A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF LAKE ELSINORE, CALIFORNIA RECOMMENDING
TO THE CITY COUNCIL APPROVAL OF GENERAL PLAN
AMENDMENT 91-3 FOR THE AMENDMENT OF THE LAND
USE ELEMENT OF THE 1990 GENERAL PLAN CHANGING
FIVE (5) AND THREE (3) ACRES FROM LOW MEDIUM
DENSITY RESIDENTIAL TO MEDIUM HIGH DENSITY
RESIDENTIAL AND NEIGHBORHOOD COMMERCIAL,
RESPECTIVELY
WHEREAS, an application has been filed with the city of Lake
Elsinore by William Tomlinson (Tomlinson & Son) to amend the City
of Lake Elsinore General Plan to revise the land uses specified on
the General Plan Land Use Map of the Land Use Element relating to
approximately eight (8) acres presently located at the terminus of
Riverside Drive, bounded by the southeast intersection of Grand
Avenue and Riverside Drive.
WHEREAS public notice of said applications has been given, and
the Planning commission has considered evidence presented by the
applicant, Community Development Department and other interested
parties at a public hearing held with respect to this application
on January 15, 1992;
NOW THEREFORE, the Planning Commission of the City of Lake
Elsinore DOES HEREBY RESOLVE as follows:

SECTION 1. The Planning Commission has considered Mitigated
Negative Declaration 91-14 to the proposed General Plan Amendment
91-3, prior to making a decision to recommend that the City Council
approve the proposed amendment to the 1990 City of Lake Elsinore
General Plan. The Planning Commission finds and determines that
Mitigated Negative Declaration 91-14 is adequate under California
Environmental Quality Act (CEQA) to analyze the environmental
effects of General Plan Amendment 91-3, and recommends City Council
approval, based upon the following findings and determinations:
SECTION 2. That in accordance with State Planning and Zoning
law and the city of Lake Elsinore the following finding for the
approval of General Plan Amendment 91-3 have been made as follows:
1. The approval of the requested designations permits development
to the highest and best nature within mitigable means to
insure maintenance of the general public health safety and
welfare.
2. Granting of the requested designations will permit reasonable
development of the property consistent with its constraints
and more compatible with adjacent properties and proposed
development.

3. The proposed General Plan Amendment would establish a land
use density and usage more in character with the subject
property's location, access and constraints.
4. The proposed change will not result in any significant adverse
impacts on the environment.
NOW, THEREFORE, based on the above findings, the Planning
Commission of the City of Lake Elsinore DOES HEREBY RECOMMEND that
the city Council of the City of Lake Elsinore approve General Plan
Amendment 91-3.

RESOLUTION NO. 92-2
A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY
OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING APPROVAL
OF A DEVELOPMENT AGREEMENT WITH NORTH PEAK PARTNERS
-
WHEREAS, North Peak Partners has made application to the City
of Lake Elsinore for a Development Agreement with respect to North
Peak Specific Plan; and
WHEREAS, the Planning Commission of the City of Lake Elsinore
held a duly noticed public hearing on the proposed Development
Agreement at its regular meeting on August 19, 1992, and considered
the evidence and testimony presented in connection with the
proposed Development Agreement, including but not limited to the
environmental documentation therefore;
NOW THEREFORE, BE IT RESOLVED by the Planning commission of
the city of Lake Elsinore as follows:
section 1. The proposed Development Agreement between North
Peak Partners and the City of Lake Elsinore is consistent with the
city's General Plan and the North Peak Specific Plan.
section 2. The previously certified Environmental Impact
Report prepared for the North Peak Specific Plan is adequate and
complete for the proposed Development Agreement.
section 3. It is recommended that the City Council of the
city of Lake Elsinore approve the proposed Development Agreement.

section 4. The Secretary of the Planning commission shall
certify to the adoption of this resolution and forward a copy to
the city Clerk for reference and consideration of the city Council.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMEND-
ING TO THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE APPROVAL OF OAK GROVE EQUITIES
(ELSINORE CITY CENTER) SPECIFIC PLAN 91-1.

