HomeMy WebLinkAboutCC Reso No 1952 -717-759 CC Reso RESOLUTION NO. 1 / 7 BE IT RESOLVED by the City Councilor the City of Elsinore, that it is to the advantage and best interests of the City of Elsinore to lease the Elsinore Sewer Farm to SAM STEWART for a period of five years commencing the date on Which Notice of Completion of the Sewer Disposal Plant, now under construction by the City of Elsinore, is recorded, in accordance with the terms and c ond it ions of tha t cer tain Ie ase attached hereto; the consideration for said lease being the transfer of title of certain property from Sam Stewart to the City of Elsinore which forms a portion of said Sewer Farm, and no other rental for the use of said property for the said period of five years being contemplated; and the Mayor and City Cle rk of said City of Elsinore are authorized and directed to execute oo~d deliver said lease to Sam stewa,rt. PARCEL 2: Lot 4 of Goodwin, Whitten and Elliott's Subdivision, as shown by Map on file in Book 4 page 241 of Maps, San Diego Coun~ Records; EXCEPTING therefrom that portion conveyed to the South Riverside Land and Water Company, by Deed recorded in Book 15 page 145 of Deeds, Riverside County Records. PARCEL 3: The Southwesterly 659.47 feet of Lot 11 in Block A, of Elsinore, as shown by Map on file in Book 8 page 377 of Maps, San Diego County Records. Ul Z III ~ 111 II: Z - 17 m ~ ~ ~ t-"~ ~ Ul II: 111 18 m 19 20 21 22 23 24 25 26 27 28 29 The consideration for this lease is the transfer of the title of certain property from Sam Stewart to the City of Elsinore and no other rental for the use of said property for the said period of five years is contemplated. The right is reserved to the first party herein to enter upon said land at any time for the purpose of prospecting and drilling for oil, gas, asphalt, naphtha and all other minerals together with reasonable right of way for roadways over which supplies may be hauled to or produce from any or all wells that may be operated as well as the right to lay and maintain any and all necessary pipe lines, in, on, or ever said premises and to erect and maintain telegraph and telephone lines and take, use and occupy reasonable space for machinery, tanks and such build- ings as maybe ne cessary in connec tion wi th the working of any wells and to develop water and take from any springs, and creeks on said premises such surplus water as will not interfere with the enjoyment and use of the said premises by the party of the second part, and the second party shall have the right to com- pensation for any damages to crops by reason of the said roadways or right of entry. The second party shall have the free use during the terms of this lease of all sewer water from the City of Elsinore normally delivered to the intake of the reservoir now located on said property. It is understood that the sewer system may be shut down for reasonable time for repairs, but that no arrangements will be made by the City of Elsinore for the delivery of sewer water to any other point. In the event second party repairs or replaces any of such equipment, such repairs or replacements shall remain the property of the first par~, but if any new or additional improve- ments are placedon said property by second party they shall remain his property and may be removed by him at the end of the term of this lease. The second par~ shall have the option to renew this lease for, an additional period of five years providing notice of his intention so to renew the same shall be given in writing to the City Clerk of the City of Elsinore on or before November 1, 1956. Said renewal shall be on the same terms and condi tions as are contained in this lease except that it shall provide for payment of a reasonable rental by second party to first party in an amount to be then agreed upono If said parties are unable to agree upon said rental it shall be fixed by a Board of three arbitrators, one to be chosen by the first party, one by the second party and they to choose a third. If either party refuses or neglects for a period of thirty days after notice to designate an arbitrator, the other party shall have the right to name two arbitrators and they to choose the third. BE IT RESOLVED by the City Council of the City of Elsinore, 4 5 that for the purpose of holding the regular municipal election on the second Tuesday of April in the year 1952, election precincts numbered 1 and 4 be, and they are hereby consolidated into one pre cinct to be known as "Elsinore Consolidated Precinct No. A tI; the 6 7 8 9 10 11 voting place for said precinct shall be at the City Hall Fire Sta- tion, at No. 130 South Main Street in the City of Elsinore, County of Riverside, State of California, AND that election precincts numbered 2, 3 and 5 be, and 12 they are hereby consolidated into one precinct to be known as tlElsinore Consolidated Precinct No. BtI; and the voting place for said precinct shall be at the Presbyterian Church Social Hall 603, West Graham Avenue, in the City of Elsinore, County of Riverside, State of California. Knowland, and to Supervisor William Jones. A-~ City Clerk of the City of Elsinore 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 1 RESOLUTION .