Home My WebLink AboutCC Reso No 1991-78RESOLUTION NO. 91- ~g A RESOLUTION OF THE CITY COUNCIL OF LARE ELSINORE~ CALIFORNIA~ ORDERING TERRITORY DESIGNATED ANNEXATION NO. 53~ ANNEXED TO THE CITY OF LARE ELSINORE WITHOUT NOTICE OF HEARING~ AND CONCURRENT DETACHMENT FROM THE ORTEGA TRAILS RECREATION AND PARR DISTRICT WHEREAS, the Riverside County Local Agency Formation Commission of the County of Riverside approved the Reorganization to include Annexation No. 53 to the City of Lake Elsinore (LAFCO # 90-56-1) and concurrent Detachment from Ortega Trail Recreation and Park District, qenerally located southeast of Stoneman Street, northeast of Grand Avenue and northwest of Ontario Way, more particularly described in Exhibit "A" attached hereto and made a part hereof; WHEREAS, the Riverside County Local Agency Formation Commission in adopting its Resolution 95-91 on September 26, 1991, making determinations and approval of said annexation has included a condition authorizing the City Council of the City of Lake Elsinore to approve the annexation without notice or hearing based upon: 1. Commission proceedings were commenced by the petition of South Lake Estates Joint Venture. 2. This reorganization is proposed to provide municipal services by the City of Lake Elsinore. 3. The short form designation of the proposed reorganization is LAFCO No. 90-56-1, Reorganization to Include Annexation No. 53 to the City of Lake Elsinore and Concurrent Detachment from Ortega Trail Recreation and Park District. 4. An Environmental Assessment was made on the proposal and a Negative Declaration filed thereon pursuant to the California Environmental Quality Act. The Negative Declaration has been reviewed and considered. 5. The boundaries of the territory as set forth in Exhibit "A", attached hereto and incorporated herein by this reference, have been approved by the County Surveyor, and are approved. 6. The territory to be annexed is uninhabited, there being fewer than 12 registered voters residing therein. 7. This reorganization is consistent with the City of Lake Elsinore's Sphere of Influence and the spheres of influence of all other affected local agencies. 8. The City of Lake Elsinore is designated as conducting authority and is authorized to proceed without notice, hearing or election. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the foregoing recitals are true and correct. 2. That the City Council does hereby approve Annexation No. 53 (LAFCO 90-56-1) without notice or hearing pursuant to the Government Code.
