HomeMy WebLinkAboutCC Reso No 1997-43RESOLUTION NO. 9~I- 43 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, CONSOLIDATING A BALLOT MEASURE WITH THE HOLDING OF A GENERAL MiJNICIPAL ELECTION TO BE HELD IN 5AID CITY ON TUESDAY, NOVEMBER 4,1997, FOR SUBMISSION TO THE QUALIFIED ELECTORS OF SAID CITY RELATING TO THE RATIFICATION OF A GENERAL BUSINESS LICENSE INCREASE EFFECTIVE JULY 15, 1995. WHEREAS, the City Council of the City of Lake Elsinore proposes to submit to the qualified electors of said City at the General Municipal Election, a ballot measure relating to the ratification of an increase of the business license ta~c effective July 15, 1995; and WHEREAS, pursuant to Article XIII C[c] "any general t~vc imposed, extended, or increased, without voter approval, by any local govemment on or after January 1, 1995, and prior to the effective date of this Article shall continue to be imposed only if approved by a majority vote of the voters voting in an election on the issue of the imposition, which election shall be held within rivo years of the effective date of the Article and in compliance with subdivision (b)." [at a regularly scheduled general election] WHEREAS, the City Council of said City is thereupon authorized and directed by statute to submit said measure to the qualified voters: NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lake Elsinore does hereby resolve, deterniine and order as follows: SECTION 1. That pursuant to the requirements of the laws of the State of California relating to cities within said State, there shall be held in the City of Lake Elsinore, County of Riverside, State of California, on Tuesday, November 4, 1997, a General Municipal Election of the qualified electors of said City, and the following ballot measure shall be consolidated into that election: PAGE TWO - RESOLUTION NO. 97-43 Shall the City continue to collact a business YES license tau increase that went into effect - July 15, 1995? NO SECTION 2. That the ballots to be used at said election shall be, both as to form and matter contained therein, such as may be required by law to be used thereat. SECTION 3. That the polls, for said election shall open at seven o'clock a.m. of the day of said election and shall remain open continuously from said time until eight o'clock p.m. of the same day when said polls shall be closed, except as provided in Section 14401 of the Elections Code of the State of California. SECTION 4. That all Councilmembers are hereby authorized, but not requued, to file written arguments either in favor of or in opposition to tYus measure. SECTION 5. That said written arguments shall be in accordance with Article 4, Chapter 3, Division 9 of the Elections Code of the State of California and said written arguments may be changed until and including the date fixed by the City Clerk after wluch no arguments for or against said City measure may be submitted to the City Clerk. SECTION 6. That the City Council directs the City Clerk to transmit a copy of the measure to the City Attomey. The City Attorney shall prepaze an impartial analysis of the measure on the e~sting law and the operation of the measure. The impartial analysis shall be filed by the date set by the City Clerk for the filing of primary arguments. SECTION 7. That in all particulars not recited in this resolution, said elections shall be held and conducted as provided by law for holding municipal PAGE T~-IREE - RESOLUTION NO. 97- 43 elections in said City. SECTION 8. That notice of the time and place of holding of said election is hereby given and the City Clerk is hereby authorized, instructed and directed to give such furkher or additional notice of said election in the form and manner as required by law. SECTION 9. That the City Clerk shall certify to the passage and adoption of this resolution; sha11 enter the same in the book of original resolutions of said City, and shall make a minute passage and adoption thereof in records of the proceedings of the City Council and said City, in the minutes of the meeting at wluch the same is passed and adopted. SECTION 10. That the City Council of said City desires the canvass of said election to be made by the County Registrar of Voters. SECTION 11. That the Riverside County Registrar of Voters sha11, prior to the 6th day of November, 1997, commence the canvass of the General Municipal Election, to be held in said City on the 4th day of November, 1997, and shall certify the results to this City Council on the November 24, 1997. SECTION 12. That said City shall reimburse the County of Riverside Registrar of Voters for the cost of services performed relative to the conduct of the General Municipal Election, after completion of all work and upon presentation to the City of a properly approved bill. SECTION 13. That the City Clerk is hereby directed to forward a certified copy of this resolution without delay, to said Registrar of Voters of Riverside County. SECTION 14. That the City Clerk shall certify to the passage and adoption of this Resolution and enter it into the book of original resolutions. SECTION 15. That this resolution shall take effect immediately.
