HomeMy WebLinkAboutCC Reso No 1998-36~~ RESOLUTION NO. 98- 36 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNLA, MAHING AN A11'~NDMENT TO THE LAKE ELSINORE GENERAL PLAN FOR THE SECOND CYCLE OF THE CALENDAR YEAR OF 1998 CHANGING THE LAND USE DESIGNATION OF ASSESSOR'S PARCEL NUMBER(S) 363-100-016, AND 022 FROM MEDIUM DENSITY RESIDENTIAL AND LOW MEDIUM DENSITY TO GENERAL COMMERCIAL. THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: WHEREAS, Section 65361(a) of the Government Code provides that no mandatory xr--, element of a General Plan shall be amended more frequently than four times during any calendar ~.: w year; WHEREAS, the Planning Commission held a public hearing on this General Plan Amendment No. 98-5 on September 16, 1998 and that the public hearing was advertised as required by law. The Planning Commission made recommendations to the City Council concerning this General Plan Amendment and has filed with the City Council copies of maps and reports; and WHEREAS, notice was duly given of the public hearing on this Amendment, which public hearings was held before the City Council on the 13th day of October, 1998 at the hour of 7:00 p.m., with testimony received being made a part of the public record; and WHEREAS, all requirements of the Califomia Environmental Quality Act have been met for the consideration of whether these projects will have a significant effect on the environment. NOW THEREFORE, in consideration of the evidence received at the hearing, and for the reasons discussed by the Council members at said hearing, the City Council now finds that the Lake Elsinore General Plan be amended as follows: GENERAL PLAN AMENDMENT NO 98-5 LOCATION: LOCATED AT THE IN'TERSECTION OF FRANKLIN STREET AND CASINO DRNE, ASSESSOR'S PARCEL NUMBER(S) 363-010-016, AND 022. Approval is based on the following: 1. The proposed General Plan Amendment will not be: a) detrimental to the health, safety, comfort or general welfaze of the persons residing or working within the neighborhood of the proposed amendment or within the City, or b) injurious to the property or improvements in the neighborhood or within the City. 2. The proposed General Plan Amendment will permit reasonable development of the area consistent with its constraints and will make the area more compatible with adjacent properties. The proposed General Plan Amendment would establish a land use density and usage more in chazacter with the subject properiy's location, access and constraints. 4.
