Home My WebLink AboutCC Reso No 1997-65RESOLUTION NO. 97-~A A RESOLUTION OF THE CITY COUNCIL OF THE CTTY OF LAKE ELSINORE, CALIFORNIA, MAKING AMENDMENT TO THE LAKE ELSINORE GENERAL PLAN FOR THE THIIiD CYCLE OF THE CALENDAR YEAR OF 1997 CHANGING THE LAND USE DESIGNATION OF ASSESSOR'S PARCEL NUMBER 377-330-007 FROM MEDIUM DENSITY RESIDENTIAL TO GENERAL COMMERCIAL THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, Section 65361(a) of the Government Code provides that no mandatory element of a General Plan shall be amended more frequently than four tunes during any calendar year; WHEREAS, the Planning Commission held a public hearing on this General Plan Amendment 97-3 on September 17, 1997 and that the public hearing was advertised as required by law. The Planning Commission made recommendations to the City Council concerning this General Plan Amendment and has filed with the City Council copies of maps and reports; and WHEREAS, nouce was duly given of the public hearing on this Amendment, which public hearing was held before the City Council on the 28th day of October, 1997 at the hour of 7:00 p.m., with testimony received being made a part of the public record; and WHEREAS, all requirements of the California Environmental Qualiry Act have been met for the consideration of whether these projects will have a significant effect on the environment. NOW THEREFORE, in consideration of the evidence received at the hearing, and for the reasons discussed by the Council members at said hearing, the City Council now finds that the Lake Elsinore General Plan be amended as follows: GENERAL PLAN AMENDMENT 97-3 LOCATION: LOCATED ALONG FRANKLIN STREET, ASSESSOR'S PARCEL NUMBER 377-330-007 Approval is based on the following: The proposed General Plan Amendment will not be: a) detrimental to the health, safety, comfort or general welfare of the persons residing or working within the neighborhood of the proposed amendment or within the City, or b) injurious to the property or improvements in the neighborhood or within the City. The proposed General Plan Amendment will permit reasonable development of the area consistent with its constraints and will make the area more compatible with adjacent properties. The proposed General Plan Amendment would establish a land use density and usage more in character with the subject property's location, access and constraints. The proposed General Plan Amendment will not have a significant effect on the environment. PURSUANT TO THE ABOVE FINDINGS, IT IS RESOLVED by the City Council of the City of Lake Elsinore, California, that the City of Lake Elsinore General Plan be amended for the third time in calendar year 1997 to reflect General Plan Amendment 97-3. DATE: November 4, 1997 ( ;~ VICI~ii KA~N4~, CITY CLERK , ~;>I'~'Y Gi' ~i ~91~E ELSINORE (3f.:t1L) RESOLUTION NO. 97-65 B A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE ACKNOWLEDGING THE "WHITE PAPER" ENTI'iZED RECYCLED WATER FOR LAKE ELSINORE: PUBLIC ACCEPTANCE ISSUES AND RECOMNIENDATIONS, PREPARED BY THE RECYCL~D WATER TASK FORCE. WHEREAS, under the 1991 Agreement to Fill and Operate Lake Elsinore, EVMWD and the City of Lake Elsinore have identified recycled water as a potential source to supplement Lake Elsinore; and WHEREAS, to have meaningful public participation, EVMWD, the City of Lake Elsinore, and the Lake Elsinore Valley Chamber of Commerce commissioned a Recycled Water Task Force to identify public acceptance issues and recommendations for using recycled water in the Lake; and WHEREAS, since January, its seventeen members have worked cooperatively to examine the facts about recycled water requirements for the protection of human health, the environment, and water quality in the Lake; and WHEREAS, the findings, conclusions and recommendations of the task force are contained in a "white paper'; WHEREAS, by successfully completing their mission, the Recycled Water Task Force has demonstrated the value of a public involvement process; NOW, THEREFORE, BE IT RESOLVED, in receiving the "white paper", this Council Appreciates the recommendations of the Recycled Water Task Force; and NOW BE IT FURTHER RESOLVED, the City Council of the City of Lake Elsinore commends the participants of the Recycled Water Task Force for considering the needs of the Lake and the Community in a balanced and thoughtful manner.
