A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF LAKE ELSINORE, CALIFORNIA,
OPPOSING PROPOSITION 218 "VOTER APPROVAL
FOR LOCAL GOVERNMENT TAXES. LIMITATIONS ON
FEES, ASSESSMENTS, AND CHARGES.
INITIATIVE CONSTITUTIONAL AMEIVDMENT."
WHEREAS, Proposition 218, "Voter Approval for Local Govemment Taxes. Limitations
on Fees, Assessments, and Charges. Initiative Constitutional Amendment." has been placed on the
NovembeT 5, 1996 Bailot; and
WHEREAS, the City of Lake Elsinore, through its Lighting and Landscape Maintenance
District (LLMD), provides Parks and Median Landscaping, Residential and Arterial Street Lighting,
Parkway Landscaping Maintenance and Tree Trirruning to the community; and
WHEREAS, the City of Lake Elsinore also provides for services including the National
Pollution Dischazge Elimination System (NPDES), Solid Waste, and Nuisance Abatement Services;
and
WHEREAS, the fees for the above listed services aze placed on the properry tax roll annually;
and
WHEREAS, Proposition 218 may reduce the City's ability to collect fees placed on the
property tax roll; and
WHEREAS, Proposition 218 will require the City to obtain voter approval and in many cases
two-thirds voter approval, of many existing fees currently placed on the tax roll; and
VVHEREAS, Proposition 218 could have serious impact on the City's finances through the
reduction of $1,795,100 in revenue to facilitate the LLMD, and additional reductions related to
NPDES, Solid Waste and Nuisance Abatement; and
WHEREAS, loss of revenue may require the closure of parks facilities, the Senior
Community Center, the elimination of youth and senior recreational programs, the elimination or
reduction of residential and arterial street lighting, and the elimination or reduction of parkway
landscape maintenance and tree trimming services; and
WHEREAS, the requirements for either a majority or a two-thirds vote, limits the ability to
collect the fees; and
WHEREAS, through an initiative referendum, a simple majority can repeal a two-thirds
majority voter approved special tax; and
WHEREAS, the implementation of Proposition 2l 8 will increase the cost of administering
the CSD through the election process; and
WHEREAS, Proposition 218 would remove longstanding policy that taxes cannot be
repealed by initiative, thereby leading to on-going financial and political instability.
VVHEREAS, Proposition 2l 8 violates the principal of having a one topic initiative, since it
is extremely complex and deals with severa] different concepts; and
WHEREAS, the City Council has discussed in an open public meeting the impacts facing the
City should Proposition 2l8 pass.
NOVV, THEREFORE, BE IT RESOLVED THAT THE CITY COUNCII. OF THE
CITY OF LAKE ELSINORE, OFFICIALLY OPPOSES PROPOSITION 218.
