HomeMy WebLinkAboutCC Reso No 1993-11RESOLUTION NO. 93-11 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE PASSING ON AND GIVING PRELINHNARY APPROVAL TO THE REPORT OF THE ENGINEER OF WORK AND APPOINTING A TIlVIE AND PLACE FOR PUBLIC MEETING AND PUBLIC HEARING WHEREAS, the City Council of the City of Lake Elsinore (the "City"), is considering the formation of an assessment district, pursuant to the Municipal Improvement Act of 1913, being Division 12 (commencing with Section 10000) of the California Streets and Highways Code, for the acquisition of certain public works and improvements, if necessary, generally described as follows: RAILROAD CANYON ROAD (the "Improvements"); and WHEREAS, the lands to be specially assessed for the Improvements shall be included within an assessment district designated: ASSESSMENT DISTRICT NO. 93-1 (Cottonwood Hills) (the "Assessment District"); and WHEREAS, pursuant to Sections 10203 and 10204 of the Streets and Highways Code, the Engineer of Work has prepazed and presented a report (the "Engineer's Report"): NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA AS FOLLOWS: SECTION 1. That the foregoing recitals are true and correct. SECTION 2. The Engineer's Report is hereby preliminarily approved and adopted as follows: (a) The plans and specifications for the Improvements to be made, contained in the Engineer's Report, aze hereby preliminarily approved and adopted; (b) The total costs and expenses of the Improvements and incidental expenses in connection therewith, contained in the Engineer's Report, is hereby preliminarily approved and adopted; (c) The diagram showing the Assessment District referred to and described in the Resolution of Intention and the boundaries and dimensions of the respective subdivisions of land within the Assessment District, as the same existed at the time of the passage of the Resolution of Intention, each of which subdivisions have been given a sepazate number upon the diagram, as contained in the Engineer's Report, is hereby preliminarily approved and adopted; (d) The proposed assessments upon the several subdivisions of land in the Assessment District, in proportion to the estimated benefits to be received by such subdivisions from Improvements, acquisition and incidental expenses in connection therewith, as contained in the Engineer's Report, are hereby preliminarily approved and adopted. SECTION 3. The Engineer's Report shall stand for the purpose of all subsequent proceedings undertaken pursuant to the Resolution of Intention. SECTION 4. The City Council hereby appoints the time and place for the Public Meeting and Public Hearing as follows: TIME 7:00 p.m. April 13, 1993 ' (Public Meeting) 7:00 p.m. April 27, 1993 (Public Hearing) PLACE Boazd Room Elsinore Valley Municipal 31315 Chaney Street Lake Elsinore, California Water District Boazd Room Elsinore Valley Municipal Water District 31315 Chaney Street Lake Elsinore, California and provides that any interested person may object to the proposed improvement, the extent of the Assessment District, or to the proposed assessment by filing a written protest with the City Clerk at or before the time set for the hearing. Such protest must contain a description of the property in which each signer thereof is interested sufficient to identify the same and, if the signers aze not shown on the last equalized assessment roll as the owners of such property, must contain or be accompanied by written evidence that such signers aze the owners of such property. SECTION 5. The City Clerk is hereby directed to cause notice of the Public Hearing and the passage of the Resolution of Intention and this Resolution to be posted on all open streets each street so posted, but not less than three (3) in all, in the time, form and manner prescribed in Chapter 4 of Divisions 12 of the California Streets and Highways Code. SECTION 6. The City Clerk is hereby directed to give notice of the Public Hearing and of the passage of the Resolution of Intention and this Resolution by causing such notice to be published, pursuant to Section 6066 of the California Government Code, in the time, form and manners prescribed in Chapter 4 of Division 12 of the California Streets and Highways Code. SECTION 7. The City Clerk is hereby directed to mail notice of the Public Hearing and the adoption of the Resolution of Intention and the filing of the Engineer's Report to all persons owning real property proposed to be assessed, whose names and addresses appear on the last equalized assessment roll for City taxes or as known to the City Clerk, in the time, form and manner prescribed in Chapter 4 of Division 12 of the California Streets and Highways Code. SECTION 8. The City Clerk is hereby directed to file a copy of the proposed Map of the Assessment District in the Office of the County Recorder within fifteen (15) days of the adoption of said map; said boundary map to be in the form prescribed in Divisions 4.5 of the California Streets and Highways Code.
