A RESOLUTION OF frEE CITY COUNCIL OF TEE CITY OF ELSINORE FINDING
AND DECLARING THAT A MAJORrry PROTEST HAS NOT BEEN MADE IN #13
LUCERNE ANNEXATION.
WHEREAS, on November 12, 1968 the City Council of the City of
Elsinore, pursuant to Resolution No. 1259 set the 13th day of
January, 1969 at 7:30 o'clock p.m. at the City Hall of the City
of Elsinore, located at 130 South Main Street, Elsinore, California
as the time and place at which any person owning real property within
the territory of Lucerne Annexation #13 could appear before the City
Council of the City of Elsinore and protest against said Lucerne
Annexation #13.
WHEREAS, Government Code Section 35121.1 provides for the
adoption within Thirty (30) days after the closing of the hearing
on protests, of a resolution by the City Council finding and de-
claring whether a majority protest has been made, and
WHEREAS, the City Clerk has advised the City Council that a
ma.jority protest has not been made to Annexation #13,
NOW, THEREFORE, TEE CrI'Y COUNCIL OF 'fEE CITY OF ELSINORE DOES
RESOLVE AS FOLLOWS:
SECTION 1: There has been an insufficient protest to terminate
further proceedings in regard to Annexa.tion #13.

APPROVAL OF CONDITIONAL EXCEPrION V-7
WITH CERTAIN CONDI'fIONS.

6 WHEREAS, the City Council held a public hearing on
7 Conditional Exception V-7, application requesting permission to
8 operate a sand buggy and jeep drag strip in an R (Recreation; District)
10 WHEREAS, no protests were filed with the City
9 zone and;
11 Council;
12 NOW THEREFORE: BE IT RESOLVED, that the City Council
13 does grant the application with the following conditions:

1. The applicant shall control the dust
problem in the area.
2. The applicant shall keep the access street
in good condition by grading.
3. Operation of the track is restricted to
Sundays and Holidays between 10:00 A.M.
and dusk.
4. The use permit is reviewable ev-ery year.

Elsinore, California on the 27th day of January, 1969.

RESOLUTION OF THE CITRUS SELT DIVISION OF LEl\GUE
OF CALIFORNIA CITIES REQUESTING THE ALLOCATION
FORMULA BE AMENDED TO PROVIDE A MORE EQUIT LE
DISTRIBUTION OF THE CIGA~ETTE TAX.
WHEREAS, Section 30462 of the Revenue and Taxation Code provides
that the cigarette tax be al10cated in proportion that sales tax revenue
are transmitted to each county, ci and county and city of the state;
and
WHEREAS, such allocation formula fails to recognize certain
provisions of the Bradley-Burns Uniform Local Sales and Use Tax Law,
wherein certain counties are, pursuant to agreement with cities
within each such county, allocated a percentage of the sales tax
earned within those cities; and
''ilHEREAS, this allocation fGnnula b~Jsed upon percentage of sales
taxes transmitted, has inadvertently failed to provide a uniform
allocation of the cigarette tax revenue; and
'I>JHEREAS, this allocation formula has provided counties with a
greater percentage of cigarette tax revenue that they would otherwise
be entitled; and
WHEREAS, this has penalized those cities that have agreed to
share their sales and use tax revenueS as provided by the BradJey-
Burns Uniform Local Sales and Use Tax Law.
NOW, THEREFORE be it resolved that the Citrus 3elt Division of
the League of California Cities recommend that the League of
California Cities sponsor legislation which will ~lmenc\ Section 30462
of the Revenue and Taxation Code to correct the inequities occurring
by use of the phrase lfsales tal' revenues transmitted."
BE IT FURTHER resolved that this phrase in subsections C(l) and
C(3) of Section 30462 of the Revenue and Taxation Code be amended to
read ilsales tax revenues derived frolll the 1% local Sales and Use Tax
levied. !

RESOLUTION NO. 1274
BE IT RESOLVED that the City of Elsinore, effective February 16, 1969,
requests participation in the Shell Oil Company bulk purchases award
by the Riverside County Board of Supervisors for the purchase of
gasoline, diesel oil, kerosene and stove oil,
BE IT FURTHER RESOLVED that the City Council of the City of Elsinore
approves the following terms and conditions relating to participation in
the county contract on gasoline, diesel oil, kerosene and stove oil:
1. Will make all purchases in its own name, for public use only;
2. Will be responsible for payment directly to the vendor and
for tax liability, and will hold the County harmless therefrom;
3. Has not and will not have in force any other contract for like
purchases.
4. Has not obtained and does not have under consideration written
bids or quotations from other vendors for like purchases.

