HomeMy WebLinkAboutPC Reso No 1985 RESOLUTION NO. 85-1 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF LAKE ELSINORE, CALIFORNIA, RECOMMENDING DENIAL OF GENERAL PLAN AMENDMENT 85-1. WHEREAS, the Planning Commission of the City of Lake Elsinore has been delegated - the responsibilities of making recommendations for changes in the General Plan; and WHEREAS, the General Plan was adopted by the City Council on December 14, 1982; and WHEREAS, the Planning Commission of the City of Lake Elsinore has considered the application of Elsinore Naval and Military Academy for a General Plan Amendment of the Land Use Element from Low Density Residential to Mixed Use for property located at the southwest corner of Grand Avenue and Ortega Highway (15890 Grand Avenue); and WHEREAS, the Planning Commission finds that the establishment of the use for which the application is made cannot be justified as required by the General Plan and Section 65356.1 of the Government Code. NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission does hereby deny - the application for General Plan Amendment 85-1 because the proposal is found to be incompatible with the intent and purpose of the General Plan as: 1. The Mixed Use General Plan Land Use designation is not the highest and best use for the parcel in question. A commercial designation would be best suited. 2. The parcels on the south side of Grand Avenue, to the east and west of the parcel, in question all have a commercial designa- tion for a depth of at 1 east 200 feet. . 3. Residential land use patterns should be minimized to inhibit direct access onto major thoroughfares. BE IT FURTHER RESOLVED, that the Planning Commission finds there is not any anticipated significant adverse effects to be caused by this change to the General Plan, and recommends to the City Council that a Negative Declaration of Environmental lmpact be fil ed for General P1 a n Amendment 85-2. BE IT FURTHER RESOLVED, that the Planning Commission finds there is not any anticipated significant adverse effects to be caused by this change to the General Plan, and recommends to the City Council that a Negative Declaration of Environmental Impact be filed for General Plan Amendment 85-7. WHEREAS, the General Plan must be periodically updated to meet new condi- tions and from time to time be revised or amplified to respond to unforeseen changes or needs; and ~ WHEREAS, the Planning Commission of the City of Lake Elsinore has been dele- gated the responsibilities of making recommendations for changes in the General Plan; and WHEREAS, the General Plan was adopted by the City Council on December 14, 1982; and WHEREAS, proposed changes in the General Pl~n should be evaluated in regard to environmental impact and consistency; and WHEREAS, the Planning Commission of the City of Lake Elsinore has held necessary hearings in accordance with State Planning Law for the adoption of General Plan Amendments to the General Plan; and WHEREAS, the Planning Commission feels the changes to the General Plan will result in a more usable and manageable General Plan. ~ NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission does hereby adopt the State Environmental Assessment and recommends approval of General Plan Amendment 85-11 amending the Environmental Resources Management Element of the General Plan by adding the following in place of Implementation Program 3.6.a.2: o The City of Lake Elsinore in conjunction with Riverside County, the Department of Parks and Recreation and other interested public and private agencies shall cooperate in developing a comprehensive multi- purpose trail system within the Lake Elsinore Planning Area. o The City of Lake Elsinore shall adopt a Master Plan of Trails. The City Planning Department in conjunction with the City Engineering Department will continue to update the Master Plan of Trails to show all existing and proposed bicycle, equestrian and hiking trails. Updating and inventory of the Master Plan of Trails shall be accom- plished through communications with equestrian, hiking, bicycle and other outdoor clubs, public associations and State and Federal Agencies, i.e., U. S. Department of Agriculture (Forest Service), State Depart- ment of Parks and Recreation, etc., and any other groups that may have an impact on the trail system. ~ o The Master Plan of Trails will represent the official policy of the City Council on the development of a City-wide multi-purpose trail system. o The Master Plan of Trails will provide staff, Planning Commission, City Council and developers with guidelines for the development and extension of multi-purpose trails. o The Master Plan of Trails will facilitate possible funding through State and Federal Agencies for the acquisition development and maintenance of trails. o The Cay, whenever possible, will look at methods other than purchasing land for the purpose of establishing trails. The CHy shall attempt to enter into joint agreements with publ ic and private agencies, which control utility easements, in order to incor- porate those lands into permanent trail 1 inkage throughout the City. In addition, trail easements can be acquired through subdivision approvals and development agreements. Also, the City may consider hav- ing developers donate land for recreational purposes. - o The City Planning Department in conjunction with the City Engineering Department will coordinate the multi-purpose trail system (specifically bicycle lanes) with the Circulation Element of the General Plan. Wher- ever possible, bicycle lanes should be incorporated into right-of-way expansions. Also, whenever possible, bicycle lanes usable for both recreation and commuting should be planned into integrated systems. Adding the following to Outdoor Recreation Standards 3.6.a.2. of the ERME: o Bicycle Trails: (See Circulation Element, Page CIR 2, and General Plan Amendment 85-13) o Equestrian and Hiking Trails: - Width: Primary trails shall have easements of 12 to 20 feet in wi dth with trail treads of 24 to 60 inches in wi dth. Secondary trails shall have easements of 10 to 12 feet in width with trail treads of 24 to 48 inches in width. Narrower trails, however, may be utilized when terrain and property acquisition constraints exist. Surfaces: The surface of trails should be low maintenance minimize dust levels and where applicable allow for the absorption of horse droppi ngs. - Safety: Equestrian trails should be separated from vehicular traffic with low maintenance aesthetically acceptable fencing. Signs should be posted identifying trails, and marking the location of crossings. Location: Trails should follow utility and drainage easements when- ever possible. Grading should be minimized. BE IT FURTHER RESOLVED, that the Planning Commission finds there is not any anticipated significant adverse effects to be caused by this change to the General Plan, and recommends to the City Council that a Negative Declaration of Environ- mental Impact be filed for General Plan Amendment 85-11. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission does hereby adopt the Staff Environmental Assessment and recommends approval of General Plan Amendment 85-12 changing the General Plan Circulation Element as follows: - Terra Cotta Road from Lakeshore Drive to Pierce Street. Revise from 100 feet of right-of-way and 76 feet curb-to- curb to 80 feet of right-of-way and 64 feet curb-to-curb. A revised map is attached hereto as Exhibit "A," entitled "City of Lake Elsinore General Plan 1992 Land Use r~ap." BE IT FURTHER RESOLVED that the Planning Commission finds there is not any anticipated significant adverse effects to be caused by this change to the General Plan, and recommends to Ute City Council that a Negative Decl aration of Environ- mental Impact be filed for General Plan Amendment 85-12.
