WHEREAS, the City Comicil of tl~e City of Lake Elsiuore desires to submit to the qualified electors of said City at the General Municipal Electiou, a measure relating to the imposition of a special t~ to fimd certaiu general govetYUnental services; and WHEREAS, flie City Couucil of said City is thereupon autl~orized uid directed by statute to submit said measure to d~e qualified voters: NOW, THEREFORE, BE IT RESOLV~D tl~at the City Council of d~e City of Lake Elsinore does hereby resolve, detennine and order as follows: SECTION 1. That pursuant to the requirements of the laws of die State of Califoniia relating to cities within said State, there sl~all be and there is hereby called aud ordered lield in die City of Lake Elsinore, County of River.Side, State of G'alifonua, op Tuesday, Noveinber 4, 1997, a Geueral Municipal El~ction ri~ ~tli~b q~+~-i~1mtl t~1~s~tt~rn of said City, Por the p~-rpos~ of submitting tUe following questiou, to wit: Shall there be imposed an annual special tax for Parks and Recreation services within the City of Lake Elsinore for a six year period commencing fiscal year 1998/99, pursuant to the following formula: Single Family Multiplc ramily Mobile Home Park Commercial/Industria l Vacant Residential ~ Varant Other ~ rics Senior C~nter YES NO ~~ ~27.00 $20.2.5 $15.75 $271.70 per acre $15.75 per equivalent unit $135.85 per acre ~'~RCENT OF TAX 62% 30%~ 8"/~ f PAGE TWO - RESOLUTION NO. 97- 44 SECTION 2. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. SECTION 3. That the polls, for said election sha11 open at seven o'clock a.m. of the day of said election and shall remain open continuously from said time until eight o'clock p.m. of the same day when said polls sha11 be closed, except as provided in Section 14401 of the elections Code of the State of California. SECTION 4. That all Councilmembers are hereby authorized, but not required, to file written arguments either in fa~or of or in opposition to this measure. SECTION 5. That said written arguments sha11 be in accordance with Article 4, Chapter 3, Division 9 of the Elections Code of the State of California and said written arguments may be changed until and including the date fixed by die City Clerk after which no arguments for or against said City measure may be submitted to the City Clerk. SECTION 6. That the City Council directs the City Clerk to transmit a copy of the measure to the City Attorney. The City Attorney shall prepare an impartial analysis of the measure on the existing law and the operation of the measure. The impartial analysis shall be filed by the date set by the City Clerk for the filing of primary arguments. SECTION 7. That in all particulars not recited in this resolution, said elections shall be held and conducted as provided by law for holding municipal elections in said City. SECTION 8. That notice of the time and place of holding of said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such further or additional notice of said election in the form and manner as required by law. SECTION 9. That tlie City Clerk shall certify to the passage and adoption of this resolution; shall enter the same in the book of original resolutions of said City, and shall make a minute passage and adoption thereof in records of the proceedings of the City Council and said City, in the minutes of the meeting at which the same is passed and adopted. SECTION 10. That the City Council of said Gity desires the canvass of said election to be made by the County Registrar of Voters. SECTION 11. That the Riverside County Registrar of Voters shall, prior to the 6th day of November, 1997, commence the canvass of the General Municipal Election, to be held in said City on the 4th day of November, 1997, and sha11 certify the results to this City Council on November 24, 1997. That said City shall reimburse the County of Riverside Registrar of Voters for the cost of services performed relative to the conduct of the General Municipal Election, after completion of a11 work and upon presentation to the City of a properly approved bill. SECTION 13. That the City Clerk is hereby directed to forward a certified copy of this resolution without delay, to said Registrar of Voters of Riverside Counry. SECTION 14. That the City Clerk shall certify to the passage and adoption of ttus Resolution and enter it into the book of original resolutions. SECTION 15. That this resolution shall take effect nnmediately.