3 Law 875, 81st Congress, as amended; and
4 WHEREAS. the City of Elsinore is a public entity within said State;
5 NOW THEREFORE, BE IT RESOLVED, by the City Council of the City of
6 Elsinore ~hat the Office of Emergency Preparedness be and hereby is
7 requested to arrange to have the appropriate Federal Agency perform the
8 following emergency work essential to the health. safety or welfare of the
9 people and property of this pmblic entity:
10 To perform essential removal of debri and/or restoration of flood
11 control channel to capacity.

A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF ELSINORE, CALIFORNIA REQUESTING
THAT THE UNITED NATIONS DECLARE THE
STATUTE OF LIMITATIONS NOT APPLY TO NAZI
WAR CRIMINALS.
WHEREAS a large segment of the population of the City of Elsinore
vividly recall the atrocities committed upon their friends and relatives
during the Nazi e~a in Germany and,
WHEREAS Genocide was a policy carried out by the Nazis during that
time,
NOW, THEREFORE BE IT RESOLVED that the Elsinore City Council
respectfully requests that the Statute of Limitations not be applied to
protect Nazi War Criminals.

RESOLUTION NO. 1280
RESOLUTION APPROVING APPLICATION OF THE PROVISIONS
OF SECTION 23 OF THE UNITED STATES HOUSING ACT OF
1937, AS AMENDED, TO LOCALITY.
WHEREAS, under the provisions of Section 23 of the United States
Housing Act of 1937, as amended, the Public Housing Administration is
authorized to provide financial assistance to local public housing
agencies in providing low-rent housing by leasing dwelling units in
existing privately-owneck;,structures; and

nants as hereinafter contained, the parties hereto do agree as
follows:

A. RECITALS: This Agreement is made with regard to the follOW-
ing facts:
1. That the.City council of the city of Elsinore did duly
advertise for bids for Restoration of certain city Streets and of.-
Asphalt pavement Heater-Remix with Asphaltic Resurfacing in the
city of Elsinore, in accordance with Plans and Specifications
entitled "Cash contract No. 1-69" and on file with the city Clerk of
said Ci t.y; and
2 . That the conr actor did fi Ie \;i th said City counc i 1 with-
in the time allowed therefore, that certain proposal, in writing, for
the furnishing of labor and materials for said contract; and
3. That the council determined that Contractor was the low-
est responsible bidder for the furnishing of said labor and materials
for said contract, and his bid having been accepted and all other
bids therefore having been rejected; and
4. That the Notice Inviting Sealed BidS, contractor's Pro-
posal, Bonds, plans, Standard specifications for public works Con-
struction and specifications, all of which are on file in the office
of the city Clerk, true copies of each of said documents are attached
hereto, incorporated herein by this reference, the same being marked
"Exhibits A, B, C, D, and E" respectively, and fully describe the
terms and conditions upon which Contractor is willing to furnish the
labor and materials to construct said contract, as called for by said
Plans and specifications and said proposal and the manner and time
constructing the same.
B. CONTRACT DOCUMENTS: Said Notice Inviting Sealed Bids, Con-
tractor's proposal, Bond5,Plans, Standard specifications for public
works construction and Specifications (hereinafter "contract DoCU-
ments") filed as aforesaid, are made a part hereof, and that the
same do, in all particulars, become the Agreement between the parties
hereto in all matters and things set forth herein and described, and
that both parties hereto hereby accept and agree to the terms and con-
ditions .of said contract Documents sa filed; and said contract

