Home My WebLink AboutCC Reso No 1990-015__._ ,,-- ~__ ~ ~.._ ~_ ~_ _ _____ _ _.__ ________ . ___ °~ I RESOLUTION NO. q(1_'IF A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LARE ELSINORE~ CALIFORNIA, REFERENCING PREVAIL- ING WAGE SCALE AND DIRECTING CALL FOR CONSTRUC- TION BIDS WHEREAS, the CITY COUNCIL of the CITY OF LAKE ELSINORE, CALIFORNIA, hae heretofore instituted proceedinga under the provis,ions~of the "Municipal Improvement Act of 1913", being Division 12 of the Streete and Highways Code o£~the State of California, for the constrnction of certain public works of improvement in a special aesessment district known and designated as NORTH- WEST SEWER ASSESSMENT DISTRICT NO. 86-1 (hereinafter referred to as the "Assessment Dietrict"); and, WHEREAS, at this time there have been submitted for final review the plans and epecifications for the works of .improvement for the Assessment District; and, WHEREAS, it ie the intention of the legielative body to aleo call for eealed propoeals or bide for the doing of said work and improvemente in said Aeseesment District; and, WHEREAS, it is necessary to determine the prevailing rate of wages for the various claesificatione of workmen required in the performance of eaid work. / NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the above recitals are all true and correct. 2. That the plane and specifications for the works of improvement in the Asaessment District are~hereby approved and authorized for bidding. / 3. That it is hereby determined and ascertained that the general prevailing rate of per diem wagee in the locality in which said~ work described is to be performed in the matter of the construc- tion of certain public works of improvement, together with appurte- nances, in the Aesessment Diatrict, under the provieions of the "Municipal Improvement Act of 1913", being Division 12 of the Streets and Highways Code o£ the State of California, Por each craft or type of workman or mechanic needed to execute the contract, and also the general prevailing rate for legal holiday and overtime.work of each craft or type of workman or mechanic, ie in accordance with the achedule obtained from the Director of Induetrial Relatione, pureuant to the provisions of Section 1773 of the Labor Code of the State of California, and reference ia hereby made to copies thereof on file with the tranacript of these proceedings, which eaid copies are available to any intereated party upon request. Further a copy shall be posted at each job site during the course of construction. 4. That the propoeals or bids ehall be opened and examined at a public meeting so called; and said results of the bidding ahall be reported at the next regular meeting of thie legislative body after the opening of the bide. 5. That the terms and conditions for bidding on the works of improve- ment for this Aasessment District are as set forth in full in the Bid Documents in the specifications as previously approved. Reference is hereby made to said eid Documents heretofore approved and identified as "NOTICE INVITING SEALED PROPOSALS, NORTHWEST SEWER ASSESSMENT DISTRICT NO. 86-1 (CONSTRUCTION)". For all parti- culars as to bidding, the Notice Inviting Sealed Proposals above referenced and all incorporated documents and laws, including but not limited to the "Municipal Improvement Act of 1913•', shall control. 6. That it is hereby determined that in the event the contractor, contracting owners included, does not complete the work within the time limit specified in the contract or within the time limit ae shall be a~thorized, the contractor or contracting ownere, as the case may be, ehall pay as liquidated damages the amovnt or amounte as set forth in the specifications for the project, said amounte herein referenced and so incorporated. That it ie impractical to determine the actual damage which will be suetained by reaeon of ~ euch delay, but that the atated sum ie a reasonable amount for said liquidated damages and ie not being impoeed as a penalty.
