RESOLUTION NO. 1o89 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELSINORE, CALIFORNIA, ORDERING, CALLING, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, FEBRUARY 26, 1963, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION FOR THE ISSUANCE OF WATER REVENUE BONDS BY SAID CITY. The City Council of the City of Elsinore, California, DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: Section 1. That a special election be held and the same is hereby called to be held in the City of Elsinore, California, on Tuesday, February 26, 1963, for the purpose of submitting to the qualified voters of said city the proposition of issuing water revenue bonds pursuant to the Revenue Bond Law of 19+1 (Chapter 6, Part 1, Division 2, Title 5 of the Government Code of the State of California) in the amount and for the objects and purposes hereinafter set forth, including all expenses incidental thereto or connected therewith. Section 2. That the purpose for which said bonded indebtedness is to be incurred and revenue bonds issued therefor is as follows: The acquisition, construction and financing of extensions of, additions to and improvements of the water system of the City of Elsinore, in- eluding the construction of separate facilities to store, convey and supply mineral water, the construction of reservoirs, pumping plants, water transmission mains, pipelines and appur- tenances and appurtenant works, wells, the acquisition of all water rights, lands, rights of way, easements and other property necessary for any of the foregoing, and including all engineering, inspection, legal and fiscal agent's fees, costs of the bond election and of the issuance of said revenue bonds, bond reserve funds and working capital and bond interest to accrue during the construction period and for a period of not to exceed twelve months after com- pletion of construction, and other costs and estimated costs incidental to and connected with such acquisition, construction and financing. Section 3. That the estimated cost of such acquisition, construction and financing is $400,000. That the principal amount of the bonds proposed to be issued is $400,000. That the maximum rate of interest to be paid on said bonds shall not exceed the maximum rate permitted by law, to wit, six per cent (6 %) per annum, payable semiannually except that interest for the first year may be payable at the end of said year, the actual rate or rates of interest on said bonds to be determined at or prior to the time of the sale or sales thereof. Section 4. That if the proposition for the incurring of bonded indebtedness so submitted receives 2. the requisite number of votes, to wit, the votes of a majority of all the voters voting on the proposition, revenue bonds as provided herein in not exceeding the principal amount stated in such proposition shall be issued and sold for the purpose set forth herein. Said bonds are to be revenue bonds payable exclusively from the revenues of the enterprise and are not to be secured by the taxing power of the City of Elsinore. Section 5. That the enterprise referred to herein is defined to be the entire water system of the City of Elsinore including all improvements and exten- sions later constructed or acquired. Section 6. That the polls for said election shall be opened at seven otclock A.M., of the day of said election and shall remain open continuously from said time until seven otclock P.M., of the same day, when said polls shall be closed, except as provided in Section 14436 of the Elections Code of the State of California, Section 7. That on the ballots to be used at said special election, in addition to any other matter required by law, there shall be printed substantially the following: MARK A CROSS (f) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL.) 3. MUNICIPAL BALLOT SPECIAL MUNICIPAL ELECTIONS CONSOLIDATED CITY OF ELSINORE RIVERSIDE COUNTY, CALIFORNIA Tuesday, February 26, 1963 INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the voting square after the word "YES" or after the word "NO." All marks, except the cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. On absent voter ballots mark a cross (+) with pen or pencil. Section 8. A cross ( +) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the proposition. A cross ( +) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the proposition. Section 9. That the manner of holding the election shall be as provided in this resolution and the manner of voting on the issuance of bonds shall be as provided in this resolution. That in all particulars not herein recited the election shall be held and the votes canvassed pursuant to law for general municipal elections held in the City of Elsinore. Section 14. That for the purpose of holding said special election there shall be and hereby are established four (4) consolidated voting precincts designated as herein- after stated. Each such consolidated voting precinct shall consist of regular election precincts in the City of Elsinore (of the numbers hereinafter stated) established for the hold- ing of state and county elections, as said regular election precincts exist on the date of adoption of this resolution. That the polling places for the respective precincts shall be the places hereinafter designated; and that the persons hereinafter named, being competent and qualified electors and residents of said City and of their respective voting precincts, are hereby appointed officers of election for their respective voting precincts and they shall hold said election and make return thereof in the manner provided by law. 5. Consolidated Voting Precinct No. 1 shall consist of regular election precincts Elsinore Nos. 1 and 8. No other notice of such election need be given. Section 13. This resolution shall take effect upon its adoption. WHEREAS, the Supreme Court of the United States on Mondaur, June 3, 1.963, rendered its decision regarding the allocation of water from the Lower Colorado River Basin; and WHEREAS, said decision greatly reduced the rights of the Metropolitan Water District to such waters; and WHEREAS, because of its low priority, it is foreseeable that the Metropolitan Water District could be deprived of any water from such source during periods of reduced flow; and WHEREAS, the quality of Colorado River water, which has never been good, is steadily deteriorating, the high dissolved solids content being extremely detrimental to many agricultural crops and very costly to water distribution pipelines, equipment and home plumbing; and WHEREAS, the demands of the Citys and County of San Diego, the Citys and County of Riverside, and Citys and County of San Bernardino for an adequate supply of good water are rapidly increading; and WHEREAS, the loss of any part of the present water supply w9.11 greatly impair the health and welfare of the present residents of such areas, even without con - sidoring expansion; and VITF:RE.AS; the P�atber River Project, has been made possible by the vote of the people of California who have approved a bond issue for that purpose; and WHEREAS,, the passage of such bond issue was principally due to the overwhelming support of the people in the three mentioned. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ELSINORE: 1. That pursuant to the provisions of the Annexation of Un- inhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of Elsinore, on its own motion, to annex to the City of Elsinore all that uninhabited territory situate in the County of Riverside, State of California, hereby designated as "Annexation No. 3, North Elsinore," and described as follows: A portion of the North Elsinore Tract and Sections 32 and 33, T 5 S, R 4 W, S.B.B. & M., and more particu- larly described as follows: Beginning at the intersection of the south line of T 5 S, R 4 W, S.B.B. & M. and the Rancho La Laguna line, County of Riverside, State of California, said Rancho line be- ing between Rancho La Laguna corners No. 7 and No. 8; Thence Northwesterly along said Rancho La Laguna line to the intersection with the center line of Second Street of the North Elsinore Tract, as shown in Map Book 5, page 105, Riverside County Records; Thence Northeasterly along the center line of Second Street to the center line of Dexter Ave. of said North Elsinore Tract; Thence Northwesterly along the center line of Dexter Ave. to the intersection with the center line of Central Ave. of said North Elsinore Tract; Thence Northeasterly along the center line of Central Ave. to the intersection with the north line of Section 32, T 5 S, R 4 W, S.B.B. & M. produced Westerly from its Northwest corner; Thence Easterly along said produced line and the north line of Sections 32 and 33, T 5 S, R 4 W, S.B.B. & M. to the Northeast corner of said Section 33; Thence Southerly along the east line of said Section 33 to its Southeast corner, being also the south line of T 5 S, R 4 W; Thence Westerly along said south line of T 5 S, R 4 W to the intersection of Rancho La Laguna line, the point of be- ginning. That the Council of the City of Elsinore desires to annex said uninhabited territory to the City of Elsinore for the follow- ing reasons: The territory is contiguous to the City of Elsinore, and its proposed annexation will contribute to and facilitate the orderly growth and development of the city and the proper development and regulation of the territory proposed to be annexed; will facilitate and contribute to the proper and orderly develop- ment both within the city and within the territory proposed to be annexed and in a manner most conducive to the welfare of said city and said uninhabited territory. 3. That the County Boundary Commission of Riverside County, California, did in session duly assembled on the 29th day of July, 1963, approve the proposed annexation boundaries of said "Annexation No. 3, North Elsinore," as above described and as sub- mitted to said Commission by the Council of the City of Elsinore. 4. That on 1963, at 7:30 P.M. in the council chambers in the City Hall in the City of Elsinore, County of Riverside, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of Elsinore, and having any objections to the proposed annexation, may appear before the Council of the City of Elsinore and show cause why such uninhabited territory should not be so annexed to said City of Elsinore. Such protests must be in writing and may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property effected, and the description and area of such property, in general terms. 5. The City Clerk of the City of Elsinore is hereby author- ized and directed to cause a copy of this Resolution to be pub- fished at least twice, but not oftener than once a week, in Elsinore Valley Sun, a newspaper of general circulation published -2- in said City of Elsinore, the city to which it is proposed to annex the aforesaid territory, and also in the Riverside Enterprise, a newspaper of general circulation published outside the City of Elsinore, but in the County of Riverside, California, the county in which is located the territory proposed to be annexed to the City of Elsinore, said publication to be completed at least twenty (20) days prior to the date set for hearing. 6. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last analyzed County Assessment Roll available on the date the above said proceedings were initiated at the addresses shown on said Assessment Roll or known to the clerk and to and per- son who has filed his name and address and the designation of the lands in which he has an interest, either legal or equitable, with the City Clerk, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 7. In the event any land within the territory proposed to be annexed is owned by the County, the City Clerk is directed to cause written notice of such-proposed annexation to be mailed to the Board of Supervisors of the County, such notice to be given not less than twenty (20) days before the first public hearing on the proposed annexation. 8. In the event there is, upon the land proposed to be an- nexed, a structural improvement owned, being acquired or leased by a County Fire Protection District, the said Clerk is directed to cause written notice of such proposed annexation to be mailed to the governing body of such district, such notice to be sent not less than ten (10) days before the first public hearing upon such proposed annexation. 9. The City Council of the City of Elsinore resolves as follows: SECTION 1. Only in order to comply with the provisions of Section 10.2 of the Collier -Unruh Local Transportation Development Act (Streets and Highways Code Section 186.1), the City of Elsinore hereby adopts a Resolution approving the imposition of additional highway users taxes and fees pursuant to said Act. SFITION 2, The City desires apportionments to be made to it in accordance with provisions of said Section of the Act and is aware of the necessity of conforming to the matching requirements rrescribed by Section 14 of said Act (Streets and Highways Code Section 186.5). SECTION 3. All monies received by the City from the State under the pro- visions of Section 10.2 of said Act shall be paid into the Special Gas Tax Street Improvement Fund and extended exclusively for acquisition of rights - of -;ray for and construction of routes on the select system of city streets established as provided in Section 12 of said Act (Streets and Highways Code Section 186.3).
