RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF EJ;..S!NOltl ADOPTING BUDGET AND APPROVING
'IR3~l)~.MtAGREEMENT FOR EXPENDITURE OF
FONDS ALLOCATED UNDER SECTION 2107.5 OF THE STREETS
AND HIGHWAYS CODE

THEREFORE, be it resolved by the city council of the

that said project statement
be and it is hereby adopted as the budget ot proposed
expenditures of the engineering allocation to cities, and
said agreement be and the same is hereby approved and the
mayor and the city clerk are directed to sign the same on
behalf of said city, said agreement to be binding upon the
city upon its execution by the authorized officials of the
State.

WHEREAS The Ortega Rroperty ewners AS6ociat~on has called to the attention
of the OOllncil fo the fact that a rock quarry has teen established adjacont to
the Ortega Highway and that due to the enormous suoply of rock ~"vailableJ other
industries of thi.s type are contemplated, and
WHEREAS The Ortega Highway with its natural scenic beauty', is the onl;"
highway in the area offering such scenery to the motorist and it being the
principal traffic artery between the southf'!tTl portion of the Pacific Coast
H:lghway and the reoreational facilities of Elsinore Vdley, which are in the pro
cess of being enlarged uDon, and
,WHEREA-S This roadway was not designed to accomodate the type of traffic
ine~dent to tlle operation this industry, and its m:ontinued use by such traffic
would impair its value as a scenic route~
THEP..EFOR BE IT RESOLVEnt By the City Council of the City of Elsinore that
we are in accord with the Ortega Property Owners Assoc:l ation and support them
in protesting the granting permission for additional industries .,r this type
along this route,

Pottery and Flint street~ adjacent to Riley Street, is perennially filling
with vegetation and debris, ~!d
~1!-rRRE.AS The cleaning of tMs ditch and culverts is a source of continous but
necessary expense to the City to protect the entire area from serious
damage in flood periods, and
WHEREAS The Wasserman Canyon outlet annually deposits sand and debris at
its confluence with the "Temescal Ditch U at the present time said deposits
appear to be as high as the 1915-16 flood level, and

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELSINORE
AUTHORIZING EXECUTION OF AGREEMENTS FOR CONSTRUCTION OF A
MINERAL WATER SYSTEM AND THE DELIVERY OF SUCH WATER.
WHEREAS the City of Elsinore operates two wells which
produce water commonly referred to as "mineral" water, and such
water has heretofore constituted the sole supply for the City
for all domestic, municipal and commercial uses, and
WHEREAS the Department of Public Health of the State
of California has advised the City that the fluoride content of
the water from these wells exceeds the standards set forth in
the U.S. Public Health Service Dripking Water Standards, 1946,
which have been adopted by the Department, and the Department,
therefore, cannot approve this mineral water in undiluted form for
a drinking water supply for the City of Elsinore, and
WHEREAS the City of Elsinore has applied to the Board
of Public Health of the State of California, pursuant to
Sections 4010 to 4035 of the Health and Safety Code, for a permit
to use such mineral water for domestic water supplied to the
people of the City of Elsinore, and such permit has been refused
unless the fluoride concentration in such water is reduced to
1.0 parts per million, and
WHEREAS the City has conducted an engineering study
of the adequacy of tHese wells to ~UPply the City for all purposes,
and it has been determined by this study that the operating wells
of the City are no longer adequate to meet the needs of the
inhabitants for all purposes, and
WHEREAS a number of commercial establishments such as
bathhouses, hotels, apartments and motels have in the past
utilized the unique properties of the mineral water in the
development of their businesses, and such establishments

contribute substantially to the general welfare and prosperity
of the entire City of Elsinore, and
WHEREAS it is the desire of the City Council of the
City of Elsinore to make the mineral water of the City available
to commercial establishments in the City relying upon the use
of this water, in such way as to contribute to the general good
of all the people of the City,
BE IT THEREFORE RESOLVED by the City Council of the
City of Elsinore as follows:
Section 10
The City Administrator be, and he hereby
is, authorized and directed to execute on behalf of the City
of Elsinore agreements with property owners operating
commercial establishments relying upon the use of mineral
water, and where the continued use of such water would con-
tribute to the general good of the whole City, in substantially
the form of agreement set forth in Exhibit "All attached hereto
and made a part hereof.
Section 2.
The amount of money which any property
owner entering into such an agreement shall be required to pay
shall be determined by the following schedule:
(a) The actual cost of furnishing and installing
all meters which may be required.
(b) For motels, apartments and other similar
establishments, $100.00 for each living unit
contained therein to which mineral water will be
made available pursuant to the terms of the agree-
ment, as set forth in Exhibit "All.
(c) For bathhouses which are not operated in
connection with a hotel or other lodging facilities,
$100.00 for each bathtub to which the mineral water