~ -./ I #" S. .> ~ ~. ~' 2 3 On a motion regula.rly made, seconded and carried, the following 4 resolution was adopted, to wit: 5 WHEREAS, the United States of America has filed a lawsuit in the 6 Federal Court against many persons residing in the vicinity of the Santa 7 Margarita watershed which extends from the ocean through Camp Pendleton and 8 into the Murieta Valley in the County of Riversi,de; and 9 10 WHEREAS, said water suit seeks to prev~~he persons takin~later from owning land within 11 the Santa 12 ',-,,-. AS, the pe.ople owning land within the portion of the Santa Margarita basin which is within the County of Riverside have land and water 13 rights by long and established use for domestic purposew, for the purpose of watering livestock, consisting of horses, cows, sheep and other domestic ani- mals, and for the irrigation of crops; and WHEREAS, it will be necessary for the persons owning lands in the portion of Santa Margarita basin which is situated within the County of Riverside to expend large sums of money for the payment of costs in defending said lawsuit and for the purpose of employing attorneys and engineers for the assembling of data and information relative to various wate~ rights within the County of Riverside; and WHEREAS, the taking of the water rights by the United States will deprive the persons in the possession of such lands of valuable property rights, reduce the assessed values of said properties, reduce the amount of taxes assessed and collected on such property and cause great hardship amongst many people who have small incomes and are financially unable to pay costs and fees necessary for the proper presentation of the available evidence. Section 2: All members of the Elsinore Recreation Commission, hereinafter called the Commission, shall serve without compensation. One 11 member at large shall be appointed by the Mayor; two of the members shall 12 be appointed by the City Council; and two shall be appointed by the Board 13 of Education. Members of the Commission shall serve for a tum of four years, 14 15 or until their successors are appointed. Meniliers of the Commission first 16 appointed shall determine their respective terms of office by lot, so that 17 18 two members thereof shall serve for a term of two years; two members there- of for a term of three years; and one member thereof for a term of four 19 years. All vacancies shall be filled for the unexpired terms of the members 20 21 whose offices are vacant in the srone manner as such members received original appointm~nts . 22 Section 3: The Coramission shall elect one of its members as 23 President, who shall hold offices for one year and until his successor is 24 elected. Section 2: All members of the Elsinore Re- creation Commission, hereinafter called the Com- mission, shall serve without compensation. One member at large shall be appointed by the Mayor; two of the members shall be appointed by the City Council; and two shall be appointed by the Board of Education. Members of the Commission shall serve for a term of four years, or until their successors are appointed. Members of the Com- mission first appointed shall determine their respective terms of office by lot, so that two members thereof shall serve for a term of two years; two members thereof for a term of three ye ars; and one member there of for a term of four years. All vacancies shall be filled for the unexpired terms of the members whose offices are vacant in the s sme manner as such members re- caived original appointments. Section 4: The term "public recreationft as used herein is defined to mean and include all ac- tivities, voluntarily engaged in, which contribute to the physical, mental or moral development of the individuals participating therein, and taking place in or upon playgrounds, athletic fields, ball parks, summer camps, recreation centers, swimming pools, beaches, streets, waterfronts, waterways, public buildings, colosseums, play areas in parks, tennis courts and other suitable places or other public lands or public waterways used, owned, con- trolled or operated by the city of Elsinore, either wi thin or wi thout its corporate limits, and such activities shall include adults as well as minors. Section 5: The Commission shall have the power to maintain and operate a program of community re- creation within the scope and contemplation of Chapter IV, Division 12 of the Education Code of the State ~ California, and shall have exclusive jurisdiction and control of the operation and conduct of all public recreational activities. It may recommend to the City Council the acquisition of lands, waterways, buildings, structures or other ecp ipment and fa- 1 and approve a.ll pJa ns for the improvement of la.nds for public recreation, and for the erection, construction or improvement of buildings or other 2 3 4 equipment, structuresand facilities for the purpose of public recreation.
