HomeMy WebLinkAboutPC Reso No 1995 RESOLUTION NO. 95-1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMEND- ING TO THE CITY COUNCIL APPROVAL OF GENERAL PLAN AMENDMENT 94-1 TO AMEND THE CIRCULATION AND HOUSING ELEMENTS OF THE LAKE ELSINORE GENERAL PLAN, INCORPORATE TECHNICAL UPDATES OF OTHER ELEMENTS AND CERTIFICATION OF THE SUPPLEMENTAL ENVIRONMENTAL IMPACT REPORT - WHEREAS, the city of Lake Elsinore desires to create a current well-integrated and consistent General Plan for the city; and WHEREAS, the General Plan must be periodically amended to meet new conditions and from time to time be revised or amplified to respond to unforeseen changes or needs; and WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated the responsibility for making recommendations for changes in the General Plan; and WHEREAS, The City has initiated amendments to the Circulation and Housing Elements of the Lake Elsinore General Plan. The Circulation Element amendment is based on an update of the city's Traffic Model and the need to upgrade various arterial highway classifications in response to projected development traffic demands. Amendment of the Housing Element is necessary in response to State legislation and input from the State Department of Housing and Community Development; and WHEREAS, addi tional technical updates have also been included as clean-up revisions to the General Plan since adoption in November 1990; and WHEREAS, the amended Circulation and Housing Elements have been prepared in accordance with the State of California General Plan Guidelines and Planning and Development Law; and WHEREAS, the Housing Element has been reviewed by the State Department of Housing and Community Development (HCD) and additional information and analysis has been incorporated into the am3ndment in response to HCD's comments; and WHEREAS, Ca~.ifornia Government Code Section 65585(f) (2) allows cities to adopt a Housing Element or Housing Element Amendment without all of the changes recommended by HCD, provided the legislative body includes in its resolution written findings explaining the reasons why the legislative body believes that the element or element amendment substantially complies with the requirements of Article 10.6; and WHEREAS, thE:! r.lanning Com",iF'sion ':.....;::; considered the required Housing Element and Findings,; a":tached as Exhibit "A"; and WHEREAS, the Planning Commission has considered the informaticn contained in the Supplement to the Final Environmental Impact Report for the Lake Elsinore General Plan, certified November 27, 1990. WHEREAS, public notice has been given, and the Planning Commission has considered evidence presented by the community Development Department and other interested parties at a public hearing held on February 15, 1995; NOW THEREFORE, the Planning Commission of the city of Lake Elsinore DOES HEREBY RESOLVE AND RECOMMENDS that the foregoing recitals are true and corr~ct and that the City Council adopt GPA 94-1 amending the Circulation and Housing Elements, accept the technical clean-up revisions, certify the Supplement to the Lake Elsinore General Plan Final Environmental Impact Report and adopt the Statement of Overriding Considerations, based upon the Resolution No. 95-1 Page 2 - following Findings and recommendations: 1. GPA 94-1 and the technical clean-up revisions are consistent with the goals of creating a current, well- integrated General Plan for the City of Lake Elsinore. 2. The Circulation and Housing Element amendments are necessary for the sound future of community development, the preservation of city-wide values and promotion of the general health, safety, welfare and convenience of the citizens of the City of Lake Elsinore. 3. The amendments to the Circulation Element and Housing Element meet the goals, objectives and policies for those elements and these amendments are internally consistent with all other elements of the General Plan; and 4. That the Housing Element substantially complies with state Housing Law, Article 10.6 of the California Government Code, section 65580, et seq, in spite of potential remaining concerns by HCD with respect to unmet housing need, emergency shelters, transitional housing and the Redevelopment Agency Low and Moderate Income Housing Fund. 5. That these findings also include that certain statement of Findings attached as Exhibit "A" for the Housing Element Amendment GPA 94-1 in accordance with Government Code section 65585(f) (2). 6. The Supplemental EIR is prepared in accordance wi th California Environmental Quality Act (CEQA) Guidelines and includes the Draft EIR, Response to Comments, Mitigation Monitoring Program, Findings of Fact and Statement of Overriding Considerations (attached). 7. Measures are incorporated which mitigate or avoid adverse impacts. 8. All reasonable alternatives have been reviewed and considered. 9. Unavoidable impacts are outweighed by the economic, social and other benefits of the General Plan Amendment. The Statement of Overriding Considerations describe how unavoidable impacts are outweighed. PASSED AND ADOPTED by the Planning Commission of the City of Lake Elsinore at a regular meeting held on February 15, 1995, by the following vote: AYES: commissioners: Neff, Matthies, Wilsey, Metze and Bullard NOES: commissioners: None ABSENT: commissioners: None ABSTAIN: commissioners: None -~Z~:::~L) Richard Bullard, Chairman Lake Elsinore Planning Commission ~~ C - ~td ~ P yllis R 9 l::S, Secretary Lake Elsinore ~lanning Commission EXHIBIT "A" HOUSING ELEMENT AMENDMENT GPA 94-1 CITY OF LAKE ELSINORE GENERAL PLAN STATEMENT OF FINDINGS GOVERNMENT CODE SECTION 65585(f) (2) - The City Council of the city of Lake Elsinore hereby finds and determines that the Housing Element amendment substantially complies with the requirements of Article 10.6 of the California Government Code based upon the fOllowing. 