A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF LAKE ELSINORE, CALIFORNIA,
ESTABLISHING A FEE FOR A PERMIT APPLICATION TO
REMOVE OR RELOCATE A SIGNIFICANT PALM TREE
PURSUANT TO CHAPTER 5.78 OF THE LAKE ELSINORE MUNICIPAL CODE
WHEREAS, Chapter 5.78 of the Lake Elsinore Municipal Code requires that a permit be
obtained from the Office of the Director of Community Services prior to the removal or relocation
of a Significant Palm as defined by Section 5.78.00 thereof; and
WHEREAS, Section 5.78.040 of the Lake Elsinore Municipal Code requires payment of an
application fee to cover the costs of processing and administering the application for removal or
relocation of a Significant Palm; and
WHEREAS, the processing and administration of the application for a permit pursuant to
Chapter 5.78 of the Lake Elsinare Municipal Code is estimated to require not less than three (3)
hours of staff time to ensure satisfaction of the requirements of Chapter 5.78, including (without
limitation) such activities as review of applications for completeness, verification of location of
Significant Palms, verification of property ownership, verification of proposed truck routes and
proposed manner of removal or relocation, verification of posting requirements, site inspections
before and after removal or relocation, and inspection of proposed relocation sites; and
WHEREAS, pursuant to Executive Order No. 95-001, the City has an adopted cost
accounting policy for cost recovery purposes establishing a One Hundred, Twenty-Three Dollar
($123.00) hourly rate for staff based upon such factors as salary, benefits, overhead and fixed asset
charges.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Lake
Elsinore does hereby resolve as follows:
Section 1. The City Council hereby establishes the application fee for removal or relocation
of a Significant Palm pursuant to Chapter 5.78 of the Lake Elsinore Municipal Code at Three
Hundred, Sixty-Nine Dollars ($369.00).
Section 2. The City Council hereby finds that the application fee established hereby is not
imposed as a condition of approval of a development project and does not exceed the estimated cost
to process and administer the application.
