Home My WebLink AboutCC Reso No 1994-58RESOLOTION NO. 94-58 A RESOLOTION OF THE CITY COONCIL OF TH8 CITY OF LAKE ELBINORE FOR THS VACATION OF INGHAM STREET WSEREAB, the City Council of the City of Lake Elsinore has determined that a certain street easement is no longer necessary to be utilized as public right of way, said easement being more particularly described as follows: Ingham Street of Unit A of Country Club Heights at Lake Elsinore, as shown by map on file in Book 16, Pages 59, 60, and 61 of maps, Riverside County records; more precisely described as follows: Beginning at the most southerly corner of Lot 120; thence a distance of 34.92 feet along a line bearing north 77 degrees, 20 minutes west; thence a distance of 148.32 feet along a line bearing north 23 degrees, 28 minutes west; thence traversing an arc, concave northward, having a radius of 80.00 feet, an included angle of 30 degrees, 39 minutes and 36 seconds, with a cord bearing north 64 degrees, 33 minutes and 33 seconds east, for a length of 37.48 feet to a point on the line of said lot; thence proceeding southwesterly along the lines of said lot to the point of beginning. Together with: Beginning at the most southerly corner of Lot 121 on the right-of-way line of Smith Avenue; thence a distance of 44.44 feet along a line bearing south 77 degrees, 20 minutes east; thence a distance of 148.34 feet along a line bearing north 23 degrees, 28 minutes west; thence traversing an arc, concave northward, having a radius of 80.00 feet, an included angle of 26 degrees, 50 minutes and 34 seconds, with a cord bearing north 86 degrees, 41 minutes and 50 seconds west, a length of 42.81 feet to a point on the line of said lot being the northernmost corner of said lot; thence continuing southeasterly along the lines of said lot to the point of beginning. and WHEREAB, the City Council for the City of Lake Elsinore desires to vacate said easement pursuant to the procedures set forth in Streets and Hiahwavs Code Section 8320, et seq.; WHEREAS, THE City Council of the City of Lake Elsinore adopted a Resolution of Intention setting a time and place for Public Hearing on said vacation; and WHEREAS, pursuant to the Resolution of Intention, the Public Hearing has been held and evidence submitted; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lake Elsinore as follows: l. That the foregoing recitals are true and correct. 2. That based upon the evidence submitted at said Public Hearing, the City Council hereby finds that the street described in this Resolution is unnee~~sary for present or prospective public use. 3. That the street easement more particularly described above is hereby ordered to be vacated. 4. That the City Clerk is hereby ordered to record the Resolution of Vacation in the Riverside County Recorder's Office.
