HomeMy WebLinkAboutCC Reso No 1998-37RESOLUTION NO. 98-37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAI{E ELSINORE, CALIFORNIA, CERTIFYING THE LA LAGUNA ESTATE • ENVIKONMENTAL IMPACT REPORT NO. 92-2 - LA LAGUNA ESTATES THE C1TY COUNCIL OF THE CTTY OF LAKE ELSINORE, CALIFORNIA, DOES ORDAIN AS FOLLOWS: WHEREAS, the La Laguna Estates Specific Plan ("Specific Plan")area consists of 489 acres and is bordered by Cleveland National Forest to the west, and is bisected by McVicker Canyon on the south and Rice Canyon on the north. The site is located directly west of Grand Avenue and Lincoln Street. WIIEREAS, the proposed Specific Plan proposes 480 single-family detached and 180 single-family attached residential units, for a total of 660 residential units and 282 total acres of Open Space. WHEREAS, on September 16, 1998, the City Planning Commission held a duly noticed public hearing to consider the Specific Plan and the Environmental Impact Report ("Final EIR") for the Specific Plan, and following such public hearing, voted unanimously to recommend that the City Council (1) certify the Final EIR as meeting the requirements of the California Environmental Quality Act ("CEQA") and the CEQA Guidelines, and (2) approve the La Laguna Estates Specific Plan; WHEREAS, the City Council held a duly noticed public hearing on October 13, 1998, for the purposes of certifying the Final EIR, and considering the Specific Plan; WHEREAS, pursuant to CEQA, the Final EIR has been prepared, certified and considered by the City Council and has been found to adequately address the potential environmental impacts of the Specific Plan. The City Council has considered the information contained in the Final EIR prior to approval of the Specific Plan and the Final EIR represents the final independent judgement of the City Council. WHEREAS, the establishment and implementation of the Specific Plan as submitted, undex current circumstances, will not be detrimental to the health, safety, comfort or general welfare of the persons residing in the area of the Specific Plan; and WHEREAS, the condifions recommended by the Planning Commission will be incorporated into the Specific Plan to ensure that the issues identified by the Planning Commission have been resolved. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL FOR THE CITY OF LAKE ELSINORE THAT: 1. The La Laguna Estates Draft EIR, Mitigation Monitoring Program, Response to Comments document, Findings and Fact document, Statement of Ovemding Considerarions, Habitat Mitigation Plan have been prepared, submitted and reviewed in accordance with requirements of the California Environmental Quality Act and the City's CEQA requirements, and are complete and adequate in their evaluation of all environmental effects of the Specific Plan and associated discretionary approvals. The La Laguna Estates Specific Plan will result in unavoidable impact to the visual character and natural aesthetic value of the hillside and will contribute to cumularive degradation of the air basin. A Statement of Overriding Considerations was prepared to offset these unavoidable impacts. The City can approve the Specific Plan even though the Specific Plan will cause significant effects on the environment, as described in Section 15043 of CEQA and Sections 21002, 21083, and 21087 of the California Public Resources Code. 2. The La Laguna Estates Specific Plan will not significantly degrade the quality of the environment, substantially reduce fish habitat or wildlife species, cause fish or wildlife population to drop, threaten plant or animal communities, reduce or restrict the range of rare or endangered plant or animal species, eliminate important cultural resources, or significantly affect or be affected by land use, energy resources, agriculture, seismicity, water quality, traffic, public utiliries or services.