The Planning Commission of the city of Lake Elsinore does
resolve as follows:
section 1. The Planning Commission hereby certifies that
there has been filed with the City of Lake Elsinore an application
by Oak Grove Equities, for adoption of Specific Plan 91-1, which
consists of approximately 49.2 acres, for general commercial uses,
with 8.6 acres of manufactured slopes, 4.2 acres of major roads and
a Future Use Area of 3.8 acres, located at the southeast corner of
Grape Street and Railroad Canyon Road; due notice of said
application has been given and public hearing conducted thereon
pursuant to State Planning and Zoning Law and local ordinances:
section 2.
The Planning Commission hereby determines that:
1. This request will result in significant environmental
impacts. Mitigation measures are proposed to reduce most
of these impacts to insignificant levels. A Statement of
Overriding Considerations shall be prepared to identify
benefits that will outweigh remaining adverse impacts.
2.
This request meets the Specific Plan criteria for content
and systematic implementation of the General Plan
established by section 65450 of the California Government
Code and Section 17.99 of the City of Lake Elsinore
Municipal Code.

3. This request will not be detrimental to the health,
safety, comfort or general welfare of the persons
residing or working within the neighborhood of the
project area, nor will it be injurious to the property or
improvements in that area or the city as a whole, based
upon the provisions of the Specific Plan, mitigation
measures and Conditions of Approval.
section 3. The Planning Commission hereby recommends that
the City Council certify Environmental Impact Report 92-3, approve
Specific Plan 91-1 and Zone Change 92-3, from C-P to SP, based upon
the findings and Conditions of Approval listed in the Staff Report.
Section 4. The Secretary of the Planning Commission shall
certify the adoption of this resolution and forward a copy to the
City Clerk for reference and consideration of the city Council.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF LAKE ELSINORE, CALIFORNIA RECOMMENDING
TO THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE APPROVAL OF GENERAL PLAN AMENDMENT
92-4 FOR THE AMENDMENT OF ALBERHILL SPECIFIC
PLAN LAND USE EXHIBIT II-3, BOUNDED BY
INTERSTATE 15, TERRA COTTA ROAD/NICHOLS,
PACIFIC CLAY AND ROBB/LAKE STREET; FILED BY
MURDOCK ALBERHILL
WHEREAS, an application has been filed with the city of Lake
Elsinore by Murdock Alberhill to amend the City of Lake Elsinore
General Plan to revise the land uses specified within Exhibit II-3
of the Land Use Element relating to the Alberhill Specific Plan;
located on either side of Nichols Road between Lake Street and
Interstate 15;
WHEREAS public notice of said applications has been given, and
the Planning Commission has considered evidence presented by the
applicant, Community Development Department and other interested
parties at a public hearing held with respect to this application
on september 2, 1992;
NOW THEREFORE, the Planning Commission of the City of Lake
Elsinore DOES HEREBY RESOLVE as follows:
SECTION 1. The Planning commission has considered the
previously certified Environmental Impact Report 89-2, the Addendum
to Environmental Impact Report (EIR) 89-2, the proposed General
Plan Amendment 92-4, prior to making a decision to recommend that
the City Council approve the proposed amendment to the 1990 City of
Lake Elsinore General Plan. The Planning commission finds and
determines that EIR 89-2 and the Addendum thereto are adequate
under California Environmental Quality Act (CEQA) to analyze the
environmental effects of General Plan Amendment 92-4, and
recommends City Council approval, based upon the following findings
and determinations:
a. only minor technical changes and additions are
necessary to make the FEIR 89-2 adequate to
address the proposed General Plan Amendment,
since substantial changes have not occurred
with respect to the circumstances under which
the existing General Plan was undertaken, the
proposed changes to the General Plan will not
require any important revision to FEIR 89-2,
and there will be no new significant environ-
mental impacts that were not considered in the
FEIR;
b. No mitigation measures or alternatives which
were previously not considered in the FEIR 89-
2 would substantially lessen any significant
effects on the environment;
c. The changes to ErR 89-2 set forth in the
Addendum thereto do not raise important new
issues about any significant effects on the
environment.
d. No new information of substantial importance
to the proposed General Plan project has
become available.

