Home My WebLink AboutCC Reso No 1991-47RESOLUTION NO. 91-47 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE AMENDING THE BOUNDARIES OF i, COMMUNITY FACILITIES DISTRICT NO. 88-3 AND AMENDING THE PUBLIC REPORT OF COMMUNITY FACILTIES DISTRICT NO. 88-3 WHEREAS, the City Council (the "City Council") of ' the City of Lake Elsinore ("the City") has heretofore on November 14, 1989, duly adopted Resolution No. 89-64 declaring ~ its intention to establish a community facilities district and to levy a special tax to pay for certain public facilities in : and Eor such community Eacilities district under and pursuant to the terms and provisions of the "Mello-ROOS Community Facilities Act of 1982" (the "Act"), being Chapter 2.5, Part i 1, Division 2, Title 5 of the Government Code of the State of California, which such community facilities district was designated as "City of Lake Elsinore Community Facilities District No. 88-3 (West Lake Elsinore)" (the "Community Facilities District"); and WHEREAS, the City Council has heretofore on November 14, 1989, duly adopted Resolution No. 89-65 declaring I its intention to incur a bonded indebtedness in the amount of thirty million dollars ($30,000,000) to finance certain public , infrastructure facilities, including streets, drainage, sewer , and water improvements, fire protection and park facilities, together with necessary appurtenances thereto and site and ' right-of-way acquisition (the "Facilities") within the ' Community Facilities District, such bonded indebtedness to be secured by the levy of a special tax within the Community Facilities District; and WHEREAS, in connection therewith and after due consideration at a public hearing the City Council adopted Resolution No. 89-76 on March 13, 1990, which, among other things, approved a"Public Report Eor Community Facilities District No. 88-3 (West Lake Elsinore)" dated as of December 21, 1989 (the "FuUlic Report"), submitted as part oE the recnrd of the hearing; a~d ' _ _ _ ___ _ - _ _ _ ._ ~ I WHEREAS, a map of the boundaries of the Community ' Facilities District has been recorded in Book 31, pages 39-45 in the Book of Maps of Assessment and Community Facilities I Districts in the County Recorder's Office of the County of Riverside as the boundary map of the Community Facilities District; and , ~ WHEREAS, the boundaries of the Community Facilities , District must now be modified to include less territory than that described in said map and only such land as is within the juxisdiction of the City, and such modification must occur prior to the issuance of bonds by the Community Facilities ' District; and , WHEREAS, an amended map has been prepared and filed with the City Clerk showing the true boundaries of the Community Facilities District; and WHEREAS, an amended "Public Report for Community Facilities District No. 88-36 (West Lake Elsinore)" dated as , of May 1991 (the "Amended Public Report") has been prepared and filed with the City Council to reflect the change in the boundaries of the Community Facilities District and to describe the facilities to be acquired or constructed by the Community Facilities District; WHEREAS, the City Council is fully advised in the premises; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, AS FOLLOWS: Section 1.
