HomeMy WebLinkAboutCC Reso No 1997-45RESOLUTION NO. 97-45 A RESO~UTION OF THE CITY COUNCIL OF THE CITY•'OF LAKE ELSINORE, CALIFORNIA, CONSOLIDATING A BALLOT MEASURE WITH THE HOLDING OF A GENERAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, NOVEMBER 4, 1997, FOR SUBMISSION TO THE QUALIFIED ELECTORS OF SAID CITY RELATING TO THE IMPOSITION OF A SPECIAL TAX TO FUND CERTAIN GENERAL GOVERNMENTAL SERVICES. r' WHEREAS, die City Comicil of die City of Lake Elsuiore desires to submit to die qualified electors of said City at the General Mwiicipal Election, a measure relating to die imposition of a special tax to fund certain general govermnental services; aud WHEREAS, the City Couucil of said City is thereupou authorized and directed by statute to submit said measure to the qualified voters: NOW, THEREFORE, BE IT RESOLVED that the City Cowicil of the City of Lake Elsinore does hereUy resolve, detennine aud order as follows: SECTION 1. That pursua~it to the requiremeiits of the laws of the State of Califoniia relating to cities wifluu said State, there sl~all be aud there is hereby called and ordered held in the City of Lake Elsiuore, Comity of River.iide, State of California, on Tuesday, November 4, 1997, a Geueral Muuicipal Election of the qualified elec4ors of said City, for the purpose of submittiug the following question, to wit: Shall there be imposed an annual special tax for Public Safety services within the City of Lake Elsinore for a six year period commencing fiscal year 1998/99, pursuant to the following formula: CATEGORY Single Family Multiple Family Mobile Home Park Commercial/Industrial Vucant Residential Vacant Other SERVICES Police Fire Structure Abatement Graffiti ~~ L- $10.50 $ 7.88 $15.75 $271.70 per acre YES NO $15.75 per equivalent unit $135.85 per acre PERCENT OF TAX 33'%~ 55"/~ G"/~ G"/~ PAGE TWO - RESOLUTION NO. 97- 4s SECTION 2. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. SECTION 3. That the polls, for said election shall open at seven o' clock a.m. of the day of said election and shall remain open continuously from said time until eight o'clock p.m. of the same day when said polls shall be closed, except as provided in Section 14401 of the elections Code of the State of California. SECTION 4. That all Councilmembers are hereby authorized, but not required, to file written arguments either in favor of or in opposition to this measure. SECTION 5. That said written arguments sha11 be in accordance with Article 4, Chapter 3, Division 9 of the Elections Code of the State of California and said written arguments may be changed until and including the date fixed by the City Clerk after which no arguments for or against said City measure may be submitted to the City Clerk. SECTION 6. That the City Council directs the City Clerk to transmit a copy of the measwe to the City Attorney. The City Attorney sha11 prepare an impartial analysis of the measwe on the e~sting law and the operation of the measure. The impartial analysis sha11 be filed by the date set by the City Clerk for the filing of primary arguments. SECTION 7. That in a11 particulars not recited in this resolution, said elections sha11 be held and conducted as provided by law for holding municipal elections in said City. SECTION 8. That notice of the time and place of holding of said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election in the form and manner as required by law. SECTION 9. That the City. Clerk sha11 certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City, and shall make a minute passage and adoption thereof in records of tlie proceedings of flie City Council and said City, in the minutes of the meeting at which the same is passed and adopted. SECTION l0a That the City Council of said City desires the canvass of said election to be made by the County Registrar of Voters. SECTION 1L That the Riverside County Registrar of Voters shall, prior to the 6th day of November, 1997, commence the canvass of the General Municipal Election, to be held in said City on the 4th day of November, 1997, and shall certify tlie results to this City Council on November 24, 1997. That said City shall reimburse the County of Riverside Registrar of Voters for the cost of services performed relative to the conduct of the General Municipal Election, after completion of all work and upon presentation to the City of a properly approved bill. SECTION 13. That the City Clerk is hereby directed to forward a certified copy of this resolution without delay, to said Registrar of Voters of Riverside County. SECTION 14. That the City Clerk shall certify to the passage and adoption of tlus Resolution and enter it into tlie book of original resolutions. SECTION 15. That this resolution sha11 take effect immediately.
