Home My WebLink AboutCC Reso No 2000-39RESOLUTION NO. 2000-39 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, CERTIP'YING NEGATIVE DECLARATION NO. 00-02 WHEREAS, Castle and Cooke California, Inc. has submitted applications for the Lake Elsinore Outlet Center Specific Plan Amendment No. 3(SPA No. 3), Zone Change No. 00-02, and Minor Design Review No. 00-02. The 43-acre Lake Elsinore Outlet Center Specific Plan area is located southwest of the I-15 Freeway, just south of Nichols Road. Collier Avenue runs along the southwestern boundary of the Outlet Center. Proposed SPA No. 3 will annex another 3.5 acres into the Specific Plan area. With project implementation, the Lake Elsinore Outlet Center will tota146.5 acres; and WHEREAS, SPA No. 3, Zone Change No. 00-02, and Minor Design Review No. 00-02 together comprise the "project" as defined by Section 21065 of the California Environmental Quality Act (CEQA), Cal: Public Resources Code § 21000 et seq., which is defined as an activity which may cause either a direct physical change in the environment, or a reasonably foreseeable indirect physical change in the environment and which includes the issuance to a person of a lease, permit, license, certificate, or other entitlement for use by one or more public agencies; and WHEREAS, Negative Declaration No. 00-02 has been prepared to evaluate environmental impacts resulting with the project; and WI3EREAS, the Planning Commission of the City of Lake Elsinore at a regular meeting held on .Tuly 5, 2000 made its report upon the desirability of the proposed project and made its recommendations in favor of certif'ying the proposed Negative Declararion by adopring Planning Commission Resolution No. 00-26 recommending to the City Council certification of Negative Declaration No. 00-02; and WHEREAS, public notice of said applications has been given, and the City Council has considered evidence presented by the Community Development Department and other interested parties at a public hearing held with respect to this item on August 22, 2000; and WHEREAS, in accordance with Secrion 15071 of the State CEQA Guidelines, Negative Declaration No. 00-02 consists of: a. A brief description of the project; b. Locarion of the project and name of the project proponent; c. Proposed finding that the project will not have a significant effect on the environment; d. An attached copy of the Initial Study, documenting reasons to support the finding; and e. Comments received on the Negatice Declaration during flie 30-day public review period, and responses to comments received. NOW THEREFORE, the City Council of the City of Lake Elsinore DOES HEREBY RESOLVE as follows: 1. The City Council finds that Negative Declaration No. 00-02 has been prepared, submitted and reviewed in accordance with requirements presented in Section 15074 of the California Environmental Quality Act and the City's CEQA requirements, and is complete and adequate in its evaluation of all environmental effects of the Lake Elsinore Outlet Center Specific Plan Amendment No. 3, Zone Change No. 00-02, and Minor Design Review No. 00-02. The Lake Elsinore Specific Plan Amendment No. 3, Zone Change No. 00-02, and Minor Design Review No. 00-02 will not result in any significant and/or unavoidable impacts. 2. The City Council finds that the proposed applications will not have impacts that are individually limited but cumulatively considerable. Given that project impacts are insignificant, cumulative impacts are not foreseen. RESOLUTION NO. ~00-39 PAGE 2 3. The City Council finds that the proposed applications do not have the potential to adversely affect humans, either directly or indirectly. 4. Negarive Declaration No. 00-02 and the records of the proceedings upon which this decision is based, aze and will be on file with the City of Lake Elsinore, 130 South Main Street, Lake Elsinore, Califomia 92530. PURSUANT TO THE ABOVE FINDINGS this City Council of the City of Lake Elsinore resolves that Negarive Declaration No. 00-02 serves as adequate and appropriate environmental documentation for Lake Elsinore Outlet Center Specific Plan Amendment No. 3, Zone Change No. 00-02, and Minor Design Review No. 00-02 and hereby certifies Negative Declarafion No. 00-02 as complete and adequate, and fully complies with the requirements of CEQA, the State CEQA Guidelines, and the City's environmental analysis procedures.