Documents are hereby expressly made a part. of this Agreement as
fully and absolutely as though herein set out in full. .
C. COMPENSATION: The Contractor agrees to perform the work and
the City agrees t.o -pay for said work after completion at the price
set forth in said Proposal, all in the manner and at the times set
forth in said Contract Documents.
D. HOURS OF LABOR: Eight (8) hours constitutes a legal day's
work. The Contractor shall forfeit, as a penalty to the City of
Elsinore, $25.00 for each workman employed in the execution of the
contract by the Contractor or any subcontractor under him for each
calendar day during which such workman is required or permitted to
work more than eight (8) hours in anyone calendar day and forty (40)
hours in anyone calendar week in violation of the provisions of the
Labor Code, and in particular Sections 1810 to 1815 thereof inclu-
sive, except that work performed by employees of Contractors in
excess of eight (8) hours per day and forty (40) hours during anyone
week shall be permitted upon compensation for all hours worked in
excess of eigh~ (8) hours per day at not less than one and one-half
(1-1/2) times the basic rate of pay, as provided in said Section 1815.
E. PREVAILING WAGES: The Contractor shall comply with Labor
Code, Section 1775. In accordance with said Section 1775, the Con-
tractor shall forfeit as a penalty to the City of Elsinore $25.00 for
each calendar day or portion thereof for each workman paid less than
the stipulated prevailing rates for such work or craft in which such
workman is employed for any work done under contract by him or by any
subcontractor under him in violation of the provisions of the Labor
Code, and in particular Labor Code Sections 1770 to 1780 inclusive.
In addition to said penalty and pursuant to said Section 1775, the
difference between such stipulated prevailing wage rate shall be paid
to each workman by the Contractor.
IN WITNESS WHEREOF, the parties hereto have caused these presents to
be executed by their officers thereunto duly authorized and their
seals to be hereunto affixed on the day and year first above written.

WHEREAS the City of Elsinore and Contractor, Holland Paving
Company, Incorporated, have entered into a contract (Cash Contract
No. 1-69) for certain street improvements and storm damage repair,
and;
WHEREAS it is in the public interest and necessity to extend
this contract beyond the lim~ts as provided by the Standard Speci-
fications, and;
WHEREAS the City of Elsinore and Holland Paving Company;
Incorporated have agreed to the particulars of such extension of
said work, and;
WHEREAS the Standard Specifications require a supplemental
agreement to authorize said extra work;
NOW THEREFOR, by signatures affixed hereto; the Contractor
agrees to perform the following extra work at the designated rate .
of compensation by the City of Elsinore:
Site 1 Cash Contract No. 1-69. Place and build up earth embankment
along roadway toe of Railroad Canyon Road from material to
be excavated from San Jacinto River. Contractor to utilize
D-7 Cat. or equivalent, furnished, operated and maintained
at a rate of $20.00 per hour. Test hole for suitability of
local materials to be located by and determination of contin-
uation of operations to be made by the City of Elsinore.

WHEREAS, the City of Elsinore desires to renew an existing note in the

WHEREAS, the First National Bank and Trust Company (Elsinore Branch) is
willing to renew said note to the City of Elsinore, Cal ifornia, upon terms
and conditions as here and after set forth;
NOW THEREFORE BE IT RESOLVED by the Mayor and City Council of the City
of Elsinore, Cal ifornia as follows:
1. That the Mayor and City Council for and on behalf of the City of
Elsinore, California, be authorized to renew said note in the sum of twenty
four thousand, two hundred and sixteen dollars and ninety two cents ($24,216.92
from the First National Bank and Trust Company (Elsinore Branch) for a period
of nine months at an interest rate of not to exceed five (5) per cent per
annum payable as follows:
December 30, 1969 - Payment of $6,000 plus interest.
March 30, 1970 - Quarterly interest payment.
June 30, 1970 - Balance of principle plus interest.
2. That the Mayor and City Clerk be authorized to execute a promissory
24 note on behalf of the City of Elsinore with the First National Bank and Trust
25 Company (Elsinore Branch) as the payee, and to execute any and all other
26 documents to effect the renewal of said note in accordance with the fore-

A RESOLUTION OF THE CITY COUNCIL, ELSINORE,
CALIFORNIA, RECOMMENDING THAT THE ELSINORE
JUSTICE COURT REMAIN IN ELSINORE AND NOT BE
CONSIDERED FOR CHANGE.
5 WHEREAS the Elsinore City Council has considered the effect in the

7 made or a change in service of the court is decreased and,

WHEREAS the City Council has determend that such change would be
detrimental to the people in the area served by the Elsinore Justice
Court and cause the people increased costs if the court were relocated
or services of the Court were decreased.
13 NOW THEREFORE BE IT RESOLVED that the Elsinore City Council recommends
14 to the Riverside County Board of Supervisors that the Elsinore Justice
15 Court not be considered for any change which would decrease the present
16 level of service.