SECTION 2. That in accordance with State Planning and Zoning
law and the City of Lake Elsinore the following finding for the
approval of General Plan Amendment 92-4 have been made as follows:
1.
The proposed General Plan Amendment would establish a land use
and allow density more in keeping with the subject property's
location, access and site characteristics.

The proposed amendment will not significantly
al ter the land uses and intensi ty of the
general plan.
The General Plan Land Use Element currently
provides an illustration of the precise land
uses approved for the project site, through
the adopted Alberhill Specific Plan. The
illustrative indicates that the Specific Plan
Area will contain residential, commercial,
institutional and open space land uses. The
proposed amendment will maintain the same land
uses in revised locations consistent with the
proposed Specific Plan.
2. The proposed General Plan Amendment is consistent with the
surrounding land use designations.
The proposed General Plan Amendment, which
proposes to allow the development of
residential, commercial, institutional, and
open space is consistent with and similar to
the surrounding residential and specific plan
areas designated by the General Plan. The
proposed Specific Plan proposes no land uses
adverse to the proj ect si te or surrounding
land uses.
NOW, THEREFORE, based on the above findings, the Planning
commission of the City of Lake Elsinore DOES HEREBY RECOMMEND that
the City Council of the City of Lake Elsinore approve General Plan
Amendment 92-4, amending of Exhibit 11-3 within the city of Lake
Elsinore General Plan, (See Exhibit 1).

TO THE CITY COUNCIL OF THE CITY OF LAKE
ELSINORE APPROVAL OF MURDOCK ALBERHILL
SPECIFIC PLAN AMENDMENT #2 FOR THE ALBERHILL
SPECIFIC PLAN 89-2; BOUNDED BY INTERSTATE 15,
TERRA COTTA ROAD/NICHOLS, PACIFIC CLAY AND
ROBB/LAKE STREET; FILED BY MURDOCK DEVELOPMENT

WHEREAS, an application has been filed with the city of Lake
Elsinore by Murdock Development to amend the Alberhill Specific
Plan 89-2 to redesignate the land uses within a portion of the
Alberhill Ranch Specific Plan area, consisting of approximately
511.4 acres of land bounded generally by bounded by the Brighton
Alberhill Specific Plan to the north, the extension of Terra Cotta
Road to the east, Terra Cotta area to the south, and Robb/Lake
Street to the west.
WHEREAS public notice of said applications has been given, and
the Planning commission has considered evidence presented by the
applicant, Community Development Department, and other interested
parties at a public hearing held with respect to this application
on September 2, 1992;
NOW THEREFORE, the Planning Commission of the City of Lake
Elsinore DOES HEREBY RESOLVE as follows:

SECTION 1. The Planning commission has considered the
previously certified Environmental Impact Report 89-2, the Addendum
to EIR 89-2, the proposed Murdock Specific Plan Amendment #2, prior
to making a decision to recommend that the city Council approve the
proposed Amendment to Specific Plan 89-2. The planning commission
finds and determines that EIR 89-2 and the Addendum thereto are
adequate under CEQA to analyze the environmental effects of Murdock
Specific Plan Amendment #2, and recommends City Council approval,
based upon the following findings and determinations:
1. The location and design of the proposed
development shall be consistent with the goals
and policies of the City's General Plan and
with any other applicable plan or policies
adopted by the ci ty , or in the process of
being prepared and adopted.
The proposed amendment to the specific plan is
consistent with the goals and polices of the
general plan, since the proposed project takes
into consideration the uses permitted,
surrounding land uses and existing and
proposed circulation system. Additionally a
concurrent general plan amendment is being
processed to ensure consistency in land uses
and policies is maintained.
2. The proposed location shall allow the
development to be well-integrated with or
adequately buffered from its surroundings,
whichever may be the case.
The propose location is well integrated and
located to its surroundings since, the
proposed project will be adjacent to similar
residential, commercial, institutional, and
open space uses which have already received
specific plan approval.
3. All vehicular traffic generated by the
development, either in phased increments or at
full build-out, is to be accommodated safely

and without causing undue congestion upon
adjoining streets.
A traffic study has been completed, which
addresses all of the anticipated circulation
system improvements necessary to adequately
handle the project's expected traffic volumes.
there will be no significant congestion during
build out or at completion of the project.
The Final Specific Plan shall identify a
methodology(s) to allow land uses to be
adequately serviced by existing or proposed
public facilities and services. In
appropriate circumstances, and as provided
elsewhere by City Code, the City may require
that suitable areas be reserved for schools,
parks and pedestrian ways; or public open
spaces shall be dedicated or reserved by
private covenant for the common use of
residents, establishments or operations in the
development.
The proposed project provides a phasing
schedule for the development of adequate
public facilities on an as needed basis tied
to the build out of project phases.
Additionally, the proposed project will
provide sites for the development of parks,
open space areas, and schools.

