Approval of the
Specific Plan shall not be interpreted as waiving compliance with other Federal or State laws or City
Codes.
5. Location of the La Laguna Estates Specific Plan allows future development to be well-integrated

welfare of the persons residing or working within the project area or within the City, nor will it be
injurious to property or improvements in the project area or within the City.
10. The La Laguna Estates Draft EIR, Mitigation Monitoring Program, Response to Comments
document, Findings and Fact document, Statement of Overriding Considerations, and Habitat
Mitigation Plan have been prepared, submitted and reviewed in accordance with requirements of the
California Environmental Quality Act and the City's CEQA guidelines, and are complete and
adequate in their evaluation of all environmental effects of the Specific Plan and associated
discretionary approvals.

11. The La Laguna Estates Specific Plan will result in unavoidable impact to the visual character and
natural aesthetic value of the hillside and will contribute to cumulative degradation of the air basin.
A Statement of Overriding Considerations was prepared to offset these unavoidable impacts. The
City can approve the Specific Plan even though the Specific Plan will cause significant effects on
the environment, as described in Section 15043 ofCEQA and Sections 21002, 21083, and 21087
of the California Public Resources Code.

12. The La Laguna Estates Specific Plan will not significantly degrade the quality of the environment,
substantially reduce fish habitat or wildlife species, cause fish or wildlife population to drop,
threaten plant or animal communities, reduce or restrict the range of rare or endangered plant or
animal species, eliminate important cultural resources, or significantly affect or be affected by land
use, energy resources, agriculture, seismicity, water quality, traffic, public utilities or services.
SECTION 3. The Planning Commission hereby recommends that the City Council certify
Environmental Impact Report 92-2 based upon the facts and findings in the staff report and presented
at the public hearing and approve Specific Plan 92-4, based upon the findings in the staff report and the
conditions of approval.
