Home My WebLink AboutCC Reso No 1993-34RESOLUTIONNO. 93 -34 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE APPROVING AMENDMENT TO CONSTRUCTION MANAGEMENT AND SUPERVISION AGREEMENT RELATING TO COMMUNITY FACILITIES DISTRICT NO. 90-3 (NORTH LAKE ELSINORE HII.IS PUBLIC IMPROVEMENTS) AND AUTHORIZING AND DIRECTING THE EXECUTION AND DELIVERY THEREOF City of Lake Elsinore Community Facilities District No. 90 -3 (North Lake Elsinore Hills Public Improvements) RESOLVED, by the City Council of the City of Lake Elsinore (the "City ") that: WHEREAS, the City, for and on behalf of the City of Lake Elsinore Community Facilities District No. 90 -3 (North Lake Elsinore Hills Public Improvements) (the "District "), has entered into a Construction Management and Supervision Agreement, dated as of February 1, 1993 (the "Agreement ") with Public Construction, Inc. (the "Company "), related to the acquisition of certain public improvements necessitated by development occurring within the District; and WHEREAS, the Company has requested that the City agree to an Amendment No. 1 to Construction Management and Supervision Agreement (the "Amendment ") between the City and the Company, in order to allow the acquisition of public improvements to occur thereunder in a more timely fashion, and City staff and consultants have reviewed the Amendment and have recommended that it be approved by this City Council; and WHEREAS, this City Council now desires to. approve the Amendment and authorize and direct its execution and delivery, in the public interest. NOW, THEREFORE, IT IS HEREBY ORDERED as follows: 1. The Amendment, in the form on file with the City Clerk, is hereby approved. The Director of Administrative Services is hereby authorized and directed to execute and deliver the Amendment in such form, together with such additions thereto or changes therein as the Director of Administrative Services shall approve upon consultation with the City Attorney and Bond Counsel to the City for the District, the approval of such additions or changes to be conclusively evidenced by the execution and delivery by the City of the Amendment. 2. This Resolution shall take effect upon its adoption. (the "Developer "), WITNESSETH: WHEREAS, the City, for and on behalf of the District, and the Developer have entered into a Construction Management and Supervision Agreement, dated as of February 1, 1993 (the "Agreement "), providing for the acquisition by the City from the Developer of certain public improvements described therein; and WHEREAS, the City and the Developer now desire to amend the Agreement as provided herein to allow the acquisition of public improvements thereunder to occur in a more timely fashion. NOW, THEREFORE, in consideration of the foregoing and for other consideration the receipt and sufficiency of which is hereby acknowledged, the parties hereto do hereby agree as follows: Section 1. The Agreement is hereby amended by deleting Exhibit A thereto and inserting therein, in lieu thereof, Exhibit A hereto which Exhibit is, by this reference, incorporated herein. Section 2. Except as amended pursuant to Section 1 above, the terms and provisions of the Agreement are hereby ratified and confirmed. Section 3.
