HomeMy WebLinkAboutCC Reso No 1994-31RESOLUTION NO. 94- 31 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ORDERING TERRITORY DESIGNATED AS " ANNEXATION NO. 62" ANNEXED TO THE CITY OF LAKE ELSINORE WHEREAS, the Riverside County Local Agency Formation Commission of the County of Riverside approved the Reorganization to include Annexation No. 62 to the City of Lake Elsinore (LAFCO # 92-14-1) of territory located west of Grand Avenue at the western termini of Amorose Street and Toft Drive, described in Exhibit "A" attached hereto and by this reference incorporated herein; and WHEREAS, the Riverside County Local Agency Formation Commission in adopting its Resolution No. 02-94 on January 27, 1994, makinq determinations and approval of said annexation has included a condition authorizing the City Council of the City of Lake Elsinore to proceed as the conducting authority. WHEREAS, the terms and conditions of annexation as approved by the Local Agency Formation Commission are as follows: 1. Commission proceedings were commenced by petition of Dr. K.S. Chen, Good Land Investment. 2. The reorganization is proposed to provide municipal services by the City of Lake Elsinore. 3. The distinctive short form designation of the annexation is LAFCO No. 92-14-1, Annexation No. 62 to the City of Lake Elsinore. 4. The City, as lead agency, has certified an Environmental ' Impact Report and complied with the California Environ- ! mental Quality Act and all appropriate State Guidelines, and the Commission has reviewed and considered the environmental documentation. 5. The Commission, as a responsible agency, hereby adopts Findings for Significant Environmental Effects and the Statement of Overriding Considerations, as adopted by the City of Lake Elsinore. 6. The territory to be annexed is uninhabited, there being fewer than 12 registered voters residing therein. 7. The proposed annexation is consistent with the City of Lake Elsincre's sphere of influence and the spheres of influence of all other affected local agencies. 8. The boundaries of the territory as set forth in Exhibit "A", Parcels A and B, attached hereto and incorporated herein by this reference, have been approved by the County Surveyor, are contiguous to the City of Lake Elsinore, and are approved. 9. The reorganization is approved subject to the following condition: Prior to recordation of the Certificate of Completion a Certificate(s) of Completion shall be recorded for annexation of the entire pocket area as shown on the Exhibit labelled Staff Recommendation, attached hereto and marked Exhibit "B". WHEREAS, the reasons for this proposed annexation are: This is a proposal initiated by the major landowner, Goodland Investments, to annex approximately 1,166 acres of uninhabited Page 2 94v3~ Resolution No. territory to the City of Lake Elsinore. Consistent with all recent proposals for annexation to Lake Elsinore. The proposal is contiguous to the City for approximately one mile along its western corporate boundaries, west of Grand Avenue. The affected territory is consistent with the City's sphere of influence; and WHEREAS, the regular county assessment roll is utilized by the City of Lake Elsinore; and WHEREAS, the affected territory will not be taxed for existing general bonded indebtedness of the City of Lake Elsinore. WHEREAS, a public hearing on this annexation was called for and held by this Council at the place and time noticed therefore on June 14, 1994, and this Council finds and determines that the value of written protests filed and not withdrawn is less than 25 percent of the registered voters residing within the territory to be annexed and less than 25 percent of the number of owners of land owning less than 25 percent of the assessed value of land within the territory. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of Lake Elsinore hereby orders the territory described in Exhibit "A" annexed, and directs the City Clerk to transmit twenty- two certified copies of this resolution with applicable fees required by Section 54902.5 of the Government Code to the executive officer of the Local Agency Formation Commission of Riverside County.
