HomeMy WebLinkAboutCC Reso No 1996-32RESOLUTION NO. 96- 32 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE EISINORE, CALIFORNIA, MAKING AMENDMENT TO THE LAKE ELSINORE GENERAL PLAN FOR THE SECOND CYCLE OF THE CALENDAR YEAR OF 1996 THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, Section 65361(a) of the Government Code provides that no mandatory element of a General Plan shall be amended more frequently than four times during any calendar year; WHEREAS, the Planning Commission held this round of General Plan Amendments on May 1, and June 5, 1996 and that these public hearings required by law. The Planning Commission made the City Council concerning these General Plan £iled with the City Council copies of maps and public hearings on 1996, May 15, 1996 were advertised as recommendations to Amendments and has reports; and WHEREAS, notice was duly given of the public hearing on the Amendment, which public hearinq was held before the City Council on the 25th day of June, 1996 at the hour of 7:00 p.m., with testimony received being made a part of the public record; and WHEREAS, all requirements of the California Environmental Quality Act have been met for the consideration of whether these projects will have a significant effect on the environment. NOW THEREFORE, in consideration of the evidence received at the hearing, and for the reasons discussed by the Council members at said hearing, the City Council now finds that the Lake - Elsinore General Plan be amended as follows: A, cFNFUAT prAhT AMENDMENT 94-3 APPLICANT/PROPERTY OWNER: Golden Castle Ltd./Unitech Building Systems LOCATION: THE PROJECT SITE ENCOMPASSES 33.7 ACRES AND IS LOCATED WEST OF THE TERMINI OF MOUNTAIN STREET AND RUNNING DEER ROAD. Change the entire 33.7 acre site,from Future Specific Plan Area "Q" (the £uture Golden Castle Specific Plan) to Low Medium Density Residential (six dwellinq units per acre) Approval is based on the following: 1. The proposed General Plan Amendment will not be: a) detrimental to the health, safety, comfort or general welfare of the persons residing or working wi'chin the neighborhood of the proposed amendment or within the City, or b) injurious to the property or improvements in the neighborhood or within the City. 2. The proposed General Plan Amendment will permit reasonable development of the area consistent with its constraints and will make the area more compatible with adjacent properties. 3. The proposed General Plan Amendment would establish a land use density and usage more in character with the subject property's location, access and constraints. 4. The proposed General Plan Amendment will not have a siqnificant effect on the environment. Page 2 Resolution No. 96- 32 B. GENERAL PLAN AMENDMENT 96-3 APPLICANT/PROPERTY OWNER: The City of Lake Elsinore IACATION: THE PROJECT SITE ENCOMPASSES APPROXIMATELY 18 ACRES CONSISTING OF TWO NINE ACRE PARCELS LOCATED SOUTHWEST OF THE INTERSECTION OF MOUNTAIN AND LAKE STREETS. Change the entire 18 acre site from Specific Plan Area "N" (Santa Rosa) to Low Medium Density Residential (six dwelling units per acre) Approval is based on the following: l. The proposed General Plan Amendment will not be: a) detrimental to the health, safety, comfort or general welfare of the persons residing or working within the neighborhood of the proposed amendment or within the City, or b) injurious to the property or improvements in the neighborhood or within the City. 2. The proposed General Plan Amendment will permit reasonable development of the area consistent with its constraints and will make the area more compatible with adjacent properties. 3. The proposed General Plan Amendment would establish a land use density and usage more in character with the subject property's location, access and constraints. 4. The proposed General Plan Amendment will not have a significant effect on the environment. C. GENERAL PLAN AMENDMENT 96-4 APPLICANT/PROPERTY OWNER: Tozai Inc. LOCATION: THE PROJECT SITE ENCOMPASSES APPROXIMATELY 10.4 ACRES OF PROPERTY FRONTING LAKESHORE DRIVE LOCATED 420' NORTHWEST OF THE INTERSECTION OF RIVERSIDE DRIVE AND LAKESHORE DRIVE. Change the entire 10.4 acre site from Future Specific Plan Area "Q" to General Commercial. Approval is based on the following: 1. The proposed General Plan Amendment will not be: a) detrimental to the health, safety, comfort or general welfare of the persons residing or working within the neighborhood of the proposed amendment or within the City, or b) injurious to the property or improvements in the neighborhood or within the City. 2. The proposed General Plan Amendment will permit reasonable development of the area consistent with its constraints and will make the area more compatible with adjacent properties. 3. The proposed General Plan Amendment would establish a land use density and usage more in character with the subject property's location, access and constraints. Page 3 Resolution No. 96-32 4. The proposed General Plan Amendment will not have a significant effect on the environment. PURSUANT TO THE ABOVE FINDINGS, IT IS RESOLVED by the City Council of the City of Lake Elsinore, California, that the City of Lake Elsinore General Plan be amended for the second time in calendar year 1996 to reflect General Plan Amendments 94-3, 96-3 and 96-4. PASSED, APPROVED AND ADOPTED this 25th day of June, 1996, by the following vote: A.
