HomeMy WebLinkAboutCC Reso No 2002-25RESOLUTION NO. 2002- 25a A RESOLUTION BY THE CITY COUNCIL OF THE CITY OF LAKE ELSINORE AUTHORIZING THE EXTENSION OF THE SERVICE FEE COLLECTED ON BEHALF OF THE RIVERSIDE COUNTY ABANDONED VEHICLE ABATEMENT SERVICE AUTHORITY UNTIL MAY 2014. WHEREAS, the Riverside County Abandoned Vehicle Abatement Service Authority was formed on or about June 1, 1994, pursuant to the provisions of California Vehicle Code sections 9250.7 and 22710 enacted by the Legislature in 1990 which authorize the establishment of a service authority and imposition of a service fee on all registered motor vehicles located within a county. WIIEREAS, beginning in 7une 1994 and continuing to the present, the Riverside County Abandoned Vehicle Abatement Service Authority has been the recipient of service fees collected on its behalf by the California Department ofMotor Vehicles; and WHEREAS, the service fees received by the Riverside County Abandoned Vehicle Abatement Service Authority are used to reimburse local governmental agencies for a portion of their costs incurred as a result of the abatement, removal and disposal as public nuisances of any abandoned, wrecked, dismantled, or inoperative vehicles or parts thereof; and WI3EREAS, the Riverside County Abandoned Vehicle Abatement Service Authority apportions and distributes service fee proceeds to each member agency according to the formula set forth in California Vehicle Code section 22710; and WHEREAS, since the establishment of the Abandoned Vehicle Abatement ~rogram in 7une 1994 it has disbursed $8,291,295 in service fee proceeds to member agencies and caused the abatement of approximately 60,671 abandoned, wrecked, dismantled, or inoperative vehicles located in various cities and the unincorporated area ofRiverside County; and WIIEREAS, the service fee collected as part of the Abandoned Vehicle Abatement program is set to expire in May 2004; and WHERAS, the Legislature recently amended California Vehicle Code Section 9250.7 to allow for an eactension of the service fee collected as part of the Abandoned Vehicle Abatement Program in increments of up to 10 years each if the Board of Supervisors of the County, by a two-thirds vote, and a majority of the cities comprising a majority of the population of the incorporated areas within the county adopt resolutions providing for the extension of the service fee; and WHEREAS, it is desirable to the City of Lake Elsinore to have the Abandoned Vehicle Abatement program continue beyond its current terrnination date of May 2004. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Lake Elsinore approves the extension of the service fee collected on behalf of the Riverside County Abandoned Vehicle Abatement Service Authority until May 31, 2014. RESOLUTION NO. 2002-25b A RESOLUTION OF TAE CITY COUNCIL OF THE CITY OF LAKE ELSINORE, CALIFORNIA, MAHING AN AMENDMENT TO THE LAKE ELSINORE GENERAL PLAN LAND USE ELEMENT FOR THE FIRST CYCLE OF THE CALENDAR YEAR 2002 FOR THE APPROVAL OF GENERAL PLAN AMENDMENT NO. 2002-02 TO AMEND THE LAND USE DESIGNATION OF PARCELS SPECIFICALLY DESCRIBED AS (APN 370-030-O11, 370- 050-002, AND 370-050-012 FROM RESIDENTIAL 2 UNDER THE LIBERTY SPECIFIC PLAN TO (L-1) LIMITED INDUSTRIAL UNDER THE GENERAL PLAN. WHEREAS, the Alesco Development has initiated proceedings to remove APN's 370- 030-011, 370-050-002, and 370-050-012 from the Liberty Specific Plan therefore triggering Amendment No. 3 to the Liberty Specific Plan and the subject General Plan Amendment. WHEREAS, Section 65361(a) of the Government Code provides that no mandatory element of a General Plan shall be amended more frequently than four times during any calendar Ye~; WHEREAS, the Planning Commission of the City of Lake Elsinore at a regular meeting held on June 5, 2002 made its report upon the desirability of the proposed project and made its recommendations in favor of said General Plan Amendment No. 2002-02 by adopting Planning Commission Resolution No. 2002-17 recommending to the City Council approval of General Plan Amendment No. 2002-02; and WHEREAS, public notice of said application has been given, and the City Council has considered evidence presented by the Community Development Department and other interested parties at a public heazing held with respect to this item on June 5, 2002; NOW THEREFORE, the City Council of the City of Lake Elsinore DOES AEREBY RESOLVE as follows: SECTION 1. The City Council has considered the proposed General Plan Amendment No. 2002-02, prior to making a decision to approve the proposed amendment to the Land Use Designation. The City Council finds and determines that Mitigated Negative Declaration No. 2002-O1 is adequate and prepared in accordance with the requirements of the California Environmental Quality Act (CEQA) which analyzes environmental effects of ends City Council certification, based upon the following findings and determinations: SECTION 2. That in accordance with State Planning and Zoning law and the City of Lake Elsinore the following findings far the approval of General Plan Amendment No. 2002-02 have been made as follows: RESOLUTION NO. 2002- 25 PAGE NO. 2 1. The proposed General Plan Amendment will not be: a) detrimental to the health, safety, comfort or general welfare of the persons residing or working within the neighborhood of the proposed amendment or within the City, or b) injurious to the property or improvements in the neighborhood or within the City. 2. The proposed General Plan Amendment will permit reasonable development of the area consistent with its constraints and will make the area more compatible with adjacent properties. 3. The proposed General Plan Amendment would establish a land use density and usage more in character with the subj ect property's location, access, and constraints. 4. The proposed General Plan and Specific Plan Amendments will not have a significant effect on the environment. PURSUANT TO THE ABOVE FINDINGS, IT IS RESOLVED by the City Counoil of the City of Lake Elsinore, California, that the City of Lake Elsinore General Plan Land Use Map hereof be amended for the First time in calendar year 2002 to reflect General Plan Amendment No. 2002-02.