will be made available pursuant to the terms of
the agreement set forth in Exhibit "A".
Section 3.
All funds deposited pursuant to said agree-
ments shall be held in a separate account of the City until such
time as it is determined by the City Council that there is
enough interest in this project to make it economically feasible
and in the general public good.
If such determination by
Resolution of the City Council has not been made by March 15,
1958, then all such funds received by the City pursuant to these
agreements shall be promptly refunded.

WITNESSEl'H:
WHEREAS the City owns three wells, two of which have been oper-
ated to produce water commonly referred to as "mineral!! or "sulphur"
water, and such water has heretofore constituted the sole supply for
the City for all domestic, municipal andcornmercial uses, and
WHEREAS a number of commercial establishments such as bath
housea"hotels, apartments and motels have utilized the unique prop"
erties of this water in the development of their businesses, and
such enterprises contribute substantially to the general welfare
and prosperity of the entire City, and
~mEREAS engineers have reported that the operating wells are no
longer adequate to meat the needs of the inhabitants of this City
for all purposes, and furthermore the mineral water in undiluted
form does not neet the standards of the United states Public Health
Service for domestic drinking purposes, and
WHR~EAS another supply of potable water is now available to the

WHEREAS the City owns three wells, two of which have been oper-
ated to produce water commonly referred to as "mineral!! or "sulphur"
water, and such water has heretofore constituted the sole supply for
the City for all domestic, municipal and commercial uses, and
WHEREAS a number of ornnmercial establishments such as bath
houses~hotels, apartments and motels have utilized the unique prop-
erties of this water in the development of their businesses, and
such enterprises contribute substantially to the general welfare
and prosperity of the entire City, and
WHEREAS engineers have reported that the operating wells are no
longer adequate to meat the needs of the inhabitants of this City
for all purposes, and furthermore the mineral water in undiluted
form does not meet the standards of the United stntes Public Health
Service for domestic drinking purposes, and
VffiRBEAS another supply of potable water 1s now availnble to the
City from the Elsinore VnlJ.ey lVIunicipal Water District, and

AUTHORIZING EXECUTION OF AGREEMENTS FOR CONSTRUCTION OF A

BE IT RESOLVED by the City Council of the City of
Elsinore that its Resolution No. 937 of February lO~ 1958~ is
hereby reaffirmed and incorporated herein~ except insofar as
it may conflict with this Resolution~ and the City Administrator
is hereby authorized and directed to execute on behalf of the
City of Elsinore agreements in substantially the form of Exhibit
A attached hereto~ and upon the same terms and conditions set
forth in Resolution No. 937.

WITNESSETH:
WHEREAS, the City owns three wells, two of which

constituted the sole supply for the City for all domestic,
municipal and co~aercial uses, and
WHEREAS, a number of cormnepcial establishments, such
as bath houses, hotels, apartments and motels, have utilized
the unique properties of this water in the development of
their businesses, and such enterprises contribute substantially
to the general welfare and prosperity of the entire City, and
WHEREAS, engineers have reported that the operating
wells are no longer adequate to meet the needs of the in-
habitants of this City for all purposes, and furthermore, the
mineral water in undiluted form does not meet the standards
of the United States Public Health Service for domestic
drinking purposes, and

available to the City from the Elsinore Valley Municipal Water
District, and
WHEREAS, it is the desire of the parties to make the
mlneral water of the City available to commercial establishments
in the City relying upon the use of this wat'er and contributing
to the general good of all the people of the City, upon terms