RESOLUTION NO. _J.~98
RESOLUTION OF THE MAYOR AND CITY COUNCIL OF THE
CITY OF ELSINORE, COUNTY OF RIVERSIDE, STATE OF
CALIFORNIA, DECLARING ITS INTENTION OF PROCEEDING
IN THE FORMATION OF A SPECIAL DISTRICT FOR SEWERS,
IMPROVEMENT TO TREATMENT PLANT AND APPURTENANCES.
WHEREAS, it has been determined that the public interest,
convenience and necessity requires the construction of sanitary
sewers and appurtenances and improvemen~s to the sewer treatment
plant;
WHEREAS, it is anticipated that a special assessment
district be formed for the purpose of accomplishing the above pur-
poses, and it is the intention of the Mayor and City Council to
approve the formation of a special assessment district under the
Improvement Act of 1911 or a similar improvement act.
NOW, THEREFORE, THE MAYOR AND CITY COUNCIL RESOLVE AND
DETERMINE AS FOLLOWS:
1. That the public interest, convenience and necessity
requires the construction of sewers and appurtenances together with
the improvement to the sewer treatment plant.
2. That it is the intention of the Mayor and City Council
that a special assessment district be formed to accomplish the above.
3. That the district of the lands to be specially assessed
to pay the costs of said improvements shall be within an area to be
determined at some later date by the Mayor and City Council.
4. That it is the intention of the Mayor and City Council
that proceedings will, in the future, be conducted for said improve-
ments in accordance with the provisions of the Streets and Highway
Code of the State of California under such action as may be determined
at said date.
5. That the City Manager of said city is hereby authorized
and directed to:

(a) Prepare the reports, preliminary plans and
estimates as may be required;
(b) Prepare all resolutions and notices in
connection with the proceedings for the project, all
in accordance with the provisions of the Streets and
Highway Code under such action as may be determined
by the Mayor and City Council; and
(c) Submit any and all expenses, including
engineering costs and other expenditures, to the City
Council which must first be approved by the City
Council before any such expenditure or indebtedness
may be incurred.

ENFORCEMENT OF DIVISION 13, PART 2.1 OF THE HEALTH
AND SAFETY CODE .OF THE STATE OF CALIFORNIA AND OF
THE PROVISIONS OF TITLE 25 OF THE CALIFORNIA ADMIN-
ISTRATIVE CODE PERTAINING TO MOBILE HOME PARKS; AND
TO NOTIFY THE DEPARTMENT OF HOUSING AND COMMUNITY
DEVELOPMENT OF THE STATE OF CALIFORNIA.
WHEREAS, the Mayor and City Council of the City of
Elsinore, California, have determined that said City of Elsinore
should assume the responsibility for the enforcement of Division 13,
Part 2.1 of the Health and Safety Code and the provisions of Title 25
of the California Administrative Code relating to the enforcement

of laws and regulations of mobile home parks.
WHEREAS, pursuant to Section 18,300 of the Health and
Safety Code of the State of California and Section 5022 of the
California Administrative Code, the Mayor and City Council do hereby
assume the responsibility of the enforcement of the mobile home
parks and of the provisions of Division 13, Part 2.1 of the Health
and Safety Code of the State of California and the provisions of
the California Administrative Code pertaining thereto.
NOW, THEREFORE, BE IT RESOLVED, that the City of Elsinore,
California, does hereby assume the responsibility for the enforce-
ment of Division 13, Part 2.1 of the California Health and Safety
Code and related administrative regulations for the enforcement
thereof, and does specifically appoint the City Manager or such
city official as he may designate as the person to whom such
enforcement of the above referred to laws and regulations shall be
specifically delegated; and does hereby make the effective date
for the enforcement of the provisions of the laws and regulations
hereinabove set forth, the 15th day of December, 1969.
BE IT FURTHER RESOLVED, that this resolution is being

BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF
THE CITY OF ELSINORE, CALIFORNIA, AS FOLLOWS:
WHEREAS, the Board of Supervisors of Riverside
County, California, did by resolution in legal session
assembled on October 27, 1958, abandon a certain county
road known as Kuhns Street, said resolution having been
recorded on October 30, 1958, as Instrument No. 78209 in
the County'Recorder's Office of Riverside County, California,
but reserving to itself existing and future public utility,
public service, drainage facilities and street uses pursuant
to Sec.tion 959.1 of the Streets and Highways Code of the
State of California,
WHEREAS, said Kuhns Street was annexed to the
City of Elsinore, Californi~ and said City of Elsinore did
succeed to the interests of the County of Riverside,
WHEREAS, an application has been made by the
INTER-ALIA CORPORATION, a corporation, for an abandonment
of said utility, service, drainage and other matters which
were reserved,
WHEREAS, the City of Elsinore has determined that
it has no present or future interest in said reserved ease- '
ment rights,
NOW, THEREFORE, the Mayor and City' Council do
hereby abandon said rights and do authorize the Mayor and
City Clerk to execute a Quitclaim Deed to the Inter-Alia

Re: Abandonment of easement on Kuhns Street.
The only property owner Involved has requested that the City
abandon this easement so that the pro~erty can be developed.
All utility companies have responded and none object to the
abandonment.
The plot plan showing the area of the easement Is attached
hereto.
The City Attorney has prepared a resolution authorizing the
abandonment and a quit claim deed for transfer of title. ~
Recommendation: That the resolution be approved for abandonment
and authorize quit claim deed be approved.

A RESOLUTION OF THE ELSINORE CITY COUNCIL
AUTHORIZING DEDUCTIONS FROM CITY EMPLOYEES
SALARIES FOR DUES AND OTHER MEMBERSHIP
BENEFITS TO THE EMPLOYEES ASSOCIATION OF
RIVERSIDE COUNTY.
WHEREAS the City Council has reviewed a request from certain
employees who are members of the Employees Associations of Riverside
County to the effect that said employees want the City to deduct from
their salaries an amount specified by the employee and,
WHEREAS such deductions from employees salaries are for membership
dues and other membership privileges such as Credit Union and,
WHEREAS the City Council was informed that membership dues include
a life insurance benefit of not less than $500 per employee.
NOW THEREFORE BE IT RESOLVED that the City Council authorizes
such deductions whenever a city employee has, In writing, authorized
that such deduction be made and that the Association provides the
information to the City not less than 3 days in advance of the closing
of the pay period.
BE IT FURTHER RESOLVED that this resol_*ion be effective January

A RESOLUTION OF THE ELSINORE CITY COUNCIL
ESTABLISHING EMPLOYEE PAY PERIODS AND SPECIFIC
PAY DAYS.

WHEREAS the City Council has reviewed the existing payroll process

and has determined that certain rules should be established governing
5
pay periods and pay days.
NOW THEREFORE BE IT RESOLVED that the pay periods shall be from

the 1st day of each month to the 15th of each month and from the 16th
8
of each month thru the last day of each month and,
9
BE IT FURTHER RESOLVED that pay days shall be the 3rd day of each
month and the 18th day of each month except that if the specified day
falls on a Saturday the pay day shall be the preceeding Friday and if
the specified pay day falls on Sunday the payday shall be on the
following Monday.

RESOLU'l'ION NO. 1303
CITY OF ELSINORE
SELECT SYSTEM MODIFICATION
WHEREAS, a select system of streets for this City has
been established in accordance with Sections 186.3 and
186.4 of the Streets and Highways Code; and
WHEREAS, the CLty Manager has submitted to this Council
a report and map in \\7hich are recommended certain additions
and/or deletions to the select system which are warranted by
changes brought about by annexations, changes in traffic or
land use patterns or other causes of equal necessity which
have occurred since the system was originally established on
September 28, 1964; and
WHEREAS, this Council finds the recommended select
system additions and/or deletions to be necessary for the
expenditure of apportioned Highway Users Tax Funds in the
manner and in accordance with the provisions of the Statutes;
NOW, THEREFORE, BE IT RESOLVED that this Council does
adopt said report and map, and in accordance' with the pro-
visions of Section 186.3 of the Streets and Highways Code
does hereby petition the California Department of pUblic
Works to approve the select system additions and deletions
set forth therein together with such modifications as the
Department may find to be necessary to conform to statutory
requirements.

19 69 , by the City Council of the City of Elsinore, State of
California, by the following vote:
