HomeMy WebLinkAboutCC Reso No 1996-51 Annexation No. 65 & Concurrent Detachments From Ortega Trails, County Waste, & Service Area 124RESOLUTION NO. 96-51 B A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, ORDERING TERRITORY DESIGNATED ANNEXATION NO. 64, ANNEXED TO THE CITY OF LAKE ELSINORE AND CONCURRENT DETACHMENTS FROM THE ORTEGA TRAILS RECREATION AND PARK DISTRICT, THE RIVERSIDE COUNTY WASTE RESOURCES MANAGEMENT DISTRICT AND COUNTY SERVICE AREA 124 WHEREAS, the Riverside County Local Agency Formation Commission of the County of Riverside approved the Reorganizatiom to include Annexation No. 64 to the City of Lake Elsinore (LAFCO # 94-20-1) and concurtent detachments from the Ortega Trails Recreation and Park District, the Riverside County Waste Resources Management District, and County Service Area 124, and generally located north of the intersection of State Highway 74 and Interstate 15, more particulazly described in Exhibit "A" attached hereto and made part hereof; WHEREAS, the Riverside County Local Agency Formation Commission in adopting its Resolution 18-96 on June 27, 1996, making determinations and approval of said annexation has included a condition authorizing the City Council of the City of Lake Elsinore to proceed as the conducting authority. WHEREAS, this proposal is made pursuant to the Cortese-Knox Local Government Reorganization Act of 1985, Govemment Code Section 57082(a) WHEREAS, notice was duly given of the public hearing on Annexation 64, which public hearing was held before the City Council of the City of Lake Elsinore on the 27th day of August, 1996, at the hour of 7:00 p.m., with no written comments or protests received. 1. Commission proceedings were commenced by the petition of William and Rosalyne Hall. 2. This reorganization is proposed to provide municipal services by the City of L,ake Elsinore. 3. The distinctive short form designation of the proposed reorganization is LAFCO No. 94-20-1--Reorganization to include Annexation No. 64 to the City of Lake Elsinore and concurrent detachments from Ortega Trail Recreation and Park District, the Riverside County Waste Resources IVtanagement District and County Service Area 124. 4. The City of Lake Elsinore, as lead agency, filed a Negative Declaration and complied with the California Environmental Quality Act and all appropriate State Guidelines, and the Commission has reviewed and considered the environmental documentation. 5. The boundazies of the territories as set forth in Eachibit "A", attached hereto and incorporated herein by this reference, have been approved by the County Surveyor, are contiguous to the City of Lake Elsinore, and are approved. 6. The tenitory to be annexed is uninhabited, there being fewer than 12 registered voters residing therein. 7. The proposed annexation is consistent with the City of Lake Elsinore's Sphere of Influence and the spheres of influence of all other affected local agencies. Page 2 Resolution No. 96-51 8. The reorganization is approved subject to the following terms: a. In accordance with Government Code Section 56375(p), waive automatic detachment from County Service Area 152 based upon the following findings: i. County Service Area (CSA) 152 is a funding mechanism for the implementation of the National Pollutant Discharge Elimination System (NPDES) emanating from the Federal 1972 Clean Water Act, and re-authorized under the Federal 1987 Clean Water Act. ii. The Ciry of Lake Elsinore annexed into CSA 152 and is included within the CSA's service area. iii. Detaclunent would deprive the area residents services needed to ensure their health, safety or welfare. iv. Waiving detachment will not affect the ability of the City or County to provide services. b. Prior to recordation of the Certificate of Completion, the City of Lake Elsinore and the County of Riverside shall execute an agreement providing for Dexter Avenue, Cambern Avenue and lOth Street to remain as permanent ingress and egress between the inhabited azeas of County Service Area 124 (Warm Springs) and Highway 74 or provide alternative access routes which are acceptable to the Riverside County Director of Transportation. The agreement shall provide that the City of Lake Elsinore shall not be responsible for closures required by the California Department of Transportation. c. Prior to the recordation of the Certificate of Completion, the City of Lake Elsinore and the County of Riverside shall execute an agreement which provides that at such time as the County desires to improve portions of lOth Street or Cambern Avenue which abut this reorganization, the City shall concurrendy contribute its proportionate share for similar improvement of the half-section within the boundaries of this reorganization. The intent is to perforxn future unprovements at the same time, under a single contract, to achieve cost-effective and coordinated improvement of those roadways. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. That the foregoing recitals are true and correct. 2. That the regulaz County Assessment Roll is utilized by the City of Lake Elsinore. Page 2 Resolution No. 96- 51 3. That the property affected by Annexation No. 64 will not be taxed for existing general bond indebtedness of the City of Lake Elsinore. 4. That the City Council does hereby approve Annexation No. 64 (LAFCO #94-20-1) with notice of hearing pursuant to the Government Code.
