A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF LARE ELSYNORE~ CALIFORNIA, ORDERING.
TERRITORY DESIGNATED ANNEXATION NO. 45,
ANNEXED TO THE CITY OF LAKE ELSINORE WITHOUT
NOTICE OF HEARING AND CONCURRENT DETACHMENT
FROM THE ORTEGA TRAILS RECREATION AND PARR
DISTRICT
WHEREAS, the Riverside County Local Agency Formation
Commission of the County of Riverside approved the Reorganization
to include Annexation No. 45 to the City of Lake Elsinore (LAFCO #
91-48-1) and concurrent Detachment from Ortega Trail Recreation and
Park District, generally located at the terminus of Mountain Street
adjacent to the Lake Terrace Tract, more particularly described in
Exhibit "A" attached hereto and made part hereof;
WHEREAS, the Riverside County Local Agency Formation
Commission in adopting its Resolution 33-92 on May 28, 1992 making
determinations and approval of said annexation has included a
condition authorizing the City Council of the City of Lake Elsinore
to approve the annexation without notice or hearing based upon:
1. Commission proceedings were commenced by the petition of
Golden Castle Plaza Limited.
2. This reorganization is proposed to provide municipal
services by the City of Lake Elsinore.
3. The short form designation of the proposed reorganization
is LAFCO No. 91-48-1, Reorganization to include
Annexation No. 45 to the City of Lake Elsinore and
concurrent Detachment from Ortega Trail Recreation and
Park District.
4. An Environmental Assessment was made on the proposal and
a Negative Declaration filed thereon pursuant to the
California Environmental Quality Act (CEQA). The
Negative Declaration has been reviewed and considered.
5. The boundaries of the territories as set forth in Exhibit
"A", attached hereto and incorporated herein by this
reference, have been approved by the County Surveyor, and
are approved.
6. The territory to be annexed is uninhabited, there being
fewer than 12 registered voters residing therein.
7. This reorganization is consistent with the City of Lake
Elsinore's Sphere of Influence and the spheres of
influence of all other affected local agencies.
8. The City of Lake Elsinore is designated as conduction
authority and is authorized to proceed without notice,
hearing or election.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. That the foregoing recitals are true and correct.
2. That the regular County Assessment Roll is utilized
by the City of Lake Elsinore.
3. That the property affected by Annexation No. 45
will not be taxed for existing general bond
indebtedness of the City of Lake Elsinore.
4. That the City Council does hereby approve
Annexation No. 45 (LAFCO #91-48-1) without notice
or hearing pursuant to the Government Code.

All of the Southeast quarter of the Southeast quarter of
Section 28, Township 5 South, Range 5 West, San Bernardino
Base and Meridian and a portion of the Northeast quarter of
the Southeast quarter of Section 28, Township 5 South,
Range 5 West, San Bernardino Base and Meridian, said portion
being described as follows:
BEGINNING at the Northeast corner of said Southeast quarter
of the Southeast quarter of Section 28;
THENCE North 00° OS' 52" East, along the East line of said
Section 28, a distance of 525.85 feet;
THENCB North 89° 51' OS" West, a distance of 140.64 feet;
THENCE South 23° 51' S7" West, a distance of 142.46 feet to
the beginning of a curve, concave Northwesterly, having a
radius of 484.00 feet;
THENCE Southwesterly along said curve through a central
angle of 33° 07' 35", an arc length distance of 279.83 feet;
THENCE South 56° 59' 32"'West, a distance of 253.34 feet to
the beginning of a curve, concave Southeasterly, having a
radius of 516.00 feet;
THENCE Southwesterly along said curve through a central
angle of 09° 40' 58", an arc distance of 87.20 feet to a
point on the North line of said Southeast quarter of the
Southeast quarter of Section 28, a radial to said point
bears North 430 41' 26" West, said point being distant
657.12 feet from said Northeast corner of the Southeast
quarter of the Southeast quarter of Section 26;
THENCB South 89° 30' 51" West, 663.56 feet along said North
line to the Northeast corner of said Southeast quarter of
the Southeast quarter of said Section 28;
THENCE continuing Southerly, Easterly and Northerly along
the boundary of said Southeast quarter of the Southeast
quarter South 00° 05' 07" East, 1,317.75 feet to the
Southwest corner thereof;
THENCB North 89° 45' 38" East, 1,315.27 feet to the
Southeast corner thereof;
THENCB North 00° OS' 52" East, 1,323.46 feet to the POINT OF
BEGINNING.
The above described parcel contains 44.01 acres, more or
less.