5. The overall design of the Specific Plan will
produce an attractive, efficient and stable
development.
The proposed amended specific plan contains
design guidelines for the long term
development of the project such as a phasing
schedule of the overall project, logical
location of land uses, and necessary
circulation improvements to facilitate
production of an attractive, efficient and
stable development of the project.
6. In accordance with the requirements of the
California Environmental Quality Act (CEQA),
impacts have been reduced to a level of non-
significance, or in the case where impacts
remain, a statement of overriding
considerations must be adopted to justify the
merits of project implementation.
An Addendum Environmental Impact Report to the
Alberhill FEIR 89-2 has been prepared to
address the minor technical revisions
associated with the proposed project. The
Alberhill FEIR addressed all the significant
impacts and developed mi tigation measures
reducing impacts to a level of
insignificance. A statement of overriding
considerations was adopted for impacts not
reduced to a level of insignificance.
SECTION 2. That in accordance with Chapter 17.99.100 of the
Zoning Ordinance, the findings by the City of Lake Elsinore
for approval of Specific Plans have been made as follows:
1. The location and design of the proposed development shall
be consistent with the Goals and Policies of the City's

General Plan and with any other applicable plan or policies
adopted by the city, or in the process of being prepared and
adopted.
The proposed amended specific plan is consistent
with the Goals and Polices of the General Plan,
since the proposed project takes in to
consideration the uses permitted, surrounding land
uses and existing and proposed circulation system.
Additionally a concurrent General Plan Amendment is
being processed to ensure consistency in land uses
and policies is maintained.
2.
The proposed location shall allow the development to be

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF LAKE ELSINORE, CALIFORNIA RECOMMENDING
TO THE CITY COUNCIL APPROVAL OF GENERAL PLAN
AMENDMENT 92-1 FOR THE AMENDMENT OF THE LAND

REDESIGNATE 20 ACRES FROM VERY LOW DENSITY TO
LOW MEDIUM DENSITY

WHEREAS, an application has been filed with the City of Lake
Elsinore by Robert R. Dyer and Linda D. Wynn to amend the City of
Lake Elsinore General Plan to revise the land uses specified on the
General Plan Land Use Map of the Land Use Element relating to
approximately twenty (20) acres situated between the northwest
corner of the Tuscany Hills Specific Plan and Tentative Tract Map
25830 (Homestead Land Development.
WHEREAS public notice of said applications has been given, and
the Planning Commission has considered evidence presented by the
applicant, Community Development Department and other interested
parties at a pUblic hearing held with respect to this application
on October 21, 1992;
NOW THEREFORE, the Planning Commission of the City of Lake
Elsinore DOES HEREBY RESOLVE as follows:

SECTION 1. The Planning Commission has considered Negative
Declaration 92-8 to the proposed General Plan Amendment 92-1, prior
to making a decision to recommend that the City Council approve the
proposed amendment to the 1990 City of Lake Elsinore General Plan.
The Planning Commission finds and determines that Negative
Declaration 92-8 is adequate under California Environmental Quality
Act (CEQA) to analyze the environmental effects of General Plan
Amendment 92-1, and recommends City Council approval, based upon
the following findings and determinations:

