HomeMy WebLinkAboutCC Reso No 1993-48RESOLUTION NO. 93-48 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORN;;A, CERTIFXING AN ADDENDUM TU 1~IIE EN1~HtUNMENTAL IMPACT REPORT FUR EAST LAKE COMA7UNITX BUILDERS/CITY OF LAKE ELS1tNURE (EAST LAKE) AND ADOPTING lE'AC7t'S, FINDINGS AND STATEMENT OF OVERITII?ING CONSIDERATIONS REGAI~IaING THE EN'VIRONMIdNTAL EFFECTS OF TIIE PROI'OSEB STADIUM AS SET FORTH IN TIIE FINAL EIR AND ADDENDUM WHEREAS, East Lake Community Builders and the City of Lake Elsinore• have prepared the East Lake Specific Ptan in accordance. with Government Cvde Section fiS4S0 et~ea, providing land use entitlements for approximately 3,000 acres of property, to include a mix of residential, commercial and open space uses along with infrastructure and public service improvea~rents ("Project") and an associated Development Agreement. The East Lake Project is located along the eastern shoreline of I..ake Elsinore and is generally bounded by Lakeshore Drive on the north; hiissioe Trail and Corydon Road on the east, the City boundary )ine on ttre south and the shoreline of Lake Elsinore vn the west, Due notice of public hearings on the Specific Plan and Development Agreement have been given and public. hearings conducted thereon pursuant to the State Planning and Zoning Law and local ordinances. The Cit}' Council and the Redevelopment Agency of the City has proposed to approve the construction of a public minor 1eague• baseball stadium and amphitheater ("Stadium") as included in the specific plan ("Specific Plan"). WHEREAS, the Environmental Impact Report of the East Lake Specific Plan (State Clearing House No. 92092027 ("Final EIR"} has been certified by the• City Council on May 25, 1993, pursuant to the requirements of the California Environmental Quality Act {"CEQA"); and WHEREAS, an Addendum 4o said Environmental Impact Report has been prepared to address the environmental effects and mitigation measures related to a proposed change in location of the Stadium; and WHEREAS, Section 21051 of CEQA and Section 15091 of the CEQA Guidelines required that the City Council make one or more of the following findings prior to the approval of a Project for which an EIR has been completed, identifying one or more significant effects of the Projects, along with statements of facts support each finding; DIN , 1 - Cltangesaralterationswithmitigateoravoidthesiggificantenvironmental effects thereof a identified in the EIR have bcen required or incorporated into the Project. FINDING 3 - Specific, economic, socia8 or other considerations make infeasible the mitigation measures or Project alternatives identified in the Project; WHEREAS, Section 15093(x) of the CBQA Guidelines requires that the Ctty Council balance the benefit cf a proposed project against its unavoidable adverse impacts in determining whether to approve the Project; and WIIEREAS, Section 1S093tb) requires that whore the decision of the City Council allows the occurrences of significant effects which are identified in the Finat EIR but are not mitigated, the City Council must state In writing the reasons to support its action, based on the EIR a:td other information sn the record; and WHEREAS, the City Council by this Resolution adopts the Facts, Findings and Statement of Overriding Considerations regarding the environmental effects of the construction of the Stadium and set forth in the Final EIR and Addendum ("!acts, Findings and Overriding Considerations") set forth as Attachment "A" and incorporated herein by this reference as required by Section 15091 and 15093 of the CEQA Guidelines; and WHEREAS, the City Council has reviewed the Final EiR and Addendum,lfinds that they have been prepared in accordance with the CEQA, and has considered the information contained therein. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. Th.e City Council hereby specifically finds that all of the facts set forth above are true and correct. 2. The City Council does hereby certify the Final EIR and Addendum is complete and adequate ir, that it addresses all of the environmental effects of the proposed Project described herein and fully complies with the requirements of CEQA Guidelines. The Final EIR is composed of the following elements. (a) The Final EIR certified on May 25, 1993 (b) T'he Addendum to Environmental Impact Report for the East Lake Specific flan dated 3uly 1993. (c) City Staff Report dated August 5, 199? (d) All atutchments, incorporations trtd (c) above. 3. The City Council makes the findings in the Facts, Findings and Statement of Overriding Considerations set forth as Attachment "A°' with respect to significant impacts identified in the Final EIR and the Addendum, together with the finding that each fact. in support of the findings is true and is based on substantial evidence in the record, including the Final EiR. a. The City Council finds that the facts set forth in ttte Facts, Findings, and Statement of Overriding Considerations are true and are supported by substantial evidence in the record, including the Final EIR and the Addendum. The Statement of Overriding Considerations is included in the Facts, Findings and State of Overriding Considerations attached as Attachment "A". 5. The City Council finds that the Addendum to the Final EIR and Addendum have identified a1i significant environmental, effects of the amended Froject and there are no known potential environmental impacts not addressed in the Final EtR or Addendum. 6. The City Council finds that all significant effects of the Project are set forth in the Facts, Findings and Statement of Overriding Considerations. 7. The City Council finds thzt although the Final EIR and Addendum identify certain significant environmental effects that will result if the amended Project is approved, all significant environmental effects that will result if the amended Project is approved, all significant effects that can be feasibly mitigated or avoided have been reduced to an acceptable level by the imposition of mitigation measures on the approved Project. Mitigation measures are incor}wration into conditions of approval to the Specific Plan. 6. The City Councit finds that potential mitigation measures or project alternatives not incorporated into the amended Project were rejected as infeasible, based upon specific economic, social or other considerations as set forth in the Facts, Findings and Statement of Overriding Considerations set forth on Attachment "A". 9. The City Councils finds that the unavoidable significant impacts of the Project as identified in the Facts, Findings and Statement of Overrid'ng Considerations, which have not been reduced to a level of insignificance have been substantially reduced in their impacts by the imposition of mitigation measures on tl•~e approved Project, Mitigation measures are incorporated into conditions of approval. vote; a ~, `i'he City Council finds that the remaining unavoidable significant impacts are clearly outweighed by the econoinic, social and other benefits of the amended Project as set forth in the Statement of Overriding Considerations set forth on [ilt?chment "A". 11. The City Council finds that the Finat EIR and Addendum have been prepared, submitted and reviewed in accordance with the requirements of CEQA and the CEQA Ciuidelines, that the Council has considered the information contained in the Final EIR and Addendum, that the Final EIR and Addendum to the EIR are complete and adequate and that they address atl environmental effects of the Project and all discretionary approvals required therefor.