hereinafter set forth,
IT IS THEREFORE AGREED between the parties in con-
sideration of their mutual promises, as follows:
1. The Property Owner upon execution of this
agreement shall deposit with the City the sum of $.
to be held in a separate account by the City untii such time
as this agreement becomes effective. If this agreement does
not become effective by March 15, 1958, then the money shall
be promptly refunded to the Property Owner. If this agreement
is made effective, as set forth in paragraph 2 below, then
the deposit shall become the property of the City and shall
be used for the purpose of constructing the mineral water
system hereinafter described.
2. This agreement shall become effective, and the
City shall forthwith proceed with necessary construction,
when a sufficient n~~ber of persons have entered into agree-
,
ments of this kind to make the project economically feasible
and in the general public good, and the City Council has
passed a resolution declaring the agreement effective and
authorizing construction.
3. The estimated completion date for construction
is four months after commencement. Water shall not be
de1ivered to any person signing this agreement untiil the unit
under construction is completed and all users within that area
can be served simultaneously.
4. In consideration of this payment by the Property
Owner, the City shall comn~nce and diligently proceed to
construct a water supply main from its mineral wells and
reservoir to the property located at
in accordance with the plans and specifications on file in the
office of the Elsinore City Clerk, which are hereby adopted and

Inade a part hereof. The pipeline installed by the City shall
run to the property line only, and all connections thereto shall
be made by the Property Ownel' at his own expense J and shall be
subject to approval by the City Building Inspector. The
connection by the Prope~ty Owner shall be made only to hot
water heaters and cold water faucets for bathtubs and showers
on the premises. Construction shall commence at the corner of
Spring and Flint Streets. The City shall also install a water
meter at no additional cost to the Property Owner. All parts
of the water system constructed and installed by the City to
the point of connection by the Property Owner shall remain the
property of the City. Upon completion of the system and
connection thereto by the Property Owner, the City shall
supply undiluted mineral water to the Property Owner at the
address given above, upon terms and conditions and at rates
hereinafter set forth.
5. I).'he rate at which mineral \'later shall be sold and
delivered to all users shall be determined by and under the
control of the City Council of the City of Elsinore, but shall
be based upon the cost of construction and modification to
existing facilities to permit delivery of the mineral water,
the amount necessary for operation, r~intenance, depreciation
and reserves for expansion of the system, and a reasonable
profit.
6. The mineral water shall not be used by the
Property Owner, nor by any other person to whom the water is
made available, for ordinary domestic purposes, but its use
shall be restricted to commercial purposes only.
7. The City agrees to use its best efforts to
produce as much mineral water as reasonably can be produced in
order to serve the customers on this mineral water system.
The City shall keep all parts of the system in good condition

and repair, and shall take all reasonable measures under
accepted engineering practices to increase the mineral water
supply where practicable and necessary in order to meet the
water demand on this system. The City shall permit inspection
of the mineral water system and wells by ahy qualified, licensed
engineer of the Property Owner.
8. Subject to the provisions hereinafter set forth,
thisag~eement shall continue in force for a period of twenty
years, and for so long thereafter as the mineral water can be
produced from the wells of the City in paying quantities.
9. It is the intention of the City to make its
mineral water supply available to the Property Owner, in comnon
with all bther present and future users under similar agreements
so long as the supply i3 adequate and to the extent that the
needs and welfare of all of the inhabitants of the City permit.
The City by this agreement does not allocate or dedicate to the
Property Owner, or any person claiming under him or using the
mineral water through him or by virtue of this agreement, all
or any part of the mineral water supply of the City. It is
understood that the mineral water in diluted form presently
constitutes part of the City's supply, and in the future it
might become necessary to use i.ncreased amounts, or all of
the mineral water supply, to meet the general needs of the
City and its inhabitants if water should not be reasonably
available from the Elsinore Valley Municipal Water District
or other supplemental source.
10. Failure to pay water charges or to abide by any
of the prOVisions of this agreement may result in disconnection
of the mineral water supply.
11. This agreement shall inure to the bene~it o~ and
be binding upon the heirs, administrators, executors, assigns
and successors of the parties hereto. The City shall defend

in accordanoe with the law any taxpayer's suit brought against
it on account of this agreement.

may conflict with this Resolution, and the City Administrator
is hereby authorized and directed to execute on behalf of the
City of Elsinore agreements in substantially the form of Exhibit