RESOLUTION NO. 92-8
A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF LAKE ELSINORE, CALIFORNIA RECOMMENDING
TO THE CITY COUNCIL APPROVAL OF GENERAL PLAN
AMENDMENT 92-3 TO IMPLEMENT THE HISTORIC
DOWNTOWN LAND USE PLAN ESTABLISHING GENERAL
PLAN LAND USE LEVEL DESIGNATIONS FOR THIS
AREA. THE HISTORIC DOWNTOWN ENCOMPASSES
APPROXIMATELY 486 ACRES AND IS LOCATED IN THE
HISTORIC CORE OF THE CITY. THE AREA IS
GENERALLY BOUNDED TO THE NORTH BY COLLIER
AVENUE AND INTERSTATE 15, TO THE SOUTH BY
LAKESHORE DRIVE, THE WEST BY CHANEY STREET,
AND THE EAST BY GROVE AVENUE, CONKLIN AVENUE
AND RUPARD STREET.
WHEREAS, the General Plan must be periodically updated to meet
new conditions and from time to time be revised or amplified to
respond to unforeseen changes or needs; and
WHEREAS, the Planning Commission of the City of Lake Elsinore
has been delegated the responsibilities of making recommendations
for changes in the General Plan; and
WHEREAS, the Planning Commission has held necessary hearings
in accordance with State Planning Law for the adoption of General
Plan Amendments t the General Plan; and

WHEREAS, the Planning Commission has considered Mitigated
Negative Declaration 92-7 to the proposed General Plan Amendment
92-3, prior to making a decision to recommend that the City Council
approve the proposed amendment to the 1990 City of Lake Elsinore
General Plan. The Planning Commission finds and determines that
Mitigated Negative Declaration 92-7 is adequate under California
Environmental Quality Act (CEQA) to analyze the environmental
effects of General Plan Amendment 92-3, and recommends city Council
approval, based upon the following findings and determinations:
1. The approval of the requested designations
permi ts development to the highest and best
nature within mitigable means to insure
maintenance of the general public health
safety and welfare.
2. Granting of the requested designations will
permit reasonable development of the property
consistent with its constraints and more
compatible wi th adj acent properties and
proposed development.
3. The proposed General Plan Amendment would
establish a land use density and usage more in
character with the subject property's
location, access and constraints.
4. The proposed change will not result in any
significant adverse impacts on the
environment.
NOW, THEREFORE, based on the above findings, the Planning
Commission of the City of Lake Elsinore DOES HEREBY RECOMMEND that
the City Council of the City of Lake Elsinore approve General Plan
Amendment 92-3.

A RESOLUTION OF THE PLANNING COMMISSION OF THE
CITY OF LAKE ELSINORE, CALIFORNIA RECOMMENDING
TO THE CITY COUNCIL APPROVAL OF GENERAL PLAN
AMENDMENT 92-2 FOR THE AMENDMENT OF THE LAND
USE ELEMENT OF THE 1990 GENERAL PLAN TO
REDESIGNATE 33 ACRES OF BUSINESS PARK AND 15
ACRES OF FREEWAY BUSINESS TO GENERAL
COMMERCIAL
WHEREAS, an application has been filed with the City of Lake
Elsinore by William and Rosalyne Hall to amend the City of Lake
Elsinore General Plan to revise the land uses specified on the
General Plan Land Use Map of the Land Use Element relating to 33
acres located at the northwest intersection of Tenth Street and
Dexter Avenue and 15 acres located to the north and south of
Cambern Avenue (east of Central Avenue [State Highway 74]).
WHEREAS public notice of said application has been given, and
the Planning Commission has considered evidence presented by the
applicant, Community Development Department and other interested
parties at a public hearing held with respect to this application
on December 2, 1992;
NOW THEREFORE, the Planning Commission of the City of Lake
Elsinore DOES HEREBY RESOLVE as follows:

SECTION 1. The Planning Commission has considered Mitigated
Negative Declaration 92-6 to the proposed General Plan Amendment
92-2, prior to making a decision to recommend that the city Council
approve the proposed amendment to the 1990 City of Lake Elsinore
General Plan. The Planning Commission finds and determines that
Negative Declaration 92-6 is adequate under California Environ-
mental Quality Act (CEQA) to analyze the environmental effects of
General Plan Amendment 92-2, and recommends City Council approval,
based upon the following findings and determinations:
SECTION 2. That in accordance with State Planning and Zoning
law and the City of Lake Elsinore the following findings for the
approval of General Plan Amendment 92-2 have been made as follows:
1. The approval of the requested designations
