Home My WebLink AboutCC Reso No 1997-67,~ - .,, ;~ ;.:;, ,.~~> ~ RESOLUTION N0. 97-67 A RESOLUTION OF TI~ CITY COUNCIL OF TI~ CITY OF LAKE ELSINORE, CALIFORNIA RESCINDING RESOLUTION NO. 95-45 (BUSINESS LICENSE FEE INCREASE) AND RE-ADOPTING FEES AS SET BY RESOLLJTION 91-11 VJHEREAS, the passage of Proposition 218 requires ihat all tax increases be voted upon after June 1995; and WHEREAS, the business license increase set by Resolution 95-45 failed to pass by the majority vote oa November 4, 1997; and NOW, Tf~REFORE, BE TT RESOLVED, by the City Council of the City of Lake Elsinore that the Business License Fees be re-established to reflect the amount established by Resolution 91-1 L• SECTION 1: Effective February 1, 1991, annual business license fees in the following categories as defined by City Ordinance No.657 will be: A General B. SECTION 2: In addition to the above stated fees, each business will be required to pay $ 6.50 per year for each employee over five (5). SECTION 3: Each general building or engineering contractor shall furnish t6e license collector with a list of all sub-contractors upon forms fiunished by the license collector prior to obtaining an iaspection of the work performed by such sub-contractors. It shall be the responsibility of every general building and engineering contractor to require sub- contractors under lris control or direction to obtain a business license as herein provided before permitting said sub-conuactor to begin or perform services for said general building or engineering contracting. Every person engaged in the business of a city license for doing the type of work suthorized before obtau~ing a city building permit. License fees shall be as follows: Group 1 -- Every person engaged in a business or acting as a general or engineering contractor (B-1 or A) -- $108.00 per annum. Group 2 -- . Every person engaged in a business or acting as a sub-contractor per classifications established by the State Contractors Boazd as set forth under the group in the Municipal Code, and other persons that do jobs less than $300.00 in value -- $ 65.00 per annum. Group 3 -- (1) A business license shall be required of every person acting as an owner-builder who builds any building or structure for the pwpose of sale or as rental units. The license tax for such owner-builder shall be $ 98.00 per annum. (2) It shall be the responsibility of every owner-builder to require all sub- contractors under his convol or direction to obtain a business license as herein provided before permitting such subconuactor to begin work or perform any service for the owner-builder. Each owner-builder shall furnish the license department with a list of sub-contractors, as mentioned above, prior to the starting of any work. It shall be the responsibility of every owner-builder to detemune that sub-conuactors have obtained a proper business license before suc6 owver-builder shall request and/or receive any city building department inspection. SECTION 4: Posting, display, etc., of liceases All licenses must be kept and posted in the following manner: (1) At a fixed place of business in the City, the license shall be kept and posted in a conspicuous place upon the premises where such business is conducted. (2) Businesses not conducted from a fixed place in the City, the license shall be ~` kept at all times in the possession of the person while conducting the business within the City. (3) For the use of any vehicle a license tag or plate or other satisfactory means of 2 ~ identification shall be issued by the license collector. It shall be conspicuously attached to every vehicle, used in the conduct of the person's business within the ~ City.' The fee for such tag or plate or other satisfactory means of identification shall be as set forth in Section 1(F) 1. . ` (4) For each coin-operated vending, cigarette, music and amusement machine a ~ license tag or other satisfactory means of identification shall be issued by the license collector. Said identification shall be conspicuously attached to each such : ~; . machine, , ~. ; S~CTION 5: Other (1) Any persons, companies or corporations coaducting business in the City of Lake Elsinore but not having their principal place of business in the City shall be assessed the same fees, zoning requirements and regulations as are applicable to other such businesses wluch are located in the City. (2) Examples of tlris category include but are aot limited to Real Estate brokers, auckioneers, salesmen, and agents who conduct business in the City on weekends and/or after the normal workday. (3) The Code Enforcement Officer shall conduct special weekend enforcement efforts to insure that proper licenses have been obtained or that notices and citations are issued to persons conducting such business in the City.