WITNESSETH:
WHEREAS, the Cit,- awns three wells, two af which have been operated
to produce water cOllmlonly" referred to as "mineraltt or "sulphurft water, ad
such water has heretefore constituted the sole supply" fer the City for all
domestic, Municipal and cemmercial uses, and
WHEREAS, a number of cOllmlercial establishments, such as bath houses,
hotels, apartments and motels, have utilized the unique properties of this
water in the development of their businesses, and such enterprises contribute
substam.tial1J' to the general welfare and prosperity of th entire City, and
WHEREAS" engineers have reported that the operating wells are
no longer adequate to meet the needs of the i1i1habi tants of this City for
all purposes, and furthermore, the mineral water in undiluted form. does
not meet the standards of the United states Public Health Service for
domestic drinking purposes, and
WHEREAS, another supply of potable water is now available to the
City from the Elsinore Valley Municipal Water District, and
WHEREAS, it is the desire of the parties to make the mineral water
of the City available to commercial establishments in the City relying upon
the use of this water and contributing to the general good of all the people
of the City, Up011 terms hereinafter set forth,
IT IS THEREFORE AGREED between the parties in consideration of
their mutual promises, as follows:
/8 rhe Property Ower shall deposit with the City the .... of
$ , as his share of the cost of the mineral water system
hereinafter referred too This amount shall be held in a separate account
by the City until such time as this agreement becomes effective. At least
sixty percent (~%) 0f this sum shall be deposited UPOD execution of this
agreement, and the balance shall be paid within thirty (30) days thereafter,
provided that in no event shall a water meter be installed or water delivered
pursu.ant to this agreement until the full amount due hereunder has been paid.
If this agreement does not become effective by April 15th, 1956, then all
money. deposited heretmder shall be promptly refunded to the Properly Owner.
If this agreement is m.cide effective, as set forth in paragraph. 2 below, then
all funds deposited shall become the property of the City and shall be used
for the purpose of constructing the mineral water system hereinafter described.
2. '!'his agreement shall become effective, and the City shall
forthwith proceed with necessar.y construction, when a sufficient number of
persons, have entered inte agreements of this kind to make the preject
ecomomically feasible and in th.e general public good, and the City Council
has passed a resolution declaring the agreement ef~ective and authoriziDg
construction.
G The estimated completion date for construction of the system
is four months after commencement thereof. Water from the mineral water
system shall be made available simultaneously to all Property Owners signing
agreements of this kind, and thereshall bene preferred treatment of any
person ar group af Property Owners on the basis of quantity of water available,
or the time of commencement of deli very of water from the proposed system.
@ In consideration of this payment by the Property Owner, the
City shall commence and diligently proceed to construct a water supply main
from its mineral wells and reservoir to serve mineral water te
units located at
, in accordance with the
plans and specifications on file in the office of the Elsinore City Clerk,
which are hereby adopted and made a part hereof. The pipeline installed. by the
City shall !"IJ.B to the property line only, and all connections theret0 shall
be made by the Property Owner at his own expense, and. shall be subject tg
approval by the City Building Inspector. The connection by the Property Owner
shall be made only to hQt water heaters and cold water faucets for bathtubs
and showers on the premises. Construction shall commence at the corner of
Spring and Flint streets. The Oi ty shall also install a water meter at na
additional cost to the Property Omter.
All parts of the water system constructed and installed by the City to the
point of connection by the Property Owner shall remain the property of the
City. Upon completion of the system amd connection thereto by the Property
Owner, the Oi ty shall su.ppq undiluted mineral water to the Property owner
at the address given above, upon terms and conditions and at rates hereinafter
set forth.
~ For the first year after water is first delivered threugh this
system, the rate at which mineral water shall be sold and delivered to all users
shall be as follows: $3.50 for the :f:'irst 1000 cubic feet, or any part thereof,
and 35 cents for each 100 cubic feet, or faraction thereof, over 1000 cubic
feet. At the end of the year, the mineral water rates shall be adjusted by
the City and the rafter set at an amount necessar,y for the operation, maintenance,
depreciation and reserve for expansion of the mineral water system, the
reeover,y of the cost of construction and modification to existing facilities
to permit delivery of the mineral water, and a reasonable return upon. the
investment of the City.
@ The mineral water shall not be used by the Property Owner,
by any other person to whom the water is made aVailable, for drinking
nor
purposes, or other internal human use or consumption.
7. The City agrees to use its best efforts to produce as much
mineral water as reasonably can be produced in order to serve the customers
on this mineral water system. The City shall keep all parts of the system in
good condition and repair, and shall take all reasonable measures under
accepted engineering practices to increase the mineral water supply where
practicable and necessar,y in order to meet the water demand on this system.
The City hsall permit inspection of the mineral water system and wells by
any qualified, licensed engineer of the Property Owner.
8. Subject to the provisions hereinafter set forth, this agreement
shall continu.e in force for a period of twenty years, and for so long there-
after as the lmineral water can be produced .from the wells 0.1' the City in
paying quantitieso
9. It is the intention of the City to make its mineral water
supply available to the Property Owner, in COIlllTlon with all other present
and future users under similar a.greements so long as the supply is adequate and
to the e:x:tent that the needs and welfare of all of the inhabitants of the City
permit. The City by this agreement does not allocate or dedicate to the Property
1WDer or any person claiming under him or using the mineral water through him
or by virtue of this agreement, all or any part of the mineral water supply of
the City. It is undarstood that the mineral water in diluted form presently
constitutes part of the City's supply, and in the future it might become necessary
to use increased amounts, or all of the mineral water supply, to meet the general
needs of the City and its inhabitants if water should not be reasonably available
from the Elsinore Valley Hunicipal Water District or other supplemental source.
ICl. Fro.lure to pay water charges or to abide by any of the provisions
of this agreement may result in disconnection of the mineral water supplyo
G This agreelllBnt shsll inure to the benefit of and be binding
upon the hairs, administrators, executors, assigns and successors of the parties
hereto. The City shall defend in accordance with the law any taxpayer's suit
brought against it on account of this agreement. In the event the City is permanentlj
enjoined and restrained by any Court of Competent Jurisdiction from proceeding
wi th its obligations pursuant to this agreement, then the money paid hereunder
shill be refunded, insofar as it has not been spent om the mineral water system.
In such event all unexpended funds still held by the City shall be pr0portionately
refunded to all periJons executing agreements of this kind.