1. FINDING - The Housing Element amendment establishes quantified objectives for the production of housing which reflects reasonable expectations over the remainder of the program planning period, 1995 through mid-1996. These objectives, however, differ from the City's assigned share of regional housing needs, unavoidably reSUlting in a lower objective for low and very low income housing, than as forecasted by SCAG, for the balance of the planning period. In its annual progress report filed with the State Department of Housing and Community Development (HCD) on October 1, 1994, the City demonstrated progress in meeting Lake Elsinore's share of the housing need identified in the Regional Housing Needs Assessment (RHNA) forecasts for the SCAG region. Although progress was made, not all of need assigned to the low and very low income housing categories 29% and 19% respectively, was attainable over the period January 1989 to July 1994. Although the development of this and other types of housing is subject to a variety of influences, a significant factor impeding progress is attributed to a decline in the economy of the State and slowdown in the rate of construction in the Southern California marketplace. As discussed in the Housing Element, the quantified objectives for new housing reflect numerical targets which the City of Lake Elsinore can reasonably attempt to attain for the balance of the program planning period. Based on the city's current housing stock, past production data and foreseeable housing trends, a reasonable expectation for the development of low and very low income housing is 30 new units for the period 1995 through mid-1996. This quantified objective is considered the maximum feasible for the balance of the planning period in view of the local and regional economy; limited funding availability from State and Federal affordable housing assistance programs and limited private sector financing for mUlti-family residential projects. The amended Housing Element identifies a series of programs and actions to assist in the provision of affordable housing within the City of Lake Elsinore, including adoption of an Affordable Housing Density Bonus ordinance and increased pursuit and participation in State and Federal housing assistance programs. To ensure that anticipated needs are properly identified and addressed the City further intends to carefully monitor and provide appropriate input to SCAG for the next RHNA update. 2. FINDING - Current programs are adequate to meet the estimated needs of the homeless in the City of Lake Elsinore and adequate sites are available for the provision of emergency shelters and transitional housing. The Housing Element amendment documents the various City and County programs serving the needs of the homeless in Lake Elsinore and, based on available resources, these programs are determined to be adequate in meeting the needs of the estimated 32 homeless persons in the City. The Lake Elsinore General Plan Land Use Element and Zoning Ordinance establish the availability of sites for emergency shelters and transitional housing. As discussed in the Page 2 Exhibit "A" - amended Housing Element, the Zoning Ordinance provides the city with the ability to permit or conditionally pe1'"11lit emergency shelters and transitional housing in certain commercial and residential zoning districts. within the city, the General Plan Land Use Element designates approximately 1,700 acres for various commercial uses and over 500 acres for medium high and high density residential uses. 3. FINDING - The Lake Elsinore Redevelopment Agency has made the necessary findings for the provision of low and moderate income housing and, on that basis, has committed the tax increment funds to public facility proj ects with no need or requirement for set aside to the Low and Moderate Income Housing Fund. California Redevelopment Law requires that the Agency set aside not less than 20% of the tax increment revenues to a separate Low and Moderate Income Housing Fund, unless certain statutory circumstances exist and appropriate findings are made. As discussed in the Housing Element amendment, the Lake Elsinore Redevelopment Agency has made the required findings and alternatively has committed the tax increment funds to public facility projects. Support for this action is substantiated in the findings filed by the Agency, and there has been no factual change in the basis for making those findings, nor is it anticipated for the balance of the program planning period. Due to commitments for bonded indebtness, the Agency's Low and Moderate Income Housing Fund has no funds available at this time. Once the bonds are retired, monies will be available for deposit into the Fund. It is not anticipated that funds will be deposited during the period 1995 through mid-1996. By the year 2000, it is anticipated that the tax increment will have increased to a point where allocation can be made to the Fund. At that time, the Agency will consider the possibility of increasing the amount of set aside from the minimum 20% to a higher percentage, as necessary based on identified need. The discussion provided in the Housing Element is consistent with the AB 1290 Redevelopment and Housing Implementation Plans adopted by the Lake Elsinore Redevelopment Agency on December 6, 1994. 4. FINDING - All remaining information and analysis contained in the Housing Element amendment is in substantial compliance with the requirements of Article 10.6 of the Government Code. The amended Housing Element includes all of the information required by State legislation enacted since adoption by the City in November 1990 and the documentation provided further satisfies the remainder of the input provided by HCD. - RESOLUTION 95-2 A RESOLUTION OF INTENTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, INITIATING AN AMENDMENT TO SECTION 17.23.110 OF THE ZONING CODE (MINIMUM DWELLING UNIT SIZE WITHIN THE R-1 SINGLE-FAMILY RESIDENTIAL ZONING DISTRICT) [ZCA 95-2] - WHEREAS, it has been recognized that there is no current provision within the R-1 Development Standards for minimum dwelling unit sizes regulating the extent to which unit sizes within a proposed development can be downsized in relation to the existing dwelling units in that same development. WHEREAS, the addition of verbiage which requires the weighted average and the smallest unit within a proposed project be 75% the size of the weighted average and of the smallest unit of the existing project, may address the need for specific criteria designed reduce the impacts of downsizing on existing dwellings. WHEREAS, the Planning Commission has researched methods of addressing this issue and subsequently determined that this proposal may be an appropriate solution. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES RESOLVE AS FOLLOWS: SECTION 1: The foregoing recitals are true and correct. SECTION 2: That the 19th day of April, 1995 at 7:00 P.M. is hereby set as the time and date for which a public hearing on ZCA 95-2 an amendment to Section 17.23.110 pertaining to the minimum dwelling unit size within the Single-Family Residential Zoning District will be discussed by the Planning Commission of the City of Lake Elsinore. SECTION 3: The Resolution of Intention shall be published at least ten (10) days prior the hearing dates before the Planning Commission and the City Council.
