A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF LAKE ELSINORE, CALIFORNIA
ADOPTING THE CITY SOURCE REDUCTION AND
RECYCLING ELEMENT (SRRE) AND HOUSEHOLD
HAZARDOUS WASTE ELEMENT (HHWE)
WHEREAS, in 1989 the California State Legislature declared the
responsibility of solid waste and household hazardous waste
management to be shared between the State and local governments and
passed the California integrated Waste Management Act of 1989 (AB
939; and
WHEREAS, AB 939 and its amendment AB 2707 require each local
government to make adequate provisions for promoting source
reduction, recycling, environmentally safe waste transformation,
and environmentally safe land disposal; and
WHEREAS AB 939 requires the diversion of 25 percent of solid
waste landfilled by 1995 and 50 percent by 2000; and
WHEREAS the diversion of solid waste within the City of Lake
Elsinore will extend existing landfill capacities within Riverside
County; and
WHEREAS, the source reduction, recycling and composting of
these materials will conserve our natural resources; and
WHEREAS, AB 2707 requires that each municipality in California
prepare a Household Hazardous Waste Element (HHWE) which delineate
what programs are to be utilized to reach stated waste diversion
goals of 25 percent by the year 1995 and 50 percent by the year
2000; and
WHEREAS, the promotion of safe handling and collection of
household hazardous waste is an environmentally sound practice; and
WHEREAS, the City has contracted with Kleinfelder, Inc. to
prepare its SRRE and HHWE, which specify programs for source
reduction, recycling, disposal, and public education for
implementation by the City to achieve the specified waste reduction
goals; and
WHEREAS, the City has monitored the development of the
documents and recommended them for adoption; and
WHEREAS, AB 939 requires that each municipality submit its

SRRE and HHWE to its respective county for inclusion in a County
Integrated WASTE Management Plan to be adopted in the year 1994;
and
WHEREAS, an initial study was conducted to assess potential
environmental effects of the SRRE and HHWE. In compliance with
the California Environmental Quality Act (CEQA) and the State CEQA
Guidelines; and
WHEREAS, based upon the information contained in the initial
study, and all related documents, there is no substantial evidence
that the project could have a significant effect on the
environment, therefore a Negative Declaration has been prepared.
The Negative Declaration adequately addresses the potential
environmental impacts of the project, and satisfies all the
requirements of CEQA, and is therefore approved. The Negative
Declaration reflects the independent judgement of the City Council
and was reviewed and considered prior to approval of the project;
and
WHEREAS, considering the record as a whole, there is no
evidence before the City that the proposed project will have the
potential for an adverse effect on wildlife resources or the
habitat upon which wildlife depends. On the basis of the evidence
in the record, this agency finds that the presumption of adverse
effect contained in Section 753.5 (d) of Title 14 of the California
Code of Regulations (CCR) has been rebutted. Therefore, the
proposed project qualifies for a De Minimis Impact Fee Exemption
pursuant to Section 753.5 (c) of Title 14, CCR.
NOW, THEREFORE BE IT RESOLVED that the City of Lake Elsinore
has complied with the requirements of AB 939, and AB 2707 and that
the City Council does hereby adopt the City of Lake Elsinore
Source Reduction and Recycling Element and Household Hazardous
Waste Element and approves their submission to the Riverside County
Waste Management Department for inclusion in the County Integrated
Waste Management Plan.