RESOLUTION OF THE CITY COUNCIL OF THE

ADOPTING BUDGET AND APPROVING
MEMORANDUM OF AGREEMENT FOR EXPENDITURE OF
GAS TAX ALLOCATION FOR MAJOR CITY STREETS.
WHEREAS, a memorandum of agreement has been presented to be
entered into with the State of California in accordance with a
project statement submitted by the City of Ilat....
for expenditure of the gas tax allocation to cities for the
fiscal year 1'~9 , and
WHEREAS, the city council has heard read said agreement in
full and is familiar with the contents thereof;
THEREFORE, be it resolved by the city council of the City of
Il.~.. that said project statement be and
it is hereby adopted as the budget of proposed expenditures of
the gas tax allocation to cities, and said agreement be and the
same is hereby approved and the mayor and the city clerk are
directed to sign the same on behalf of said City, said agreement

AUTHORIZING THE SALE AND DELIVERY OF MINERAL WATER FROM THE
4 WELLS OF THE CITY FOR NON -DRINKING USES.

WHEREAS the City of Elsinore owns certain wells which
produce water, commonly known as "mineral" water, and

WHEREAS this water has a fluoride concentration of
between 3.0 and 4.0 ppm, and the State of California Department of
Public Health has stated by letter dated January 23, 1958, "There-
fore, the department cannot approve of a drinking water supply at
Elsinore having a fluoride concentration in excess of 1.0 p.p.m.1I
WHEREAS a number of commercial establishments such as

bathhouses, hotels, apartments and motels have utilized the
unique properties of this water in the development of their

businesses, and such enterprises contribute substantially to the
general welfare and prosperity of the entire City, and
WHEREAS it is the purpose of this resolution to make
such water available to these businesses for bathing purposes,

BE IT RESOLVED by the City Council of the City of
Elsinore as follows:

1. That the water department of the City of Elsinore be

authorized to sell and deliver mineral water upon conditions
hereinafter stated from the wells of the City to users within the
City of Elsinore.
2. That such water shall be sold for bathing and commercial
purposes only, and shall not be sold to anyone using the water or
permitting it to be used for drinking purposes.
3. That the water shall be sold in units of 1000 gallons,
and the minimum sale for delivery of such water shall be 1000
gallons.

That the water be sold and delivered to customers at the

well site, or subject to the availability of City equipment and
personnel, it be delivered to the purchasers at any place of use in
the City of Elsinore.

That the rates at which such water shall be sold shall be

determined from time to time by the City Council of the City of

Elsinore, and until further action, such rates are hereby set at

If the City delivers the water to the customer at any place other
than the well site, the actual cost of such delivery shall be added

Elsinore.
That all mineral water sold and delivered hereunder
shall be received by the purchaser in clean and wholesome containers
or tanks, and the City reserves the right to refuse delivery where
such conditions do not exist.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ELSINORE
AUTHORIZING AN INVESTIGATION OF RECENT CHARGES CONCERNING CITY
GOVERNMENT.
WHEREAS, Recently there have been made certain charges
that the Chief of Police of the City of Elsinore and other charged
with enforcement of the law, have not carried out the obligations
of their offices; and
WHEREAS, There have been circulated in the City
certain anonymous publications concerning allegations of a
Communist attempt to control City Government; and
WHEREAS, there have been committed certain acts of
vandalism in the City involving symbols of the Communist Party
and the Klu Klux Klan;
BE IT RESOLVED by the City Council of the City of
Elsinore that the Mayor be and she hereby is authorized to appoint
a committee to investigate and report to the Council upon the
following matters:
(1) Whether the Chief of Police has taken all
diligent measures to determine the persons
responsible for the recent acts of vandalism
and anonymous publications being circulated
within the City;
(2) Whether the Communist Party or any members
thereof or sympathizers therewith, are
involved in efforts to affect City Government
by illegal or subversive measures or through
the use of false or malicious information.

OF MINERAL WATER.
BE IT RESOLVED by the City Council of the City of
Elsinore that the City Administrator be and he hereby is
authorized to execute on behalf of the City agreements for
the sale and delivery of mineral water by tank truck delivery
in the form attached hereto as Exhibit "A" and made a part
hereof.
BE IT FURTHER RESOLVED that this Resolution and the
terms of said contract shall supercede Resolution No. 955
insofar as they may be in conflict.

TANK TRUCK DELIVERY AGREEMENT
AGREEMENT made this

between the CITY OF ELSINORE~ a Municipal Corporation, herein-
after called the City, and
hereinafter called the Purchaser.

WIT N E SSE T H:

WHEREAS the City Council of the City of Elsinore by
Resolution No. 955 has authorized the sale and delivery of mineral
water from its wells to users within the City of Elsinore,
subject to the terms and conditions set forth in said
Resolution, and
WHEREAS the State of California Department of Public
Health has authorized in the Domestic Water Supply Permit issued
to the City on August 22, 1958 the delivery of mineral water in
tank trucks for mineral bath purposes,
IT IS THEREFORE AGREED in consideration of the mutual
covenants of the parties as follows:
1. The City agrees to sell and deliver mineral water
from the City wells to the Purchaser at
, Elsinore, California by tank truck deliver~
2. The price of such water initially shall be $1.25
per lobo gallons, subject to changes as may be determined from
time to time by the City Council of the City, but in no event
shall the price be more than the reasonable cost of production
of the water.
Delivery charges shall be in addition to the
aforesaid cost of the water, and shall be determined by the
water department of the City on the basis of the actual cost
of such deliveries.

3. Purchaser shall pay all water and delivery
charges by the tenth day of each month for water purchased and
delivered during the preceding calendar month.
Overdue
accounts shall bear interest at the rate of seven per cent ~7%)
per annum~ and the City shall be under no obligation to make
further deliveries to Purchasers who are delinquent in any such
payments.
4. Purchaser agrees to pay to the City a minimum
charge of $ ~~ per month, which shall be credited
against water purchases.
5. Purchaser agrees that the water Shall not be used
for any purpose other than mineral baths.
6. All water sold shall be in units of at least 750
gallons, and the minimum delivery shall be 750 gallons. All
sales and deliveries shall be subject to the availability of
City equipment and personnel, the availability of mineral water
supply, and the availability of pumping facilities.
The City
shall, however, make all reasonable efforts to deliver such
water promptly upon placement of orders therefor.
Water will
be delivered only into sanitary containers which have been
approved by the City.
7. The sale, delivery and use of this water shall
be subject to the continuing approval of the State of
California Department of Public Health and any other
governmental agency having jurisdiction, and to such terms and
conditions as may be required from time to time by said
Department or agency.
8. The term of this agreement Shall be for three
(3) years and the agreement shall thereafter be automatically
renewed year by year unless cancelled by either party by giving
thirty (30) days written notice to the other party prior to
the expiration of any year.
